(7:38 p.m.) Duane Amundson, Lot 4 Block 5, Leaf Lake Pleasure Grounds, Middle Leaf Lake in Leaf Lake Township, requested a variance of 66’ from the required ordinary high water level setback of 100’ for the placement of a structure 34’ from the ordinary high water level. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Robert Schwartz and unanimously carried, to approve a variance of 66’ from the required ordinary high water level setback of 100’ for the placement of a structure 34’ from the ordinary high water level with the following conditions; 1.) the existing house and garage must be removed prior to the issuance of a site permit for the proposed project, and 2.) no more than 25% of the total lot area can be covered with impervious surfaces. The Board noted that if they required the placement of the proposed development outside of the shore impact zone the applicant’s view would be obstructed by the structures on the adjacent properties. Hardship is a substandard lot of record. Kevin Christianson - Denied. (7:42 p.m.) Kevin Christianson, Lot 4 Block 1, Sunlight Beach, Pelican Lake in Dunn Township, requested a variance of 15’ from the 20’ maximum allowable height of a non-dwelling structure for the construction of a proposed 2,560 square foot barn storage building having a height of 35’. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to deny the variance as requested noting that no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. The Board noted that the applicant has adequate area to place the structure at a setback that would accommodate the desired height and that the applicant can obtain a reasonable use of his property without the granting of the variance as requested. David and Joyce Monk - Approved the variance as requested. (7:48 p.m.) David and Joyce Monk, Lot 4 Block 1, Town & Country Addition, Wright Lake in Aurdal Township, requested a variance to have a substandard back lot declared a buildable lot for the construction of a dwelling with an attached garage and for an additional detached garage as depicted on the applicant’s drawing. Wayne Schuett, proposed buyer, represented the applicant at the public hearing. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously carried, to approve the variance as requested. The Board noted that the approval of this request is consistent with past actions of the Board of Adjustment and is consistent with the existing development within this immediate area. Roxane K Case - Approved a modified variance. (8:50 p.m.) Roxane K Case, Lot 9 Broadwater Beach, Pelican Lake in Dunn Township, requested a variance of 2’ from the required side lot line setback of 10’ and a variance of 2’ from the required lift station setback of 10’ for the placement of an 18’ wide garage 8’ from the south property line and 8’ from the lift station. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Randall Mann made a motion, second by Cecil Femling and unanimously carried, to approve a variance of 4’ from the required lift tank setback of 10’ for the placement of an 18’ wide garage 6’ from the lift tank and 10’ from the side lot line with the condition that an existing 10’ by 12’ shed must be removed on or before September 1, 2004. The variance as granted will provide the applicant with an ability to enjoy the same rights and privileges as others in the immediate area.
