(Platting) A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A determination that a practical difficulty exists is based upon consideration of the following criteria: The applicant identified the following practical difficulty: We want to sell one of the lots and when the previous owners purchased the lots they didn't take in to consideration where the lot line was when they developed the property. The property line runs right UP against the house and the drain field are on lot 19. My drainfield has failed and I am currently in the process of putting a mound system on Lot 20. Once done the septic system will all be on Lot 19 and will not be on Lot 20. If the Variance is approved the lots will be the requirements for a buildable lot. A condition must be directly related to and must bear a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep rooted vegetative buffers, rain gardens, etc.) It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an infrequent remedy where an ordinance imposes a unique and substantial burden. Called to Order Thomas Lee, Chair called the meeting of the Board of Adjustment to order at 6:01 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the June 11,2020 meeting. The records show that you own both Lot 19 & Lot 20 of Oakview Heights and the dwelling is located on Lot 20. At the time your dwelling was constructed, lots 19 & 20 were under the same ownership and they constructed their dwelling less than 10 feet to the lot line of Lot 19. Since the Shoreland Management Ordinance requires a structure setback of 10 feet to a lot line, in order to sell lot 19, a variance would be required for the noncompliant setback. My request is to sell lot 19 as a single family residential lot, it meets shoreline (150') and square footage (1.49 acres) requirements. My intent is to keep and maintain lot 20 as single family residential lot as well. Our home, located on lot 20 is within less than the 10 feet of the original lot line. I would request a variance(?) allowing me to sell lot 19 in it's entirety without a plat change. Also, note that I am having a new septic mound system installed for the home. The mound will be on lot 19 if we follow the original lot lines. My preference would be to have the revised property line stay in place (lot 19 still meets riverfront and square footage requirements) but if that is not possible, I am willing to revert to original lines. 1 Your help is appreciated!
