Motion was made by Dan Oehler, seconded by Craig Anderson and carried with Cecil Femling
voting no, to approve a variance of 42' from the required ordinary high water level setback of
100' for the construction of a dwelling; a variance of 54' from the ordinary high water level
setback of 100' and a 12' variance from the required 30' setback from the top of a bluff for the
construction of a 12' by 59' deck, subject to the determination, measurement, and certification
by the Land and Resource Management office as to the location of the top of the bluff and with the
condition that the 12' by 59' deck will be constructed using cement piers and that the main
structure will be out of the bluff zone area.
