It was noted that a 14’ by 24’ garage which is located very close to the side lot line will be removed resulting in a net improvement to the applicant’s property. It was also noted that the side lot lines on the applicant’s lot converge as they head to the west. Allan Anderson October 4, 1990 Otter Tail County Board of Adjustment Courthouse Fergus Falls, MN 56537 Re: Ron Okerstrom application Dear Board Members: I have reviewed the Title Opinion of Richard Nitz regarding the "Winger-Okerstrom Property", which Ron Okerstrom asked that I review. He felt that it may have some impact upon his application for a variance from the Subdivision Controls Ordinance to allow him to acquire the portion of the abandoned railroad right-of-way directly across the road from his property. I am not certain what impact it has. The Title Opinion basically concludes that the title is not good or marketable because vague and uncertain legal descriptions were used in the past, so that it is not ^possible to trace the chain of.title. It suggests that there is no certainty as to exactly where the railroad right-of-way is located. That raises a question as to the description of the portion of the right-of-way that Okerstrom wants to acquire. A surveyor's drawing will be necessary to provide any certainty as to the description. The title problems that apply to Okerstrom's property should not affect the railroad right-of-way, but may result from that right-of-way. There is nothing in the opinion that suggests that he owns the fee interest in the land beneath the public road. The issue before the Board of Adjustment is still whether or not to allow the subdivision of a parcel of less than two and one-half acres, without platting, in these circumstances. If so, it should at least be required that the property be joined as one parcel with his current property, never to be separated. Of course, you have considered these types of applications before and are well familiar with these types of conditions. I told Ron Okerstrom about my conclusions regarding the Title Opinion. He informed me that he would be unable to attend the board meeting on October 4. He intended to leave this matter up to your discretion and was prepared to accept whatever decision you make. If you have any further questions or comments, I hope that Kurt will be able to answer them for yod.
