MOTION AS FOLLOWS:
Motion was made by Cecil Femling, seconded by Bert Olson and unanimously carried, to grant a
variance for the construction of a 14' wide by 15‘ long deck in the bluff impact zone with the
condition that there will be no excavation, other than for the placement of the post for the deck,
in the bluff impact zone area by the applicant.

LOT 24 LOT 1 BIRCHWOOD RIVER ESTATES

This is a request for a variance to place a deck behind our new house being
built near the Ottertail River East of Fergus Falls.
The back of the house faces toward the east and the back wall is located approximately
300 feet from the river. A bluff of mild slope is located behind the house.
The house was constructed to make certain that the bluff impact zone, which
is defined as 30 feet from the top of the bluff/ is not entered. The southeast
corner of the house actually is about 33 feet back from the top of the bluff/
and the northeast part of the house is approximately 52 feet back from the
top of the bluff. The deck would be 14 feet wide and would enter a maximum
of 11 feet into the impact zone.
The required sewer system included a double tank and 1100 square foot drain
field. Because this could not be put behind the house toward the river/ it
had to be installed in the front yard toward the road. This was suggested
by Shoreline Management. However/ the sewer system does occupy all of the
central and south side of the lot in the front yard/ and the well and well
buffer zone occupies the north side of the front yard. Placement of the sewer
and well are the reasons that the house is near the bluff zone.
