Grace Schroeder owns Lot 14, Block 1, Wall Lake Development Number 1 (See Exhibit 1) which is also Parcels A, B and C on Exhibit 2. Grace Schroeder requests a variance so that she can sell Parcels A and C (on Exhibit 2) which is also identified as Lot 14 on Exhibit 1. Parcel B would be added to the Schroeder metes and bounds tract. In order to properly evaluate the situation, please provide as much supplementary information as possible, such as: maps, plans, information about surrounding property, etc. APPLICIANT SHALL BE PRESENT AT THE SCHEDULED HEARING. Hefte Law Office Building 110 North Mill Street Fergus Falls, MN 56537 Dear Mr. Hefte: Subject: JOHN SCHROEDER PROPERTY - WALL LAKE YOUR LETTER OF FEBRUARY 17, 1987 The Aurdal Town Board, meeting in regular session on March 12, 1987 , has considered the request for approval to divide Lot 14, Block 1, Wall Lake Development Number 1, into three parcels as shown on Exhibit #2 which you furnished to us. It is the Board's understanding that the Otter Tail County Board has given approval to the variance request subject to Aurdal Township's approval. It should be noted that the proper proce­ dure, according to a County resolution that has been in effect for several years, would have been to obtain the Township's approval prior to bringing the matter before the County. It is respectfully requested that this procedure be followed in future matters of a similar nature involving requests for variances. Aurdal Township's Zoning Ordinance, adopted April 20, 1981, requires that buildi-ng lots be a minimum of 88,000 square feet, with a minimum width of 200 feet. However, since the area in question was platted in 1974,. before the enactment of the Zoning Ordinance, Lot 14 is entitled to have one, and only one, single­ family residence located on it. Therefore, if Lot 14 is divided as proposed Parcel C could be sold as a lot to be used for residential building purposes, provided that other site con­ siderations are met. Parcel B is not large enough to be considered as a building site, nor does it seem to have any practical value other than to attach it to the adjacent metes and bounds tract where the Schroeder home is now located. Parcel A, once it has been split from the remainder of Lot 14, becomes subject to the Zoning Ordinance and would not be large enough nor would it have the proper width to comply with the minimum requirements for building purposes. Parcel A could, however, be sold for non-building purposes. In addition to being too small, the Board considers Parcel A to be unsuitable for Mr. Richard C. Hefte Page 2 building purposes because it is a low-lying area and too close to the* water table. In summary, the Aurdal Board of Supervisors hereby approves the splitting of Lot 14 into parcels A, B, & C as shown on Exhibit 2, but with the following stipulations; Parcel A may be sold, but for non-buiIding £U£poses only. 1. Parcel B may not be sold and must be attached to the adjacent metes and bounds tract. 2. Parcel C may be sold as a buildable site, building setback requirements and to requirements of the Otter Tail County Shoreland Management Regulations. subject to3.
