James Larson - Approved
James Larson, Mounds Viev, MH, requested a variance of 138' from the required ordinary
high water level setback of 200' and a variance of 38' from the required shore impact zone
setback of 100' for the location of existing structures the closest being 62' from the
ordinary high water level. The property is described as Lots 8 and 9, Pleasure Point,
Fish Lake in Aurdal Township. Clem Hendrickson, Surveyor, appeared along with the
applicant at the public hearing. The applicant's variance request had been previously
tabled at the November 2nd, 1995, Board of Adjustment meeting. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by
Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve an ordinary
high water level setback of 100', as recommended by the Land and Resource Department, for
Lots 1 through 12, Pleasure Point, with the condition that the applicant must place all
structures in a location that either complies with the 100' setback or with the other
provisions of the shoreland ordinance by July 15th, 1996. It was noted that the depth of
these lots make the 200' setback from the ordinary high water level impossible and the
100' setback is a reasonable compromise for these twelve lots.

Gary Hook, Maplewood, MN, requested a variance of 112' from the required ordinary high
water level setback of 200' and a variance of 12' from the required shore impact zone
setback of 100' for the location of existing structures the closest being 88' from the
ordinary high water level. The property is described as Lots 1 through 7, Pleasure Point,
Fish Lake in Aurdal Township. The applicant's variance request had been previously tabled
at the November 2nd, 1995, Board of Adjustment meeting. Clem Hendrickson, Surveyor,
appeared along with the applicant at the public hearing. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by Craig

Recently, while inspecting in the area, I noticed what appeared to be
several new structures on your above mentioned property. After viewing the
site, I could not find any Site Permit posted for these structures.
Upon returning to the office, I found no evidence of permits being issued on
this property. Please contact me by September 25, 1995 in regards to this
matter.

Tim Griep and Kyle Westergard were onsite with Clem Hendrickson of Anderson
Land Surveying and the following suggestions are offered:
Gary Hook Lot:
To allow the sauna to remain in its current location as a WOAS, needing
a variance for the height (currently at 10.6').
remove or relocate the outhouse and small generator shed,
these structures relocated, the only structure in the Shore Impact Zone
(SIZ) would be the sauna.

location.
James Larson Lot:
Ideally, the RCU & addition should be located 100' back from the lake
(out of the SIZ). However, please note that the RCU is in the same
location as the previous mobile home and that the current RCU &
addition are behind the existing building line of the cabin on
Estenson's lot and the cabin on Hook's lot.

If it is determined that the structure be moved back, a Grade & Fill
Permit would be needed from this Office to level a building site.
Recommend that the outhouse and old mobile home be relocated or
removed.
2.
NOTE: These are only suggestions from this Office and should not be
construed as the best solution(s), other resolutions may be more
appropriate. The final determination must come from the Board of
Adjustment.
Current Water Level is 1.49' low
All distances used are from a survey done by Anderson Land Surveying, the
actual numbers can be adjusted as the water level rises or lowers.
