to approve a variance of 147’ from the required ordinary high water level setback of 200’ for the construction of a
second story on the existing house/garage 53’ from the ordinary high water level and to deny the variances as
requested for the 25’ by 10’ utility/mud room and for the 30’ by 30’ garage noting that the applicants have a
reasonable use of their property with the variance allowing the second story addition and with the variance previously
granted for a 24’ by 24’ garage. Hardship for the graritirjg-of4hesecond story addition variance is the terrain of the

Thursday, November 3, 2005
The Otter Tail County Board of Adjustment met Thursday, November 3, 2005, with the following persons in
attendance:

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the October 13, 2005 Board of Adjustment meeting as
mailed.
The Board of Adjustment considered the following applications for variance:
as and Janet Nolden - Approved the second story addition as requested. The variances as
requested for the utility/mud room and for the 30’ by 30’ garage were
denied. (6:32 p.m.)
Thomas and Janet Nolden, Lots 1, 2, 3, 4 and Reserve Block 1, First Addition to Clear Beach Resort and
part of the Northeast Quarter of Section 2 of Aurdal Township by Fish Lake, requested a variance of 147’
from the required ordinary high water level setback of 200’ for the construction of a second story on an
existing house/garage 53’ from the ordinary high water level, a variance of 134’ from the required ordinary
high water level setback of 200’ for the construction of a 25’ by 10’ utility/mud room 66’ from the ordinary
high water level and a variance of 136’ from the required ordinary high water level setback of 200’ for the
construction of a 30’ by 30’ garage 64’ from the ordinary high water level. Jason Allen, Contractor,
appeared at the public hearing with Thomas Nolden. The audience was polled with no one speaking for or
against the variance as requested. A letter from Todd and Lisa Langston in support of the variance as
requested was read for the record. After consideration and discussion, Steve Schierer made a motion,
second by Randall Mann and unanimously carried, to approve a variance of 147’ from the required ordinary
high water level setback of 200’ for the construction of a second story on the existing house/garage 53’
from the ordinary high water level and to deny the variances as requested for the 25’ by 10’ utility/mud
room and for the 30’ by 30’ garage noting that the applicants have a reasonable use of their property with
the variance allowing the second story addition and with the variance previously granted for a 24’ by 24’
garage. Hardship for the granting of the second story addition variance is the terrain of the applicants’
property.
Doug and Lynne Schmoll - Denied. (6:40 p.m.)
Doug and Lynne Schmoll, part of Government Lot 5, Section 23 of Scambler Township by Tamarac Lake,
requested a variance of 4.5’ from the required lot line setback of 10’ for the placement of a structure 5.5’
from the lot line. The audience was polled with no one speaking for or against the variance as requested.
A letter from Terry and Pam Taralson in support of the variance as requested was read for the record.
After consideration and discussion, Cecil Femling made a motion, second by Steve Schierer and
unanimously carried, to deny the variance as requested noting that had the applicants requested the
variance prior to the completion of the project it would not have been granted, granting the variance as
requested would establish precedence and no adequate hardship unique to the property had been shown
that would allow for the granting of the variance as requested as a reasonable use of the property could
have been obtained by placing the structure 10’ from the lot line.

After consideration and discussion, Steve Schierer made a motion, seconded by Randall Mann and unanimously
carried, to approve the construction of an attached 24’ by 24’ garage. The Board noted that an attached garage will
provide the applicants with a reasonable use of there property and the variance as approved will place most of the
proposed structure in the center of the lot. Hardship is the terrain and configuration of the lot.
