Minnesota • Oune 1,2000 Page 4 Todd Langston - Denied Todd Langston, Fergus Falls, MN, requested a variance of 145’ from the required ordinary high water level setback of 200’ for an addition to an existing dwelling 55’ from the ordinary high water level. The property is described as Lots 8, 9, 10 and 11, Clear Beach Resort, Fish Lake in Aurdal Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Mark Steuart, second by Joe Maske and unanimously carried, to deny the variance as requested as no adequate hardship had been shown that would allow for the granting of the variance and noting that the proposed development would be within the shore impact zone. Paul W and Sandra L Perala - Approved with condition. Paul W. and Sandra L. Perala, Henning, MN, requested a variance for a sewing room addition to main floor of house above existing walkout. The existing structure is approximately 30’ from present water level and I believe it to be 28’ from the high water mark. It is no closer to the water than the oldest section of our home, which was built in 1914. This addition will not obstruct anyone’s view of the lake or anything else. We are retired and suffer the early onset of medical conditions, which will limit us to main floor use only. We have no where else to add this needed space. We will be no closer to the lake nor will we cover anymore ground then presently. Required ordinary high water level setback is 100’. Current impervious surface coverage is 29.3%. Maximum allowable coverage is 25%. The property is described as Lots 49 and 50, Lindenwood, Middle Leaf Lake in Leaf Lake Township. The audience was polled with no one speaking for or against the request. A letter from Terry Lechjer, Area Hydrologist with the Minnesota Department of Natural Resources, opposing the granting of this request was read for the record. After consideration, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to approve a variance for a sewing room addition to the main floor of the existing structure noting that it would be above the existing walkout with the condition that after completion of the proposed development no more than 25% of the applicants’ total lot area can be covered with impervious surfaces. It was suggested that the applicants work with the Land and Resource Department to assure that after the project is completed no more then 25% of their lot area will be covered with impervious surfaces. Hardship is a substandard lot of record. Diane Ross - Tabled Diane Ross, Battle Lake, MN, had been previously tabled until the June 1, 2000 meeting of the Board of Adjustment. Prior to the June 1, meeting Diane Ross contact the office, by letter, indicating that she would not be available for the June 1 meeting and requested that her variance hearing be reschedule for another date. Diane Ross has been rescheduled for the June 8 meeting of the Board of Adjustment. . It should be noted that the porch will be added to the side of the dwelling and that it would be no closer to the ordinary high water level than the existing structure. It should also be noted that the original structure was placed at the 75’ setback due to an error in the classification of the lake at the time the original site permit was issued. The property is described as Lot 31, Timberlane Beach Rearrangement, Round Lake in Everts Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to approve a variance of 25’ from the required ordinary high water level setback of 100’ for the addition of a 12’ by 12’ porch 75’ from the ordinary high water level noting that the addition will be no closer to the ordinary high water level than the existing dwelling and the addition does not obstruct the view of the adjacent property owner. Hilary and Marilyn Barry - Approved Hilary and Marilyn Barry, Richville, MN, requested a variance of 106' from the required ordinary high water level setback of 200’, a variance of 6' from the required shore impact zone setback of 100’ and a variance of T from the required 3’ minimum ground water separation for the location of an outhouse 94’ from the ordinary high water level and 2’ above the ground water. It should be noted that the outhouse is only used as an emergency backup to the applicant’s septic system. The property is described as part of Government Lots 7 and 8, Section 25 of Dead Lake Township by Dead Lake. The audience was polled with Duane Donley speaking in favor of the variance request. After discussion and consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve the placement of an outhouse either at a location further up the hill that will provide for the proper ground water separation or at an ordinary high water level setback of 94’ with the condition that the outhouse has an approved sealed chamber. Gerard William Kranz and Al David Johnson - Approved Gerard William Kranz and Al David Johnson, Richfield, MN, requested a variance of 130’ from the required ordinary high water level setback of 200’ and a variance of 30’ from the required shore impact zone setback of 100’ for the construction of a dwelling 70’ from the ordinary high water level. The new dwelling will be located behind the string line, but within the shore impact zone. The property is described as Lots 12,13 and 14, Clear Beach Resort, Fish Lake in Aurdal Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to approve a variance of 130’ from the required ordinary high water level setback of 200’ and a variance of 30’ from the required shore impact zone setback of 100’ for the construction of a dwelling 70’ from the ordinary high water level.
