Chairman Planning Commission Date Les Estes Minnesota Pollution Control Agency February 27, 1997 Daryl Tysdal Route 3, Box 217 Fergus Falls, Minnesota 56537 Interim Permit for the Planning, Construction and Operation of an Animal Feedlot and/or Manure Storage Area MPCA-11916(A)R Pursuant to Minnesota Pollution Control Agency (Agency) Rules (7020.02 -7020.19) governing the control of pollution from animal feedlots, this Interim Permit is issued for the planning, construction and operation of animal feedlot facilities located in the northwest one-quarter of Section 17 in Aurdal Township of Otter Tail County. This feedlot shall consist of the following facilities and operating procedures described below; 1. a 34’ X 120’ total confinement bam to house 57 dairy cows and 10 calves; 2. a 24’ X 30’ bam with an attached open lot to house 25 calves; 3. a 24’ X 56’ bam with an attached open lot to house 35 replacement heifers; and 4. a 90’ X 178’ X 12’ earthen basin. This permit provides authorization to modify the existing facilities which will serve to prevent the discharge of feedlot pollutants to a wetland. The proposed animal feedlot facilities at this location have been identified as a potential pollution hazard. On the date of issuance of this interim permit the Permittee has access to 665 acres of cropland for land application of manure. Manure from the animal feedlot will be removed from the earthen basin 1-2 times per year and applied to cropland. The following plans are hereby approved: a. Either diverting the runoff from the area located south of the east half of the hay shed to the new earthen holding basin or removing the livestock from this area; and b. February 27, 1997 Daryl Tysdal - MPCA-I 1916(A)R Page 2 This Interim Permit shall become effective on the date of issuance by the Commissioner of the Minnesota Pollution Control Agency (Commissioner) and shall supersede any existing feedlot permit upon issuance. This Interim Permit shall expire at midnight on December 26, 1997. The Permittee shall proceed with construction or improvements to the feedlot operation in accordance with plans submitted to and approved by the Commissioner. The Permittee shall proceed in accordance with the following conditions; CONSTRUCTION 1. The Permittee shall have either diverted runoff from the area located south of the east half of the hay shed to the new earthen holding basin or removed the livestock from this area by July 1, 1997; 2. The Permittee shall have completed repairs to the diversions by July 1, 1997; 3. The Permittee shall notify the Commissioner (at 612-296-7327 or 612-296-9332) when the work required in Special Conditions #1 and #2, above, have been complete so that an inspection may be performed at the discretion of the Agency staff; OPERATION AND MAINTENANCE 4. The application rate of manure shall not exceed recommended crop nutrient requirements. Crop nutrient requirements shall be based on projected crop yields, soil fertility (from the standard Minnesota Extension Service Soil Analysis Guidelines), and manure nutrient availability; 5. The Permittee shall maintain, either by direct ownership, rental, or written agreement with a neighboring land owner(s), access to sufficient acreage to properly land apply manure at rates that are based on nutrient requirements of subsequent crops and soil fertility; 6. Annual records on land application of manure shall be kept on file for a minimum of three years by the Permittee and made available to the Agency upon request. These records shall include, at a minimum, the location of each land application site, number of acres at each land application site, results of any manure analysis, and nutrient applieation rate of any land application activities; 7. This Interim Permit shall replace existing permit number MPCA-I 1916(A); 8. BEST PRACTICES SURVEY Assessor, Bob Moe, updated board members regarding a Legislative Auditor/Best Practices survey. The goal of the survey is to identify successful methods of conducting business. Survey areas include township snowplowing, property assessments, and '94 County Board of Equalization. Motion by Portmann, seconded Stone and unanimously carried, with Windels opposed, that Commissioner Windels, the '94 Board Chair, complete the Board of Equalization legislative survey. REQUEST TO PURCHASE MONITORS County Coordinator, Larry Krohn, informed the board that the IBM monitors the county has been purchasing have been discontinued. Motion by Portmann, seconded Lee and unanimously carried to authorize the Management Information Systems Director to purchase twenty (20) Sony monitors because of good quality, availability, and reduced cost. PERFORMANCE EVALUATION SUMMARY - PUBLIC HEALTH DIRECTOR Motion by Portmann, seconded Lee and unanimously carried to approve a positive performance review summary for Public Health Director, Diane Thorson. RESOLUTION DECLARING REIMBURSEMENT INTENT RELATING TO RECYCLING CENTER OTTER TAIL COUNTY RESOLUTION NO. 95-54 Upon a motion by Windels, seconded Portmann and unanimously carried, the following resolution was adopted: BE IT RESOLVED by the Board of Commissioners of Otter Tail County as follows: 1. The County is in the process of constructing an expansion of its recycling center (the "Project"). The County expects that all costs of the Project will be financed in the future through the issuance of bonds in the principal amount of up to $1,000,000 (the "Bonds").
