Nyhus, Staples, MN, requested a variance of 76 square feet from the maximum size of a water - oriented accessory structure of 260 square feet for an 8' by 12' addition to an existing 12' by 20' water - oriented accessory structure. The existing structure plus the addition would have 336 square feet of area. The property is described as Lots 20, 21, 22, and West 1/2 of Lot 23, Peach's Beach First Addition, Star Lake in Star Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. It was noted that granting a variance to exceed the maximum area, of 260 square feet for a,water - oriented accessory structure by 76 square feet would establish a precedent and would not be consistent with previous actions of the Board of Adjustment. After additional discussion and consideration, motion was made by Craig Anderson, seconded by Cecil Femling and carried with John Everts voting no, to grant the applicant a 2' by 12* addition to the existing structure. Richard W. Erikson - Approved Richard W. Erikson, Crystal, MN, requested a variance of 6* 4” from the required holding tank setback of 10' and a variance of 6' 6" from the required road right-of-way setback of 20' for the location of an existing 10' by 10' storage shed 3' S'* from the holding tank and 13' 6" from the road right-of-way. The property is described as Lot 3, Ukkelberg Beach, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Leslie Estes and unanimously carried, to approve a variance of 6' 4" from the required holding tank setback of 10' and a variance of 6’ 6” from the required road right-of-way setback of 20' for the location of an existing 10' by 10' storage shed on skids 3' 8" from the holding tank and 13' 6" from the road right-of-way with the condition that the 10' by 10' structure and the 4’ by 8' structure be allowed to remain on the applicant’s lot until the applicant receives a building permit for the construction of a garage at which time both sheds must be removed. It was noted that the granting of the requested variances will not establish a precedent and it will allow the applicant to enjoy the same rights and privileges as his neighbors. It was also noted that since the 10' by 10' structure is on skids it should not present a problem if the septic system should require servicing or maintenance. James L. Knapp - Approved James L. Knapp, Fergus Falls, MN, requested a variance of approximately 69’ from the required ordinary high water level setback of 200' for the construction of a 14' by 14' screen porch to the south side of an existing cabin. The south side of the cabin is the side opposite from the lake shore. The property is described as part of the SWl/4 NWl/4, Section 12 of Aurdal Township on Fish Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance of approximately 69' from the required ordinary high water level setback of 200' for the construction of a 14' by 14' screen porch to the south side of an existing cabin.
