The following is from the November 12, 2015 Board of Adjustment Minutes -
Tyler Currie - Variance application approved as requested. (7:40p.m.)
Tyler Currie, East Half of Lot 3J and all of Lot 36, Eldorado Beach, Otter Tail Lake in Amor Township,
requested the following: Proposing to replace the existing dwelling being 50 'from the ordinary high water
level, being no closer than the existing dw’elling requesting a 25 ’ variance, 75 ' setback required. Also
proposing to add 14’ by 16’ deck, being 50 'from ordinary high water level, requesting 25 ’ variance. 75 '
setback required. Reuse existing foundation for new house. Lindy Currie and Darold Woessner, Contractor
attended the public hearing. The audience was polled with no one speaking for or against the variance as
requested. After consideration and discussion, Thomas Lee made a motion, second by Paul Larson and
unanimously carried, to approve a variance of 25 'from the required ordinary high w’ater level setback of
75 'for the placement of a dwelling and for the addition of a deck as described in the variance application
dated October 22. 2015 and as depicted on the drawing submitted with the variance application 50 ' from
the ordinaiy high water level. The proposed development is a single stoiy structure. The variances as
approved do not directly or indirectly grant any other variances for the proposed development.
Discussion (7:25 p.m.) - The applicant recently attempted to obtain a building/site pennit for a one and an
half/two story structure. The office declined to issue the pennit based on the above motion and notes that
indicated that the proposed development would be a single story structure. Prior to the April 14, 2016
meeting, staff from the Land and Resource Department listen to the recording of the November 12, 2015
meeting and detennined that the discussion supported that the proposed development would be a single
story structure. The Land and Resource Department indicated that if the structure is going to be more than a
single story structure it will need to be placed 75' from the ordinary high water level or the property owner
will need to submit another variance application for the Boards' consideration.
A representative of the applicant (Mike with Woessner Constmetion) appear at the hearing to discuss the
November 12, 2015 Board of Adjustment decision and to detemiine if the above stated motion could be
amended to reflect a stmeture having more than a single story. After discussion and consideration, it was
determined by general consent that the November 12, 2015 motion should not be amended and that a new
variance application should be submitted for consideration and review.
Scott V and Judy K Zenner - Variance application approved as requested. (7:35 p.m.)
Scott V and Judy K Zenner, part of Government Lot 3, Section 1 of Aurdal Township by Fish Lake,
requested the following; 166 feet from the ordinary high water level from the required 200' setback for the
proposed detached garage. Requesting a 34' variance. We propose to build a 38' by 28' garage. The
audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve a
variance of 34' from the required ordinary high water level setback of 200’ for the construction of a 38' by
28'garage 166' from the ordinary high water level as described in the variance application dated March 7,
2016 and as depicted on the drawing submitted with the variance application. Hardship/practical difficulty
is a unique shape lot. It was noted that the proposed development is behind the existing stmeture and is
further back from the ordinary high water level than the existing development. The granting of this variance
as requested is consistent with past decisions. The variance as approved does not directly or indirectly
grant any other variances for the proposed development.
