CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 12:00 p.m. Tuesday, December 3, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Mortenson called for approval of the Board Agenda. Motion by Rogness, second by Johnson and
unanimously carried to approve the Board of Commissioners' agenda of December 3, 2024, with the following

OPIOID SETTLEMENT FUNDS RFA GRANT AGREEMENTS
Community Health Planner Andrea Demmer provided an update on the Otter Tail County Opioid Settlement
Funds Request for Applications (RFA) Round 1. Demmer reviewed priorities, available funding and the
timeline for applications and contract agreements. Recommended recipients include Community and Life
Services, Lake Region Halfway Homes, Otter Tail County Probation, and Perham 180 all with a focus on
treatment and recovery and The Bridge Center focusing on prevention. Demmer outlined agreement
requirements and next steps for the grant agreements.
Motion by Johnson, second by Rogness and unanimously carried to authorize appropriate County Officials'
signatures to execute the following Otter Tail County Opioid Settlement Fund Grant Agreements as presented
with an effective date of January 1, 2025:
> Community and Life Services > Lake Region Halfway Homes > Otter Tail County Probation > Perham 180 > The Bridge Center
POST EMPLOYMENT HEAL TH CONTRIBUTION MOU
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures on a Memorandum of Understanding (MOU) between Otter Tail County and Law Enforcement
Labor Services, Inc., Local 397, Essential Deputies Unit, to amend the collective bargaining agreement to
include the option for employees to contribute 2% of their gross pay to their individual Post Employment Health
Care Savings Account through a payroll deduction, effective January 1, 2025.
SOCIAL SERVICES SUPERVISOR -MnCHOICES
Motion by Johnson, second by Rogness and unanimously carried to approve the addition of a 1.0 full-time
equivalent (FTE) Social Services Supervisor-MnCHOICES to the current class structure to provide additional
capacity to supervisors for the multi-disciplinary team conducting assessments. This position is included in the
proposed 2025 budget.
2025 NON-UNION COLA
Motion by Rogness, second by Bucholz and unanimously carried to approve a 3.5% Cost of Living Allowance
(COLA) for non-union employees effective January 1, 2025. The COLA is consistent with all collective
bargaining agreements for 2025.

At 12:18 p.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 12:26 p.m.
JOINT POWERS AGREEMENT
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to execute a Joint Powers Agreement between Otter Tail on behalf of the Otter Tail County Sheriffs
Office and the State of Minnesota on behalf of the Bureau of Criminal Apprehension for a Minnesota Internet
Crimes Against Children Task Force.
RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS
WITH THE COUNTY OF OTTER TAIL ON BEHALF OF ITS SHERIFF'S OFFICE
REGARDING THE MINNESOTA INTERNET CRIMES AGAINST CHILDREN TASK FORCE
OTTER TAIL COUNTY RESOLUTION NO. 2024-102
WHEREAS, the County of Otter Tail on behalf of its Sheriffs Office desires to enter into Joint Powers
Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to
utilize applicable state and federal laws to investigate and prosecute crimes committed against children and
the criminal exploitation on children that is committed and/or facilitated by or through the use of computers.
NOW, THEREFORE, BE IT RESOLVED by the County Board of Otter Tail, Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting
through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Otter Tail on
behalf of its Sheriff's Office, are hereby approved. A Copy of the Joint Powers Agreement is attached to this
Resolution and made a part of it.
2. That the Sheriff, Barry Fitzgibbons, or his or her successor, is designated the Authorized Representative
for the Sheriff's Office. The Authorized Representative is also authorized to sign any subsequent amendment
or agreement that may be required by the State of Minnesota to maintain the County's connection to the
systems and tools offered by the State.
3. That Kurt Mortenson, the Chair of the County of Otter Tail, and Nicole Hansen, the County Administrator,
are authorized to sign the State of Minnesota Joint Powers Agreements.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

WALKING TRAILER PURCHASE
Motion by Rogness, second by Bucholz and unanimously carried to authorize the Solid Waste Department to
purchase a Mac Walking Floor Trailer from North American Trailers, in the amount of $122,007.00, for the
new Henning transfer station facility as presented by Assistant Solid Waste Director Scott Bjerke. This
purchase is funded through a Minnesota Pollution Control Agency (MPCA) grant.
SOLID WASTE DEPARTMENT
RESOLUTION CHANGING SOLID WASTE MANAGEMENT SERVICE CHARGE
OTTER TAIL COUNTY RESOLUTION NO. 2024-103
WHEREAS, pursuant to the authority granted under Minnesota Statute 400.08 and Section 4:02(C) and 4:03
of the Otter Tail County Solid Waste Management Ordinance, Otter Tail County may impose solid waste
management charges; and adjust the amount charged; and
WHEREAS, Solid Waste Management Service Charges may be billed and collected on a per parcel basis.
They may also be collected by licensed haulers. Currently, Otter Tail County uses a per parcel basis to collect
service charges. Parcels are charged based on the number of points calculated and the cost per point; and
WHEREAS, public notices were published and a public meeting was held satisfying requirements of the
aforementioned ordinance for adjusting the per parcel based service charge; and
WHEREAS, the Otter Tail County Solid Waste Department has recommended increasing the cost per point
from sixteen and 00/100 dollars ($16.00) to seventeen and 00/100 dollars ($17.00) per point per year.
NOW THEREFORE BE IT RESOLVED THAT, that the Otter Tail County Board of Commissioners hereby
authorizes the per parcel service fee to be increased from sixteen and 00/100 dollars ($16.00) to seventeen
and 00/100 dollars ($17.00) per point per year, effective January 3, 2025.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Lahman, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

NEOT LAND PURCHASE
Motion by Rogness, second by Bucholz and unanimously carried to approve the signed purchase agreement
between Otter Tail County and Dennis M. Koehn and Audrey G. Koehn for the purchase of 10 acres, in the
amount of $120,000.00, for the expansion of the Northeast Otter Tail Landfill to accommodate ash recycling.
OUT-OF-STATE TRAVEL REQUESTS
Motion by Rogness, second by Lahman and unanimously carried approve out-of-state travel for Land and
Resource Management Director Chris LeClair to travel to East Lansing, Ml from January 7-8, 2025 to attend
the Michigan Onsite Wastewater Recycling Association Conference and travel to Columbia, MO from January
20-22, 2025 to attend the Missouri Small Flows Conference, at no cost to the County.

2025 COMMISSIONERS SALARY AND BENEFITS
OTTER TAIL COUNTY RESOLUTION NO. 2024-106
Commissioner Rogness offered the following and moved its adoption:
WHEREAS, Minnesota Statute §375.055 provides that County Commissioners may receive per diem
payments and reimbursement for necessary expenses incurred in performance of the duties of the office and
shall receive compensation of annual salaries, as set by resolution of the County Board; and
WHEREAS, the current annual salary for Otter Tail County Commissioners is $43,960.67 effective January 1,
2024;and
WHEREAS, the current per diem rate for Otter Tail County Commissioners is $90.00.
NOW, BE IT RESOLVED, that the annual salary for Otter Tail County Commissioners shall be established as
$45,499.29 effective January 1, 2025, which reflects a 3.5% Cost-of-Living Adjustment similar to increases
received by other employee groups.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the per diem rate for Otter Tail County
Commissioners remains at $90.00.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the annual employer contribution for benefits for
CY2025 will be set in accordance with the benefits structure previously adopted by this board on October 22,
2024.

KONIARSKI TRANSPORTATION ADVOCATE AWARD
Former Otter Tail County Public Works Director Rick West and County Engineer Krysten Foster presented
Commissioner Wayne Johnson with the William Koniarski Transportation Advocate Award for 2024. This
award, presented by the Minnesota Transportation Alliance, honors those who demonstrate exceptional
leadership and commitment to improving and advancing Minnesota's transportation infrastructure.

SAP 056-589-001 STATE FUNDED PROGRAM FOR IIJA
DISCRETIONARY GRANT ASSISTANCE
TERMS AND CONDITIONS
OTTER TAIL COUNTY RESOLUTION NO. 2024-104
WHEREAS, Otter Tail County has applied to the Commissioner of Transportation for a grant from the State
Program for IIJA Assistance; and
WHEREAS, the Commissioner of Transportation has given notice that funding for this project is available; and
WHEREAS, the amount of the grant has been determined to be $30,000.00 through Otter Tail County Highway
Department request for proposals (RFP) standard procedures.
NOW THEREFORE BE IT RESOLVED THAT, Otter Tail County does hereby agree to the terms and conditions
of the grant consistent with Minnesota Laws 2923, Chapter 68, Article 1, Section 2, Subdivision 5(a), and will
pay any additional amount by which the cost.,exceeds the estimate, and will return any amount appropriated
for the project but not required. The proper county officers are authorized to execute a grant agreement and
any amendments thereto with the Commissioner of Transportation concerning the above-referenced grant.

SPONSORING AGENCY RESOLUTION
CITY OF BATTLE LAKE NATURE TRAIL & MAIN STREET CONNECTION APPLICATION
OTTER TAIL COUNTY RESOLUTION NO. 2024-105
WHEREAS, City of Battle Lake has requested Otter Tail County sponsor their Active Transportation (AT)
project since non-state aid cities and townships must have a county sponsor; and
WHEREAS, City of Battle Lake understands the city will be responsible for all costs not covered by the AT
grant including but not limited to consultant engineering, right of way acquisition, construction administration
and inspection, utility relocation, as well as construction costs above the AT award; and
WHEREAS, City of Battle Lake agrees to maintain such improvements for the lifetime of the improvements;
and
WHEREAS, City of Battle Lake agrees to enter in to a separate agreement, which outlines county and city
responsibilities for project management if the city is selected as a recipient of these funds.
NOW, THEREFORE BE IT RESOLVED, Otter Tail County act as sponsoring agency on behalf of the City of
Battle Lake for an Active Transportation (AT) project identified as Nature Trail & Main Street Connection.
BE IT ALSO RESOLVED, Krysten S. Foster, County Engineer is hereby authorized to act as agent on behalf
of this applicant.

OUT-OF-STATE TRAVEL REQUEST
Motion by Johnson, second by Bucholz and unanimously carried to approve out-of-state travel for the County
Engineer to travel to Schaumburg, IL from April 14-18, 2025 to attend the National Association of County
Engineers Conference. This conference has been budgeted for 2025.
HIGHWAY DEPARTMENT YEAR END REVIEW
County Engineer Krysten Foster reviewed Highway Department Highlights from 2024. Foster noted Highway
Maintenance projects and accomplishments, Road & Bridge construction projects and improvements, the
County Ditches program, and additional points of interest including breaking ground on the Perham Garage,
software improvements including the new electronic timekeeping program, and the kickoff of the 2050
Transportation Plan. Foster expressed appreciation for the entire Highway Department, interdepartmental
cooperation, and for former County Engineer Chuck Grotte.
RECESS & RECONVENE
At 1 :38 p.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 1 :45 p.m.
PENALTY ABATEMENT REQUESTS
Motion by Johnson, seconded by Rogness and unanimously carried to deny the request of Michael Jonasson
for the abatement of accrued penalty on Parcel No. 17-000-99-2053-000, in the amount of $11.92, for the late
payment of second half property taxes as the reasons stated do not fall in line with the County's hardship
policy.
Motion by Johnson, second by Rogness and unanimously carried to approve the request of Mark Bloomquist
for the abatement of accrued penalty on Parcel No. 17-000-36-0411-001, in the amount of $24.40, and for the
abatement of accrued penalty on Parcel No. 53-000-99-0501-000, in the amount of $84.04, for the late
payment of second half property taxes as the reasons stated fall in line with the County's hardship policy.
OTWMD BOARD REAPPOINTMENT
Motion by Johnson, second by Lahman and unanimously carried to reappoint Nancy Johnson to the Otter Tail
Water Management District (OTWMD) Board of Commissioners for an additional four-year term effective
January 1, 2025.
ROAD AND BRIDGE CAPITAL EXPENDITURE REIMBURSEMENT
Motion by Rogness, second by Bucholz and unanimously carried to approve a transfer of funds from the
Capital Improvement Fund to the Road and Bridge Fund for a purchase, in the amount of $16,892.00, for a
Mini Full Matrix Changeable Message Board and a purchase, in the amount of $147,926.66, for two (2) 262D3
Skid Steer Loader with Loader Bucket 74" General Purpose. Both purchases were previously approved by
committee.
ESTABLISH PUBLIC HEARING
Motion by Johnson, second by Lahman and unanimously carried to establish, per the provision of Minnesota
Statute §116A, a public hearing for 10:00 a.m. on Tuesday, January 28, 2025 for the purpose of considering
the expansion of the Otter Tail Water Management District through the addition of the following parcels:

PUBLIC HEARING
At 2:01 p.m., Chari Mortenson opened the Public Hearing regarding Property Tax Abatements Related to the
Single-Family Tax Rebate Program. Chair Mortenson asked for comments from the public and no comments
were received.
The Public Hearing was closed at 2:02 p.m.
1174 WESTERN AVENUE LEASE AGREEMENT
Deputy Administrator Nick Leonard provided an update to the Board regarding the Lease Agreement for the
property located at 1174 Western Avenue, Fergus Falls, MN. The Board of Commissioners previously
authorized a lease agreement between Otter Tail County and NBH Fergus Falls, LLC at the November 5th
Board of Commissioners meeting. Since then, there have been changes to the agreement. Leonard noted
that the agreement will be a 48-month lease with the Option to Purchase at any time and include a $25,000
earnest fee.
Motion by Rogness, second by Johnson and unanimously carried to authorize appropriate County Officials'
signatures to execute the lease agreement between Otter Tail County and NBH Fergus Falls, LLC for the
property located at 117 4 Western Avenue, Fergus Falls, MN 56537, beginning January 1, 2025 through
December 31, 2028 with the Option to Purchase at any time with an earnest payment of $25,000 due on
January 1, 2025.
ADJOURNMENT
At 2:08 p.m., Chair Mortenson declared the Otter Tail County Board of Commissioners meeting adjourned
with a closed session to follow. The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday,
December 17, 2024, at the Government Services Center in Fergus Falls and via livestream.
CLOSED SESSION
At 2:12 p.m., Chair Mortenson declared the Board of Commissioners meeting closed to the public. The closed
session is authorized under Mirmesota Statute §13D.05, Subd. 3(b) for Attorney-Client Privilege regarding
Otter Tail County Jail Threatened Litigation. Present in the room were Commissioners Kurt Mortenson, Lee
Rogness, Dan Bucholz, Wayne Johnson, and Bob Lahman, County Administrator Nicole Hansen, County
Attorney Michelle Eldien, County Sheriff Barry Fitzgibbons, County Board Secretary Hannah Anderson and
Stephanie Angolkar with Iverson Reuvers Law Firm, joined virtually. The closed session ended at 2:41 p.m.

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 2:46 p.m. Tuesday, December 3, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Mortenson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Lahman, second by Rogness and unanimously carried to approve the Drainage Authority Agenda of
December 3, 2024 and the Consent Agenda of December 3, 2024 as follows:

2. Warrants/Bills for December 3, 2024 (Exhibit A)
DITCH 51 -INVESTIGATION
Drainage Inspector Colby Palmersheim provided the Drainage Authority with information regarding County
Ditch 51 tiling violations. Palmersheim was notified by the West Otter Tail Soil and Water Conservation District
about spoil piles and tiling work underway in Ditch 51 in Lida Township, Parcel No. 37000180092000.
Palmersheim noted that the property owner has not been given permission to work in the ditch, nor has the
Drainage Authority received any request or petition for improvements to the ditch. A stop work order has been
issued and potential violations are under investigation through the TEP panel. The Drainage Authority will wait
for recommendations from the TEP panel prior to proceeding with next steps.
DITCH 25 -DNR LETTER FOR PERMISSION
Drainage Inspector Colby Palmersheim provided an update and presented the Drainage Authority with a letter
from the Department of Natural Resources (DNR) granting permission to proceed with repair on County Ditch
25 in accordance with the amended repair proposal which limits ditch bottom excavation to vegetation and
associated root mass, not to exceed 4-6 inches in depth, to avoid the potential draining of public wetlands.
DITCH 45 -CULVERT ADDITION
Motion by Johnson, second by Lahman and unanimously carried to approve the installation of a crossing and
culvert, with culvert size to be determined by the Drainage Inspector, along County Ditch 45 in Effington
Township, Parcel No. 21000230163000 at the expense and future placement of the property owner.

At 2:55 p.m., Chair Mortenson declared the Otter Tail County Drainage Authority meeting adjourned. The next
Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday, December 17,
2024, at the Government Services Center in Fergus Falls and via livestream.
