CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, November 5, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Mortenson called for approval of the Board Agenda. Motion by Rogness, second by Bucholz and
unanimously carried to approve the Board of Commissioners' agenda of November 5, 2024, with the following
additions:
Joint Powers Agreement with DOC
EMSRB Sprint Pilot Grant Agreement
APPROVAL OF CONSENT AGENDA
Motion by Johnson, second by Lahman and unanimously carried to approve the consent agenda items as
presented:
1. October 22, 2024, Board of Commissioners' Meeting Minutes
2. Warrants/Bills for November 5, 2024 (Exhibit A)
3. Approval of the application to conduct Off-Site Gambling permit for Abate of MN for
3/1/2025 at the Silver Moon Lounge & Steak House.
4. Approval of the temporary On-Sale Application for American Cancer Society/Relay for
Life Otter Tail County for February 8, 2025, to be held at The Countryside Barn in
Perham, MN.
5. Approval of the issuance of a County Purchasing Card, with a 30-day limit of $1,000.00,
to Adam Lundsten, Supervisor as requested by Doug Cannell, Department Head.
PROBATION SUPERVISOR
Motion by Lahman, second by Johnson and unanimously carried to approve a 1.0 full-time equivalent (FTE)
Probation Supervisor within the Probation Department as part of the transition from the County Probation
Officer model to the Community Corrections Act model of probation service delivery. This position will be
funded through the probation funding subsidy for 2025.
NOVEMBER IS ADOPTION MONTH PROCLAMATION
OTTER TAIL COUNTY RESOLUTION NO. 2024-84
WHEREAS, adopting a child is a great joy and a great responsibility. The family, serving as teachers can help
children learn character and values, the importance of giving back to their community, and the courage to
realize their potential; and

WHEREAS, during Adoption Awareness Month, we honor adoptive and foster parents for giving children a
chance to love and be loved and to reach their full potential in a secure, supportive environment; and
WHEREAS, currently, there are approximately 490 foster children in Minnesota waiting for an adoptive family;
and
WHEREAS, the majority of the families seeking children for adoption are pursuing the adoption of younger
children. there is a continued need for an increased number of families in the State of Minnesota and in Otter
Tail County who will adopt older children, especially older children with special needs as 68% of children
waiting to be adopted have a documented special need, including physical, mental, emotional or a behavioral
disability; and
WHEREAS, public and private sectors are working together to encourage our friends and neighbors to open
their hearts and homes to the children and youth throughout the Counties and the State of Minnesota who are
still waiting for their forever families; and
WHEREAS, public and private sectors work to create a network of support for adoptive families.
NOW, THEREFORE, we, the Otter Tail County Human Services Board, by virtue of the authority vested in us
as County Commissioners of Otter Tail County, do hereby proclaim November as Adoption Month in Otter Tail
County. In honor of this event, we encourage community agencies, religious organizations, businesses, and
others to celebrate adoption, honor families that grow through adoption, further awareness of the changes
and issues in adoption, and focus attention on those children who live in the shadow of an uncertain future
while they await permanent families.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Rogness, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

OPERATION GREEN LIGHT
County Veterans Service Officer Robb Emerson spoke about the 2024 Operation Green Light initiative
honoring and raising awareness for veterans. Otter Tail County buildings will shine with green lights November
4-11, 2024 to show support and appreciation for military veterans. Otter Tail County residents are encouraged
to participate by displaying a green light at their residence or businesses. Emerson thanked the Board of
Commissioners for their continued support for veterans in Otter Tail County.
PURCHASE OF SHERP RESCUE VEHICLE
Motion by Johnson, second by Rogness and unanimously carried to approve the Sheriffs Office to purchase
a Sherp Search and Rescue Vehicle using $163,042.00 from public safety funds and $50,000.00 from the

Sheriffs Office forfeiture fund to cover the costs. The Sherp Rescue Vehicle will be utilized during water or
poor ice events, blizzard or snow events, and over terrain that would not be accessible by other Sherrifs Office
assets. There will be no impact on the budget and levy dollars will not be used.
RECESS & RECONVENE
At 9:01 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 9:05 a.m.
STATE AFFORDABLE HOUSING AID AGREEMENT
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to execute a Statewide Affordable Housing Aid (SAHA) agreement between Otter Tail County and
the Otter Tail County Housing and Redevelopment Authority (HRA), authorizing the County's 2023 SAHA
allocation for the North Fields of Dalton Affordable Senior Housing Project. Community Development Director
Amy Baldwin noted a correction to the monetary amount listed on the agreement submitted.
NORTH FIELDS OF DAL TON
Community Development Director Amy Baldwin provided an update on the North Fields of Dalton Affordable
Senior Housing. Baldwin noted that the units will be ready for occupancy beginning December 1, 2024 with
the Housing and Redevelopment Authority (HRA) currently accepting applications. There will be an Open
House and Tours available to the public on November 22, 2024 from 1 :30 -3:30 p.m.
JOINT POWERS AGREEMENT WITH DOC
Motion by Lahman, second by Johnson and unanimously carried to authorize appropriate County Officials'
signatures to execute an agreement between Otter Tail County and the State of Minnesota Department of
Corrections for Otter Tail County to fill two (2) vacant probation agent 1.0 full-time equivalent {FTE) positions
and bill costs back to the State ahead of the delivery system transition in January as part of the transition to
community corrections.
EMSRB SPRINT PILOT GRANT AGREEMENT
Motion by Bucholz, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to execute a grant contract agreement between Otter Tail County and the State of Minnesota,
Emergency Medical Services Regulatory Board, for the Sprint Pilot Project that evaluates alternative EMS
response models in ambulance services primary service areas in Otter Tail and Grant counties. Otter Tail
County will serve as fiscal agent for this project.

1174 WESTERN AVE LEASE RENEWAL
Motion by Rogness, second by Johnson and unanimously carried to authorize appropriate County Officials'
signatures to renew a lease agreement between Otter Tail County and NBH Fergus Falls, LLC for the property
located at 117 4 Western Avenue, Fergus Falls, MN 56537, beginning January 1, 2025 through December 31,
2026 with the Option to Purchase on or before December 31, 2026 and, at the discretion of the County, this
agreement will automatically renew for a 24-month period if the Option to Purchase is not exercised.

OTTER TAIL WATER MANAGEMENT DISTRICT BOARD APPOINTMENT
Commissioners held discussion regarding the Otter Tail Water Management District (OTWMD) Board
appointment process. Commissioners raised questions about the process for the appointment of members
and were in consensus that they would like more information prior to moving forward with an appointment.
Land and Resource Management Director Chris LeClair will inquire about the process at the next OTWMD
meeting and report back to the commissioners.
TRANSFER FUNDS FROM CAPITAL IMPROVEMENT FUND TO ROAD & BRIDGE FUND
Motion by Johnson, second by Lahman and unanimously carried to approve a transfer, in the amount of
$136,993.45, from the Capital Improvement to the Road and Bridge Fund for the purchase of a 2024 Ford
F350 SRW XL with flatbed and a 2024 Ford F350 SRW XL with tommy gate.
PREMISE PERMIT -ERHARD 4TH OF JULY
LG230 APPLICATION TO CONDUCT OFF-SITE GAMBLING
OTTER TAIL COUNTY RESOLUTION NO. 2024-85
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits
for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, Erhard 4th of July, will be submitting to the Gambling Control Board an LG230 Application to
Conduct Off-Site Gambling at the Ice Hole Portable Bar, which is located at the Lake Lida Public Access off
County Highway 4, on the ice in Lida Township of Otter Tail County; and
WHEREAS, the gambling activities allowed under this application would be limited to no more than twelve off-
site events each calendar year (December 15, 2024, to February 28, 2025) not to exceed a total of 36 days;
and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial
premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving
the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by Erhard 4th of July at the Ice Hole Portable Bar, which is located at the Lake Lida Public
Access off County Highway 4, on the ice in Lida Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, thatthe Otter Tail County Board of Commissioners hereby approves
the conduct of lawful gambling by Erhard 4th of July at the Ice Hole Portable Bar, which is located at the Lake
Lida Public Access off County Highway 4, on the ice in Lida Township of Otter Tail County provided the
applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control
Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Lida by sending them a copy of this resolution.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly

unanimously.

COUNTY STATE AID HIGHWAY NO. 1 RIGHT OF WAY ACQUISITION
OTTER TAIL COUNTY RESOLUTION NO. 2024-86

Parcel Nos. 4 & 7
WHEREAS, Otter Tail County and the City of Fergus Falls propose to cooperatively construct a roundabout
to improve the intersection of County State Aid Highway No. 1 (Fir Avenue) and Friberg Avenue (MSAS 123)
located in:
Sections 26 & 35, of T133N, R43W; and
WHEREAS, the reason for the construction of this roundabout is to significantly reduce traffic congestion and
increase efficient traffic flow; and
WHEREAS, this improvement is necessary to provide for the safety of the walking, biking, and driving public;
and
WHEREAS, Otter Tail County has a right to acquire the right of way after an award of damages has been filed
with the County Auditor in accordance with Minnesota Statute, Section 163.02 and 163.12; and
WHEREAS, all necessary additional highway rights of way and/or temporary construction easements have
been acquired for this construction except for 2 tracts:
A) Parcel 4
Tract owned by: Patti L. Swetland
Tract being a strip of land described as follows:
A permanent easement for road right-of-way purposes over, under, and across that part of
Government Lot 7, Section 26, Township 133 North Range 43 West, Otter Tail County, Minnesota,
described as follows:
Beginning at the southeast corner of said Government Lot 7; thence North 00 degrees 16 minutes 50
seconds West (assumed bearing), along the east line of said Government Lot 7, a distance of 20.00
feet; thence South 89 degrees 43 minutes 10 seconds West, parallel with the south line of said

This temporary construction easement shall commence with the award of the project and

NOW THEREFORE BE IT RESOLVED THAT, the Otter Tail County Board of Commissioners hereby
authorizes the acquisition of the requested right of way as described above pursuant to Minnesota Statute,
Section 163.02 and 163.12, and to take title and possession of that land after an award of damages has been
filed with the County Auditor in accordance with Minnesota Statute, Section 163.12; including the "Quick-Take"
provisions provided for in Minnesota Statute 117 .042.
BE IT FURTHER RESOLVED that the Otter Tail County Attorney is authorized to file the necessary documents
in court and represent the county in this matter.

RINKE NOONAN-LEGAL REPRESENTATION
Motion by Johnson, second by Lahman and unanimously carried to authorize retaining the services of Rinke
Noonan Law Firm for the Fir Avenue Roundabout Project according to their 2024 rate schedule that was
approved on January 23, 2024 as recommended by the County Engineer.
PERHAM SALT SHED
Motion by Bucholz, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures for the purchase of a 65'x60' Britespan Atlas Series salt shed, in the amount of $218, 150.00
including installation, from Greystone Construction through the Sourcewell cooperative contract to be
constructed at the Perham Garage.
RELEASE OF RIGHT OF WAY
OTTER TAIL COUNTY RESOLUTION NO. 2024-87
WHEREAS, THE County of Otter Tail has found the need for the release of a portion of right-of-way on County
State Aid Highway 35 as shown on Otter Tail County Right of Way Plat No. 33, and which property is no longer
required for right-of-way purposes; and
WHEREAS, there remains adequate right:-of-way for highway purposes; and
WHEREAS, the following parcels from Otter Tail County Right of Way Plat No. 33 are to have the right-of-way

released with areas designated in the turn back column on their respective sheets of the plat which is recorded
as Document 1273363 in the Office of the Otter Tail County Recorder:

IT IS HEREBY RESOLVED THAT, the portions of existing highway easement beyond the platted right of way
boundaries for County State Aid Highway 35 are hereby released.

SPEED ZONE STUDY REQUEST RESOLUTION
OTTER TAIL COUNTY RESOLUTION NO. 2024-88
WHEREAS, city stakeholders requested Otter Tail County take such action as may be necessary in order to
pursue a reduced speed limit on the segment of County State Aid Highway No. 56 east of CSAH 67 in New
York Mills; and
WHEREAS, Otter Tail County believes that a speed zone study of CSAH 56 between CSAH 67 and
approximately one-half mile east to the unnamed waterway at city limits would be beneficial in this area.
NOW THEREFORE BE IT RESOLVED, that Otter Tail County does hereby request that this area of CSAH 56
be studied by the Minnesota Department of Transportation to determine the need for a revised speed zone or
zones, if any.
BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal
speed zone if the findings of the traffic study are supportive.

seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

CSAH 37 HYDRAULIC ANALYSIS AGREEMENT AMENDEMENT
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures on an Engineering Services Agreement amendment with Houston Engineering, Inc. in the amount
of $178.50 for a revised contract total up to $6,178.50 for the CSAH 37 Hydraulic Analysis.
ADJOURNMENT
At 10:07 a.m., Chair Mortenson declared the Otter Tail County Board of Commissioners meeting adjourned.
The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday, November 19, 2024, at the Government
Services Center in Fergus Falls and via livestream.

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 10:31 a.m. Tuesday, November 5, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Mortenson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Lahman, second by Bucholz and unanimously carried to approve the Drainage Authority Agenda of November
5, 2024 with the addition of County Ditch 43 and the Consent Agenda of November 5, 2024 as follows:
1. October 22, 2024, Drainage Authority Meeting Minutes
COUNTY DITCH NO. 32 HEARING POSTPONEMENT
OTTERTAIL COUNTY RESOLUTION NO. 2024-89
WHEREAS, the Otter Tail County Board of Commissioners is the Drainage Authority for County Ditch No. 32;
and
WHEREAS, The Drainage Authority ordered the redetermination of benefits for County Ditch No. 32 on the
23rd day of April 2024 and appointed 3 ditch viewers; and
WHEREAS, the ditch viewers completed their duties and submitted their findings with the drainage authority
and a public hearing was ordered to take place on the 18th day of November; and
WHEREAS, it was later realized that the 16.5' buffer damage payments were calculated using a larger buffer
area than intended and required under Minn. Stat. §103E.021 .
NOW THEREFORE BE IT RESOLVED THAT, the Public Hearing for the Redetermination of Benefits for Otter
Tail County Ditch No. 32, scheduled for the 18th day of November 2024, be postponed until further notice to
allow ditch viewers to submit amended findings to reflect adjustments to buffer acres, damages and their
adjacent benefits, with approval.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Lahman and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

COUNTY DITCH 43
Drainage Inspector Colby Palmersheim informed the Board that the buffer damage payments were calculated
incorrectly on the property owners' reports that had been included in the documentation for the Order to Set
a Public Hearing for the Redetermination of Benefits for County Ditch 43. Since the property owners' reports
have yet to be mailed out to property owners, Palmersheim inquired as to whether the corrected and amended
reports could be mailed out prior to Board approval to forego the need to postpone the upcoming December
2, 2024 public hearing. Motion by Johnson, second by Lahman and unanimously carried to authorize Drainage
Inspector Colby Palmersheim to send out the amended reports to benefited property owners prior to Board
approval so that property owners can receive timely notice prior to the December 2, 2024 public hearing.
Palmersheim will bring the amended reports to the November 19, 2024 Drainage Authority meeting for
approval.
ADJOURNMENT
At 10:41 a.m., Chair Mortenson declared the Otter Tail County Drainage Authority meeting adjourned. The
next Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday,
November 19, 2024, at the Government Services Center in Fergus Falls and via livestream.
