CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, September 24, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Mortenson called for approval of the Board Agenda. Motion by Rogness, second by Lahman and
unanimously carried to approve the Board of Commissioners' agenda of September 24, 2024 as presented.
APPROVAL OF CONSENT AGENDA
Motion by Bucholz, second by Lahman and unanimously carried to approve the consent agenda items as
presented:

TECHNOLOGY ANALYST -CYBERSECURITY
Motion by Rogness, second by Johnson and unanimously carried to approve a 1.0 full-time equivalent (FTE)
Cybersecurity Technology Analyst, with approval to hire within the 2024 calendar year, to manage the
County's cybersecurity risk.
OTTER TAIL COUNTY SAFE COMMUNITIES COALITION
Health Educator Emily Frustol provided an update on the Toward Zero Deaths (TZD) traffic safety program.
The Otter Tail County Safe Communities Coalition is a local group carrying out Minnesota's statewide TZD
traffic safety program, with a mission to drive Otter Tail County towards zero deaths on the roadways by
developing community partnerships and promoting and implementing effective traffic safety initiatives. Frustol
highlighted that from November 2023 to Memorial Day, May 27, 2024, Otter Tail County had zero fatalities.

Priority areas for 2024-2025 include older adults and driving, distracted driving, seat belt use, pedestrian and
biking education, motorcycle safety, speeding, impairment and impact speakers. The Otter Tail County Safe
Communities Coalition will continue their efforts in community outreach to reduce the number of fatal and
serious injury crashes in the county. Frustol emphasized the importance of inviting community members to
make personal changes to model safe behaviors as traffic fatalities and serious injuries are preventable.
RESOLUTION AUTHORIZING EXECUTION OF GRANT AGREEMENT
OTTER TAIL COUNTY PUBLIC HEALTH
OTTER TAIL COUNTY RESOLUTION NO. 2024-72
THEREFORE, BE IT RESOLVED THAT Otter Tail County Public Health enter into a grant agreement with the
Minnesota Department of Public Safety, for traffic safety projects during the period from October 1, 2024
through September 30, 2025.
THEREFORE, BE IT FURTHER RESOLVED THAT the Otter Tail County Public Health Director is hereby
authorized to execute such agreements and amendments as are necessary to implement the project on behalf
of Otter Tail County Public Health and to be the fiscal agent and administer the grant.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Rogness and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

RECESS & RECONVENE
At 8:51 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 8:56 a.m.
2025-2027 TRIMIN CONTRACT
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to ratify the amended professional services agreement between Minnesota Counties Computer
Cooperative (MnCCC) and TriMin Systems, Inc. for the maintenance and support of IFS, the County's
Integrated Financial System as presented by IT Director Rick Kelsven.
PLANNING COMMISSION RECOMMENDATIONS
Otter Tail Beach Club, Inc.
Motion by Johnson, second by Lahman and unanimously carried to approve a Conditional Use Permit for Otter
Tail Beach Club, Inc. for a change in structure, from a mobile home to a stick-built dwelling, with the condition
that the 145 square foot concrete pad be removed when the existing dwelling is removed. This proposal is
located at 39692 County Highway 1, Richville, MN 56576, Section 12, Amor Township, Otter Tail Lake (56-
242), GD.

Ace Group LLP
Motion by Rogness, second by Bucholz and unanimously carried to approve the Conditional Use Permit for
Ace Group LLP for commercial use for 22 storage units in four buildings to be rented monthly as well as 1500
cubic yards of earth moving with the conditions that: 1) There is one approach (westerly) for the project with
the elimination of the easterly approach, 2) the Stormwater Pollution Prevention Plan (SWPPP) permit is
submitted to Land & Resource Management prior to the issuance of the Conditional Use Permit, 3) an unlit
sign on the building, 4) use of motion detected security lights, 5) none of the units are at any time to be resided
in or used as a dwelling or living unit, 6) hours of operation are 8:00 a.m. to 8:00 p.m., and 7) the property
owner must maintain dust control in front of the site. This proposal is located at 39225 Clitherall Lake Road,
S., Battle Lake, MN 56515, Section 26, Clitherall Township, Crane Lake (56-293), RD.
Joseph & Iliana Clauson Trust
Motion by Johnson, second by Rogness and unanimously carried to follow the recommendation of the
Planning Commission and deny the Conditional Use Permit for Joseph and Iliana Clauson Trust for a 26-unit
commercial RV campground with 15 boat slips as the property is not compatible with the surrounding area
due to the lake size and depth, located at 16446 470th Street, Pelican Rapids, MN 56572, Section 31,
Scambler Township, Grove Lake (56-952), NE.
FINAL PLAT -BOE'S BEACH 1ST ADDITION
Motion by Johnson, second by Bucholz and unanimously carried to approve the Final Plat known as "Boe's
Beach 1st Addition", consisting of 4 Single Family Residential Non-Riparian Lots, 1 Block, located West of
46956 Boe's Drive, Pelican Rapids, MN, Section 31, Dunn Township, Lizzie Lake (56-760), RD.

UNIVERSITY OF MINNESOTA EXTENSION AGREEMENT
Motion by Bucholz, second by Johnson and unanimously carried to authorize appropriate County Officials'
signatures on an agreement between Otter Tail County and the Regents of the University of Minnesota for
local Extension programming and the employment of Extension staff effective January 1, 2025 through
December 31, 2027.
SWCD AGREEMENT
Motion by Rogness, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures on an agreement between Otter Tail County and East Otter Tail Soil & Water Conservation Board
and Wadena County Soil & Water Conservation Board for providing Extension programs locally and employing
Extension staff effective January 1, 2025 through December 31, 2026.
RECOVERY MONTH PROCLAMATION
OTTER TAIL COUNTY RESOLUTION NO. 2024-73
WHEREAS more than 21 million Americans are in recovery from substance use disorder; and
WHEREAS only one in ten people in the United States with a substance use disorder receives treatment; and
WHEREAS ensuring everyone has the resources they need to recover and thrive is fundamental to the future
of Otter Tail County; and

WHEREAS people in recovery serve every sector in society, as business leaders, public servants, community
leaders, and more; and
WHEREAS Otter Tail County is the recipient of Opioid Settlement Funds with a goal to save lives and support
strategies to fight the opioid and substance abuse crisis; and
WHEREAS Otter Tail County has convened an Advisory Council to guide the planning, decision making, and
disbursement of funds aimed at Prevention and Treatment & Recovery; and
WHEREAS Otter Tail County, together with the MN Judicial Branch and other key partners, offers Treatment
Court, known to be the single most useful intervention for leading people living with substance abuse and
mental health disorders out of the justice system and into lives of recovery and stability; and
WHEREAS Otter Tail County has invested in numerous positions to expedite assessment and access to
treatment and other recovery services and supports; and
WHEREAS Otter Tail County Health and Wellness Team and its many partners collaborate to support
individuals in recovery as well as their loved ones; it is appropriate that the month of September be set apart
for highlighting and bringing awareness on the importance of recovery; and
NOW, THEREFORE, We, Otter Tail County Board of Commissioners, do hereby proclaim the month of
September to be National Recovery Month; and urge our citizens and all agencies and organizations
interested in supporting those with addiction or substance use disorder needs to unite in observance of and
join the important work occurring in our communities to promote recovery and address the needs of those
experiencing and living with addiction or substance use disorders and their families.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Lahman and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

PARKS AND TRAILS UPDATE
Parks & Trails Director Kevin Fellbaum provided an update to the Board. Among the highlights Fellbaum
noted: > The 2024 season's rainfall impacted the construction schedule and delayed completion of the Heart of the
Lakes Trail -Maplewood State Park Segment. Since the last update, the rains have stopped which has
allowed for construction to continue and progress forward. There have been lengthy discussions with the
Department of Natural Resources (DNR), contractor, and consultant engineer about how the project will
continue to move towards completion. The DNR understands the difficulties due to the heavy and constant
rains and they are open to the idea of delaying final completion until the Spring. This will allow for the
corridor to sit for a full freeze/thaw cycle and produce a better final product and should not result in
additional change orders. The grading portion is set to be complete in two to three weeks, dependent on

weather, and some gravel base and bituminous may be placed as well with the rest of the project to
resume and be completed in the Spring.
> There is an application in the works for the Phelps Mill Campus to be considered for the National Register
of Historic Places with plans to consult a conservator and preservationist to offer guidance in the process
of preserving and protecting this historic property which includes the milling equipment on the inside of the
Historic Mill. > Otter Tail County received a Minnesota Historical Society Grant in the amount of $350,000 to perform
repair work at the Phelps Mill Store, which would include foundation, porch, and roof repair.
Commissioners will participate in a walkthrough of the Phelps Mill Store to get a better look and assess
the store's current conditions.
NATIONAL REGISTER OF HISTORIC PLACES
Commissioners received a letter from the Minnesota Department of Administration State Historic Preservation
Office regarding a property in Otter Tail County that was nominated to the National Register of Historic Places.
The Foss, Ole and Anne House in Underwood, Minnesota will be considered by the State Historic Preservation
Review Board (SHPRB) on Tuesday, November 12, 2024.

At 9:53 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 10:00 a.m.
MARKET PRICE FOR THE SOLID WASTE MANAGEMENT TAX
OTTER TAIL COUNTY RESOLUTION NO. 2024-74
WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market
price if the political subdivision:
Subsidizes the cost of service at a facility.
WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market
price amount identified through this resolution; and
WHEREAS, the market price is identified in state statutes as the "lowest price available in the area"; and
WHEREAS, Otter Tail County has performed research to identify the lowest price available in the area; and
THEREFORE, the County of Otter Tail declares a market price of $77.97 per ton for a facility, based on a
tipping fee amount of $48.37 per ton at the Dakota Landfill and an additional contracted transportation cost of
$29.60 per ton.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

WHEREAS, on or before Monday, September 30, 2024 Otter Tail County may adopt a Proposed Budget for
Fiscal/Calendar Year 2025 and must adopt and certify a proposed net property tax levy for Payable Year
2025;and
WHEREAS, the Otter Tail County Auditor-Treasurer's office has accumulated the Departmental and outside
agency requests; and
WHEREAS, the Otter Tail County Finance, Property & License Management Committee has met to discuss
and review in general terms levy and budgetary guidelines, as well as the proposed department budgets and
various agency requests; and
WHEREAS, the Otter Tail County Finance, Property & License Management Committee will complete
additional review and discussion, as needed and required, of the 2025 proposed tax levy and budget prior to
final adoption on Tuesday, December 17, 2024.
NOW THEREFORE BE IT RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail County,
Minnesota, that
The amount of $56,066,737 be adopted as Otter Tail County's Proposed Gross Property Tax Levy for the
Payable Year 2025 representing a 3.34% increase from the Gross Property Tax Levy for the Payable Year
2024, and that the amount of $53,055,419 be adopted as Otter Tail County's Proposed Net Property Tax Levy
for the Payable Year 2025 representing a 3.72% increase over the Net Property Tax Levy for the Payable
Year 2024, and that
The amount of $235,075 be adopted by Otter Tail County as the Proposed Lake Improvement District Property
Tax Levies for the Payable Year 2025, representing a 9.37% increase from the Lake Improvement District
Property Tax Levies as adopted by Otter Tail County for the Payable Year 2024, and that
The amount of $1,610,431 be adopted by Otter Tail County as the Proposed Otter Tail County HRA Special
District Property Tax Levy for the Payable Year 2025, representing a 6.39% increase from the Property Tax
Levy as adopted by Otter Tail County for the Payable Year 2024, and that
The amount of $644,287 be adopted by Otter Tail County as the Pay 2025 Proposed Otter Tail County CDA
levy as authorized under the housing and redevelopment authority statutes representing a 18.92% increase
from the Property Tax Levy as adopted by Otter Tail County for the Payable Year 2024.
BE IT FURTHER RESOLVED that the amount of $145,000,000 (includes inter-fund transfers) be adopted as
Otter Tail County's Proposed Budget for the General Fund, for the Budgeted Special Revenue Funds and for
the Budgeted Debt Service Funds for the Fiscal/Calendar Year 2025 (Expenditures/Transfers/Other Uses).

PUBLIC HEARING DATE FOR PROPOSED BUDGET AND LEVY
Motion by Johnson, second by Rogness and unanimously carried to set the Proposed Levy and Budget Truth
in Taxation Public Hearing for 6:00 p.m. on Tuesday, December 3, 2024 in the Otter Tail Lake Room at the
Government Services Center (GSC) in Fergus Falls, MN.
CANVASSING BOARD APPOINTMENTS -GENERAL ELECTION
Motion by Rogness, second by Johnson and unanimously carried to appoint Commissioners Rogness and
Lahman to the 2024 Presidential General Election Canvassing Board which will meet on November 12, 2024
at 10:00 a.m. in the Otter Tail Lake Room at the Government Services Center (GSC).
SKID STEER ACQUISITION
Motion by Rogness, second by Johnson and unanimously carried to authorize the Solid Waste Department to
purchase a Skid Steer Loader from Ziegler CAT, in the quoted amount of $58,248.09 with a 5-year, 5,000-
hour warranty, with the option to trade in Asset #5931, with a quoted trade in allowance of $11,000.00, as
presented by Recycling Manager Brooks Andersen.
RECOMMENDATION FOR AWARD & CONTRACTS AND BONDS
Motion by Rogness, second by Lahman and unanimously carried to award Project S.A.P. 056-599-063 to
Houle Excavating, LLC of Little Falls, MN with the low bid amount of $118,000.00 and to authorize appropriate
County Officials' signatures to execute the contract between Otter Tail County and Houle Excavating, LLC of
Little Falls, MN for Project S.A.P. 056-599-063.
FIR AVE ROUNDABOUTS & PEDESTRIAN PRELIM DESIGN AGREEMENT
Motion by Johnson, second by Rogness and unanimously carried to authorize appropriate County Officials'
signatures on an agreement between Otter Tail County and Widseth in the amount of $141,984.00 plus
reimbursable expenses for the Fir Avenue Roundabouts and Pedestrian Safety Preliminary Design as
presented by County Engineer Krysten Foster.
NORTH TOWER ROAD & COLLEGE WAY INTERSECTION CONTROL EVALUATION
Motion by Rogness, second by Johnson and unanimously carried to authorize appropriate County Officials'
signatures on an agreement between Otter Tail County and Alliant Engineering, Inc. in the amount of
$27,320.00 plus reimbursable expenses for the North Tower Road and College Way Intersection Control
Evaluation as presented by County Engineer Krysten Foster.
PERHAM INTERSECTION STUDY AGREEMENT
Motion by Bucholz, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures on an agreement between Otter Tail County and SRF Consulting Group, Inc. in an amount up to
$12,500.00 for the Perham, MN Intersection Study for West Main Street and County State Aid Highway
(CSAH) 34/51 as presented by County Engineer Krysten Foster.

HIGHWAY DEPARTMENT UPDATE
County Engineer Krysten Foster provided a brief Highway Department update. Among the highlights Foster
noted: > The Highway Department is nearing the end of the 2024 construction season pending the completion
of the Bluffton Township project. > The Highway 47 Single T Curves Reconstruction project is substantially complete and reopen for
harvest season traffic. > A majority of the seal coat contract is striped with a few crosswalks and tum arrows to finish. > Highway 24 (Hwy 59 in Erhard to CSAH 3) resurfacing is nearing completion.
> Highway 35 (Underwood to CSAH 18) patch to be repaved before the winter. > Summer maintenance is winding down with operations focused on shouldering and mowing. > September 25th is the scheduled bid opening for the new Perham highway garage.
ADJOURNMENT
At 10:43 a.m., Chair Mortenson declared the Otter Tail County Board of Commissioners meeting adjourned
with a closed session to follow. The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday, October
8, 2024, at the Government Services Center in Fergus Falls and via livestream.
CLOSED SESSION
At 10:45 a.m., Chair Mortenson declared the Board of Commissioners meeting closed to the public. The closed
session is authorized under Minnesota Statute §13D.05, Subd. 3(c)(3) to discuss the sale or purchase of
property: Tax Parcel ID #71-003-50-0195-030 and #71-003-99-1810-000. Present in the room were
Commissioners Kurt Mortenson, Lee Rogness, Dan Bucholz, Wayne Johnson, and Bob Lahman, County
Administrator Nicole Hansen, County Attorney Michelle Eldien, Deputy Administrator Nick Leonard,
Community Development Director Amy Baldwin, and County Board Secretary Hannah Anderson. The closed
session ended at 11 :14 a.m.

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 11:18 a.m. Tuesday, September 24, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Mortenson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Lahman, second by Bucholz and unanimously carried to approve the Drainage Authority Agenda of
September 24, 2024 and the Consent Agenda of September 24, 2024 as follows:

DITCH 32 -ORDER FOR HEARING
Motion by Johnson, second by Lahman to approve the Order to Set a Public Hearing for the Redetermination
of Benefits for County Ditch 32 to be held on November 18, 2024 at 6:30 p.m. at the Pelican Rapids Public
Library in Pelican Rapids, MN. After discussion thereof and upon vote being taken thereon, the motion passed
on a roll call vote as follows:

DITCH 55 -REPAIR AMENDMENT
Drainage Inspector Colby Palmersheim reported that after consulting with the DNR Regional Hydrologist it
was determined that an in-kind culvert replacement on County Ditch 55 at the 300th Avenue crossing would
likely affect multiple public waters. The DNR Hydrologist proposed replacing the culvert at an elevation higher
than current so as not to affect public waters.
Motion by Johnson, second by Rogness and unanimously carried to amend the previous approval from June
11, 2024 for County Ditch 55 culvert replacement at the 300th Avenue crossing from an in-kind culvert
replacement to securing the necessary DNR permits to change the invert elevations of the culvert placement
which would provide relief during times of high-water levels without affecting the public waters, with Star Lake
Township to split costs with the ditch fund.
DITCH 25 -REPAIR UPDATE
Drainage Inspector Colby Palmersheim gave an update regarding County Ditch 25 repair. After the County
Ditch 25 Public Information Meeting, Houston Engineering recommended performing ditch cleanings south of
Highway 35 and north of Big McDonald Lane due to sediment and blockage. Palmersheim was contacted by
the DNR Regional Hydrologist with concerns regarding public waters and requested additional surveying. After
Houston Engineering surveyed, the DNR stated that if the repair would be done as recommended, it would
change current runout elevation resulting in partial drainage of public waters. Palmersheim noted that they are
still in the planning stages. The Drainage Authority and County Attorney advised Palmersheim to consult with
Rinke Noonan regarding ditch law for this repair.
H2OVERVIEWERS-DITCHES 10, 11 AND 31
Drainage Inspector Colby Palmersheim introduced Scott Henderson with H2OverViewers who presented on
County Ditches 10, 11 and 31. Henderson explained H2OverViewers' processes and with their findings he
noted that:
> County Ditch 10 is redetermined to benefit approximately 1300 acres with a value just under $340,000. > County Ditch 11 is redetermined to benefit approximately 400 acres with a value of $150,000. > County Ditch 31 is redetermined to benefit approximately 4600 acres with a value of $2.5 million.
Palmersheim and Henderson discussed next steps with the Drainage Authority and Palmersheim will bring a
Public Hearing request to an upcoming Drainage Authority Meeting.
ADJOURNMENT
At 11 :43 a.m., Chair Mortenson declared the Otter Tail County Drainage Authority meeting adjourned. The
next Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday, October
8, 2024, at the Government Services Center in Fergus Falls and via livestream.
