CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, August 27, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Mortenson called for approval of the Board Agenda. Motion by Rogness, second by Lahman and
unanimously carried to approve the Board of Commissioners' agenda of August 27, 2024, with the following
additions:

Motion by Johnson, second by Bucholz and unanimously carried to approve the consent agenda items as

WOT SWCD UPDATE
West Otter Tail Soil and Water Conservation District (SWCD) District Manager Aaron Larsen provided the
Board with an update on noxious weed issues in East Otter Tail County. Larsen outlined the enforcement
process of noxious weed violations for non-compliant property owners.
ACCOUNTANT POSITIONS -RECLASSIFICATION
Motion by Johnson, second by Lahman and unanimously carried to approve reclassifying an Accounting
Specialist position in the Housing and Redevelopment Authority (HRA) from a B21 on the classification and
compensation structure to a B24 Accountant-HRA position and reclassifying an Accounting Specialist-
Advanced/Payroll position from a B23 on the classification and compensation structure to a B24 Accountant-
Payroll position due to significant changes to the tasks and responsibilities.

PUBLIC HEAL TH NURSE
Motion by Lahman, second by Bucholz and unanimously carried to approve a 0.8 to 1.0 full-time equivalent
(FTE} Public Health Nurse/Registered Nurse position to work with the Family Health team as a support to
prenatal and early childhood preventative interventions with capacity for Parent Support Outreach Program
(PSOP) support work within the Health & Wellness team. This position will be funded through multiple funding
sources.
2023 PUBLIC HEALTH ANNUAL REPORT
Public Health Director Jody Lien and Assistant Public Health Director Kristi Goos presented the 2023 Public
Health Annual Report to the Board. Otter Tail County Public Health (OTCPH) has nearly 40 employees across
six programs: Administration, Family Health, Environmental Health, Community Health, Disease Prevention
& Control, and Long-Term Services & Supports. Some of the 2023 highlights include:
> OTCPH has an annual budget of approximately $4.6 million in local, state, federal and fee-based funds
with local tax levy funds accounting for 23% of total revenue in 2023, a 3% decrease from 2022 and
2021.
> In 2023, OTCPH advised the Board in the development and adoption of a moratorium on the sales of
THC edibles and beverages, and a public use ordinance for the consumption of cannabis and cannabis
derived products. They continue to collaborate with local organizations, stakeholders, and partners to
identify opportunities to reduce youth access and use and inform the public of the health-related
impacts of cannabis use. > In 2023, the Lake Region Takes Root Community Garden, through the Statewide Health Improvement
Partnership (SHIP), shared nearly 15,000lbs of fresh fruits and vegetables with Fergus Falls, Battle
Lake, and Pelican Rapids Food Shelves along with the Fergus Falls Salvation Army.
PLANNING COMMISSION RECOMMENDATIONS
Troje's Resort
Motion by Rogness, second by Bucholz and unanimously carried to approve a Conditional Use Permit for
property owner Josh Hanson for the conversion of an existing commercial resort into an 11-Unit Residential
CIC, consisting of 9 cabins and 2 camper spots, with the conditions that Unit 10 be removed, there be a
reduction of docks to 3 docks with 11 boat slips, and overflow parking on the north side of the access road off
County Highway 44. This proposal is located at 38092 County Highway 44, Richville, MN 56576, Section 16,
Dead Lake Township, Dead Lake (56-383), NE.
Michael & Sylvia Skrogstad
Motion by Lahman, second by Bucholz and unanimously carried to approve a Conditional Use Permit for a
seasonal wedding venue (May through September) with a capacity of up to 200 people with the condition that
a sign cannot exceed 4'x8' in size. This proposal is located at 54014 County Highway 38, Parkers Prairie, MN
56361, Section 20, Parkers Prairie Township, Clarno Lake (56-29), NE.
Otter Tail Power Company -Aurdal Township
Motion by Johnson, second by Lahman and unanimously carried to approve a Conditional Use Permit for Otter
Tail Power Company for the installation of a 40KW ground mount solar array located at 22016 265th Avenue,
Underwood, MN 56586, Section 35, Aurdal Township, Non-Shoreland.

Motion by Lahman, second by Bucholz and unanimously carried to approve a Conditional Use Permit for Minn

FINAL PLAT
Motion by Johnson, second by Rogness and unanimously carried to approve the Final Plat known as

RESOLUTION TO APPROVE REVISION OF
OTTER TAIL WATER MANAGEMENT DISTRICT (OTWMD) ORDINANCE
OTTER TAIL COUNTY RESOLUTION NO. 2024-68
WHEREAS, Minnesota Statute 115.55 requires all counties to have an ordinance that comply with revisions
to Minnesota Rules, Chapter 7080-7083 and requires that the county ordinance regulating subsurface sewage
treatment systems be applicable county wide other than cities or towns that adopted ordinances that comply
with Minnesota Statute 115.55 and are as strict as the applicable county ordinance; and
WHEREAS, Otter Tail County meets Minnesota Statute 115.55 with the Otter Tail County Sanitation Code,
which regulates subsurface sewage treatment systems in the county; and
WHEREAS, Otter Tail County and the Otter Tail Water Management District (OTWMD) entered into a
Memorandum of Agreement in 2023; and
WHEREAS, the Memorandum of Agreement requires that the OTWMD ordinance be as strict as the Otter Tail
County Sanitation Code and be approved by the Otter Tail County Board of Commissioners.
NOW THEREFORE BE IT RESOLVED THAT, Otter Tail County by this resolution has reviewed and approves
the attached Otter Tail Water Management District ordinance regulating subsurface sewage treatment
systems in the OTWMD jurisdiction with the following comments:
1. Section 17 paragraph 2 appears outside the scope of Minnesota Rules, Chapter 7080-7083, but rather,
the jurisdiction of Minnesota plumbing code.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Rogness and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

LETTER TO MN EMS REGULATORY BOARD -LAKE REGION AMBULANCE
Motion by Johnson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures on a letter to the Minnesota Emergency Medical Services (EMS) Regulatory Board in support for
Lake Region Healthcare's application to upgrade their ambulance license from part-time advanced life support
(ALS) to full-time ALS.
LETTER TO MN EMS REGULATORY BOARD -RINGDAHL AMBULANCE
Motion by Johnson, second by Rogness and unanimously carried to authorize appropriate County Officials'
signatures on a letter to the Minnesota Emergency Medical Services (EMS) Regulatory Board in opposition to
Ringdahl Ambulance lnc.'s application for a part-time advanced life support (ALS) license with the intent for
the Minnesota EMS Regulatory Board to facilitate a public hearing so that concerns regarding the transition
from full-time to part-time emergency services may be adequately addressed.
COUNTY ADMINISTRATOR AGREEMENT
Motion by Rogness, second by Bucholz and unanimously carried to authorize appropriate County Officials'
signatures to execute an updated employment agreement between Otter Tail County and Nicole Hansen for
the Otter Tail County Administrator position.
LANGUAGE BARRIERS WORK GROUP RECOGNITION
Deputy Administrator Lynne Penke Valdes presented on Otter Tail County's agreement with Language Line
Services, Inc., addressing language barriers within the County. County Departments have used language line
services over many years to assist in providing County services. It was recognized that numerous departments
utilized translation services, so a work group was developed with members of employees from Human
Services, Administration, Motor Vehicle, Highway, Probation, Recorder,. HRA and Public Health. The work
group negotiated one master contract for all Otter Tail County and put together a toolkit so that all County
employees have access to interpreter services, document and website translation, and a language
identification card to better serve the residents of Otter Tail County. Negotiating one countywide contract also
reduced costs for language line services.
COUNTY EXTENSION COMMITTEE APPOINTMENT
Motion by Lahman, second by Bucholz and unanimously carried to appoint Dwayne Woodbridge to the Otter
Tail County Extension Committee effective September 1, 2024 through December 31, 2027.
CHILDREN'S JUSTICE ACT TASK FORCE GRANT
Motion by Rogness, second by Lahman and unanimously carried to authorize acceptance of the Children's
Justice Act Task Force Grant from the Department of Children, Youth and Families in the amount of
$25,000.00 for the relocation and redesign of Otter Tail County Human Services CornerHouse Room, which
is utilized for forensic interviewing, as outlined by Assistant Human Services Director Jess Steinbrenner.

AMC ANNUAL CONFERENCE
Discussion was held regarding the Association of Minnesota Counties (AMC) Annual Conference to be held
December 9-11, 2024 in Bloomington, MN. Otter Tail County Commissioners plan to attend this conference.
RECESS & RECONVENE
At 9:54 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 10:08 a.m.
MICA 2024 END-OF-SESSION BRIEFING
Executive Director Matt Massman, Transportation Liaison Steve Novak, and Health and Human Services
Liaison Nancy Silesky of Minnesota Inter-County Association (MICA) provided a 2024 End-of-Session Briefing
for the Board. They covered key county priorities and provided a recap of county impacts including Tyler
Settlement Funding, Transportation, Emergency Medical Services, and Health & Human services.
MAPLEWOOD TRAIL UPDATE
Parks and Trails Director Kevin Fellbaum and Project Engineer Jeff Langan with Houston Engineering, Inc.
provided an update to the Board regarding the Heart of the Lakes Trail -Maplewood State Park Segment.
This seasons rainfall volume and frequency has made construction of the new trail corridor difficult and has
made site conditions in some areas unworkable which has impacted the overall schedule and could potentially
delay final completion for this year. Fellbaum will be meeting with project stakeholders-DNR Park staff, County
staff, contractors and Houston Engineering to determine how the final completion date will need to be adjusted
and set goals for what work can still be completed this construction season and what construction activities
may need to be delayed to next construction season.
EXTINGUISHING INTEREST IN A CERTAIN PORTION OF CSAH 31
OTTER TAIL COUNTY RESOLUTION NO. 2024-69
WHEREAS, because of the completed construction of County State Aid Highway Number 31 in Government
Lot 5 (5), Section Two (2), Township One Hundred Thirty-seven (137) North, Range Forty-two (42) West, in
Otter Tail County, a portion of the pre-existing right of way is no longer used or necessary; and
WHEREAS, the County Highway Engineer, Krysten Foster, recommends that the interest in the said old
portion of the right of way no longer used or necessary be extinguished; and
WHEREAS, the original right of way interest was part of County Aid Road 37, then County Aid Road 40 and
finally County State Aid Highway Number 31; and
WHEREAS, the original right of way interest was established more than 40 years ago, was not fee title and
was not recorded with the Otter Tail County Recorder; and
WHEREAS, no maintenance has occurred within the last 40 years.
NOW THEREFORE BE IT RESOLVED THAT, pursuant to Minnesota Statutes 163.11, subdivision 7, Otter
Tail County extinguish interest in the tracts of land lying northerly of the following described boundary:
Commencing at the intersection of the West boundary of Government Lot 5 of Section 2,
T137N-42W and the northerly right of way line of County State Aid Highway Number 20 and

continuing northeasterly along the northerly right of way line of said CSAH 20 to the North
boundary of Government Lot 5 of said Section 2 and there terminating.
The names of the parties known by the Board to be owners and occupants or interested in the above-described
land are as follows:
Luke E. Conklin and Tracy L. Conklin (PIN 17000020028000 & 17000020028002) and St.
Mary of the Lakes, Inc. (PIN 17000020028001)
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Lahman and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

HIGHWAY DEPARTMENT UPDATE
County Engineer Krysten Foster provided a brief Highway Department update. Among the highlights Foster
noted: > CSAH 47 -Preconstruction meeting this week for the reconstruction of CSAH 47 curves at 110th St.
and work is expected to start and complete in September. > Bluffton Town Bridge -Box culvert installation on Leaf River Road is expected in October. > CSAH 24 -Resurfacing project is expected to be complete East of Erhard by the end of September.
> CSAH 80 -The Main Street project in Perham is progressing with reclaiming starting outside of town.
> CSAH 1 -The Highway Department plans to readvertise for bids for the CSAH 2 to 1-94 project in
October.
) CSAH 6 -The Highway Department is currently working through the permitting process to reopen the
road. There are culverts under the existing road that function as water level control structures and
those will be reinstalled. The County is not abandoning the idea of an off-take ditch or water
management system in the area to prevent future flooding. The grade raise is a short-term solution
while the Highway Department continues to move forward with future solutions.
PERHAM GARAGE LEASE AGREEMENT
Motion by Johnson, second by Bucholz and unanimously carried to authorize appropriate County Officials'
signatures to execute the lease agreement between Otter Tail County and the City of Perham for the rental of
approximately two acres of land at the City of Perham Public Works Facility property for a period of twenty-
five (25) years, September 1, 2024 through August 31, 2049, for Highway Department Garage and Salt/Sand
Storage purposes.
1174 WESTERN AVE LEASE AGREEMENT
Motion by Rogness, second by Johnson and unanimously carried to authorize Otter Tail County Administration
to finalize the lease agreement between Otter Tail County and NBH Fergus Falls, LLC. as well as authorize
appropriate County Officials' signatures to execute the agreement for the lease of the Otter Tail County facility
located at 1174 Western Avenue, Fergus Falls, MN 56537.

RESOLUTION APPROVING PROPERTY TAX ABATEMENTS
OTTER TAIL COUNTY RESOLUTION NO. 2024-70
BE IT RESOLVED by the Board of Otter Tail County, Minnesota (the "County"), as follows:
1. Recitals.
(a) The County proposes to approve tax abatements in connection with the construction of single family
homes (the "Projects"), The County proposes to use the tax abatements for the Projects provided for
in Minnesota Statutes, Sections 469.1812 through 469.1815 (the "Abatement Law"), from the property
taxes to be levied by the County on Parcel Identification Numbers 38000130085001,
38000240177001, 74000990607002, 74000990607003, 25000991267000, 25000991268000,
28000110077012, 51000060074012, 06000240178000, 35000210191003, 37000991506000,
32000990732000, 57000990459000, 56000990554000, 14000990370000, 22000260228001,
18000990290900 (collectively, the "Tax Abatement Properties").
(b) The County proposes to approve tax abatements on a portion of the County's share of property taxes
on the Tax Abatement Properties in the amount of $10,000 for a term of up to five (5) years to finance
a portion of the costs of the Project.
(c) The tax abatement is authorized under the Abatement Law.
2. Findings for the Tax Abatement. The Board hereby makes the following findings:
(a) The tax abatement is the County's share of real estate taxes which relate to the Projects being
constructed on the Tax Abatement Properties and not the real estate taxes that relate to the value of
the land (the "Abatement").
(b) The Board expects the benefits to the County of the Abatement to be at least equal or exceed the
costs to the County thereof.
(c) Granting the Abatement is in the public interest because it will increase the tax base in County.
(d) The Tax Abatement Properties are not located in a tax increment financing district.
(e) In any year, the total amount of property taxes abated by the County by this and other resolutions and
agreements, does not exceed the greater of ten percent (10%) of the net tax capacity of the County
for the taxes payable year to which the abatement applies or $200,000, whichever is greater. The
County may grant other abatements permitted under the Abatement Law after the date of this
resolution, provided that to the extent the total abatements in any year exceed the Abatement Limit
the allocation of the Abatement limit to such other abatements is subordinate to the Abatement granted
by this resolution.
NOW THEREFORE BE IT RESOLVED THAT, the Abatement is hereby approved. The terms of the
Abatement are as follows:
(f) The Abatement shall be for up to five (5) years anticipated to commence for taxes payable 2026 and
shall not exceed $10,000. The County reserves the right to modify the commencement date, but the
abatement period shall not exceed five (5) years.
(g) The County shall provide the Abatement as specified in this resolution.

(h) The Abatement shall be subject to all the terms and limitations of the Abatement Law.
BE IT FURTHER RESOLVED THAT, the Board hereby approves the Tax Abatement Agreements for payment
of the Abatement in substantially the form submitted and the Chair and Clerk are hereby authorized to execute
the Tax Abatement Agreements on behalf of the County.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Lahman and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

SINGLE FAMILY PROPERTY TAX REBATE PROGRAM STATUS
Community Development Director Amy Baldwin updated the Board on the recommendation from the
Community Development Agency (CDA) regarding the Single-Family Tax Rebate Program. The CDA Board
recommends allowing the program to expire as currently structured with the application submission deadline
of December 31, 2024 and if requested by City partners, it is recommended that Otter Tail County offer a
property tax rebate in those Cities who wish to continue to offer in their community. Formal approval of City
specific tax rebate program will be brought forward for the Board's consideration as they are requested by a
City.
ADJOURNMENT
At 11 :26 a.m., Chair Mortenson declared the Otter Tail County Board of Commissioners meeting adjourned
with a closed session to follow. The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday,
September 10, 2024, at the Government Services Center in Fergus Falls and via livestream.
CLOSED SESSION
At 11 :27 a.m., Chair Mortenson declared the Board of Commissioners meeting closed to the public. The closed
session is authorized under Minnesota Statute §13D.05, Subd. 3(b) for Attorney-Client Privilege regarding the
Otter Tail County Jail. Present in the room were Commissioners Kurt Mortenson, Lee Rogness, Dan Bucholz,
Wayne Johnson, and Bob Lahman, County Administrator Nicole Hansen, County Attorney Michelle Eldien,
County Sherrif Barry Fitzgibbons, County Board Secretary Hannah Anderson and Cally Kjellberg-Nelson with
Quinlivan and Hughes, P.A., joined virtually. The closed session ended at 11 :50 a.m.

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 11 :52 a.m. Tuesday, August 27, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Lee Rogness, Vice
Chair; Wayne Johnson, Dan Bucholz, and Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Mortenson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Lahman, second by Rogness and unanimously carried to approve the Drainage Authority Agenda of August
27, 2024 and the Consent Agenda of August 27, 2024 as follows:

JOINT DRAINAGE AUTHORITY APPOINTMENT RESOLUTION
OTTER TAIL COUNTY RESOLUTION NO. 2024-71
WHEREAS, The Otter Tail County Board of Commissioners is the Drainage Authority for Otter Tail County
under Minn. State Statute §103E.103E.005 Subdivision 4; and
WHEREAS, Judicial Ditch #2 and Judicial Ditch #4 are joint systems, benefitting both Wadena County
properties and Otter Tail County properties; and
WHEREAS, evidence of a Joint Drainage Authority being established between Otter Tail County and Wadena
County has not been found; and
WHEREAS, A Joint Drainage Authority consisting of two Otter Tail County Commissioners, acting as the Otter
Tail County Drainage Authority, and three Wadena County Commissioners, acting as the Wadena County
Drainage Authority is needed.
NOW THEREFORE BE IT RESOLVED THAT, the District 1 Otter Tail County Commissioner, currently held
by Commissioner Dan Bucholz, and the District 4 Otter Tail County Commissioner, currently held by
Commissioner Robert (Bob) Lahman be appointed to represent Otter Tail County in the Joint Drainage
Authority for JDL2, located within Section 1 of Bluffton Township and JDL4 in Section 14 and 25 in Bluffton
Township.

The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly
seconded by Commissioner Rogness and, after discussion thereof and upon vote being taken thereon, passed
unanimously.
Adopted at Fergus Falls, MN this 27th day of August 2024.

DITCH 56 -CLEANING
Motion by Johnson, second by Lahman and unanimously carried to approve cleaning approximately 200 feet
of Ditch 56 in the Northeast Quarter of Section 20 of Tronhjem Township due to cattail growth and beaver
dam obstructions with the expenses to be paid by the ditch fund as recommended by Drainage Inspector
Colby Palmersheim.
DITCHES 10, 11, & 31 VIEWER RESCINDMENT
Motion by Lahman and second by Johnson to adopt the Amendment to the Findings and Order Appointing
Viewers for the Redetermination of Benefits for Ditches 10, 11, and 31 regarding the rescindment of Aaron
Goemann as Viewer. After discussion thereof and upon vote being taken thereon, the motion passed on a roll
call vote as follows:

DITCH 47 -REPAIR
Motion by Johnson, second by Lahman and motion carried with Rogness abstaining to approve repair in Ditch
47, along County Highway 1 in Section 17 of Buse Township, as recommended by Drainage Inspector Colby
Palmersheim. Palmersheim plans to look at grant funding sources for this repair.
ADJOURNMENT
At 12:01 p.m., Chair Mortenson declared the Otter Tail County Drainage Authority meeting adjourned. The
next Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday,
September 10, 2024, at the Government Services Center in Fergus Falls and via livestream.
