CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, January 23, 2024, at the
Government Services Center in Fergus Falls, MN. Commissioners Kurt Mortenson, Chair; Wayne Johnson,
Dan Bucholz, and Bob Lahman were present in the room; Commissioner Lee Rogness, Vice Chair; was
present via Webex and did not participate in the vote pursuant to Minnesota Statute 130.
APPROVAL OF AGENDA
Chair Mortenson called for approval of the Board Agenda. Motion by Johnson, second by Bucholz and
unanimously carried to approve the Board of Commissioners' agenda of January 23, 2024, with the following
changes and additions:
Removed Payment #14162 from Warrants/Bills
General Discussion: Board Communications Expectations & Long Prairie Watershed
EGCI Committee: Legislative Priorities & Highway Garages Update

APPROVAL OF CONSENT AGENDA
Motion by Lahman, second by Bucholz and unanimously carried to approve the consent agenda items as
amended:

and Grill, located at 43974 390th St. in Rush Lake Township.
PH-DOC 2024 CONTRACT RATIFICATION
Motion by Johnson, second by Lahman and motion carried to authorize appropriate County Officials'
signatures to ratify the PH-Doc Maintenance and Support Agreement between Avenue Insights & Analytics,
LLC and the Minnesota Counties Computer Cooperative (MnCCC) on behalf of the Community Health
Services (CHS) User Group for maintenance and support of the PH-Doc Software effective January 1, 2024.
COMMUNICATIONS OFFICER/E-911 DISPATCHER
Motion by Bucholz, second by Lahman and motion carried to approve two (2) 1.0 full-time equivalent (FTE)
Communications Officer/E911 Dispatcher positions within the Sheriffs Office to help manage an increased
call load. These positions are included in the 2024 budget.
RECESS & RECONVENE
At 8:42 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 8:46 a.m.
MnDOT & CITY OF HENNING & OTTER TAIL COUNTY
COOPERATIVE CONSTRUCTION AGREEMENT RESOLUTION
OTTER TAIL COUNTY RESOLUTION NO. 2024-10
NOW THEREFORE BE IT RESOLVED THAT, Otter Tail County enter into MnDOT Agreement 1054764 with
the State of Minnesota, Department of Transportation for the following purposes:
To provide for payment by the County to the State of the County's share of the costs of the ADA improvements,
lighting and other associated construction to be performed upon, along, and adjacent to Trunk Highway No.
108 from 7 40 feet west of 4th Street to Trunk Highway 210 under State Project No. 5624-20.
IT IS FURTHER RESOLVED THAT the County Board Chair and the County Board Clerk are authorized to
execute the Agreement and any amendments to the Agreement.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Lahman, duly
seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed.
Adopted at Fergus Falls, MN this 23rd day of January 2024.

COUNTY STATE AID HIGHWAY 1 RIGHT OF WAY ACQUISITION
OTTER TAIL COUNTY RESOLUTION NO. 2024-11
Motion by Johnson, second by Bucholz and motion carried to approve County State Aid Highway 1 Right of
Way Acquisition Resolution No. 2024-11 as set forth in the attached Exhibit B.
RINKE NOONAN-2024 LEGAL REPRESENTATION AND RATES
Motion by Bucholz, second by Lahman and motion carried to authorize appropriate County Officials' signatures
on an hourly rate services agreement between Otter Tail County Highway Department and Rinke Noonan Law
Firm for the County State Aid Highway (CSAH) 1 Reconstruction Project as presented by County Engineer
Krysten Foster.
REQUEST FOR PUBLIC HEARINGS
Motion by Johnson, second by Lahman and motion carried to approve the proposed list of 2024 Public Hearing
dates regarding the Single-Family Tax Rebate Program as presented. Notices of the public hearings will be
published as each hearing date approaches.

At 8:58 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 9:00 a.m.
PLANNING COMMISSION RECOMMENDATION
Motion by Johnson, second by Bucholz and motion carried to approve a Conditional Use Permit for property
owner Mike Anderson to construct a 2,100 foot road to county and township specifications for a total of 3,500
cubic yards of shoreland alterations with conditions that 1) the cul-de-sac have a traveled surface diameter of
a minimum of 100 feet and 2) the property owner meet with the County Wetland Inspector onside prior to
beginning grading work to ensure there will be no wetland impacts. This proposal is located West of 23006
Blybergs Ln., Pelican Rapids, MN 56572, Section 17, Dunn Township, Fish Lake (56-768), GD.
SSTS GRANT & LOAN GUIDELINES
Motion by Bucholz, second by Lahman and motion carried with Johnson abstaining to approve the SSTS Local
Cost Share Fix Up Fund Program, Otter Tail River One Watershed One Plan, 2024 Application Guideline for
financial assistance to replace eligible Subsurface Sewage Treatment Systems (SSTS) as presented by Land
and Resource Management Director Chris Leclair.
Motion by Lahman, second by Bucholz and motion carried with Johnson abstaining to approve the SSTS
Minnesota Clean Water Program (CWP) Loan Program 2024 Application Guideline to provide low interest
loans to property owners to replace non-compliant subsurface sewage treatment systems (SSTS) as
presented by Land and Resource Management Director Chris LeClair.
Motion by Bucholz, second by Lahman and motion carried with Johnson abstaining to approve the SSTS Local
Cost Share Fix Up Fund Program, Minnesota Pollution Control Agency, 2024 Application Guideline for
financial assistance to replace eligible subsurface sewage treatment systems (SSTS) as presented by Land
and Resource Management Director Chris LeClair.

OUT-OF-STATE TRAVEL REQUEST
Motion by Johnson, second by Bucholz and motion carried to approve out-of-state travel for Land and
Resource Management Director Chris LeClair to travel to Devils Lake, ND from February 12-13, 2024 to attend
the 2024 North Dakota Onsite Wastewater Association (NDOWA) Annual Conference.
BOARD COMMUNICATIONS EXPECTATIONS
Commissioners held discussion on best practices in keeping the Board informed on communications received
without violating the Open Meeting Law.
LONG PRAIRIE WATERSHED
Commissioner Lahman informed Land and Resource Management Director Chris LeClairthat the Long Prairie
Watershed has interest in looking at grants to support replacing eligible subsurface sewage treatment systems
(SSTS) within the watershed.

At 9:25 a.m., Chair Mortenson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The Board of Commissioners meeting was reconvened at 9:30 a.m.
REQUESTS FOR ABATEMENT OF PENAL TY AND INTEREST
Motion by Johnson, second by Bucholz and motion carried to deny the request of Michael and Lori Siems for
the abatement of accrued penalty and interest on Parcel No. 71-002-99-0611-000, in the amount of $97.73,
for the late payment of property taxes as the reasons stated do not fall in line with the County's hardship policy.
There was no County error causing the taxes to be paid late.
Motion by Lahman, second by Bucholz and motion carried to approve the request of Phillip Koep for the
abatement of accrued penalty and interest on Parcel Nos. 27-000-29-0192-000, 36-000-08-0056-001, 36-000-
14-0091-000, 36-000-15-0107-000, and 36-000-05-0037-000, in the amount of $387 .31, for the late payment
of property taxes as the reasons stated fall in line with the County's hardship policy.
Motion by Johnson, second by Lahman and motion carried to deny the request of Charles and Vanessa
Boehm for the abatement of accrued penalty and interest on Parcel No. 82-000-99-0173-000, in the amount
of $172.24, for the late payment of property taxes as the reasons stated do not fall in line with the County's
hardship policy. There was no County error causing the taxes to be paid late.
ELECTION SERVICES AGREEMENT
Motion by Johnson, second by Bucholz and motion carried to authorize appropriate County Officials'
signatures on the Election Services Agreement between Otter Tail County and Election Systems and Software
for a three (3) year period ending December 31, 2026.
PUBLIC DEMONSTRATION OF THE EXPRESSVOTE EQUIPMENT
County Auditor-Treasurer Wayne Stein provided a demonstration of the new ExpressVote Universal Voting
System, a voter assist terminal, which will replace the AutoMARK equipment previously used by Otter Tail
County.

ADJOURNMENT
At 10:25 a.m., Chair Mortenson declared the Otter Tail County Board of Commissioners meeting adjourned.
The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday, February 13, 2024, at the Government
Services Center in Fergus Falls and via livestream.

OTTER TAIL COUNTY RESOLUTION NO. 2024-11
Project No. SAP. 056-601-067
Parcel Nos. 2, 3, 4, 5, 6, 8, 10, 13, 14, 16, 20, 24, 26, 28 and 32
WHEREAS, Otter Tail County proposes to reconstruct and improve County State Aid Highway No. 1 from 347
feet north of CSAH 2 to Interstate 94, and located in:
Sections 8, 9, 16, 17, 20, 21, 28 & 29, of T132N, R43W, and
WHEREAS, the reason for the construction of this segment of County State Aid Highway No. 1 is due to the
existing highway's poor condition; and
WHEREAS, this improvement is necessary to provide for the safety of the traveling public; and
WHEREAS, Otter Tail County has a right to acquire the right of way after an award of damages has been filed
with the County Auditor in accordance with Minnesota Statute, Section 163.02 and 163.12; and
