Commissioners Wayne Johnson, Chair; Kurt Mortenson, Vice Chair; Dan Bucholz, Lee Rogness and Bob Lahman were present. APPROVAL OF AGENDA Chair Johnson called for approval of the Board Agenda. PROBATION ADVISORY COMMITTEE STIPEND Motion by Mortenson, second by Lahman and unanimously carried to approve a $60 stipend plus mileage reimbursement for community members serving on the Probation Advisory Committee retroactive to October 1, 2023 as recommended by Probation Director Michael Schommer. Page 1 of 14 Board of Commissioners' Meeting Minutes October 24, 2023 RESOLUTION TO AUTHORIZE SIGNATORY ON BEHALF OF OTTER TAIL COUNTY FOR THE MN FAMILY INVESTMENT PROGRAM (MFIP) BIENNIAL SERVICE OTTER TAIL COUNTY RESOLUTION NO. 2023-75 WHEREAS, the State of Minnesota acting through its Department of Human Services (State) has the authority to enter into contracts/agreements for the following services: Minnesota Family Investment Program (MFIP); and WHEREAS, the County is responsible for the administration of MFIP for eligible families; and WHEREAS, the Otter Tail County Board of Commissioners grants signatory authority for the MFIP Biennial Service Agreement to Deb Sjostrom or successor, Otter Tail County Human Services Director; and WHEREAS, the agreement requires signatory authority and the agreement must be submitted through the State process. THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners authorizes Deb Sjostrom or successor, Otter Tail County Human Services Director to sign on behalf of the County. The motion for the adoption of the foregoing resolution was introduced by Commissioner Rogness, duly seconded by Commissioner Bucholz and, after discussion thereof and upon vote being taken thereon, passed unanimously. OTTER TAIL COUNTY BOARD OF COMMISSIONERS Dated: November 14, 2023 Attej I tAL ~ Nicole Hansen, Clerk INTRODUCTION OF ASSISTANT HUMAN SERVICES DIRECTOR Human Services Director Deb Sjostrom introduced to the Board, Jessica Steinbrenner, the new Assistant Human Services Director. Steinbrenner shared her experience and background and noted that it is a privilege to join the Human Services team. Steinbrenner joined Otter Tail County in mid-September. CANNABIS PUBLIC USE ORDINANCE Motion by Mortenson, second by Lahman and unanimously carried to adopt the Otter Tail County Ordinance Regulating the Use of Cannabis and Cannabis Derived Products in Public Places, effective upon publication, as presented by Public Health Director Jody Lien. This ordinance will prohibit and regulate the public use of cannabis and further define the public place to be more stringent to protect the public from exposure to cannabis smoke, aerosol and vapor, prohibit smoking and vaping of cannabis outdoors at establishments unless licensed for onsite consumption, and establish a petty misdemeanor charge for violations of the ordinance. Page 2 of 14 Board of Commissioners' Meeting Minutes October 24, 2023 2024 DENTAL INSURANCE RFP RECOMMENDATION Motion by Rogness, second by Bucholz and unanimously carried to approve the recommendation of the Benefits Committee to continue with Delta Dental as the carrier for group dental insurance. Rates will increase 5% in 2024 with a 2-year rate guarantee and the removal of waiting periods. 2024 EMPLOYER CONTRIBUTION AMOUNTS Motion by Mortenson, second by Rogness and unanimously carried to approve matching the non-union employer contribution to the 2024 union contracts. 2024 Employer Contributions are as follows: Grandfathered (Legacy) Single Employees Existing Dependent Coverage & New Employees Single Single + Child(ren) Single + Spouse Family $1405 $850 $1500 $1500 $1775 PLANNING COMMISSION RECOMMENDATIONS Douglas E. Cummings An After the Fact Conditional Use Permit request to excavate and grade the old Sunset Beach Road roadbed to address drainage concerns was tabled by the Planning Commission to allow time for property owner Douglas Cummings and Engineer to review available options with the Soil and Water Conservation District (SWCD) and their Engineer. Stonybrook Properties LLP Motion by Mortenson, second by Lahman and unanimously carried to approve a Conditional Use Permit for a Non-Dwelling Planned Unit Development (PUD) consisting of 26 total storage units (14 units within 1000' of Fish Lake) and Shoreland Alteration for 5,000 cubic yards of earthmoving, located in Section 1 of Aurdal Township, Fish Lake (56-684), NE Parcel No. 03000010001900 with the following conditions: the Minnesota Pollution Control Agency Storm Water Prevention Plan Permit is approved prior to beginning work, the County Highway Department approves an approach off County Highway 1, or if denied, the addition of a cul-de-sac added to the west end of the development, and Township approval for two approaches off Fish Lake Beach Road. Strinden Addition to Lida View Hills Motion by Rogness, second by Bucholz and motion carried with Johnson abstaining to approve a Preliminary Plat titled "Strinden Addition to Lida View Hills", owned by Tom Strinden, consisting of 3 Single Family Residential Non-Riparian Lots, 1 Block, located in Section 23 of Lida Township, Lida Lake (56-747) GD, Parcel No.37000230112000. Chad Rheault Motion by Mortenson, second by Lahman and unanimously carried to accept the withdrawal of a Conditional Use Permit Application, for a Commercial Planned Unit Development (PUD) located at 29151 Pleasant Lake Rd., Underwood, MN 56586, Section 5 of Sverdrup Township, Pleasant Lake (56-449) RD and Little Anna Lake (56-450) NE, submitted by property owner Chad Rheault. Board of Commissioners' Meeting Minutes October 24, 2023 RESOLUTION APPROVING SINGLE-FAMILY TAX ABATEMENTS OTTER TAIL COUNTY RESOLUTION NO. 2023-76 (a) The County proposes to approve tax abatements in connection with the construction of single family homes (the "Projects"), The County proposes to use the tax abatements for the Projects provided for in Minnesota Statutes, Sections 469.1812 through 469.1815 (the "Abatement Law"), from the property taxes to be levied by the County on Parcel Identification Numbers 39000050030003, 73000990623001, 55000290206001, 71002991960000, 03000190132000, 03000990854000, 46000991232000, 74000110006014, 26000990522000, 07000260169002, 47000210137004, 52000010005000, 02000180130001, 47000240156001, 20000120073007, 52000990575000, 74000100005903, 74000990201001 (collectively, the "Tax Abatement Properties"). (b) The County proposes to approve tax abatements on a portion of the County's share of property taxes on the Tax Abatement Properties in the amount of $10,000 for a term of up to five (5) years to finance a portion of the costs of the Project. (c) The tax abatement is authorized under the Abatement Law. 2. Findings for the Tax Abatement. The Board hereby makes the following findings: (a) The tax abatement is the County's share of real estate taxes which relate to the Projects being constructed on the Tax Abatement Properties and not the real estate taxes that relate to the value of the land (the "Abatement"). (b) The Board expects the benefits to the County of the Abatement to be at least equal or exceed the costs to the County thereof. (c) Granting the Abatement is in the public interest because it will increase the tax base in County. (d) The Tax Abatement Properties are not located in a tax increment financing district. (e) In any year, the total amount of property taxes abated by the County by this and other resolutions and agreements, does not exceed the greater of ten percent ( 10%) of the net tax capacity of the County for the taxes payable year to which the abatement applies or $200,000, whichever is greater. The County may grant other abatements permitted under the Abatement Law after the date of this resolution, provided that to the extent the total abatements in any year exceed the Abatement Limit the allocation of the Abatement limit to such other abatements is subordinate to the Abatement granted by this resolution. NOW THEREFORE BE IT RESOLVED THAT, the Abatement is hereby approved. The terms of the Abatement are as follows: (f) The Abatement shall be for up to five (5) years anticipated to commence for taxes payable 2025 and shall not exceed $10,000. The County reserves the right to modify the commencement date, but the abatement period shall not exceed five (5) years. (g) The County shall provide the Abatement as specified in this resolution. BE IT FURTHER RESOLVED THAT, the Board hereby approves the Tax Abatement Agreements for payment of the Abatement in substantially the form submitted and the Chair and Clerk are hereby authorized to execute the Tax Abatement Agreements on behalf of the County. OTTER TAIL COUNTY BOARD OF COMMISSIONERS Dated: November 14, 2023 Attest&! ~ Nicole Hansen, Clerk OCTOBER IS MANUFACTURING MONTH 2023 PROCLAMATION OTTER TAIL COUNTY RESOLUTION NO. 2023-77 WHEREAS, the manufacturing industry is a critically important part of Minnesota's and Otter Tail County's diverse economy; and WHEREAS, manufacturing contributed $58.7 billion to Minnesota's economy in 2022, representing 13% of the state's gross domestic product; and WHEREAS, manufactured exports brought $24 billion into the Minnesota economy in 2022; and WHEREAS, workers took home $235.8 million in wages from Otter Tail County manufacturing jobs in 2022, the largest total payroll among private sector industries; and WHEREAS, manufacturing in Otter Tail County pays an average annual wage of $57,910, which is 22% higher than the county's overall average private sector wage; and WHEREAS, manufacturing provides more than 4,000 highly skilled, well-paying jobs, which significantly contribute to Otter Tail County's high standard of living and economic vitality; and WHEREAS, there are 87 manufacturing companies in Otter Tail County, making a wide range of products that improve life, create solutions and bring joy in Minnesota and around the world. NOW, THEREFORE, I, Wayne Johnson, do hereby proclaim the month of October 2023 shall be observed as: MANUFACTURING MONTH in Otter Tail County. SALES ORDER AGREEMENT WITH ELECTION SYSTEMS AND SOFTWARE Motion by Lahman, second by Rogness and unanimously carried to authorize appropriate County Officials' signatures on the Agreement with Election Systems and Software for the purchase of 82 Express Vote Universal Voting Systems to replace the current AutoMARK equipment. CITY OF PERHAM PROPOSAL & TIF PLAN County Auditor-Treasurer Wayne Stein confim,ed with the Board that they had received notification from the City of Perham regarding a proposal to modify the Development Program for Development District No. 2 and to adopt a Tax Increment Financing (TIF) Plan to establish Tax Increment Financing District No. 2-45: Bongards Warehouse Expansion. RECESS & RECONVENE At 9:28 a.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board of Commissioners meeting was reconvened at 9:40 a.m. ENGINEERING SERVICES AGREEMENT PROPOSAL Motion by Mortenson, second by Rogness and unanimously carried to approve the proposal from Moore Engineering, Inc. for Engineering Services for the County State Aid Highway (CSAH) 35 Improvements Project from Dent to Vergas as recommended by County Engineer Krysten Foster. BNSF CROSSING SURFACE INSTALLATION AGREEMENT Motion by Lahman, second by Bucholz and unanimously carried to approve the Crossing Surface Installation Agreement between Otter Tail County and BNSF Railway Company to replace the existing concrete crossing surface at County State Aid Highway (CSAH) 75 with a new concrete crossing surface as presented by County Engineer Krysten Foster. DISTRICT COURT JUDGES MEETING Commissioner Mortenson gave a brief update on his recent meeting with Minnesota District Court Judges Kevin Miller and Michael Fritz regarding the use of virtual court hearings. They noted that the input and feedback received by the Steering Committee strongly supported the continued use of virtual hearings for the type of hearings where use can serve both the interests of the parties and the court. They further acknowledge and recognize the concerns and challenges that virtual hearings can present but look to guidance from the Judicial Council on how best to address issues raised by stakeholders. As of right now, virtual hearings will continue to be part of the Judicial System. Page 6 of 14 MICA UPDATE Board of Commissioners' Meeting Minutes October 24, 2023 Commissioner Rogness provided a brief update on his recent meetings with Minnesota Inter-County Association (MICA). Discussion focused on priorities for the 2024 legislative season. RECESS & RECONVENE At 9:48 a.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board of Commissioners meeting was reconvened at 10:00 a.m. MINNESOTA DNR UPDATE Minnesota Department of Natural Resources (DNR) Northwest Regional Director Theresa Ebbenga, along with DNR Representatives Erik Anthonisen, Nicolas Snavely, Shawn Donais and Kerry Ross, provided an update to the Board highlighting DNR presence in Otter Tail County. After a brief overview Ebbenga asked the Board for input on concerns or opportunities within the county. Improvements to public water access sites was a topic of interest as well as lake outlet structures and dams, and aquatic invasive species within Otter Tail County lakes. LAKES COUNTRY SERVICES COOPERATIVE-BOARD MEMBER TERM Motion by Bucholz, second by Lahman and unanimously carried to nominate Commissioner Mortenson to run for a position on the Lakes Country Service Cooperative Board of Directors for the term beginning February 1 , 2024 and ending December 31, 2027. MCIT VOTING DELEGATES AND AL TERNA TES County Administrator Nicole Hansen confirmed with the Board that Commissioner Rogness will serve as the voting delegate with Commissioner Johnson the alternate for the 2023 Minnesota Counties Intergovernmental Trust (MCIT} Annual Meeting held in December. ADJOURNMENT At 10:29 a.m., Chair Johnson declared the Otter Tail County Board of Commissioners meeting adjourned with a closed session to follow. The next regular Board meeting is scheduled at 8:30 a.m. on Tuesday, November 14, 2023, at the Government Services Center in Fergus Falls and via livestream. CLOSED SESSION At 10:32 a.m. Chair Johnson declared the Board of Commissioners meeting closed to the public. :07 p.m. CALL TO ORDER The Otter Tail County Drainage Authority convened at 11 :07 p.m. Tuesday, October 24, 2023, at the Government Services Center in Fergus Falls, MN. Commissioners Wayne Johnson, Chair; Kurt Mortenson, Vice Chair; Dan Bucholz, Lee Rogness and Bob Lahman were present. APPROVAL OF AGENDA & CONSENT AGENDA Chair Johnson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by Rogness, second by Mortenson and unanimously carried to approve the Drainage Authority Agenda of October 24, 2023 as presented and the Consent Agenda of October 24, 2023 as follows: 1. Warrants/Bills for October 24, 2023 (Exhibit A) DITCH 49 REDETERMINATION OF BENEFITS HEARING ORDER Motion by Lahman, second by Bucholz and unanimously carried to adopt the Findings and Order Setting a Public Hearing for Ditch 49 Redetermination of Benefits on December 11, 2023 at 7:00 p.m. with the location to be determined. DITCH 12 REDETERMINATION OF BENEFITS ORDER Drainage Inspector Colby Palmersheim presented the final Findings and Order Approving the Redetermination of Benefits for Ditch 12. Palmersheim reported on the final Ditch 12 benefit amounts after the secondary reviews were applied. Motion by Mortenson, second by Lahman to adopt the final Findings and Order Approving the Redetermination of Benefits for Ditch 12. Page 1 of 3 DITCH 58 CULVERT Drainage Authority Meeting Minutes October 24, 2023 Motion by Bucholz, second by Lahman and unanimously carried to authorize approval for property owner Gabor Kerekes to work in Ditch 58 to install a dual 3-foot culvert, not to exceed 24 feet long, for driveway access at the property owners' expense and contingent upon proper Land & Resource Management, Soil and Water Conservation District and DNR approval and permits. DITCH 12 CLEANING Motion by Rogness, second by Mortenson and unanimously carried to authorize approval for property owner Dave Johnson to work in Ditch 12 to replace a collapsed culvert at the property owners' expense and to approve cleaning approximately 1000 feet in Ditch 12 to remove cattails with cleaning costs to be paid by the ditch fund. DITCH 41/65 BRIDGE REPLACEMENT Motion by Lahman, second by Bucholz and unanimously carried to authorize approval for the Otter Trail Riders Snowmobile Club to replace a collapsed snowmobile bridge on Ditch 41/65 northwest of New York Mills on the 390th St. crossing with the ditch fund to split costs, paying 50% or less. LMKP MAINTENANCE PUMPING Motion by Mortenson, second by Lahman and unanimously carried to authorize approval for Litte McDonald, Kerbs, & Paul Lake Improvement District (LMKP) to conduct maintenance pumping, pending DNR approval, to ensure pumps are working properly and to include annual maintenance language to future contracts.
