CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, May 23, 2023, at the
Government Services Center in Fergus Falls, MN. Commissioners Wayne Johnson, Chair; Kurt Mortenson,
Vice Chair; Dan Bucholz, Lee Rogness and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Johnson called for approval of the Board Agenda. Motion by Mortenson, second by Lahman and
unanimously carried to approve the Board of Commissioners' agenda of May 23, 2023, with the following

12. Approval of the issuance of a Temporary On-Sale 3.2 Malt Liquor License to St.
Lawrence Church for an event scheduled for Sunday, August 6, 2023.
13. Approval of the LG220 Application for Exempt Permit as submitted by St. Lawrence
Church for an event scheduled for Sunday, August 6, 2023 at the St. Lawrence Church
located at 46404 County Highway 14 in Otto Township.
14. Approval of the issuance of an Off-Sale 3.2 Malt Liquor License to ECR Assets LLC dba
Lakeland General Store for the period of July 1, 2023 through June 30, 2024.
15. Approval of the LG220 Application for Exempt Permit as submitted by MN Finnish
American Historical Society for an event scheduled for Sunday, August 20, 2023 at the
Finn Creek Museum located at 55442 340th Street in Deer Creek Township.
EXTENSION POSITION
Motion by Bucholz, second by Lahman and unanimously carried to authorize appropriate Count Officials'
signatures to execute the Addendum Ill between Otter Tail County and the University of Minnesota for the
addition of a 1.0 full-time equivalent (FTE) Agriculture/Horticulture Extension Educator and the removal of a
.40 FTE Master Gardener Coordinator and execute an agreement between Otter Tail County and the East
Otter Tail and Wadena County Soil and Water Conservation Boards for employing Extension staff. The
Agriculture/Horticulture Extension Educator position will be held in partnership among the University, Otter
Tail County, and the East Otter Tail and Wadena County Soil and Water Conservation Districts (SWCDs).
Otter Tail County will be funding .50 FTE and East Otter Tail and Wadena County Soil and Water Conservation
Districts will each fund .25 FTE.
MAY 15 MENTAL HEALTH AWARENESS MONTH
OTTER TAIL COUNTY RESOLUTION NO. 2023-39
WHEREAS, in honor of Mental Health Awareness Month, Otter Tail County recognizes the importance of the
overall health and well-being of all individuals, families, communities, schools, and businesses; and
WHEREAS, everyone has experienced times of difficulty and stress in their personal and professional lives,
and community understanding and available supports and services can greatly impact a person's ability to
have good mental health; and
WHEREAS, identifying and addressing mental health concerns earlier improves the quality of life for adults
and children and their chance to succeed; and
WHEREAS, each business, school, government agency, health care provider, organization, and community
member shares the burden of mental health problems and has a responsibility to promote mental wellness
and support prevention efforts; and
WHEREAS, the need for comprehensive, coordinated mental health services for children, adults, families and
communities places upon our community a critical responsibility; and
WHEREAS, it is appropriate that the month of May be set apart each year for the direction of our thoughts,
awareness and support toward mental health and well-being.

NOW, THEREFORE, BE IT RESOLVED THAT WE, the Otter Tail County Board of Commissioners, does
hereby proclaim May 2023 as Mental Health Month in Otter Tail County. We call upon community members,
government agencies, public and private institutions, businesses, and schools in Otter Tail County to recommit
to increasing awareness and understanding of mental health, the steps community members can take to
protect their mental health, and the need for appropriate and accessible services for all people with mental
health conditions.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Mortenson, duly
seconded by Commissioner Lahman and after discussion thereof and upon vote being taken thereon, passed
unanimously.

MINNESOTA DEPARTMENT OF HEALTH GRANT APPROVAL
Motion by Rogness, second by Mortenson and unanimously carried for authorization for Public Health to
accept a Suicide Prevention Comprehensive Plan Approach Grant Award of $100,000 per year for four (4)
years from the Minnesota Department of Health for staffing, outreach efforts and implementation of suicide
prevention throughout the county.
PLANNING COMMISSION RECOMMENDATIONS
Motion by Mortenson, second by Rogness and unanimously carried to approve a Conditional Use Permit for
"Sunset Development, LLC" owned by Glenn Vanzee and Scott Olson to convert a Commercial Plan Unit
Development (PUD) to a Residential PUD, CIC #102 with the condition that the sewage treatment system
permit be issued prior to the issuance of the Conditional Use Permit and the condition that no commercial
camping units be allowed in this development. The proposal is located at 42502 240 St., Battle Lake, MN,
Section 28, Girard Township, West Battle Lake (56-239), GD.
Motion by Rogness, second by Lahman and motion carried with Johnson abstaining to approve a Conditional
Use Permit for "Kohler-Strom's Resort" owned by Brent Kuehne and Nate Hunter to convert a Commercial
Plan Unit Development (PUD) to a Residential PUD with the conditions that Unit #1 be eliminated, the 15 non-
residential storage units not be used as dwellings, no overnight sleeping in the 15 non-residential storage
units, and to remove Section 7.4.2 "Living Quarters" language from Kohler Strom's Resort Declarations. The
proposal is located at 51021 Fish Lake Rd., Detroit Lakes, MN, Section 2 & 11, Dunn Township, Pelican Lake
(56-786), GD.
USPCA GRANT APPROVAL
Motion by Lahman, second by Bucholz and unanimously carried for authorization for the Sheriffs Department
to accept a grant in the amount of $7,500 from the United States Police Canine Association (USPCA) to go
toward the purchasing and training expenses of a replacement K-9.

K-9 DONATIONS

Motion by Rogness, second by Mortenson and unanimously carried to give authorization for the Sheriffs
Department to accept current and future donations for the K-9 Unit Account for public safety for the purchase,
training, and other related expenses of a replacement K-9.
DONATION
Motion by Bucholz, second by Lahman and unanimously carried for authorization for the Sheriffs Posse to
accept a donation in the amount of $400 from the Fergus Falls Saddle Club Association.
JAIL FEASIBILITY STUDY
Motion by Rogness, second by Lahman and unanimously carried to approve the Otter Tail County Jail and
Sheriffs Office Facility Feasibility Study with a contract through ICS as recommended by Chief Deputy Reed
Reinbold. ICS will work in collaboration with Otter Tail County to identify existing and future needs of the Otter
Tail County Jail.
RECESS & RECONVENE
At 9:24 a.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed
for a short break. The Board of Commissioners meeting was reconvened at 9:33 a.m.
PHELPS MILL BOARDWALK/PRAIRIE RESTORATION PROJECT
NEGATIVE EAW DECLARATION
Motion by Lahman, second by Mortenson and unanimously carried to authorize appropriate County Officials'
signatures for the Negative Declaration on the need for an Environmental Assessment Worksheet (EAW) for
the Phelps Mill Trail and Boardwalk Project. Otter Tail County, in coordination with Houston Engineering,
reviewed EAW categories and fulfilled procedural requirements pursuant to Minnesota Rule 4410. The project
was determined to not present a potential for significant environmental impacts, so an EAW is not required.
PAYMENT TO LAKE REGION HEALTHCARE
Motion by Mortenson, second by Rogness and unanimously carried to approve payment in the amount to
$772.20 to Lake Region Healthcare for services provided under the provisions of Minnesota Statute §609.35.
CITY OF CLITHERALL -AUTHORIZED PUBLIC USE OF TAX-FORFEITED LAND
Motion by Lahman, second by Mortenson and unanimously carried to classify the following described parcel
of tax-forfeited land as non-conservation land and to approve the City of Clitherall's application to acquire this
parcel of tax-forfeited land for an authorized public use as a park under the provisions of Minnesota Statute
§282.01.
Lots 1, 2 and 3, Except the West 17 feet of Lot 3, of the Resurvey of Lots 4, 5, 6 , 7 and 8 Block 6,
Original Plat of Clitherall, Otter Tail County, Minnesota.
PRIVATE EASEMENT ACROSS TAX-FORFEITED LAND
Motion by Rogness, second by Mortenson and unanimously carried to table discussion regarding Otter Tail
County Resolution No. 2023-40, Private Easement Across Tax-Forfeited Land for access to Lot One (1) and
Lot Two (2) of Midland Beach from County Highway 31, to the County Board of Commissioners meeting on
June 13, 2023.

OUT-OF-STATE TRAVEL
Motion by Rogness, second by Bucholz and unanimously carried to approve out-of-state travel for County
Commissioner Kurt Mortenson to attend a public risk management conference June 4-7, 2023 through
Minnesota Counties Intergovernmental Trust (MCIT). Commissioner Mortenson is on the MCIT Board and all
expenses are funded through MCIT.
LONG PRAIRIE WATERSHED
Motion by Rogness, second by Mortenson and unanimously carried to approve Commissioners Rogness,
Bucholz and Lahman, in coordination with County Engineer Chuck Grotte, to attend a future meeting with the
Long Prairie Watershed District to discuss Otter Tail County State Aid Highway 6 challenges with Nelson Lake.
Further discussion about confirming a meeting date and time can be discussed at the Economic Growth and
Community Investment Committee at the next board meeting.
RECESS & RECONVENE
At 10:01 a.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed
for a short break. The Board of Commissioners meeting was reconvened at 10:08 a.m.
FRAUD & COLLECTIONS REPORT
Collections Officer/Investigator Crystal Herman provided the Board a brief update on the 2021 and 2022 Fraud
Investigation and Collections Report. Among the highlights Ms. Herman noted:
> Total collections recoveries for 2021 were $847,373.30 with the County retaining $280,137.66. > Total collections recoveries for 2022 were $1,088,699.34 with the County retaining $336,740.87.
78 Fraud Prevention Investigations (FPls) were conducted in 2021 and 96 Fraud Prevention
Investigations in 2022. > As of January 1, 2023 the Fergus Falls Police Department is no longer providing criminal fraud
investigative services and those investigations will be done internally.
> The COVID-19 pandemic emergency presented many challenges to fraud investigations in 2021 and
2022 resulting in a large reduction in the number of FPls generated.
> FPI referrals were also impacted by several staff with less than two years experience in processing
public assistance cases. The Economic Assistance Team has support and training in place to help
Eligibility Workers navigate FPI referrals and policy changes related to the end of the public health
emergency.
The Fraud and Collections Unit remains committed to prevention, detection, prosecution, and
elimination of fraud in taxpayer funded public assistance programs regardless of the investigative
challenges and difficulties the COVID-19 pandemic has presented.
BETHEL CEMETERY OF PELICAN RAPIDS WARRANTY DEED
Motion by Rogness, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to execute the Warranty Deed between Otter Tail County and Bethel Cemetery of Pelican Rapids
Association located at the following described location:
Part of the North Half of the Southwest Quarter (N1/2SW1/4) of Section 10, Township 136, North, Range 43
West, Otter Tail County, Minnesota described as follows:
Commencing at the northwest comer of said Southwest ¼; thence on an assumed bearing of
South 89° 31' 32" East on the northerly line of said Southwest¼ for a distance of 225.44 feet;
then South 13° 28' East for a distance of 791.36 feet to point of beginning of area to be

ADOPTION OF THE OTTER TAIL COUNTY 2040 TRANSPORTATION PLAN UPDATE
OTTER TAIL COUNTY RESOLUTION NO. 2023-41
WHEREAS, the Otter Tail County Board of Commissioners is the duly elected governing body for Otter Tail
County and is responsible for the planning, development, and preservation of a safe and functional
transportation system; and
WHEREAS, Otter Tail County has undertaken the task of updating their long range comprehensive County
Transportation Plan to ensure the continued performance of the County's transportation network; and
WHEREAS, the transportation planning process was guided by a Project Management Team, comprised of
County Highway staff; and
WHEREAS, the public was invited, encouraged and involved in the Plan's preparation; and
WHEREAS, the Otter Tail County 2040 Transportation Plan Update (2023) includes the following key
elements: existing conditions, future multi-model analysis, system preservation strategies and a financial an
performance analysis with an implementation plan; and
WHEREAS, this County Transportation Plan will assist County and local officials to cooperatively preserve
and improve the County's transportation system.
NOW THEREFORE BE IT RESOLVED THAT, the Otter Tail County Board of Commissioners does hereby
adopt the Otter Tail County 2040 Transportation Plan Update (2023), and agrees to use it as a guide for future
transportation system decisions.

seconded by Commissioner Mortenson and, after discussion thereof and upon vote being taken thereon,
passed unanimously.

RESOLUTION DESIGNATING COUNTY STATE AID HIGHWAY LOCATION
COUNTY STATE AID HIGHWAY NO. 35
OTTER TAIL COUNTY RESOLUTION NO. 2023-42
WHEREAS, it appears to the County Board of Commissioners of the County of Otter Tail that the highway
right of way required for County State Aid Highway 35 from CSAH 18 to CSAH 1 under County Project No.
S.A.P. 056-635-042 should be accurately described and located by a highway right of way plat.
NOW THEREFORE BE IT RESOLVED THAT, the Board of County Commissioners for the County of Otter
Tail is hereby designating the definite location of County State Aid Highway No. 35, in Sections 4, 5 ,8, 9 and
17, Township 133 North, Range 41 West, all in the 5th Principal Meridian as shown in Otter Tail County
Highway Right of Way Plat No. 35.

JUNETEENTH HOLIDAY
A legislative bill recently passed and signed by Governor Walz includes an effective date to observe
Juneteenth on June 19th as a holiday each year beginning on June 19, 2023. Motion by Lahman, second by
Mortenson and unanimously carried to declare Juneteenth an official paid county holiday with county offices
to be closed on June 19, 2023. Administration will work with union groups to establish Memorandums of
Understand (MOU) regarding this new effective date.

ASSISTANT HUMAN RESOURCES DIRECTOR POSITION
Motion by Rogness, second by Bucholz and unanimously carried to approve reclassifying Human Resources
Professional Stephanie Retzlaff from a C43 on the classification and compensation structure to a C51
Assistant Human Resources Director position. This reclassification is included in the 2023 budget.
MOU FOR COMMUNITY HEALTH PLANNER
Motion by Mortenson, second by Rogness and unanimously carried to authorize appropriate County Officials'
signatures to execute the Memorandum of Understanding between Otter Tail County and Minnesota
Teamsters Employee's Union, Local No. 320 for the addition of a position assignment of a Community Health
Planner in the Public Health Department to that collective bargaining unit.
LETTER TO COURTS
Motion by Rogness, second by Lahman and unanimously carried to authorize Commissioner Johnson's
signature on a letter to the Minnesota Supreme Court emphasizing the importance of in-person hearings.
ADJOURNMENT
At 10:59 a.m., Chair Johnson declared the Otter Tail County Board of Commissioners meeting adjourned. The
next regular Board meeting is scheduled at 8:30 a.m. on Tuesday, June 13, 2023, at the Government Services
Center in Fergus Falls and via livestream.

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 11 :08 a.m. Tuesday, May 23, 2023, at the Government
Services Center in Fergus Falls, MN. Commissioners Wayne Johnson, Chair; Kurt Mortenson, Vice Chair;
Dan Bucholz, Lee Rogness and Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Johnson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Bucholz, second by Lahman and unanimously carried to approve the Drainage Authority Agenda of May 23,
2023 as presented and the Consent Agenda of May 23, 2023 as follows:
1. May 9, 2023, Drainage Authority Meeting Minutes
DITCH 12 CULVERT
Motion by Mortenson, second by Rogness and unanimously carried to authorize Minnesota Department of
Transportation (MnDOT) to work in County Ditch 12 to repair a collapsed culvert on TH 59.
BEAVER DAMS
Motion by Bucholz, second by Lahman and unanimously carried to authorize the removal of beaver dams
from Ditches 16, 4, 38, 41/65 and 43 as presented by the Drainage Inspector.
DITCH 63 PETITION TO IMPOUND WATER
Motion by Rogness, second by Mortenson and unanimously carried to appoint Caroline Clarin, P.E. as
engineer for the petitioned lmpoundment of Otter Tail County Ditch 63 Drainage System waters. Landowner
Ten Points Properties, LLC, in collaboration with the US Fish & Wildlife Service (USFWS), is seeking approval
to impound water for habitat restoration efforts.
Motion by Mortenson, second by Lahman and unanimously carried to authorize a Public Hearing regarding
Ditch 63 Water lmpoundment on June 27, 2023, at 1 :00 p.m. during the regular Drainage Authority meeting.
ADJOURNMENT
At 11 :19 a.m., Chair Johnson declared the Otter Tail County Drainage Authority meeting adjourned. The next
Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday, June 13, 2023,
at the Government Services Center in Fergus Falls and via livestream.
