CALL TO ORDER
The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, April 25, 2023, at the
Government Services Center in Fergus Falls, MN. Commissioners Wayne Johnson, Chair; Kurt Mortenson,
Vice Chair; Dan Bucholz, Lee Rogness and Bob Lahman were present.
APPROVAL OF AGENDA
Chair Johnson called for approval of the Board Agenda. Motion by Mortenson, second by Bucholz and
unanimously carried to approve the Board of Commissioners' agenda of April 25, 2023, with the following

LETTER OF SUPPORT
Motion by Lahman, second by Rogness and unanimously carried to approve appropriate signatures on a letter
of support to the Minnesota Board on Aging regarding the equitable Intrastate Funding Formula (IFF) for rural
communities. This funding formula would help support programs and services for the aging population in rural
Minnesota.
PREMISE PERMIT -ERHARD 4TH OF JULY
OTTER TAIL COUNTY RESOLUTION NO. 2023-29
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits
for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, Erhard 4th of July, has submitted to the Gambling Control Board an LG230 Application to Conduct
Off-Site Gambling at Hillbillies Ice Hole Bar located at the Lake Lida Public Access off County Highway 4 in
Lida Township of Otter Tail County; and
WHEREAS, the gambling activities allowed under this application would be limited to no more than twelve off-
site events each calendar year (August 1, 2023 to August 1, 2024) not to exceed a total of 36 days, and
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial
premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving
the application for a permit; and
WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by Erhard 4th of July at Hillbillies Ice Hole Bar located at the Lake Lida Public Access off
County Highway 4 in Lida Township of Otter Tail County.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves
the conduct of lawful gambling by Erhard 4th of July at Hillbillies Ice Hole Bar located at the Lake Lida Public
Access off County Highway 4 in Lida Township of Otter Tail County provided the applicant meets all the
necessary criteria for the licenses and permits as required by the Gambling Control Board.
IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Lida by sending them a copy of this resolution.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Mortenson, duly
seconded by Commissioner Lahman and, after discussion thereof and upon vote being taken thereon, passed
unanimously.

the General FuFld Economic Development Budget to the Community Development Agency Fund as planned
in the approved 2023 County Budget.
DONATION
Motion by Rogness, second by Bucholz and unanimously carried to accept a donation to the Sheriffs Office
in the amount of $250 to be used for the purchase of Individual First Aid Kits (IFAK) for deputies.
PLANNING COMMISSION RECOMMENDATIONS
Motion by Lahman, second by Bucholz and unanimously carried to approve a Preliminary Plat titled "Dietrich
Addition", owned by Luther Dietrich, consisting of 2 Non-Riparian Lots, 1 Block being permanently attached
to 2 Riparian Lots located at 40350 Misty Lane, Richville, MN, Section 7, Rush Lake Township, Marion Lake
(56-243), GD.
A Conditional Use Application for "Kohler-Storm's Resort" was tabled by the Planning Commission for
concerns about adequately viewing and observing the property in making a fair judgement and
recommendation to the County Board due to the amount of snow coverage. The application was given a 60-
Day Review Extension and will be reviewed at the May 10th Planning Commission Meeting.
NOXIOUS WEED PROGRAM APPEALS
OTTER TAIL COUNTY RESOLUTION NO. 2023-30
WHEREAS, the West Otter Tail SWCD and East Otter Tail SWCD administers the Noxious Weed Program
for Otter Tail County, including issuing an order for control or eradication of noxious weeds; and
WHEREAS, Minnesota Statute 18.83, Subp. 3 allows a recipient of an individual notice to appeal an order for
control or eradication of noxious weeds; and
WHEREAS, Minnesota Statute 18.83, Subp. 3 requires the County Board to appoint members to an appeal
committee; and
WHEREAS, Minnesota Statute 18.83, Subp. 3 allows a County Board to delegate the duties of the appeal
committee to its Board of Adjustment pursuant to Minnesota Statute 394.27.
NOW THEREFORE BE IT RESOLVED THAT, that the Otter Tail County Board of Adjustment is hereby
authorized to hear and decide on an appeal of an order for the control or eradication of noxious weeds from
either SWCD regarding a noxious weed issue.

RESOLUTION APPROVING SINGLE FAMILY TAX ABATEMENTS
OTTER TAIL COUNTY RESOLUTION NO. 2023-31
BE IT RESOLVED by the Board of Otter Tail County, Minnesota (the "County"), as follows:
1. Recitals.
(a) The County proposes to approve tax abatements in connection with the construction of single family
homes (the "Projects"), The County proposes to use the tax abatements for the Projects provided for
in Minnesota Statutes, Sections 469.1812 through 469.1815 (the "Abatement Law"), from the property
taxes to be levied by the County on Parcel Identification Numbers 51000040060009,
71001990953000, 35000310254000, 74000990757000, 08000990554000, 77000991042000,
26000990537000, 75000990550000, 14000150118005, 58000990413000, 06000990336000,
63000990541000, 03000990677000, 54000990257000 (collectively, the "Tax Abatement
Properties").
(b) The County proposes to approve tax abatements on a portion of the County's share of property taxes
on the Tax Abatement Properties in the amount of $10,000 for a term of up to five (5) years to finance
a portion of the costs of the Project.
(c) The tax abatement is authorized under the Abatement Law.
2. Findings for the Tax Abatement. The Board hereby makes the following findings:
(a) The tax abatement is the County's share of real estate taxes which relate to the Projects being
constructed on the Tax Abatement Properties and not the real estate taxes that relate to the value of
the land (the "Abatement").
(b) The Board expects the benefits to the County of the Abatement to be at least equal or exceed the
costs to the County thereof.
(c) Granting the Abatement is in the public interest because it will increase the tax base in County.
(d} The Tax Abatement Properties are not located in a tax increment financing district.
(e) In any year, the total amount of property taxes abated by the County by this and other resolutions and
agreements, does not exceed the greater of ten percent (10%) of the net tax capacity of the County
for the taxes payable year to which the abatement applies or $200,000, whichever is greater. The
County may grant other abatements permitted under the Abatement Law after the date of this
resolution, provided that to the extent the total abatements in any year exceed the Abatement Limit
the allocation of the Abatement limit to such other abatements is subordinate to the Abatement granted
by this resolution.

NOW THEREFORE BE IT RESOLVED THAT, the Abatement is hereby approved. The terms of the
Abatement are as follows:
(f) The Abatement shall be for up to five (5) years anticipated to commence for taxes payable 2025 and
shall not exceed $10,000. The County reserves the right to modify the commencement date, but the
abatement period shall not exceed five (5) years.
(g) The County shall provide the Abatement as specified in this resolution.
(h) The Abatement shall be subject to all the terms and limitations of the Abatement Law.
BE IT FURTHER RESOLVED THAT, the Board hereby approves the Tax Abatement Agreements for payment
of the Abatement in substantially the form submitted and the Chair and Clerk are hereby authorized to execute
the Tax Abatement Agreements on behalf of the County.

OTTER TAIL COUNTY RESOLUTION NO. 2023-32
NOW THEREFORE BE IT RESOLVED THAT, Otter Tail County agrees to act as sponsoring agency for a
2024 Carbon Reduction Program project identified as Glacial Edge Regional Trail Project along Otter Tail
County State Aid Highway 1 which is a part of the Otter Trail Scenic Byway and has reviewed and approved
the project as proposed. Sponsorship includes a willingness to secure and guarantee the local share of costs
associated with this project and responsibility for seeing this project through to its completion, with compliance
of all applicable laws, rules and regulations.
BE IT FURTHER RESOLVED THAT, Kevin Fellbaum, Otter Tail County Parks and Trails Director is hereby
authorized to act as agent on behalf of this sponsoring agency.

MAINTAIN FACILITY -GLACIAL EDGE TRAIL
OTTER TAIL COUNTY RESOLUTION NO. 2023-33
WHEREAS, The Federal Highway Administration (FHWA) requires that states agree to operate and maintain
facilities constructed with federal transportation funds for the useful life of the improvement and not change
the use of right of way or property ownership acquired without prior approval from the FHWA; and
WHEREAS, 2024 Carbon Reduction Program projects receive funding via Infrastructure Investment and Jobs
Act; and
WHEREAS, the Minnesota Department of Transportation (Mn/DOT) has determined that for projects
implemented with alternative funds, this requirement should be applied to the project proposer; and
WHEREAS, Otter Tail County is the sponsoring agency for the 2024 Carbon Reduction Program project
identified as Glacial Edge Regional Trail Project along the Otter Trail County State Aid Highway 1 which is
also a part of the National Scenic Byway, the Otter Trail Scenic Byway.
NOW THEREFORE BE IT RESOLVED THAT, the sponsoring agency hereby agrees to assume full
responsibility for the operation and maintenance of property and facilities related to the aforementioned 2024
Carbon Reduction Program project.

signatures to execute the contract between Otter Tail County and Sir Lines-A-Lot, LLC of Edina, MN for Job

OTTER TAIL COUNTY TRI-LAKES FIRST ADDITION EASEMENT
Motion by Mortenson, second by Lahman and unanimously carried to authorize appropriate County Officials'
signatures to grant Highway Easement to Otter Tail County for a 60' Right-of-Way on CSAH 4 and 31, Part of
Lot 1, Block 1, Tri-Lakes Estates First Addition as described.
ENGINEERING AGREEMENT
Motion by Lahman, second by Rogness and unanimously carried to authorize appropriate County Officials'
signatures for the agreement between Otter Tail County and Interstate Engineering, Inc. for OTC CSAH 19
Bridge No. 92517 Replacement Project, SP 056-619-015.
ASSISTANT HUMAN SERVICES DIRECTOR POSITION
Motion by Rogness, second by Bucholz and unanimously carried to approve a 1.0 full-time equivalent (FTE)
Assistant Human Services Director position within the Human Services Department. The Assistant Human
Services Director will provide leadership to program supervisors, develop and implement service delivery
strategies, and direct and implement Human Services programs. This position is included in the 2023 budget.
HOUSING PROGRAM SUPERVISOR POSITION
Motion by Rogness, second by Mortenson and unanimously carried to approve at 1.0 full-time equivalent
(FTE) Housing Program Supervisor position within the Housing and Redevelopment Authority (HRA) to direct
and administer housing assistance, housing rehabilitation, and housing development programs. This position
has been budgeted for 2023.
EMERGENCY MANAGEMENT SUMMIT
Commissioner Rogness led discussion regarding the Annual Emergency Management Summit that took place
April 20th at the Bigwood Event Center highlighting the session led by Douglas County Emergency
Management Director Julie Anderson regarding the tornadoes that hit Douglas County last May. Rogness
noted the struggle property owners had with cleanup and insurance coverage of debris that ended up in area
lakes. With Otter Tail County and its 1,000+ lakes, Rogness called for a meeting with Otter Tail County
Emergency Manager Patrick Waletzko to review what protocols are in place to address these types of
unintended consequences.
LETTER OF APPRECIATION
Motion by Bucholz, second by Lahman and unanimously carried to send condolences and a letter of
appreciation to the family of James Johnson, former Mayor of Perham and past Otter Tail County employee,
who passed away on April 12, 2023.

GARY OLSON FEEDLOT
Commissioner Lahman brought awareness to the Board about a barn replacement on the turkey feedlot
belonging to Gary Olson. The barn will be larger in size, but the amount of animal units will not be changing.
The MPCA will detennine whether a public meeting is needed for pennitting.
RECESS & RECONVENE
At 9:38 a.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed
for a short break. The Board of Commissioners meeting was reconvened at 9:59 a.m.
SUMMIT CARBON SOLUTIONS UPDATE
Summit Carbon Solutions representatives Joseph Caruso and Scott O'Konek provided an overview and
update about the carbon dioxide storage pipeline project. As part of the next steps in the route pennitting and
review process, Summit Carbon Solutions will complete an Environmental Impact Statement (EIS). In efforts
to learn more about the impact on the surrounding environment, the Minnesota Public Utilities Commission
(MPUC) will be holding public infonnational meetings regarding the Otter Tail to Wilkin Carbon Dioxide Pipeline
Project. These meetings are scheduled for May 2, 2023 from 6:00 -9:00 p.m. at the Breckenridge High School
in Breckenridge, MN and May 3, 2023 from 1 :00 -4:00 p.m. and 6:00-9:00 p.m. at the Bigwood Event Center
in Fergus Falls, MN.
CLOSED SESSION
At 10:35 a.m., Chair Johnson declared the Board of Commissioners meeting closed to the public. The closed
session is authorized under Minnesota Statute §13D.05, Subd. 3(b) for Attorney-Client Privilege regarding
threatened litigation related to the Otter Tail Water Management District. Present in the room were
Commissioners Wayne Johnson, Lee Rogness, Dan Bucholz, Kurt Mortenson, and Bob Lahman, County
Administrator Nicole Hansen, County Attorney Michelle Eldien, Deputy Administrator Nicholas Leonard,
County Auditor-Treasurer Wayne Stein, Land and Resource Director Chris LeClair, Assistant Land and
Resource Director Kyle Westergard, and County Board Secretary Hannah Anderson. The closed session
ended at 12:01 p.m.
RECESS & RECONVENE
At 12:03 p.m., Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners recessed
until 1 :00 p.m. The Board of Commissioners meeting was reconvened at 1 :03 p.m.
PUBLIC HEARING
Land and Resource Management Director Chris Leclair reviewed the proposed ordinance revisions to the
Sanitation Code for Subsurface Sewage Treatment Systems, which include regulating the location, design,
installation, and use and maintenance of subsurface sewage treatment systems in Otter Tail County.
At 1 :14 p.m. Chair Johnson opened the Public Hearing for comments about the proposed revisions to the
Sanitation Code. Public comments included concerns about timeframe, financial burden, and interpretation of
the deadline regarding the change from 24-months to 12-months for replacement of a failing SSTS and
concerns about the pumping reporting deadline of 90 days. The public asked for clarification on the county's
official soil verification dates and clarification on why the non-shoreland vertical separation is changing from
3' to 2' when it's currently a 3' separation county-wide. The public advocated for the landowner to have the
option to have the system replaced in its original location and suggested the County keep the 50% rule but
eliminate verbiage regarding lot lines to allow landowners and septic designers to make decisions without
applying for a variance.

The Public Hearing was closed at 1 :32 p.m. at which time Mr. LeClair responded with comments and
clarification. He noted that the language pertaining to pumping reporting has been in place since 1973 and
has simply been added to this ordinance. With the new online web-based permitting software for Land and
Resource Management, reporting will have the capability to be done directly through an app on a smartphone.
Regarding the change from 24-months to 12-months to replace a failing SSTS, in reviewing the past three (3)
years, the process from non-compliance notification to replacement took an average of 6.8 months. Property
owners can apply for programs within the County to help with funding replacement systems. LeClair also noted
that the 2' vertical separation only applies to systems outside of shoreland that were put in prior to April 1,
1996, as that is in the state code and statute. If there is no date on record, the standard 3' separation will be
applied.
The proposed revisions to the Sanitation Code as presented by Land and Resource Management will be
scheduled for further consideration on May 9, 2023.
ADJOURNMENT

CALL TO ORDER
The Otter Tail County Drainage Authority convened at 12:02 p.m. Tuesday, April 25, 2023, at the Government
Services Center in Fergus Falls, MN. Commissioners Wayne Johnson, Chair; Kurt Mortenson, Vice Chair;
Dan Buchol~ '1:.e:te-:R9.9.n(;ls$f.Jnd ·Bob Lahman were present.
APPROVAL OF AGENDA & CONSENT AGENDA
Chair Johnson called for joint approval of the Drainage Authority Agenda and Consent Agenda. Motion by
Lahman, second by Bucholz and unanimously carried to approve the Drainage Authority Agenda of April 25,
2023 as presented and the Consent Agenda of April 25, 2023 as follows:
1. April 11, 2023, Drainage Authority Meeting Minutes
2. Warrants/Bills for April 25, 2023 (Exhibit A)
DITCH 17
Motion by Mortenson, second by Lahman and unanimously carried to appoint three (3) ditch viewers, Craig
Heber, Jeff Wiebe, and Gary Denbrook to appraise land and assess damages to complete a previously
approved ditch repair on Ditch 17, Branch 3.
Motion by Rogness, second by Bucholz and unanimously carried to approve the request for a Public Hearing
regarding Ditch 17 for a special provision of repair to be held on May 23, 2023, at 1 :00 p.m. in the Otter Tail
Lake Room at the Government Services Center (GSC).
DITCH UPDATES
Drainage Inspector Colby Palmersheim provided a brief Drainage Ditch Update. Among the highlights Mr.
Palmersheim noted:
) Ditch 41/65 cleaning is mostly complete and will resume once road restrictions are lifted. > The Otto Township washout on 380th street was fixed. They requested an additional overflow
protection pipe which will not need Drainage Authority approval.
) Viewers have been selected for Ditches 10, 11 and 49 to begin the Redetermination of Benefits
process. > Viewers should be completing redetermination on Ditches 13 and 19 in the next couple of weeks.
) Redetermination is mostly complete for Ditches 12 and 50 -property owner reports should be mailed
in the next month and a Public Hearing to commence in May or June.
Updated values on Ditches 64, 50 and JD2. JD2's information was passed on to the Buffalo Red River
Watershed.
Annual Inspections should be complete in the next two weeks.
Beaver trappers are being dispatched and dams will be removed once road restrictions are lifted.

April25,2023 > It is suggested that Ditch 56 be brought to the Drainage Authority for consideration of redetennination
once viewers have completed their current assignments. > Water quality testing has commenced on Ditch 25. RMB Labs will complete three (3) test samples
through Spring and into Summer.
> Culvert Inventory will begin as the water recedes and ditches thaw.

Drainage Authority meeting will immediately follow the next regular Board meeting on Tuesday, May 9, 2023,
at the Government Services Center in Fergus Falls and via livestream.
