HomeMy WebLinkAboutFeedlot Public Meeting Policy OTTER TAIL COUNTY – MINNESOTA FEEDLOT PUBLIC MEETING POLICY POLICY Otter Tail County is not a delegated Feedlot Officer County and an expansion or new feedlot outside of the shoreland area and over 300 AU is required by the Minnesota Pollution Control Agency (MPCA) to hold a Public Meeting for comment. Otter Tail County does not issue permits for feedlots but will hold a public meeting on behalf of the MPCA when requested. Permits are issued by the MPCA and Otter Tail County has not taken on the responsibility to permit feedlots as referenced below: Minnesota State Statute 116.07 (l) – (Applies if feedlot is located in an undelegated county and over 300 AU after expansion/construction) After January 1, 2001, a county that has not accepted delegation of the feedlot permit program must hold a public meeting prior to the agency issuing a feedlot permit for a feedlot facility with 300 or more animal units, unless another public meeting has been held with regard to the feedlot facility to be permitted. FEEDLOT PUBLIC MEETING NOTIFICATION The Otter Tail County Board of Commissioners request the following regarding notification for a new or expanded feedlot that requires a Public Meeting with permit jurisdiction held by the MPCA: Publication of Public Meeting date, time, and location in a newspaper of general circulation within the affected area Written notification to property owners within 5,000’ of the location of a new or expanded feedlot 20 business days prior to the date of the Public Meeting (the County Board Secretary will provide a list of mailing addresses and a sample letter). A copy of the letter provided to property owners and information regarding returned mailings. A copy of the affidavit from newspaper. MINUTES FROM JUNE 27, 2017 Motion by Rogness, second by Lindquist and unanimously carried to require notification to property owners within 5,000’ of the location of a new or expanded feedlot which requires a Public Meeting be held by the County with permit jurisdiction held by the MN Pollution Control Agency. These Public Meetings are applicable outside of the Shoreland Management Ordinance district boundaries. COUNTY RESPONSIBILITIES Minutes and comments are forwarded to the MPCA for their use in determining approval of a feedlot permit.
