HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/08/1989CALL TO ORDER ALL PRESENT MINUTES APPROVED LEVY -1990 TAX-FORFEITED LAND ACQUISITION, SD 544 ABATEMENT APPROVED ~INUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA November 8, 1989 Pursuant to adjournment, the Board of County Commissioners of Otter Tail County met Wednesday, November 8, 1989. Chairman Nelson called the meeting to order at 12:30 with all members present. Motion was made by Bert Hovland, seconded by Andy Lindquist and unani- mously carried, to approve the minutes of the meeting of November 1st as mailed. Wayne Stein, Deputy Auditor/Accountant, appeared before the Board for the purpose of discussing the proposed levy for the year 1990, and after considerable discussion, the following resolution was offered by Bert Hovland who moved for its adoption: RESOLVED by the Board of County Commiss·ioners of Otter Tail County Minnesota, that There be levied upon the taxable property of Otter Tail County payable during the year 1990, the following amounts for the several county funds : County Revenue Fund Human Services Fund Road & Bridge Fund Regional Library Fund Bonded Debt County Building Fund TOTAL TAXABLE LEVY $ 4,472,423.00 4,838,940.00 l ,401 ,952 .00 127,976.00 549,638.00 103,618.00 $11,494,547 .00 The motion ~as seconded by Hub Nordgren and carried unanimously. Upon motion made by Mel 0. Olson, seconded by Andy 'Lindquist and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS application has been made by Independent School District #544, a governmental subdivision, for acquisition of the following tax- forfeited lands: C. J. Wright's 1st Add'n ,to the City of Fergus Falls: Lots 3, 4, 5, 36, 37, 38 & 39, Block 2, and one-half vacated avenue adjacent East 40' of S 25 1 of Lot 2, Block 2, and one-half vacated avenue adj a cent North 25oi of R~s. l & one-half vacated avenue adjacent Lots l, 2, 3, 4 & 5, Block l , and one-half vacated avenue adjacent WHEREAS, the County Board has examined into the allegations of said application, NOW, THEREFORE, BE IT RESOLVED, that the aforementioned application for acquisition by School District #544 be and is hereby granted. Adopted at Fergus Falls, MN this 8th day of November, 1989. Upon motion made by Bert Hovland, seconded by Mel O. Olson and unani- mously carried, the following application for reduction of valuation was approved: Ervin & Lucille Opsaker Scambler Twp. Cabin overvalued RESOLUTION SPECIAL LEGISLATION SALE OF TAX-FORFEITED LAND ON PUBLIC WATER OTTER TAIL LAKES AREA SEWER DISTRICT CONDITIONAL USE PERMITS APPROVED CLEANERS LICENSE APPROVED PRELIMINARY PLAT APPROVED BED & BREAKFAST MORATORIUM County Board -2 -November 8, 1989 Upon motion made by Andy Lindquist, seconded by Hub Nordgren and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of · Otter Tail County Minnesota, that WHEREAS special legislation is required to include properties located on public waters in any tax forfeited land sale, and WHEREAS it has been determined to be in the best interests of Otter Tail County to offer such lands for sale to the public, NOW, THEREFORE, BE IT RESOLVED, the Otter Tail County Board does hereby request special legislation that the following lands, located on public water, be offered for sale at public auction: (ll Lot 13, Sylvanus Crest, Clitherall Township (21 Lot 14, Sylvanus Crest, Clitherall Township (3) Government Lot 8, Section 32, Township 133, Range 43. (4) Part of Government Lot 10, begin-ning 282.5 feet wouth- westerly of the northwest corner of Lot 71, Pleasure · Rark Beach; thence southeast 199 .6 feet; thence south- west 75 feet on lake; thence northwest 214.14 feet; thence northeast 75 feet to beginning, Section 4, Town- ship 134, Range 39. Charles Krekelberg, Attorney for the Otter Tail Lakes Area Sewer District, appeared before the Board relative to the allegations by Marc Wermager in the fact their property was not included in the grant funds for installation of a new sewer slystem. Comments also by Assistant County Attorney Senyck. with the conclusion that entire jurisdiction rests with the Otter Tail Lakes Area Sewer District and if a resolution cannot be determined at that level, District Court is the next step. Upon motion made by Hub Nordgren, seconded by Bert Hovland and unani- mously carried, the following applications for conditional use permit were approved, subject to conditional requirements: Richard Peterson Clitherall Twp. Fred & Rose Ka 1 k Girard Twp. site to 2 mobile home sites & 21 RVs Construct road to service pl at Change configuration of camp sites Motion was made by Sydney Nelson, seconded by Bert Hovland and unani- mously carried, to approve the following application for sewage dis- posal system cleaners license: Lee Wallace Ace Septic Pumping Vergas, MN Motion was made by Sydney Nelson, seconded by Mel 0. Olson and unani- mously carried·, to gnant ,re-approvaL1of a prel:i:m·inary plat of Twin Oak Heights, 1st Add'n, in Sections 17 & 18, Pine Lake Township. Upon motion made by Bert Hovland, seconded by Andy Lindquist and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that A moritorium is hereby imposed on Conditional Use Permit applications for Bed & Breakfast facilities until February 1, 1990, to allow the Otter Tail County Planning Commission time to develope guidelines to adjudicate such application. Upon motion made by Andy Lindquist, seconded by Hub Nordgren and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS on the 11th of October, 1989, the County Board accepted the bid of Miller's Bobcat, Fergus Falls, MN, in the amount of $11,367.16 for one bobcat loader with bucket and pallet, and WHEREAS, the above equipment has now been delivered to the satisfaction of the county board at a total cost of $11,367.16, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $11,367.16 to Miller's Bobcat, Fergus Fa 11 s , MN, in full payment thereof. Dated at Fergus Falls, MN this 8th day of November, 1989. Upon motion made by Bert Hovland, seconded by Mel 0. Olson and carried, with Andy Lindquist abstaining and A. Hubert Nordgren voting 11 no 11 , the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agrement·between the Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the U.S. Fish and Wildlife Service is re- quested, and WHEREAS, representatives of the U. S. Fish and Wildlife Service met with the Board of Commissioners on November 8, 1989 and informed said Board that a purchase agreement had been secured from Sel vin E. Tros- vig on a 37.75+ acre parcel in G.L. 7, Section 7, Norwegian Grove Township, NOW, THEREFORE, BE IT RESOLVED after consideration, the above request for acqusition by the U.S. Fish and Wildlife Service is hereby approved. Adopted at Fergus Falls, MN this 8th day of November, 1989. NORTijEAST LANDFILL CLOSURE, FINANCIAL ASSURANCE PLAN AD FOR BIDS CSAH #1 & CSAH #35 MAJOR DRAINAGE STRUCT. AURDAL & SVERDRUP PICK-UP DELIVERY MOORE FORD VARIANCE HI-WAY DEPT. RADIO SYSTEM ADJOURNMENT County Board -4 -November 8, 1989 Debra A. McDona-ld, P.E., with the firm of Bruce A. Liesch Associates, Inc., Plymouth, MN, together with Mike Hanan, Solid Waste Officer, appeared before the Board and presented the Northeast Otter Tail Land- fill Closure, Post-Closure, Contingency Action and Financial Assurance Plans. After review, motion was made by Andy Lindquist, seconded by Hub Nordgren and carried with Bert Hovland being absent during vote, to accept the plan as submitted by Bruce A. Liesch Associates, Inc., and direct Michael Hanan, Solid Waste Officer, to forward same to the Minnesota Pollution Control Agency in compliance with regulations. Motion was made by Hub Nordgren, seconded by Andy Lindquist and unani- mously carried, to advertise for bids to be received until 10:00 a.m., Wednesday, December 6, 1989, for grading, aggregate base, plat mix bituminous base & surface, under S.A.P. 56-601-20, CSAH #1, and #56-635-19, CSAH #35. Motion was made by Andy Lindquist, seconded by Mel 0. Olson and unani- mously carried, to approve payment in the amount of $1,478.75 to Aurdal Township, representing 50% of the total cost of replacing a major drainage structure involving Aurdal and Sverdrup Townships. Engineer Berend reported that Moore Ford is unable to deliver the 4 wheel drive pick~µp, on a bid awarded April 19, 1989. Motion was made by Hub Nordgren, seconded by Andy Lindquist and unanimously carried, to authorize accepting quotations for the purchase of a 2 or 4 wheel drive pick-up manual transmission, tabling action on the surety from ~oore Ford until purchase of the replacement vehicle. Ben Nelson of Jaeger Realty appeared before the Board relative to a variance request to replace a garage recently lost by fire. Mr. Nelson was informed the County Board does not have jurisdiction over variances, that the Board of Adjustment dealt with such issues. The Highway Department Radio System was discussed with no action taken. At 4:28 p.m., with no further business, Chairman Nelson declared the meeting adjourned until 9:30 Wednesday, November 15, 1989.
