Pursuant to adjournment, the Board of County Commissioners of Otter
Tail County Minnesota met Wednesday, October 4, 1989. Chairman
Nel~on called the meeting to order at 9:31 a.m.,. with all members
present.
Minutes of the September 27th meeting were approved as mailed upon
motio"n made by Andy Lindquist, seconded by Hub Nordgren and unani-
mously carried.
Marc Wermager appeared before the Board requesting compensation from
Otter Tail County because his property was n.ot included in the Otter
Tail lakes Area Sewer District for grant funds in the installation of
a new sewage system. Motion was made by Mel 0. Olson, seconded by
Bert Hovland and unanimously carried, to direct the County Attorney
to research the allegations and feport back to the Board as to the
Countyis responsibilities.
Henry Fischer appeared before the Board requesting an additional
extension of time for the construction of a new road by Fair Hills
Resort on Lake Five. Motion was made by Hub Nordgren, seconded by
Bert Hovland and' unanimously carried, to grant ex tens ion in said con-
struction until November l, 1989 for the back portion of the road
near Lake Five, allowing until November 15, 1989, for the completion
·of the entire project, with final approval by the Land & Resource
Management office. ·
Motion was made by Mel 0. Olson, seconded by Andy Lindquist and unani-
mously carried, to approve paymerit in the amount of $10.0Q to the
City of Fergus Falls for an application for permit to construct an
aprdi1 on the approach to the recycling building in Fergus Falls.
A letter from Margaret Lindeberg was presented to· the board, indica-
ting a desire to donate Lots 41 & 42, Oak Point, together with lake
frontage, bs a memorial park to the donors' ancestors who settled the
·area in 1872. Motion was made by Hub Nordgren, seconded by Andy
Lindquist and unanimously carried, to refer the offer to the County
Attorn'ey ·and Land & Resource Management to check on the feasibility.
Motion was made by Bert Hovland, seconded by Andy Lindquist and unani-
mously carried, to approve payment in the amount of $765.00 to the
National Association of Counties, representing the 1990 membership
dues.

mously carried, to approve the following applications for reduction
of tax capacity:

Motion was made by Bert Hovland, seconded by Mel O. Olson and unani-
mously carried, to approve two clerks from the County Auditor's
office attendance at a Land Record Infoy,mation Systems Seminar to be
held in Saint Cloud on October 20th.
Amy Beske, Solid Waste Recycling Coordinator, informed the Board the
small service building at the Pelican Rapids Sanitary Landfill had
been destroyed by fire. Motion was made by Andy Lindquist, seconded
by Hub Nordgren and unanimously carried, authorizing Beske and Commis-
sioner Hovland research and make a determination as to replacement.

LIABILITY COVERAGE
County Board -2 -October 4, 1989
Upon motion made by Hub N9rdgren, seconded by Andy Lindquist and unani-
mously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, on May 3, 1989, the County Board accepted the bid of
$86,859.61 from McLaughlin & Schulz, Inc., for county wide sand
seal under S.A.P. 56-601-30, etc., and
WHEREAS the above contract has now been completed to the satisfaction
of the County Board at a total cost of $89~597~07, !an·increage of
$2,737.46 due to additional work on CSAH #1 and township projects,
NOW, THEREFORE, BE IT RESOLVED the County Auditot is hereby authorized
and directed to i~~ue a warrant in the amount of $36,822.10 payable
to McLaughlin & Schulz, Inc., as final payment.for this work.

County Engineer Berend discussed right-of-way on Old CSAH #79 that
is still owned by the County and yet not used since the new CSAH #79
was re-routed. No action taken.
Larry Krohn, County Coordinator, informed the Board that the proba-
tionary period for Roland Sauck, Ag/Ditch Inspectob., is up and auto-
maticj; change to permanent employee with base pay is in order if no
objections are voroded. No action.
Krohn also discussed the fact that all counties included in the Joint
Powers Board are individually payin_g liability costs for those members
of the Joint Powers Board, stating that perhaps the Joint Powers
Board should have liability coverage for the entire board, rather
.than individually. Krohn was instructed to explore the cost of
liability r~overage of the joint powers board and report.
FAX MACHINE TRUNK LINE.· Motion was made by Bert Hovland, seconded by Mel 0. Olson and unani-
mously carried, to switch a telephone trunk line from general court
house use and dedicate the access for the fax machine in the Court
Administrator's office.

Upon. motion ~~de by Hub Nordgren, ~econded by Bert Hovland and unani-
mously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail Count,y
Minnesota, that
WHEREAS, the Minnesota Pollution Control Agency has formulated and
adopted rules requiring landfill financial assurance by Counties,
and ·
WHEREAS, the Minnesota State Legislature~ through the legislative
process, can require financial assurance and make provisions for its
funding,
NOW, THEREFORE. BE IT RESOLVED? the Board of Commtssioners of Otter
Tail County Minnesota opposes this mandate set forth by the Minne~
sota Pollution Control Agency's rules,
BE IT FURTHER RESOLVED, the Board of Commissioners of Otter Tail
County Minnesota hereby requests a Legislative review of the
Minnesota Pollution Con'trol Agency's rules with regard to financial
assurance requirements,
BE IT FURTHER RESOLVED, the Legislature should prohibit inappropriate
power provided for in the rule making process ·by any State Agency
which results in a taxing authority,
BE IT FURTHER RESOLVED, copie~ of this resolution be forwarded to
al 1 ·legislators representing Otter Tail County, and to the },sso-
ciation of Minnesota Counties, and to the Minnesota Pollution
Control Agency.
Adopted at Fergus Falls, ,MN this 4th day of October, 1989.
At 1~39 p.m., with no further business, Chaitman Nelson declared the
meeting adjourned until the afternoon of Wednesd·ay, October 11,
