August 2, 1989
Pursuant to adjournment, the Board of County Commissioners 6f Otter
Tail County Minnesota met Wednesday, August 2, 1989. Chairman Nelson
called the meeting to order at 9:32 a.m., with Commissioners Olson,
Lindquist, Nelson and Nordgren present, Commissioner Hovland absent.
Motion was made by Mel 0. Olson, seconded by Andy Lindquist and unani-
mously carried, to approve the minutes of the July 26th meeting as
mailed.
Dave Anderson of Anderson Land Survey, Inc. ,appeared before the Board
relative to the county's monumentation program. Motion was made by
Mel 0. Olson, seconded by Hub Nordgren and carried, to approve purchase
of fifty (50) 2&3Ml" monuments, at a cost of $37 .. 75 per monument, pl us
freight.

Motion was made by Hub Nordgren, seconded by Andy Lindquist and carried,
to approve payment in the amount of $888.16 to Community Co-ops, Lake
Park, MN, for commercial spraying, to take advantage of a $79.24
discount if paid prior to Au§ust 15.
Motion was made by Andy Lindquist, seconded by Mel O. Olson and carried,
to approve a transfer of $2,000 into the general maintenance checking
account for minor purchases.
Motion was made by Hub Nordgren, seconded by Mel 0. Olson and carried,
to set the hearing on the county's budget for tax of 1990 for $100
p.m., Wednesday, September 20, 1989, and the time of 1:00 p.m.,
October 4, 1989, for the recessed hearing on the county budget, if
necessary.
Motion was made by Andy Lindquist, seconded by Mel O. Olson and carried,
to deny forgiveness of penalty on late payment of tax by Leland Larson,
Maine Township.
Motion was made by Hub Nordgren, seconded by Andy Lindquist and carried,
to approve applications from Thomas Volberding, Hi-·Way Park Ballroom,
Elmo Township, for permit to hold public dances, for on and off sale
non-intoxicating malt liquor and pefmt~ to allow consumption and dis-
play of intoxicating liquor, subject to certification of insurances.
A letter was presented to the Board from Mike Kirk, County Attorney,
regarding unauthorized utilization of a Wilkin County ditch system
by certain landowners in Wilkin & Otter Tail Counties, stating that
steps are being taken in the form of a notice from Wilkin County
that such outlets be blocked as requested by the drainage authority.

Count,y Board -2 -August 2, 1989
Pursuant to published notice, a hearing was conducted for the purpose
of considering a petition presen~ed by Barbara Green and Jerome Green
requesting the re-establishment of the section corner monuments for
Government Lot 4, Section 6, Township 137, Range 41. After listening
to the various interested parties and the Otter Tail County Surveyor,
the matter was referred to the County Attorney who was instructed to
report to the board on August 9th, regarding certain legal aspects
involved in such request.
Engineer Be rend appeared before the Board and dis cussed. prob 1 ems
being encountered by Lida Township in the graveling of a township
road, in which the county is acting as a vehicle through which the
township obtained grarlt funds from the State of Minnesota. No action.
Engineer Berend also discussed problems involved in obtaining right-
of-way for CSAH #1 on irrigated land. No action.
David Chase appeared before the Board in responsle to a denial by
the Board on July 26th for forgiveness of penalty on a late payment
of tax. No act ion.
Sheriff Gary Nelson discussed the use of Mickie Wellnitz for an
additional month extension as a temporary deputy. No action.
Tim Brand, Data Processing Manager, discussed the use of the con-
sultant in the Highway Department for computerization purposes.
No action taken.
Representatives of the Perham Lions Club appeared before the Board
relative to their application before the Gaming Division for a
gambling permit at the Lanterns Supper Club. Motion was made by
Sydney Nelson, s.econded by Hub Nordgren and carried, to request
the Gaming Division waive the 60 day waiting period.
The Board also discussed a proposed extension of the bicycle path
to-;connect up with a mile and half of township road and CSAH #8
out of the City of Perham. No formal action.
An application from the Perham Eagles Aerie #4224, for a gambling
permit at Cactus Garden Saloon was presented to the Board, with
no objections raised.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and car-
ried, to approve a one day beer license for the Church of the Sacred
Heart, Edna Township, without fee, subject to approval by the County
Sheriff.

ried, with Mel 0. Olson abstaining, to approve payment in the amount
of $14,25, to Vision World, !Ne., Minneapolis, ,N, for the replacement
of a lens under the county's self insurance deductible for a deten-
tion officer whose lens broke during a scuffle with a'prisoner.
At 1:37 p.m., with no further business, Chairman Nelson declared the
meeting adjourned until the afte non of August 9, 1989.

Pursuant to adjournment, the Board of County Commissioners of Otter
Tail County met Wednesday, August 9, 1989. Chairman Nelson called
the meeting to order at 12:30 p.m., with Commissioners Hovland,
Olson, Nelson and Lindquist present, Nordgren absent.
Motion was made by Mel 0. Olson, seconded by Andy Lindquist and car-
ried, to approve the minutes of the Augutt 2, 1989 meeting as mailed.
Upon motion made by .. Andy Lindquist, seconded by Mel 0. Olson and
carried, to re-schedule the hearing on the County Budget to 7:30
p.m., September 20th, and 1~30 ~.m., October 4th, for the reconvened
hearing, should the meeting be recessed.
Upon motion made by Bert Hovland, seconded by Andy Lindquist and car-
ried, the following resolution was adopted:
RESOLVED by the Board of County. Commissioners of Otter Tail County
Minnesota, that
WHEREAS, the Minnesota PE1llution Control Agency (.hereinafter 11 Agency 11 ),
pursuant to Minn. Stat. 5 115A.54, subd. 2a(Supp. 1987) and Reorgani-
zation Order No. 155 (Department of Administration 1988) is empowered
to administer the Solid Waste Processing Facility Capital Assistance
Program in accordance with the requirements of ~inn. Stat.~ ll5A.49-
.54 (Supp. 1987) and Agency rules governing the Solid Waste Processing
Facility Capital Assistance Program, Minn. Rules pts. 9210.0100-
. 0180; and
WHEREAS, Otter Tail County (hereinafter 11 Governmental Unit 11 L applied
for a grant under the Solid Waste Processing Facility Capital Assis-
tance Program, pursuant to the provisions of Minn. Stat.§ 115A.49-
_54 and Minn. Rules pts. 9210.0100-0180 for a Recyclable Materials
Processing Project (hereinafter 11 Project11 ); and
WHEREAS, after reviewing the application and all supplemental documen-
tation submitted by the Governmental Unit, the Agency has found that
the application has satisfied the requirements of Minn. Stat. ~ 115A.51,
Minn. Stat.~ 115A.54, subd. 2a, and Minn. Rules pt. 9210.0160; and
WHEREAS, the Agency has approved a grant to the Governmental Unit in
an amount not to exceed Two Hundred Eight-Eight Thousand and no/100
($288,000); and
WHEREAS, the Commissioner of the Agency (Commissioner), acting on
behalf of the Agency, is empowered by Minn. Stat.§ 115A.06, subd. 8
to enter into this Agreement;
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board au-
thorized the Chairman of the County Board to sign the Solid Waste
Processing Facility Capital Assistance Grant Agreement.

ried, to approve payment in the amount of $20.00 for advanced regis-
tration for Amy Beske 1 s attendance at the 1st Recycling Association
of Minnesota annual meeting at the Americana Inn, Sa~nt Cloud, MN
Motion was made by Andy Lindquist, seconded by Bert Hovland and car-
ried, with Mel 0. Olson voting 11 no 11 , to approve payment in the amount
of $3,746.50 for spraying the county road ditches in Aastad, Western
and Oscar Township~, to,lthe. Fal'imers Oo~op, Wendell, MN, and the
amount of $1,015.60 to Ag Service Center, Brandon, MN, for spraying
the county road ditches in Elmo and Parkers Prairie Townships.

ried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, th at
WHEREAS, in accordance with a Procedural Agreement between the Minne-
sota Department of Natural Resources and the U.S. Fish and Wildlife
Service, dated May 23, 1962, certification by the County Board of
Commissioners for acquisition of lands by the U. S. Fish and Wildlffe
Service is requested, and
WHEREAS, representatives of the U.S. Fish and Wildlife Service met
with the County Board on August 9, 1989 and informed said Board that
an access easement had been secured from Albert J. Huwe on a strip
of land 33' either side of the center line of a driveway as presently
located across the E½SW¼ of Section 26-137-37, and waterfowili ease-
ments from Howard K. Buckholz on a 119.50 acre tract in Section 4-133-
42, and Lawrence m. Berg in the SE¼, SE¼NW¼, E½SW¼, SW¼SW¼ of Section
5-137-43,
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve
the aforementioned acquisitions by the U. S. Fish and Wildlife Ser-
vice.

the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, the County Board on the 26th of April, 1989, accepted the
bid of Bob Resset, Pelican Rapids, MN, in the amount of $19.800.00
for the rehabilitation of the former county jail facility, and
WHEREAS, the above contract has now been completed to the satisfaction
of the County Board at a total cost of $19,800.00,
NOW, THEREFORE? BE lT RESOLVED 1 the County Auditor is here by autho-
rized and diretted to issue a ~arrant in the amount of $8,685.00 · ·

carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, on July 10, 1989, the County Board accepted the bid of
N.H. Snider Const. Co., Slayton, MN in the amount of $178,821.25
for construttion of Bridge #56529, under S.A.PA 56-601-27,
WHEREAS the above contract has now been completed to the satisfaction
of the County Board at a total cost of $179,194.65, an increase of
$373.40 due to supplemental agreement and change order,
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized
and instructed to issue a warrant in the amount of $8,959.73 payable
to N.H. Snider Construction Co., as final payment on said contract.

HIGHWAY DEPARTMENT Engineer Berend discussed the request for retainage of the computer/
COMPUTER CONSULTANT engineer consultant for compu'beli'izi ng the county's highway program,
with a motion being made by Andy Lindquist to approve the contract
with Wm. Strand to co~plete the highway department's program, at a
total cost not to exceed $6,000. The motion was seconded by Mel 0.

Upon motion made by Andy Lindquist, seconded by Bert Hovland and car-
ried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, the rural areas of Otter Tail County need and deserve
the same options and quality of telecommunications service available
in the urban areas of the state, and
WHEREAS, without those services, our community is disadvantaged
socially, and from an economic development standpot~t,
NOW, THEREFORE, BE IT RESOLVED, the Otter Tail County Board has con-
sidered the potential benefits of the Minnesota Independent Equal
Access Corporation, and the opportunity for access to compett~g
long distance carriers, and therefore access to those carriers'
services and rate options •. along with the opportunity.for our citi-
zens to have access to the same telephone services as residents and
businesses in the metropolitan area, does hereby support the pro-
posal of the Minnesota Independent Equal Access Corporation.

The matter of the hearing on the request for placing of monuments
in Govetnment Lot 4, Section 6, Candor Township, came up for final
action and upon motion made by Bert Hovland, seconded by Andy Lind-
quist and carried, the following resolution was adopted;
RESOLVED by the Board of County Commissioners of Otter Tai. l County
Minnesota, that
The Otter Tail County Board does hereby deny the petition requesting
placing of monuments in G.L. 4, Section 6, Candor Township, as there
is not sufficient benefits to the property owners to just1fy the
costs of such survey. ·
