Chairman Lindquist called the meeting to order at l :10 p.m., with Commissioners Nelson, Hovland and Lindquist present, Commissioners Nordgren and Olson ab- sent. Upon motion made by Bert Hovland, seconded by Sydney Nelson and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS on the 28th of September, 1988, the County Board accepted the bid of Rupp Construction Co., for crushing salvaged bituminous materials. in the amount of $37,361.09, and WHEREAS the above contract has now been completed to the satisfaction of the County Board at a total cost of $36,781.09, a decrease of $580.00 due to liquidated damages, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $17,239.57 t0 Rupp Construction Company, as final payment thereof. Dated at Fergus Falls, MN this 28th day of December, 1988. In response to a letter received from Attorney Richard Nitz r·elative to property purchased by the County in 1939 but deed not recorded until 1984, involving removing of clay from said property, motion was made by Bert Hovland, seconded by Sydney Nelson and unanimously carried, authorizing Attorney Mike Kirk to consult with Attorney Nitz for the purpose of negotiating a settlement, on the Sitzer property in Corliss Township. The matter of the Otter Tail Snowmobile Trail Association's ut·ilization of county highway crossings and road right-of-ways was returned to the Board for finalization. Upon motion made by Andy Lindquist, seconded by Bert Hovland and unanimously carried the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The right to use the county highway system, as designated on Map #1, Otter fail Snowmobicle Trail·; in locations so indicated, be and is hereby approved, BE IT FURTHER RESOLVED, permission to use said right-of-way systen granted subject to compliance of Minn. Stat. 84.87 by saiid Snow- mobile Trail Association. Adopted at Fergus Falls, MN this 28th day of December, 1988. Upon motion made by Sydney Nelson, seconded by Bert Hovland and unani- mously carried, the minutes of the meeting of Decenber 21, 1988 were approved as mailed. Upon motion made by Sydney Nelson, seconded by Bert Hovland and unani- mously carried, approval was given to payment in the amount of $3,886.06 to Barr Engineering for professional services in connection with Phelps Mill dam repair. FINAL CERTIFICATION JUSTICE FACILITY RESOLUTION STATE AID SCREENING BOARD SHERIFF DEPARTMENT EMPLOYEE STATUS DICK KAUSLER OVER TIME COMPENSATION PELICAN RAPIDS REPEATER STATION fUNERAL LEAVE PERSONNEL POLICY RETIREES ACCUMULATED SICK LEAVE BENEFIT DATA PROCESSING NEEDS County Board -3 -December 28, 1988 Motion was made by Sydney Nelson, seconded by Bert Hovland and unani- mously carried, to approve payment in the amount of $275.00 to Construction.;.Analysis & Management, representing final payment to said firm for their professional services in connection with the construction of the justice facility. Upon motion made by Sydney Nelson, seconded by Bert Hovland and unanimously carried, the Chairman of the Board and the County Auditor were authorized to execute the final certification of completion of the Otter Tail County Justice Facility. Upon motion made by Sydney Nelson, seconded by Bert Hovland and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, Minnesota Statutes require that representation on the County State Aid Screening Board be composed of a County Engineer from each Minnesota Department of Transportati:on construction district, and WHEREAS, the 1988 Legislature directed that a Transportation Study Board review the state transportation systems, which includes the State Aid System, NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of Otter Tail County opposes any change of membership in the County State Aid Screening Board. Sheriff Gary Nelson and Deputy Sheriff Dick Kausler appeared before the Board with a request to move Marlene Hauge, sheriff department employee, from a permanent part time to a full time status, which was approved upon motion made by Bert Hovland, seconded by Sydney Nelson and carried unanimously. Motion was made by Andy Lindquist, seconded by Bert Hovland and unanimously carried, to select the option of a 10% additional compensation for Deputy Dick Kausler for extra time spent rather than pay the time and one-half for overtime duties. Joe Peloquin informed the Board there were problems with the repeater station at Pelican Rapids that were repaired by the purchase of a used unit, to combine the two units to get the station up on line, at a considerable savings over the $1,000 estimated repair cost. Representatives of the Employee Committee, Dake Akerman spokesman, appeared relative to the change in funeral leave for immediate family members. After considerable discussion, motion was made by Bert Hovland, seconded by Sydney Nelson and unanimously carried, to amend the Personnel Policy, to include a maximum of three days for attending a funeral of an imniegiate family member, as defined in the personnel policy, at the discretion of the department head, with any additional days required, be taken as sick leave. Motion was made by Bert Hovland, seconded by Sydney Nelson and unani- mously carried, to allow retirees to withdraw funds reppesenting accumulated sickleave in cash, or remain on the county group health coverage under full premium. Larry Krohn discussed data processing needs for the Sheriff Department and cost accounting for the Highway Department, recommending that the county board members become active in user needs. Chairman Lindquist appointed Bert Hovland, along with himself, to meet with Data Processing, Larry Krohn, and possibly the user committee on data processing needs. RESOLUTION LEAF LAKE TOWNSHIP ROADWAY County Board -4 -December 28 , 1988 Upon motion made by Bert Hovland, seconded by Sydney Nelson and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on or be~ore January 6, 1915 a public roadway ran in a general northerly and southerly direction in and through Section 22 of Leaf Lake Township in Otter Tail County Minnesota and did more particularly appear in the plat of Leaf Lake Pleasure Grounds as a roadway layed out and referred to therein as "State Highway No. 9 designated as Minnesota Scenic Highway" (which roadway is hereinafter referred to as 11 the road- way"); and WHEREAS, by resolution dated January 6, 1915 the County Board of Otter Tail County did designate and include 11 the roadway" as a part of State,~-, Road No. 9 under the laws and practices as were then in force and exis- ting; and WHEREAS, by his Order No. 8569 dated December 28, 1988, the Commissioner of Highways of the State of Minnesota did order as follows: IT IS HHREBY ORDERED that the temporary location of Trunk Highway Route No. 181 in OTTER TAIL County be over the following public road, to wit: Beginning at a point on Route Number 2 at Perham; thence extending southerly and easterly along Otter Tail County State Aid Road Number 9 to a point on Route Number 36 at Henning; The County and subdivisions thereof are hereby relieved from maintenance responsibilities and duties thereon, until such time as the permanent location of said route is constructed and open to traffic; and WHEREAS, on or about January 25, 1936 the permanent route of Trunk Highway No. 108 (previously designated as Trunk Highway No. 181) was established, constructed and open to the public through the area platted as Leaf Lake Pleasure Grounds along a route lying to the east of, and generally parallel to the course of, 11 the roadway" and pur- suant to said Commissioner's Order the maintenance responsibilities and duties thereon were returned to "said county and subdivisions thereof11 , and WHEREAS, after a diligent search by the Otter Tail Cou11nty Auditor and personnel of the Otter Tail County Highway Department, it is not now possible to located a record of action taken by the County Board of Otter Tail County in determining or designating the status of 11 the roadway" following the opening of Trunk Highway No. 108 to traffic, and WHEREAS, subsequent to January 25, 1936 and for a period of time of not less than 40 years and continuing to this date, the Township of Leaf Lakes has assumed and undertaken the responsibility for maintenance of 11 the roadway" as a town road all with the knowledge and consent of the County Board and the County Highway Department of Otter Tail County, NOW, THEREFORE, BE IT RESOLVED, that for all intents and purposes, the County of Otter Tail - (l)_ does hereby assign and surrender to the Township of Leaf Lakes all right, title and interest in and to 11 the roadway" which the County may have had in the past or now may have at the present, if any, re- troactive to January 25, 1936; (ii) does hereby surrender any and all ·residual control over, and main- tenance responsibility for 11 the roadway", that may have evolved to Otter Tail County by reason of Commissioner of Highways Order No. 8569, retroactive to January 25, 1936; and (iii) does hereby consent to, and acquiesce in, all of the acts and doings of the Township of Leaf Lake in its assumption of the control over, and maintenance responsibility of, 11 the roadway" as a town road at all times material to the designation of said roadway as Town Road T-403A, Town Cartway C-403A and as a four foot public walkway by the Town Board of Leaf Lake Township in tts resolution of October 3, 1988. County Board -5 -December 28, 1988 CITY OF FERGUS FALLS Larry Krohn advised the Board of a meeting with the City of Fergus LEACHATE & ASH DISPOSAL Falls on leachate and ash disposal to be held at 10:00 a.m., January 5, 1989, at City Hall, urging all commissioners to attend if possible. DEPARTMENT REPORTS CLOSED TO PUBLIC AD~OURNMENT Krohn also discussed the possibility of having all department heads report on the year's activities, to inform the board about the depart- ment's duties and accomplishments on an annual basis. Krohn was in- structed to schedule times with all department heads during the month of February. At 2:50 p.m., ,motion was made by Sydney Nelson, seconded by Bert Hov- 1 and and unanimously carried, to close the meeting to the public for the purpose of discussion on labor negotiations.
