DANGEROUS DOG REGISTRA- TION FEE -$25.00 KLEIN-McCARTHY BILL RICCIO SPLIT APPROVED TAX OF 1983 BROOKS ANDERSON SALARY INCREASE MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA August l O, 1988 Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met Wednesday, August 10, 1988, with all members present. Chairman Lindquist called the meeting to order at 12:40 p.m. Motion was made by Mel 0. Olson, seconded by Bert Hovland and unani- mously carried, to approve the minutes of the meeting of August 3, 1988. Representatives of the Economic Development Committee, Wm. Giesen spokesman, appeared before the Board relative to the proposed hiring of a plam'writer to assist in acquiring federal and state grants for various economic development projects throughout the county. Giesen reported that three individuals had been interviewed, Joseph A. Merz, J. Brightnose & Associates, and Del Redetzke, and recommended the Board retain Del Redetzke as the county•s planner. After consider- ation, motion was made by Mel 0. Olson, seconded by Bert Hovbnd and unanimously carried, to authorize the Economic Development Committee to meet with Redetzke, to clarify the agreement, costs, etc., and when the committee is satisfied with all aspects of the agreement, as·to source of funds coming out of the economic development appro- priation, etc., to return with a recommendation to the Board. The Board, having previously advertised for bids to be received for replacement of a bridge on CSAH #1, under SAP 56-601-27, proceeded to open bids which were found to be as follows: N. H. Co., Glenwood, MN 238,694.00 Northern Improvement Co., Fargo, ND 295,912.10 After review by the County Engineer, mot i"bn was made by Hub Nordgren, seconded by Bert Hovland and unanimously carried, to accept the bid of N. H. Snider Const. Co., Slayton, MN, in the amount of $178,821.25 being the lowest bid. Pursuant to Minn. Stat. 347 .51, Subdivision 3, motion was made by Bert Hovland, seconded by Andy Lindquist and unanimously carried, to establish a fee of $25.00 as the annual fee for registration of a dangerous dog under this section, and the County Auditor was in- structed to advertise such fee in the local newspapers. A bill from Klein-McCarthy in the amount of $3,294.54 for services rendered in connection with the justice factility was presented to the Board, and tabled by general consent. Motion was made by Hub Nordgren, seconded by Mel O. Olson and unani- mously carried, to approve a ~plit of a 1983 tax for Edward Riccio in Sverdrup Township, allowing Mr. Riccio to pay the delinquent 1983 tax on that portion of property purchased by him in 1983 where the current tax on the entire parcel had not been paid prior to his purchase. Motion was made by Sydney Nelson, seconded by Mel 0. Olson and unani- mously carried, to grant a 4% increase, effective January l, 1988, for BrooksAnderson, helper at Phelps Mill Park, who had been overlooked in the 4% increases granted for the year 1988. Olson and unani- mously carried, to approve the following applications for homestead classification and/or reduction of assessed valuation: Donald & Donna Herman Michael & Donna Koep Mary Hilden Windels Paum_;and Deanna Harvego Elmo Urbank Newton Everts Split Mid-year homestead Trailer house removed, reduce value of real estate and rembve solid waste user charge Cottage assessed on wrong lot, remove sol id waste user charge A reclassification of the appraisers in the County Assessor's office, from a Range 14 to a Range 15 for the certified specialized appraisers was presented to the Board and approved upon motion made by Mel O. Olson, seconded by Hub Nordgren and unanimously carried, effective September l, 1988. Erwin Siems, County Assessor, discussed with the Board the acqui- sition of property along CSAH #35, stating the individual who was holding out on the right-of-way purchase has now agreed to $12,600 for his property. Siems was told to continue the condemnation pro- ceedings. Motion wasxmade by Sydney Nelson, seconded by Bert Hovland and unani- mously carried to approve the following plats: Walker North Shore Add'n, replat of Outlot A, Echo Ranch Riviera 1st Add'n Vic's Beach, Section 13-135-41 Whispering Springs Replat, Section 2-134-43 Motion was made by Sydney Nelson, seconded by Hub Nordgren and unani- mously carried, to uphold the decision of the Otter Tail County Planning Commission and deny the application of Leander Fruhwirth, to construct a boat ramp on Lot 5, McGowen Riverside, on the\iOtter Tail River in Rush Lake Township. Upon motion made by Mel 0. Smith Geoffrey Smith Henning, MN Rick Odenbrett & JOhn Herr Jonric Pumping INSTALLERS LICENSE APPROVED LEACHATE DETECTOR RENTAL I County Boa rd -3 -August 10, 1988 Upon motion made by Hub Nordgren, seconded by Bert Hovland and unani- mously carried, the following applications for sewage disposal instal- lers license were approved: John Boit Boit Construction Lake Park, MN Malcolm Lee, Shoreland Management, appeared before the Board and in- formed the Board that requests have been made for the use of the county's leachate detector, after the county has completed use of it for the summer season. After consideration, motion was made by Mel 0. Olson, seconded by Bert Hovland and unanimously carried, to approve rental of the unit by other subdivisions, at a charge of $25.00 per hour, with a minimum outlay of $480.00, to be returned in the same condition it was obtained. RESOLUTION -U OF M Upon motion made by Hub Nordgren, seconded by Bert Hovland and unani- EDUCATIONAL TRAINING mously carried, the following resolution was adopted: PROGRAM -SEWAGE TREAT-·RESOLVED by the Board of County Commissioners of Otter Tail County MENT Minnesota, that DRY-HYDRANTS COMMISSIONERS CONTIN- GENCY FUND OTTER TAIL -BECKER JOINT POWERS AGREEMENT WHEREAS, Ground and Surface water quality is a major concern to the Otter Tail County Board of Commissioners, and WHEREAS, the University of Minnesota has provided an excellent quality educational training program for onsite septic system installers, pum- pers and inspectors since 1971, and WHEREAS, nearly 5000 installers, pumpers and inspectors have partici- pated in this program with approximately 1500 of those becoming cer- tified and requiring on going training to maintain that certification, NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners feels that the University involvement with this pro- gram has been extrmeely successful and would strongly urge the Univer- sity to make a long term commitment to insure that this program con- ti nu es. Adopted at Fergus Falls, MN this 10th day of August, 1988. The matter of dry-hydrants for fire protection was discussed, with no action taken. Motion was made by Bert Hovland, seconded by Andy Lindquist and unani- mously carried, to approve payment in the amount of $56.50 to the Otter Tail County Jail for furnishing coffee and cookies for the Board meetings, payment to be made out of the County Commissioners Contingency Fund. Mike Hanan, Solid Waste Officer, and Mike Kirk, County Attorney, appeared before the Board in response to a directive from the Board to meet with the Becker County Board and attempt a resolution relative to Becker County's withdrawal from the joint powers agreement. After consideration, motion was made by Mel 0. Olson, seconded by Bert Hovland and carried, with Hub Nordgren and Andy Lindquist voting "no", to accept Becker County's offer, as outlinedin letters received from Solid Waste Officer Del Hanson, dated July 5, and 26, 1988, requesting Otter Tail County release their claim on the transfer station, together with funds that may be recalled by the M.P.C.A., release from future liability, relin- quishing the $22,776 contingency fund, and securing releases from Qua- drant and the other counties involved, subject to the following: 1. Prepanation of an appropriate legal agreement to cancel the contract between Otter Tail and Becker Counties. 2. Negotiate for an agreement between Otter Tail County and Quadrant which would allow the re-opening of the Quadrant facility. 3 .. Acceptance of items #1 and #2 by written and binding agreements with Wadena County, Todd County, Hubbard County and Quadrant. I ~ ' ' • BIG DIPPER ENTERPRISES GARBAGE BAG PROBLEM BATTLE LAKE LANDFILL CLOSED TO PUBLIC ADJOURNED County Board -4 -August 10, 1988 John Beardsmore of Big Dipper Enterprises appeared before the Board in response to complaints on the Big Dipper garbage bags being left along the roads for some length of time, broken and the contents strewn. Beardsmore discussed various alternatives to solve the problE!!m with no formal1 aoUon taken by the Board. The proposal on the purchase of the Battle Lake landfill was presented to the Board, requesting that Otter Tail County purchase said landfill for a demolition site. By general consent, Mike Hanan, Solid Waste Officer, was instructed to contact Jim Warner of the Minnesota Pollu- tion Control Agency for the purpose of negotiating a resolution on the Battle Lake landfill and the possible superfund liability. At 3:45 p.m., motion was made by Bert Hovland, seconded by Hub Nordgren and unanimously carried, to close the meeting to;:the public to discuss labor negotiations with the County Attorney.
