Pursuant to adjournment, the Board of County Cc:xllllssioners of otter
Tail County Minnesota met weanesday, Jtily 23, 1986, with all members
present. Chairman Olson called the meeting to order at 12:47 p.m •
.Motion was made by Bert Hovland, seconJd by Andy Lindquist and unani-
mously carried, to approve the minutes 9f the July 16th meeting as
mailed.
Representatives from Construction-Analysis and Management, Inc.,
appeared before the Board and presented!the budget update for July.
C-A·,-M discussed with the Board the installation of five additional
windows on the second fl(X)r of the justice facility and the proposed
possible use of the space involved. After consideration, motion was
made by Andy Lindquist, seconded by Bert Hovland and unanimously car-
ried, to install the additional five windows on the second fl(X)r.

M:>tion was· made by Hub Nordgren, second~d by Andy Lindquist and unani-
mously carried, to approve the contract: with Medical Aids, Inc. ,
Eagen, MN, in the anount of $9,129.70 for installation of one
American Stair Glide E-51 in the courthouse, and the Chairnian of the
, . I Board was authorized to execute the con:tract on behalf of otter Tail
County. 1

in the amount of $131,850.00 frarn:Brandti1Electric~ ,fo.t the Security
System in the jail facility, with additional conduit required to accan-
modate the Security System in an amount! of $7,486.55. After consider-
ation, motion was· made· by Sydney Nelson1, seconded by Hub Nordgren and
unanimously· carried, to accept the total bid fran Brandt Electric,
in the amount of $139-.486.55. 1 _./ , ,

mously carried, the following resolution was adopted:

Department of Natural Resources and the, u. s. Fish and Wildlife Service,
dated May· 23, 1962, certification by the County Board of Cmnnissioners
for aa:Jllisition of lands by the U. s. Fjish and Wildlife Service is re-
quested, and !
WHEREAS, representatives of the u. S. Fish and Wildlife Service met
with the County Board on July 23, 1986 and informed said Board that a
waterfowl easerrent had been secured fran,,Mr. and Mrs. Harold E. Oehler
on the following described property:
S½NE¼ and NW¼ SE¼ of Section 9-131-44
NCW, THEREFORE, BE IT RESOLVED, the County Board has considered the

Upon motion made by Bert Hovland, seconded by :Andy'Lindquist and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of Cmmty Cornnissioners of otter Tail County
Minnesota, that
WHEREAS, in accordance with a Procedural Agreement between the Min-
nesota Department of Natural P.esources and the u. s. Fish and Wild-
life Service, dated~.ay 23, 1962, certification by the County Board
of Commissioners for acquisition of lands by the U.S. Fish and Wild-
. life Service is requested, and
WHEREAS, representatives of the U. s~. Fish and Wildlife Service net
with the County Board on July 23, 198_6 and informed said Board that a
waterfowl easement had been secured from Mr. and Mrs. ,Jarres E. John-
son on the following described property:

NOO, THEREFORE, BE IT RESOLVED, the County Board has considerdd the

Upon motion made by Bert Hovland, seconded by Andy Lindquist and unani-
·mously carried, the following resolution was adopted:
RESOLVED by the Board of County Canmissioners of otter Tail County
Minnesota, that
WHEREAS, in accordance with a Procedural Agreement betwen the Minnesota
Deparbnent of Natural Resources and the U.S. Fish and Wildlife Service,
dated May 23, 1g62, certification by the County Board of Commissioners
for acquisition of lands by the u. S. Fish and Wildlife Service is re-
quested, and
WHEREAS, representatives of the U.S. Fish and Wildlife Service met
with the Countiy Board on July 23, 1986 and informed said Board that
a purchase agrement has been secured from Mr. and Mrs. Lloyd H. Duenow
. on the following described lands:

NOW, THEREFORE, BE IT RESOLVED, the County Board has considered the
_aforementioned acquisition bythe U. S. Fish and Wildlife Service
and does hereby grant approval thereof.

Motion was made by Hub Nordgren to table sending out the user fee
statements on solid waste until the joint powers board meets and a
decision is made on the establishment of one or two solid waste dis-
tricts in the county. The motion was seconded by Bert Hovland aut
failed with Mel O. Olson, Andy Lindquist and Sydney Nelson voting "no".
Upon motion made by Sydney Nelson, seconded by Bert Hovland and unani-
mously carried, the following applications for conditional use permit

mously carried, to approve the following applications to sell non-

!Ybtion was made by Bert Hovland, seconded by Andy Lindquist and unani-
mously carried, to approve payment in the amount of $19,084.50 to
Klein McCarthy & Co. , Deephaven, MN, for professional services
rendered in connection with. the jail expansion project.
IDtion was made by Bert Hovland, seconded by Hub Nordgren and unanimously
carried, to accept ·the proposal of G. Barry Excavating, Unde:rwood, MN
for removing the footings on the Nelson house at Phelps Mill and
hauling to a durrp, at a cost of $550.00.
Sharon Bailey from R-C-M, Engineers, appeared before the Boa.rd and
reported the test wells at the northeast otter Tail County landfill
shav no pollution. Also discussed was the closing of the northeast
landfill and the request by the Northeast Otter Tail County Landfill
Association f9r the take-over of said landfill.
!Ybtion was made by Bert Hovland, seconded by Hub Nordgren and unani-
mously carried, to approve payment for insurance coverage at 50% of
the initial amount of premium, or an approximate figure of $6,900,
to the Minnesota Counties' Insurance Trust Fund.
Chainnan Olson appointed Mike Kirk and Larry Krohn as otter Tail
County •·s representatives to rreet with the Northeast Otter Tail County
Landfill Ass'n,on the request for the county to assume responsibility
of the landfill.
Also discussed was the prop:>sed closure of the Battle lake Landfill
and assurrption of costs for the closure. No action taken.
In response to a request by the County Board the ccmnittee report on
the proposed purchase.of optical scan vote counting equiprent indicated
a recanmendation that the county purchase the optical scan reader with
the various peripheral equipnent, :Le. ballot boxes, sleeves, etc.,
being purchased by the voting precincts. After consideration, motion
was made by Bert Hovland, seconded by Andy Lindquist and carried with
Hub Nordgren voting "no", to table until the spring of 1987, and keep
the committee intact to make additional recorrmendations.

Colll1ty Board -4 -July 23, 1986
Representatives from the City of Fergus Falls appeared before the
Board and stated the contract for the purchase of steam fran the
proposed refuse burner between the City of Fergus Falls and the
State of Minnesota has nav been signed, and they requested final
approval of the City of Fergus Falls-Colll1ty of Otter Tail contract.
After considerable discussion, motion was made by Sydney Nelson to
delay action until the August 11, 1986 board meeting. The motion
was seconded by Hub Nordgren and carried with Bert Hovland and Hub
Nordgren voting "no".
Dennis Berend, County,Engineer, reported to the County Board the
supplemental agreement for S'.·A.P.·,156-604-04, etc., with Mark Sand &
Gravel Canpany which was approved at the July 16th meeting, was not
acceptable with Item #5 calling for damages due to delay in con-
. structioo. After reconsideration, motion was made by Andy Lindquist,
seconded by Mel Olson and carried, with Hub.Nordgren voting "no", to
approve a supplemental agreement onS.A.P. 56-604-04, etc., eliminating
Item #5 pertaining to damages due to delay, in construction, because of
the fact delays have occurred because of variance delays caused by the
state and county. ·
Motion was made by Sydney Nelson, seconded by Bert Hovland and unani-
mously carried, to approve payment to Jacobson & Sons Excavating, Inc.
unden.iood, MN, in the amount of $8,112.50 for installation of cattle
passes on S.A.P. 56-63~09, 56-640-03 and 56-627-08.
Supplemental Agreement Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani-
F.dna Township mously carried, to approve a supplerrental agreement to include &lna
Tawnship,pn a road construction project, for an additional $70,900.00.

-Representatives fran the Wilkin County Board of Commissioners appeared
before the Board asking if Otter Tail County would be interested in
participating in the cost of rebuilding a t\\D mile stretch of road on
the county line between Otter Tail and Wilkin Counties, north of
Highway #108./ The Wilkin County Board was instructed to prepared some
figures as to cost and return to the Otter Tail County Board.
Upon motion made by Bert Hovland, seconded by Sydney Nelson and unani-
mously carried, the follaving resolution was adopted:
RESOLVED by the Board of Colll1ty Commissioners of Otter Tail County
Minnesota, that
WHEREAS Legislation has been introduced and passed under Minnesota
laws, 1986, Chapter 340, applying to solid waste management and
establishment of a joint powers agreement between Stevens, Grant, Todd
Hubbard, wadena, Traverse, Wilkin, Becker and Otter Tail Counties, and
WHEREAS local approval must come after final enactment of the bill
and fo:rwarded tothe Secretary of State,
NOW', THEREFORE, BE IT RESOLVED, approval of Chapter 340, Minnesota
laws, 1986, is hereby granted, and
BE IT FURI'HER RESOLVED, a copy of this resolution be forwarded to the
Secretary of State of the State of Minnesota.
