Pursuant to adjournment, the Board of County Corrmissionersof otter
Tail Col.ll1ty Minnesota met Thursday, June 26, 1986. Chairman Olson
opened the meeting at 12:40 p.m. with all members present.
Motion was made by Bert Hovland, seconded by Andy Lindquist and unani-
mously carried, to approve the minutes of the Jl.ll1e 16 meeting.
Mark Bowers, West otter Tail Counb.f Agricultural Inspector, appeared
before the Board with a weed problem of 120 acres in Maine 'Ibwnship.
M:>tion was made by Bert Hovland, seconded by Hub Nordgren and unani-
mously carried, authorizing Bowers to have said property sprayed and
place the cost as a special assessment upon the property.
Glen IV'..elby, County Sheriff, appeared before the Board relative to
the radio system which has had considerable breakdown and repair.
Melby stated the Amor site needs an upgrading at an estimated cost
of.$8,000.00 and requested pellPission to retain a consultant to
do a study of the needs of the sheriff's department and coordinate
with the telephone system in the new law enforcement center and jail
facility. Motion \-Ja.S made by Andy Lindquist, seconded by Sydney
Nelson and unanirrously carried, to authorize the Sheriff to obtain
figures for consultant fees for the radio study, and to proceed with
the necessary repairs on the current system to keep it operational,
at an estimated cost of $8,000.00
Virgil Florhaug and Jim Perras of C-A-M appeared before the Board
with the monthly report on the jail construction progress and the
budget report.
Jeffrey Gaffney and Dennis Christiansen of the H.R.A. appeared before
the Board with a report on the Snall Ci ties Development (';I"ant in East
Otter Tail County.
A letter fran Sandy L. DiBrito, City Manager of Perham, was presented
to the Board, requesting consideration on the lowering of heme properties
in the City of Perqam, to reflect a more realistic market value,
stating properties will not sell at the market value placed on them
by the assessor. No action taken.
Motion was made by Bert Hovland, seconded by Andy Lindquist and unani-
mously carried, to approve the following change orders in connection

Lee discussed with the Board the necessity of purchasing additional
semi-trailers for hauling of solid waste. No official action taken.
Sharon Bailey, Reikke-carol-Mueller, appeared before the Board rela-
tive to the costs involved in the soils samplings and hydrogeological
studies completed at the Northeast Otter Tail County and the Battle
Lake Area Landfill sites. Motion was made by Bert Hovland, seoonded
by Hub Nordgren and unanimously carried, authorizing R-C-M to pay
the bill in ilie amount of $18,285.00 for the studies on the Battle
Lake landfill, as stated in the contract agreement. 1'1otion was made
by Sydney Nelson, seconded by Andy Lindquist and unanimously carried,
to pay the arnount of $14,900 for the sudies on the northeast land-
fill, as stated in the contract agreement. .Motion was then made by
Hub Nordgren, seconded by Bert Hovland and unanimously carried, to
instruct the county attorney's office investigate the contracts to
determine under the terms of the contracts if the overruns should
be paid. The county attorney's office was also instructed to check
into the federal register requirements in an effort to get the Battle
Lake Landfill rerroved from the Super Fund list, or let a work plan be
developed and then place on hold until a resolution can be arrived at.

for All Building Corporation, Fergus Falls, MN on sheet irregularity

mously carried, the following resolution was adopted:
BE IT RESOLVED by the Board of County Commissioners of otter Tail County
Minnesota, that
WHEREAS, certain portions of County State Aid Highway #3 were relocated
and areopen for travel taking the place of the pre-existing portion of
county Road #3, and
WHEREAS, the Otter Tail County Board of Conmissioners desired to vacate
the following described portion of the pre-existing County Road #3 by
resolution: .
That part of the Northeast Quarter of Section 5, Township .
134 North, Range 42 West, otter Tail County, Minnesota
described as follows:
Commencing at the East Quarter Section comer of said
Section 5; thence North (assumed bearing) along the
East line of said Section 5 a distance of 960.86 feet
to its intersection withthe easterly right-of-way line
of County Road Number 3, said point being the point of
beginning; thence continuing on a bearing of North
along said East line a distance of 430.55 feet; thence
northwesterly along a tangential curve concave to the
west a distance of.b58.51 feet, said curve having a
central angle of 17 25'20" and a Radius of 521.29 feet;

passed and notice of this resolution :p0sted for at least 10 days as
required by law.

A request for reconsideration on the forgiveness of penalty for late
payment of tax by Edward Wallace in Pine Lake Township was presented
to the Board, lbased on the claim a statement was mailed to a fonrer
address, never received by the property owner~ and attempts made by
said property owner to obtain a statement.produced no results.
Motion was made by Sydney Nelson to forgive penalty and interest.

Upon motion made by Andy Lindquist, seconded by Bert Hovland and unani-
rnously carried, the foll0vving resolution was adopted:
RESOLVED by the Board of County Corrrnissioners of Otter Tail County
Minnesota, that
WHEREAS, the Otter Tail County.Board of Comnissioners has requested
from tge Comnissioner of Transportation a variance from ~innesota
Rules§ 8820.9914, and
WHEREAS, there are four sag vertical curves on the segment of C.S.A.H.
No. 35 (S.A.P. 56-635-10), between Dalton to 2.7 miles South of Under-
wood \\nich do not meet the required 40 mile per hour design speed for
special resurfacing projects, and
WHEREAS, the request for a variance to restrict the said sag vertical
curves to 36 miles per hour will be granted.
NG'J, . THEREFORE, BE IT RESOLVED, that the Otter Tai;L County Board of
Commissioners, in accordance with Minnesota Rules§ 8820.9914 indem-
nifies, saves and holds hannless the State of Minnesota and all its
agents and employees of and from any and all claims, demands, actions
or causes of actions of any nature or character arising out of or by
reason of, in any manner, the resurfacing of C.S.A.H. No. 35 from
Dalton to 2. 7 miles South of Unden-x,od in any other manner than as
a design speed of 40 miles per hour and further agrees to defend at
their sole cost and expense any action or proceeding comrenced for
the purpose of asserting any claim of matsoever character arising as
a result of the granting of this variance.

rnously carried, to grant permission to close CSAH #2 for one week
and to allow one lane traffic for another week to accomnodate the
construction work contemplated by the DepartrcEnt of US Aney Corps of
Engineers regarding "Reservoir Subimpoundment" at Orwell Dam.1 ,
Motion was made by Sydney Nelson, seconded by Hub Nordgren and unani-
mously carried, to approve payment in the arrount of $35,847.20 to
Burlington Northern Railroad Co., for installation of Rubber Crossing
and Crossing signals at the Industrial Park in Perham to serve the
refuse burner.
Representatives from the City of Fergus Falls, David Nycklerroe, City
Attorney, spokesman, appeared before the Board relative to the
contract between the City of Fergus Falls and Otter Tail County on
the refuse burner in the City of Fergus Falls, requesting the County
approve the contract agreed UfX)n in November 1st of 1985, with a
change of language·allOW'ing a letter of intent from the State of
Minnesota to suffice instead of a signed agreement fran the State.
Resolutions and ccmnents from various persons and individuals from
the City of Perham objecting to the establishment of a second burner
in the City of Fergus Falls were heard. After considerable discus-
sion, motion was made by Andy Lindquist, seoonded by Sydney Nelson
and unanimously carried, to table any action on the final contract
approval until the 3rd of ,Tuly, after the county attorneys from the
cmmties involved in the joint :p:::wers agreement have met and made
a decision on the technicalities involved in the acceptance of a
letter of intent from the State of :M.innesota rather than the signed
contract as ori~inally included in the contract.
