Pursuant to adjournment, the Board of County Comnissioners of otter
Tail County Minnesota met Tuesday, r,-rarch 4, 1986. Chairnian Olson
declared the meeting open at 1:03 p.m., with Sydney Nelson, Berton
Hovland, Andy Lindquist and ~l 0. Olson present, Hub Nordgren absent.
Motion was made by Andy Lindquist, seconded by Bert Hovland and unani-
mously carried, to approve the minutes of the February 21st meeting as
mailed.
Sheriff .IY'.Elby appeared before the Board, reporting a new individual
in the clerical staff has been hired, starting :r,,t.arch 3, 1986. Motion
was made by Andy Lindquist, seconded by Be:tt Hovland and carried with
Sydney Nelson voting "no", to refer compensation for said employee to
the Personnel Cormnittee.
Sheriff J\~1.by presented his annual report for the year 1985.

mously carried, to approve the following applications for sewage system

Upon motion made by Bert Hovland, seconded by Andy Lindquist and
unanimously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of otter Tail County
Minnesota, that
The follav."'i.ng findings are detennined in the adoption of the 1986
Amendrrent to the Solid Waste Ordinance:
I. It is necessary for otter Tail County to raise funds in order to
pay for disposal of solid waste in confo:rmance with the Otter Tail
County Solid Waste Plan.
II. It is necessary to car:ry out the purpose of Chapter 400 that a
service charge be imposed on all waste generators.
III. Transportation problems, economic factors, environmental fac-
. tors, and requirements of state law make such action necessary
to protect the public health and safety of the citizens of otter
Tail County.
IV. Use of the County Solid Waste Management Services is the most
conomically sound disposition of solid waste in the county.
V. Across-the-board service charge is the only adminstratively econ-
omic method of collecting the charges.
VI. !-Eking services available to all residents will reduce the arrount
of litter, other non-aesthetic biproducts and health and safety
hazards of individual solid waste disposal.
VII. The eqonanics of operating solid waste incinerators are of sig-
nificance, and even though costly, provide the county with the
most canprehensive method of waste management services.

nnusly carried, the following resolution was adopted:

' The Board of-County Canrnissioners of Otter Tail County does ordain:
' The otter Tail County Solid Waste Ordinance, as effective May 1, 1973,
is hereby amended by the addition of the following:
' SECI'ION XIII: SERVICE CHA.RGE
Subdivision 1: Purpose and Authority. This section is enacted pursuant
to Minnesota Statutes 400.08 granting otter Tail County the authority
to i.mpose a se:rvice charge for solid waste management services provided
by the, county or by those under contract with the county.
Subdi yision 2 : Revision and Collection. The County Board by resolution
may re~ise t.li.e rate and charges established herein, men deerred advisable.
No charges shall be adopted or collected in any year unless first cer-
tified by the County Board to the County Auditor for the follaving year.
Subdivision 3: Rates and Charges Payable in 1986. °"7ners of real pro-
. perty shall pay a base fee in 1986 for access to waste management ser-
vices provided by the County or by persons under contract with the
County,.
A.: Factors in Establishing Rates and Charges. Rates and charges
payable m 1986 may take into account the character, kind, and quality
of the, service and of the solid waste: the irethod of disposition inclu-
ding but not limited to activities such a recycling composting, co-
canposting, resource recover, the number of people served at each place
of collection: and all other factors that enter into the cost of se:rvice,
including but not limited to depreciation and payment of principal and
interest on money borrCMed by the Colil1ty for the acquisition or better-
ment of solid waste facilities, the establishment of a reserve fund for
payments of a fee to Quadrant, Inc., and the City of Fergus ', Falls for
for services to be provided at solid waste incineration facilities, and
administrative costs associated with providing waste management services
to county residents.
B. Establishment of Rates for Cha:rges Payable in 1986. The rates
for charges payable in 1986 shall be as stated on the 1986 Rate Schedule
for Solid Waste Management cha:rges adoptecil by the County Board, a copy•
of which shall be kept on file in the Office of the County Auditor.
Subdiv:j..sion 4: Rates and Cha:rges Payable in Years Subsequent to 1986.
In years subsequent to 1986, the County nay require owners of real pro-
perty to pay a volme or tonnage-based fee for waste management services
provided by the County or by persons under contract with the County.
Rates and charges payable in years subsequent to 1986 may take into ac-
count any or all of the factors listed in Subsection 3(A) above: and
specifically may take into account as an additional cost of se:rvice,
the amount of waste estimated to be generated by different classifica-
tions of solid waste generators, as determined by the Colil1ty.
The rates for charges payable in years subsequent to 1986 shall be as
stated in the Rate Schedule for Solid Waste Management Charges adopted
by the County Board at its first meeting in February of each year. If
no new rate schedule is adopted in any given year, the rate schedule
frcxn the previous year shall remain in ef feet. A copy of the current
rate schedule shall be kept on file in the Office of the County Auditor
subdivision 5: Rates and charges shall be billed in a manner detennined
by the County Board.

A. · Taxable Properties. On or before October 15 in each year,
the County Board shall certify to the County Auditor all unpaid out-
standing charges for services hereunder, and a statement of the des-
cription of the lands which were serviced and against which the
charges arose. It shall be the duty of the County Audi tor, upon order
of the County Board, to extend the assessments with the interest of
six percent upon the tax rolls of the County for the taxes.of.the year
in which the assessment is filed. For each year ending Cx::tober 15 the
assessment with interest shall be carried into the tax becaning due and
payable in January of the following year, · and shall be enforced and col-
lected in the manner provided for the enforcement and collection of
real property taxes in accordance with the provisions of the law of the
state. The charges, if not paid, shall beoome delinquent and be subject
to the same penalties and the same rate of interest as the taxes under
the general laws of the state.
B. Tax...;.Exerrpt Properties. Unpaid charges may be collected in
Small Claims Court of through such other means as·may be approved by the
County Attorney.
Subdivision 7: Appeals .
Any property owner who believes that the service charge imp::,sed upon
his property is too high ma.y appeal that charge. Toda so the property
owner must obtain a conplaint fonn from the Solid Waste Officer and re-
turn it to that officer within thirty (30) days of the date of mailing
of notice of the service charc;e. Upon receipt of the completed com-
plaint, the Solid Waste Officer or his or her designee shall have ten
(.10) days to reviBv the corrplaint and following review · shall notify
the carnplaining property owner by mail of the decision to either adjust
the service charge in response tothe ccrnplaint or to deny the canplaint.

lowest bid for pick~s. Motion was made by Bert Hovland, seconded by

At the request of the Comty Board, rrembers of the Star Lake Tcwn
Board and the Star Lake Property Ormers Association appeared before
the Board relative to the proposed bridge construction on CSAH #41
over Star Lake. After considerable discussion, rnotion was rrade by
Bert Hovland, seconded by Andy Lindquist and unanirrously carried, to
proceed with the bridge design with a clearance of 6½ feet over the
nor!T'al water level. ·
Upon rrotion made by Andy Lindquist, seconded by Bert Hovland and mani-
rnously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of otter Tail Cmmty
Minnesota, that
WHEREAS, otter Tail County State ld.d Highway No. 35 located between
Dalton and Underwood has deteriorated to the point where major repairs
are needed, and
WHEREAS, it has been determined that a new bitur~nous overlay is the
best corrective rreasure that can be taken, and
WHEREAS, the existing design speed on four sag vertical curves is 36
miles per hour, and
WHEREAS, the minimum design speed standard is 40 miles per hour,
Na-J, THEREFORE, BE IT RESOLVED, that Otter Tail Comty is requesting
a variance from minimum State Aid Standards H., l., d., 14 .1'-CA...R. L 5032
for special resurfacing projects to permit the expenditure of State
Aid Construction Fmds on this CSAH No. 35 project which has a minimum.,,

mously carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County

WHEREAS, the otter Tail County Board of Commissioners has' requested
from the Corrmissioner of Transportation a variance from State Aid
Rules 14 MCAR 1.5032 (M) indemnifies, saves and holds harmless ·the
State of Minnesota and ail its agents and employees of and fran any
any all claims, derrands, actions or causes of actions of any nature
or character arising out of or by reason of, in any mIDI1er, the re-
surfacing of C.S.A.H. No. 35 from Dalton to 2.7 miles South of Under-
wood in any other manner than as a design speed of 40 miles per hour
and further agrees to defend at their sole cost and expense any action
or proceedings commenced for the pul:J;Ose of asserting any claim of
whatsoever character arising as a result of the granting of this var-
iance.

Engineer presented a request from the Highway Department Union
Representative for an increase in salary for Ricki Swanberg from
$6.25 to $7.52 per hour. No official action taken.
Motion was made by Andy Lindquist, seconded by Sydney Nelson and unani-
rnously carried, to authorize the Veterans Service Officer to purchase
100 bronze star grave markers, at a cost of $5.25 per marker.
John Halvorson, Sheriff's Department, appeared before the Board with
architectural drawings on changes in the jail plan to facilitate
additional bed capacity, as recomrrended by the Jail Stud/ Conmittee,
and approved by Dennis Falenscheck of the Deparbuent of Corrections.
Motion was made by Bert Hovland, seconded by Andy Lindquist and unani-
mously carried, to approve Change Order #1, Miller & Sons Drywall, Inc.
west Fargo, ND, for Gypsum Drywall, deduct $40 l. 00 , per architects'
supplemental instruction.

GeOrge Hegstran for late payrrent of tax on property in Connan Township,
error in the county offices.
Motion was made by Sydney Nelson, seconded by Mel O. Olson and unani-
rrously carried, to grant forgiveness of penalty and interest on late
payment of tax by Henry & Jean Alberts, City of New York Mills, where
an effort was made to obtain the arrount of the tax for payrrent with
no satisfaction, error in the county offices.
Motion v.B.s made by Sydney Nelson, seconded by Bert Hovland and unani-
mously carried, to approve forgiveness of penalty on late payrrent of
tax by Otter Tail County on property purchased during 1985 with the
last half of the current tax owing.
Upon motion made by Bert Hovland,. seconded by Andy Lindquist and unani-
mously carried, the following resolution was adopted:
RESOLVED by the Board of County Carmissioners of otter Tail County
Minnesota, that
WHEREAS, on December 11, 1985, the County Board accepted the proposal
of Hilgren Ford, Parkers Prairie, MN, in the amount of $11,100.00 for
a five passenger wagon for use by the Veterans Service Office, and
WHEREAS, the above vehicle has na-1 been delivered to: the satisfaction
of the County Board at a total cost of $11,100.00,
NOW, THE_~ORE,· BE IT RESOLVED, the County Auditor is hereby. ,authorized
