MEETING OF THE BOA.'RD OF COUNTY COMMISSIONERS OITER TAIL COUNTY r-,T..INNESOTA I Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met Friday, November 22nd, 1985. Chainnan Nord- gren called the meeting to order at 1:10 p.m. with all members present. Upon motion made by Andy Lindquist, seconded by Mel Olson and carried, with Sydney Nelson voting "no", the following resolution was adopted: In accordance with a procedural agreement between the Minnesota Depart- ment of Natural Resources and the U. s. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Ccmnissioners for acquisition of lands by the u. S. Fish and Wildlife Service is re- quested, and lvHEREAS, representatives of the U. s. Fish and Wildlife Service met with the Board of Cammissioners of otter Tail County on November 22, 1985,.and informed said Board that a purchase agreement had been se- cured frorn Mr •. and Mrs. Peter J. f abi~ on. the . following described properties:· · Section 25-131-44, the T.•J 16 chs. of the N 17 chs. and the N 2.5 chs. lying E of the H 16 chs. of the SE¼SE¼, the N 17 chs. of government lot 4 , N1·v¼SE¼, governrrent lot 3 of the correctional plat "otter Tail County W.A. No. 10", Section 30--131-43, Parcel 2 of the plat "Otter Tail County W.A. No. 19,", ex. tract,. and Parcel 4 of said plat, ex. tr. Section 31-131-43, the E 378 feet of the N 210 feet of the E\1NW.ii', except tracts. NOW, THEPEFORE, BE IT RESOLVED, the County Board does hereby grant approval to the U. s. Fish and Wildlife Service for the above mentioned purchase agreerrent. Dated at Fergus Falls, MN. this 22nd day of November, 1985. Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani- mously carried, to approve the plat of Lazy Acres, located in Section 5-135-39. The application of Jerorre Schroeder for :;ierrrission to extend a special use permit on Pelican Lake, tabled from11.the-November 12th meeting, was brought up for final action. Motion was made by Bert Hovland, seconded by Mel Olson to request a proper drawing from Schroeder and return to the County Board. The motion was withdrawn. After additional dis- cussion, motion was made by Andy Lindquist to request a new application be presented to the otter Tail County Planning Commission, acc:orrpanied by the proper drawings be subrni tted. The motion was seconded by ~'.'el O. Olson and carried with Bert Hovland and Hub Nordgren voting "no". MalCX)]m Lee, Solid Waste Manager, appeared before the Board and reported on the progress of the construction of the transfer stations. Lee also reported receiving proposals from Brogard, Henning, and Robert- son Well Drilling, Ashby, for hook!ing up the well at the Henning trans- fer station. No formal action taken. Lee also reported to the Board otter Tail County's portion of the $85,842 grant funds for the transfer station and trailer costs to be $61,881, with Becker County receiving $23,961. Pelican Rapids Malcolm Lee was directed to write a letter of clarification to the Garbage hauling costs PELICAN PAPIDS PRESS on costs involved in the handling of garbage from Pelican Rapids to the Detroit Lakes transfer station. 0. Motion was made by Bert Hovland, seconded by Sydney Nelson and unani- mously carried, to deny the request of the HUD to extend the receipt of payment of tax on Parcels #396 and #691, Maine 'Ibwnship, in the narre of Wm. & Esther Rinke, on the amnesty program llltil the middle of December. Upon motion made by Bert Hovland, seconded by .Mel 0. Olson and lllani- mously carried, the following resolution was adopted: RESOLVED by the Board of Coilllty Camnissioners of otter Tail County J\l'ill111esota , that WHEREAS, Minnesota Statutes section 471.98, subd. 3, authorizes politi- cal subdivisions to establish self insurance pools; and WHEREAS, the J:111.innesota Colllties Insurance Trust (MCIT), and joint powers organization illlder Minn. Stat. section 471.59, has created a Property and Casualty Division self insurance pool to offer property, motor vehicle and general liability coverages to eligible political subdi- visions; and WHERE.2\S, Otter Tail Coilllty desires to obtain such coverage and became a member of the M::IT Property and Casualty Division, NClv~ THEPEFORE I BE IT. RESOLVED, that the Colllty Board of Otter Tail Colllty fonnally apply for membership in the JI.CIT-Property and Casualty Division, BE IT FURI'HER RESOLVED, that the otter Tail Coilllty Board acknowledges receipt of the by-laws of the JI.CIT-Property and Casualty Division, that its members ha_ve read them and certifies th·at the County of Otter Tail shall be round by them. BE IT FINALLY RESOLVED, that a certified copy of this resolution be fo:r:warded to the appropriate officers of the JI.CIT for further action. M:>tion was made by Hub Nordgren, seconded by Sydney Nelson and lil1ani- mously carried, to approve payment in the arrount of $1,133.76 to Blowers Township, representing one-half the cost of installation of two major drainage structures. Dennis Berend, Colil1ty Engineer, reported a request from the Cities of Dent and Vergas for winter maintenance of the citys' streets. Olson and l.Il1ani- mousiy carried, the;£ollowing resolution was adopted: RESOLVED by the Board of Colil1ty Commissioners of otter Tail Colil1ty Minne- sota, that WHEREAS, to cc:mp1y with Traffic Engineering recorrnrendations as sugges- ted by the Federal Highway Administration. BE IT PESOLVED, that highway traffic approachlng the junction of CSAH No. 60 and CSAH No. 51 be controlled as follows: 1. Establish the East-West traffic flow as the through route re- quiring no stop or yield signs. 2. Yield signs be installed for the North-South traffic both on the township road to the north and CSAH No. 51 to the south. Adopted at Fergus Falls, .MN this 22nd day of November, 19 85. Engineer Berend informed the Board the Erickson Engineering Finn has been retained for the design of bridges at Star Lake. A request from Inman Township for flil1ding reimbursement on culvert replacement was presented to the Board and tabled for additional in- formation. Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani- mously carried, to approve the minutes of the meeting of Noverrber 12th. Dave Johnson, Veterans Affairs Officer, appeared before the Board and presented quotations for the purchase of a new van for the Veterans Service Office. Johnson was instructed to a<XJU.ire additional quota- tions to be presented to the Board December 3rd. Upon motion made by Bert Hovland, seconded by Mel O. Olson and unani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Corrrnissioners of otter Tail County Minnesota, that WHEREAS, by resolution of the Board of County Commissj.oners, otter Tail County, Minnesota, dated December 13, 1973, the County of otter Tail was authorized to enter into a plan of deferred canpensation with eligible participants, and · WHEREAS, the resolution authorizing the deferred corrpensation plan did not authorize a specific individual to act as the financial officer for the deferred carpensation account and such an appointment is necessary in order to make disbursements from the fund to eligible members, NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of County Commissio- ners of otter Tail County Minnesota that the otter Tail County Auditor, which is currently Sylvia G. Motion was made by Andy Lindquist, seconded by Sydney Nelson and unani- mously carried, to approve pre-pay,rrent of a bill in the amount of $467.47 to A & B Automotive Center, Detroit Lakes, MN, to take advantage of discmmt. :Motion was made by Andy Lindquist, seconded by Bert Hovland and unani- nously carried, to place all delinquent 1985 personal property taxes into judgment, and the following report of the County Board of the County of otter Tail, State of Minnesota, of uncollected personal property taxes for the year 1985 is presented: November 22, 1985 BE IT KNOWN, that the otter Tail County Board did rreet in session on the 22nd day of November, 1985, that at said session the County Treasurer of said County delivered to said Board the list of tn1collected personal property taxes for the year 1985, together with his certification thereon as required by law; and that at said session the said Board did duly con- sider said list of tn1collected taxes, and did cancel such taxes as they are satisfied cannot be collected. Olson and unani- rrously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of otter Tail County r.~inne- sota, that WHEREAS, otter Tail County is exempt from the payment of sales and use . tax; and l'VHEREAS, the county by separate bid specification and separate contract has .warded a bid to Northern Woodworking, Inc. , for the purchase of rraterials to be used in Phase 2 of the jail project; and WHEREAS, the Minnesota sales tax reguM.tions allow for the designation of a contractor as purchasing agent for the county for the purchase of rra- terials where the materials were bid separately, are separately.con- tracted for, and where the specifications did not provide for the award of the contract to the lowest lump sum bid of materials and labor; and WHEREAS, the sales and use tax exemption of the county can be utilized for the purchase of materials for Phase 2 of the project if Nortthern·, Woodworking, Inc., is appointed as purchasing agent for the county, NOW, THEREFORE, BE IT RESOLVED, that the otter Tail County Board of Conr missioners does hereby appoint as its purchasing agent Northern Wood- working; Inc., for purchase of materials utilized in Phase 2 of the jail project. 'Ihis appointrrent shall be limited to the purchase of personal property, building materials, a;ruiprrent and supplies which are necessary to Phase 2 of -t;:he jail construction project, and shall become affixed to and a part of the real estate. Notwithstanding any other contract, Northern Woodworking, Inc., shall have the authority and re- sponsibility as required by law to qualify said purchases·of personal property, building rraterials, equiprrent and supplies as exempt from Minnesota sales tax and use tax. The Chainnan of the County Board is authorized to enter into any contracts reasonable and necessa:ry to car:ry out the terms and intent of this resolution. Olson, seconded by Bert Hovland and unani- rrously carried, to authorize the Chainnan of the Board to sign the contracts for all the accepted bids on the jail facility project.
