ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OITER TAIL COUNTY MINNESarA September 11, 1985 Pursuant to adjournment, the Board of County Commissioners of otter Tail County J.Vri.nnesota net Wednesday, September 11, 1985, with Hub Nordgren, Mel o. Olson, Andy Lindquist1and Sydney Nelson present, Bert Hovland absent. Chairman Nordgren called the meeting to order at 9:30 a.m. Motion was made by Mel O. Olson, seconded by Andy Lindquist and unani- rrously carried, to approve the minutes of the meeting of September 6th, with correction. · County Engineer Dennis Berend appeared before the Board and the matter of the deteriorated condition of CSAH #1 on the north end of otter Tail Lake was discussed. Berend recoorrrended State Aid Bonding against future State Aid Funds, of up to t\..o years, to cover various recon- struction and resurfacing projects. No action taken. At the request of the City of Clitherall, rrotion was made by Andy Lind- quist, seconded by Mel O. Olson and unanirrously carried, to allow the City of Clitherall to close off a portion of CSAH #5 on September 14th for a street dance. The matter of acceptance of bids on the semi-trailers for use in the transportation of solid waste was brought up. l'vbtion was made by Mel o. Olson, seconded by Andy Lindquist and unanirrously carried, to post- pone acceptance of bids on said trailers until September 25th. Cliff Keller, together with other members of the West otter Tail Soil and Water Conservation District, appeared before the Board and presented the District's budget for the year 1985-86, with a request of county funds of $33,500.00. After consideration, motion was made by Mel O. Olson, seconded by Andy Lindquist and unanirrously carried, to appropriate the sum of $32,500, which represents the sane funding as for 1984-85. Upon rrotion made by Sydney Nelson, seconded by Mel 0. Olson and unani-· rrously carried, the following resolution was adopted: WHEREAS Legislation has been passed requiring all governmental sub- divisions pay a recording fee of $10. 00 for all documents filed in the office of the County Recorder, and WHEREAS it is deemed redundant by this county Board to require offices within the County Revenue Fund pay said filing fee, NOW, THEREFORE, BE IT RESOLVED, the Otter Tail County Recorder's Office is hereby not required to collect a filing fee f:rom other county offices for the recording of docurrents. Olson and lll1ani- nously carried, the following resolution was adopted: RESOLVED by the Board of Col.Il1ty Comnissioners of otter Tail County Minnesota, that WHEREAS, the Omnibus Tax Law, Article 20, Sections 4, 5, 13 and 16, allOIIIT the colll1ty board.to increase the fee charged for filing of various docUITEnts to cover administrative costs, NOW, THEREFORE, BE IT RESOLVED, the County Board doe~ hereby establish a filing fee of $10.00 for the filing of an application for repurchase of tax-forfeited lands. Adopted at Fergus Falls, MN this 11th day of September, 1985. Upon motion made by Andy Lindquist, seconded by Sydney Nelson and lll1ani- mously carried, the following resolution was adopted: RESOLVED by the Board of County Conrnissioners of otter Tail County Minnesota, that The County Auditor assess a service fee of $10.00 per parcel to cover the cost to prepare and publish the colll1ty tax judgment list. Adopted.at Fergus Falls, MN this 11th day of September, 1985. Upon motion made by Sydney Nelson, seconded by Andy Lindquist and carried, with Iv'.el 0. Olson voting "no", RESOLVED by the Board of County Commissioners of otter Tail County Minnesota, that The month of November, 1985, be and is hereby set by the Col.Il1ty Board as Armesty Month in otter Tail Col.Il1ty, during which tirre delinquent taxes may be paid in their entirety without penalty, tax plus interest to be paid by certified check, cashier's check or money order. Adopted at Fergus Falls, MN this 11th day of September, 1985. Olson, seconded by Andy Lind:Juist and unanimously carried, to accept the bids from the Blue Cross-Blue Shield, for tenn life and accident & health insurance, being the lowest bid. Upon notion made by Andy Lindquist, seconded by Sydney Nelson and unani- mously carried, the folla.,ring resolution was adopted: RESOLVED by the Board of County Commissioners of otter Tail County Minne- sota, that WHEREAS, otter Tail County is exernpt from the payment of sales and use tax; and WHEREAS, the county by separate bid specification and separate contract has awarded a bid to Breitbach Construction for the purchase of materials to be used in Phase 1 of the jail project; and v-JHERFAS, the fv'linnesota sales tax regulations allow for the designation of a contractor as purchasing agent for the county for the purchase of materials where the materials were bid separately, are separately con- tracted for, and where the specirications did not provide for the award of the contract to the lowest lurrp sum bid of materials and labor; and WHEREAS, the sales and use tax exemption of the county can be utilized for the purchase of materials for Phase 1 of the project if Breitbach Con- struction is appointed as purchasing agent for the county, NOW, THEREFOPE, BE IT RESOLVED, that the otter Tail County Board of Cornnis- sioners does hereby appoint as its purchasing agent Breitbach Construc- tion for purchases of materials utilized in Phase 1 of the jail project. This appoint:rrent shall be limited to the purchase of personal property, building materials, equipment and supplies which are necessary to Phase 1 of the jail construction project, and shall become affixed to and a part of the real estate. Notwithstanding any other contract, Breitbach Construction shall have the authority and responsibility as required.by law to qualify said purchases of personal property, building materials, equipment and supplies as exempt frcrn Minnesota sales taxe and use tax. The Chairman of the county board is authorized to enter into any contracts reasonable and necessary to carry ou-the ternlS and intent of this reso- lution. Motion was made by Sydney Nelson, seconded by .Melo~ Olson and unanirrously carried, to grant forgiveness of penalty on a late payrrent of tax by David J. & Esther B. Pauly in Paddock Township, due to a confusion of a returned remittance of the 1984 tax with a split of property involved. Motion was made by Mel Olson, seconded by Andy Lindquist and unanirrously carried, to approve payment in the arrount of $300.00 towards expensed in- curred by Ken Rose in attendance at a National Convention of Agricultural Extension Agents to be held in Pennsylvia, as recanrrended by the County Extension Committee. .In response to correspondence from the County Zoning Adminstrator of Becker County regarding a camrrercial poultry feedlot proposed for estab- lishment in Section 29 of Lake Eunice Township, Chairman Nordgren appointed a representative of the Land & Resource Management office to attend a rreeting regarding said feed lot establishrrent on September 14th at the Becker County Courthouse. Motion was made by Andy Lindquist, seconded by Melo. Olson and unani- mously carried, to approve the plat of Church Bay Beach, to be located in Section 22-137-42. Hearing Merle Hough Construction Hearing Robert Esster Sewage Disposal Installers License County Board -4 -September 11, 1985 Pursuant to notice thereof, a hearing was held at 1:30 p.rn., for the purpose of considering revocation of a sewage system installer's license issued to Merle Hough dba Merle Hough Construction. After listening to the various interested parties, rnotioo was made by Mel o. Olson, seconded by Sydney Nelson and.urianirrously carried, to place Hough on a probationary period until relicensing.in March of 1986. Pursuant to notice thereof, a hearing was held at 1: 30 p .rn. , for• the purpose of considering revocation <:>f a sewage system installer'.s license issued to Robert Esser. After consideration, rnotion was made by Sydney Nelson, seconded by Mel O. Olson and unanirrously carried, to revoke said license, due to irregularities. Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani- mously carried, to approve the application of Joseph J. Esser, dba Esser Plumbing & Heating, for a sewage disposal in~tallers license. Water Resources .M:)tion was made by ·sydney Nelson, seconded by Melo. Olson and unani- Board, A. Lindquist rnously carried, to submit the narre of P.ndy Lindquist for nomination to the Water Resources Board local Advisory Committee.
