Chainnan Nordgren called the rreeting to order at 9: 31 a.m •• Motion was made by Bert Hovland, seconded by Sydney Nelson and unanirrously carried, to grant extension of leave of absence for sick leave from March 20, 1976, to November 21, 1976, for Orris Widness, Highway Department, for PERA purposes, with no other obligation on the part of the County. David Barton of the Viking Library System appeared before the Board, presenting literature and brochures on the books and information available through the Viking Library System , and also presented the library's re- quest for funding for the year 1986 in the arrount of $121,358. Mr. Barton was asked to return to his Board of Directors for the purpose of exploring the possibility of reduction of funding request by 5%. Eugene Gaustad, courthouse custodian, appeared before the Board relative to certain recamrendations by the recent boiler inspection and what action had taken place on said recomrrendations. Pursuant to published notice thereof, at 10: 30 a.m., Chairman Nordgren de- clared the hearing open for the purpose of hearing testllIIOny from persons concerned with the question of establishing a service area or areas within the County for solid waste management services. Introductory remarks were made by Mike Kirk, County Attorney, with f'-'lalcolm Lee and Tim Brand speaking. Public input was received from Duane Donley, Dead Lake Tov.mship, Richard Jensen, City of Pelican Rapids, Ray Haugrud, Norwegian Grove 'Ibwn- ship and Del Porter, Dane Prairie 'Ibwnship. With no further discussion, .Chai:rman Nordgren declared the hearing closed at 11:10 a.m •• The Dane Prairie Town Board, w'ith Calvin Johansen spokesman, appeared be- fore t.~e Board with a request to re-negottate the agreement between Otter Tail County and Dane Prairie 'Ibwnship on the transfer of roads between the township and Otter Tail County and maintenance of the turn back road to the tavnship. Johansen stated the township had expended funds for replacement of culverts on road in question on Otter Tail County Ditch #18, and cost of grading was considerably rrore than had been anticipated • .IYbtion was made by Andy Lindquist, seoonded by Mel o. Olson and unanirrously carried, to authorize the township to submit bills to the County for consideration and review on the replacerrent of culverts, with assessment back to the owners of property on Cmmty Ditch #18, and also to pay one-half of the cost of grading, up to $1,250.00 per year until the road is tarred.· U.S. FISH &·WILDLIFE · Upon motion made by Bert Hovland, seconded by Andy Lindquist and carried, EASEMENT with Sydney_Nelson voting "no", the follo.ving resolution was adopted: RESOLVED by the Board of County Commissioners of Otter TailCounty Minnesota, that: ~JHEREAS, in· accordance with a procedural agrEl!lrel1t between the Minnesota De- partrren.t 6f Natural Resources and the U.S. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the u. s. Fish and Wildlife Service is requested, and WHEREAS, representatives of the u .. s. Fish and Wildlife Service rret with the County Board on August 12, 1985 and infonred said Board that a waterfowl easerrent had been secured from Mr. and Mrs. Richard L. Pemberton, et al, on G.L. 3, ex. E 80 rods thereof, G.L. 4 & 5, and fracl. SW¼ lying east and north of Interstate Highway #94, in Section 6-133-43, NO\T, THEREFOPE, BE IT RESOLVED, the aforerrentioned acquisition by the U. s. Motion was made by Bert Hovland, seconded by Sydney Nelson and unanirrously carried, to approve the minutes of the August 2nd and 9th meetings, as mailed. Upon motion made by Andy Lincquist, seconded by Bert Hovland and unanirrously carried, the following resolution was adopted: P-ESOLVED BY the Board of County Commissioners of Otter Tail County Minne-_ sota, that WHEREAS,.Marvin & Mary Nyberg, owners of record of the following described properties: Triangular tract 358.6' x 375' x 555' in G~L. 3 to rear of 3rd Add'n to Sunnyside, Section 1-132-39 Part of G.L. 3, Triangular tract adjacent to Lot 2, Sunnyside I 1st Add'n, Section 1 -132 -39 Said property having forfeited to the State of Minnesota for non-payrrent of the 1975 and 1974 taxes, respectively, and having paid the aggregate sum of all delinquent taxes, assessments, penalties, costs and interest in the arrount of $663.17, NOW THEREFORE, the County Board of Otter Tail County does hereby approve said repurchase, to be in the best public interest and relieve undue hardship. Motion was made by Bert Hovland, seconded by Andy Lindquist and carried with Hub Nordgren voting "no", to uphold the decision of the Otter Tail County Planning Corrmission and deny the application of Anthony Ludovissie for pe:rmission to construct a boat ramp on the S 75' of N 755' of lot 2, Section 23, Rush Lake 'Ibwnship. Motion was made by Bert Hovland, seconded by Mel O. Olson and unanirrously carried, to accept the recomrrendation of the Otter Tail County Planning Corrmission and deny the request from Karl Hanson, Jr., to fill low area behind ice ridge on Lot 2, Sherbrooke Estates, Lida 'Ibwnship. Motion was made by Bert Hovland, seconded by Mel O. Olson and unanirrously carried, to accept a petition from the Lake Lizzie Association to have Lake Lizzie placed on the priority list for inspection of sewage systems. Motion was made by Andy Lindquist, seconded by Mel O. Olson and unani- rrously carried, to accept the reoomnendation of the Otter Tail County Planning Cammission that a tennination date of 9-1-85 be placed on the oonditional use pennit of William True, dated August 25, 1980, due to change in ordinance that no longer allows for open ended pennits. The matter of acceptance of bids received for the transfer stations opened August 2nd was brought up for consideration. l'btion was made by Andy Lindquist, seconded by Mel O. Joe Witwicke appeared before the Board speaking against the conditional use pennit that had been approved for Cynthia Skalsky in Everts To.vnship. Motion was made by Bert Hovland, seconded by Andy Lindquist and unani- rrously carried, to advertise for bids to be received until 2: 30 p.rn., Friday, September 6, 1985, for serni.,-trailers .. Members of the Becker County Board of Comnissioners appeared Before the Board along with the Becker County Solid Waste officer relative to Becker County's participation and/or acceptance of the solid waste agree-· ment. No fonnal action taken. lbuglas Ackling, Perham, appeared before the Board together with Mary Lu Est lick of Auturm Agency, Inc. , Perham with a proposal for the sale of · the Ackling Building in Perham, now being occupied by several Otter Tail County offices, for a total list price of $270,000, incil'Uding furniture and accessories in the court room and judge's chamber. Chainnan Nordgren appointed Sydney Nelson, Mel o. Olson, Eugene Davenport and Mike Kirk to a corrmittee to explore the matter and make recorrmendations to the Board Upon notion made by Andy Lindquist, seconded by Bert Hovland and unanirrously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minneso- ta, that WHEREAS, on July 10, 1984, the County Board accepted the bid of Stromseth Construction, Watertown, SE in the arrount of $261,252.35 for grading and aggregate surfacing on C.R. #124 between CSAH #33 and CSAH #35, and WHERE'l\S, the above contract has now been completed to the satisfaction of the county board at a total oost of $272,006.57, an increase of $10,754.22 due to overruns on aggregate surfacing and equiprrent rental hours, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby authorize and direct the County Auditor to issue a warrant in the arrount of $13,600.33 payable to Stromseth Construction as final payment for this '1,,,'.0rk.
