BOARD OF COUNTY COMMISSIONERS
OI'TER TAIL COUNTY MINNESOTA
Pursuant to adjotirnment, the Board of County Corrmissioners of otter
Tail County.Minnesota met Wednesday, July 10, 1985, with all members present. Chair-
rran Nordgren opened the meeting at 9: 37 a .m ••
Pursuant to published notice thereof, a hearing was conducted for the
purpose of considering anendments to the county's Food and Beverag-.e ·Esuwl!is~nt ·-Or-
dinance and the County Lodging Establishrrents Ordinance. After listening to the
various interested parties, Chairman Nordgren declared the hearing closed.
Motion was made by Bert Hovland to adopt the ordinance regulations as
presented, with corrections being made on fee schedule and definitions at a later date.
The motion was seconded by Andy Lindquist and the following amendments=s were adopted,
effective January 1, 1986:
Food and Beverage Establishments Ordinance
B. water Supplies: Every food and beverage service establishment shall
obtain a safe, adequate supply of water fran a public comnunity water supply system,
a public non-corrrrnunity water supply system, or a source, of supply and system which is
located, constructed and operated in accordance with the provisions of the rules of the
commissio;er governing public water and wells (7 M:AR. ~ 1.210. -H.223). If the water
source is private, the water shall be tested for colifonn bacteria:1 and nitrate nitro-
gen by the Health Department as needed, but not less than once every two years.

II. Definitions
G. RESORI': Shall rrean any building, structure, or enclosure, or any part
thereof, located on, or on prope:rty neighboring, any lake, stream, or skiiing or hunting
area for purpose of providing convenient accessthereto, kept, used, maintained, or ad-
vertised as, or held out to the public to be an enclosure where sleeping accomrrodations
are furnished to the public, and primarily to those seeking recreation, for period of
one day, one week, or longer, and have for rent two or more cottages, rooms, or enclosures.
J. Water Supply. A safe adequte supply of water shall be provided. The water
supply system shall be rocated, constructed and operated in accordance with the rules of
the Board. After January 1, 1984, the temprature of hot water which is provided in any
public area or guest room, including, but not limited to, lavatories, bath tubs or show-
o 0 ers shall not exceed 130 F. (approx. 55 C.). If the source of water supply is a private

source, the water shall be tested for colifonn bacteria and nitrate nitrogen by the
Heal th Departnent as needed, but not less than once every two years.
Motion was made by Hub 'tbrdgren, seconded by Sydney Nelson and unani-
mously carried, to pay $15.00 per beaver, for beaver control, subject to approval by
the MN Deparbrent of Natural Resources and the townships, with collection of tails
and pa.yirent being made by the t<J\mShips, reimbursed by the county.
County Engineer Berend infonred the Board a three way stop has been
requested at the intersection of CSAH #1, #35 and #74 in Arror Township. No action
taken.
Motion was made by Sydney Nelson, seconded by Mel O. Olson·and unani-
mously carried, to instruct the County Auditor to set up a Solid Waste Fund with a
transfer of $350,000 out of the County Revenue Fund.
Motion was made by Andy Lindquist, seconded by Bert Hovland and unani-
mously carried, to add a portion of highway north of Battle lake to existing sand-seal
contract.
Motion was made by Andy Lindquist, seconded by ~l O. Olson and unani-
mously carried, to approve an addition to the sand-seal overlay contract at River Oaks
Addition in Fergus Falls Township and Buse Township, subject to township approval.
A suggested application for variance to allow right-of-way encroachnent
for advertising signs was presented to the Board by Engineer Berend. Motion was made
by Bert Hovland to hold up on sign placements on road right-of-way violations until
a decision is made on how to handle variance requests. The notion was seconded by
Sydney Nelson and unanirrously carried.
Motion was made by Mel O. Olson, seoonded by Bert Hovland and· unani-
mously carried, to approve placement of no parking signs along CSAH #115 during the
Airfest in August, 1985.
Gordon Hydukovich, City Planner, 1 Fergus Falls, appeared before the .
Board relative to the county Economic Developrrent Program, stating the cost to the
county for updating the EDA progITam would be $6,000. No action taken.

Ron Henderson and Dave Ewert appeared bef?re the Board requesting a
clean out of portions of County Ditch #11 in.Tordenskjold. Motion was made by Andy
Lindquist~ seconded by Bert Hovland and una.r{i.mJusly carried, to proceed with the
necessary errergency clean-out on said ditch.
Motion was made by iv.el O. oison, seoonded-by Andy. Ll.ndquist and unani-
mously carried, to approve a Tower Space I.ease with Charles Grunewald on the radio
' tCMer located near the otter Tail Lake Nursing Home in AIIDr Township, and the Chainnan
ofthe Board and the County Auditor were authorized to s~gn said agreement on behalf of
otter Tail County.
Motion was made by Sydney Nelson, seoonded by Melo. Olson and unanirrously
carried, to approve the minutes of the meeting of July 1st.
Motion was rrade by Mel O. Olson, seconded by Andy Lindquist and unani-
mously carried to change the date for opening of bids on the sale of the house located
at the comer of Mill and Junius in the City of Fergus Falls, to 2: 00 p.rn. , Monday,
August 12, 1985.

mously carried, to approve the following applications for sewage disposal installers
license, subject to posting of bond:

Maloolm Lee discussed with the Board the,various classifications for
assessments for garbage disposal, with tentative classifications being proposed as
horrestead, non-horrestead, seasonal & recreational, cornrrercial, cluster, manufacturing,
and non-profit or govenurent.
Larry Ibm, financial consultant, appeared before the Board and reported
on progress of the bond issue for the jail facility.
George Klein and Pichard Mccarthy, of Geo. Klein & Co., appeared before
the Board reporting.on the progress of the design documents for the jail facility,
stating said documents will be ready for bids in mid-August.
Motion was made by Andy Lindquist, seconded by Mel O. Olson and canried,

as oonstruction manager for the jail facility construction.
C-iene Fahey and Pam Swenson of the otter Tail County Hurrane Society appeared
before the Board relative to their request for additional funds for the Society. :r-'btion
was made by Mel O. Olson, seconded by Bert Hovland and unaninously carried, to grant
funds in the anount of $7,498.68 for operation of the Society through December, 1985.
Upon notion made by Bert Hovland, seconded by Sydney Nelson and unani-

carried, to approve payrrent in the amount of $1,370.00 to Burghardt Amateur Center,

Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani-
rrously carried, to authorize Control Data Business Advisors, Inc., Minneapolis, .MN,
for the Comparable Worth Study for otter Tail County.
With no further business, at 4:00 p.rn., Chai:rman Nordgren declared the
rreeting adjourned until the afternoon of July 23rd.
