OF THE
BOARD OF COUNTY COMMISSIONERS
OITER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of
otter Tail County Minnesota met Tuesday, February.19, 1985, with AndyLlndquist,
f'Jlel 0. Olson and Sydney G. Nelson present. Vice Chairman Olson called the meeting
to order at 12:32 p.m.
Motion was made by Sydney Nelson, seconded by Andy Lindquist and
lIDal1imdl,lSlY, carried, :-;to-, approve. the minutes. ,of 11:.he February 1st rmetiing as mailed.
Motion was rrade by Andy Lindquist, second~d by Sydney Nelson and
unanim:>usly carried, to approve payrrent in the amount of $4,800 to the otter Tail
County Humane Society, to be increased at a later time if proposed legislation is
passed.
Motion was made by Andy Lindquist, seconded by Sydney Nelson and unani-
nously carried, to .authorize the County Attorney to sul:mit a claim to the Johns-Manville
Corporation in the bankruptcy for costs incurred as a result of the use of asbestos in
the county buildings.
Motion was made by Sydney Netson, seconded by Andy Lindquist and unani-
nously carried, accepting the letter from Attorney Randolph E. Stefanson on notice
of claim by John Landberg and the county auditor was instructed to forward said letter
on to the county's insurance carrier.
Motion was made by Andy Lindquist, seconded by Sydney Nelson and unani-
nously carried, to deny the request of Mid-central Federal Savings & Loan Ass'n for
forgiveness of penalty on late payment of tax,, Alois Walz in Newton. Township •

nously carried, to forgive penalty and interest on· :l\ate payrrent of tax on the Elrrer
& Ruby Neuleib property in Ward 2, City of Fergus Falls.because of confus:j.on in
nailing statements due to disability classification where the prcperty was split and
only one statement received.

Motion was made by Andy Lindquist, S(:;!conded by Sydney Nelson and un~i-
mously carried, to grant forgiveness of penalty on late payment ·of tax by Rodney & Ag-
nes Jorgenson· in Ward 2, Fergus Falls, where the_ property was split due to disability
classification and only one statement receiVed and paid.
Ivlotion was made by Andy Lindquist, seconded by Sydney Nelson and unani-
mously carried, to grant forgiveness of penalty on late payment of tax on Randall Nel-
·soh property in the City of Unde:twood where an attempt was.made to.pay the tax, being
told a statenent would be mailed, staterrent mailed three different ti.Ires to the wrong ·
Nelson.

Motion was made by Melo. Olson, seconded by Andy Lind:]uist and unani-
mously carried, to grant forgiveness of penalty on late payment of tax by Citicorp
Horreowners Services, Inc. on two parcels m the City of Fergus Falls and .one in the
City of Perham were mailed into the Treasurer's office and refunded, with taxes due
and owing.

M:>tion was made by Melo. Olson, seconded by Sydney Nelson and unani-
mously carried,-to deny forgiveness of penalty on late payment of tax by Western
Minnesota Savings & Loan on the Neil Shirreff property in Buse Township.
Motion was made by Andy Lindquist, secooded by Mel O. Olson and mani-
mously carr_ied, to grant forgiveness of penalty_ on late payment of tax by Orrin
Christianson on property in the City of Underwood, where an attempt was made by
Christianson to pay the tax and was told there was no tax owing.due to a mix-up in
description ownership.
Kenneth Becker,· East otter Tail Countx Agricultural Inspector, appeared
before the Board and presented his report of activities fo~ the year 1984. Motion
was made by Sydney Nelson, seconded by Andy Lindquist and unanimously carried, to
accept said re]?'.)rt and authorized the·Chairman of the·Board to sign same on behalf
of the County.
The County Board discussed various changes to the commissioners room
including proper recording equiprrent for the purpose of taping the county board rreetings
and also the use of a p'.)dium for persons to use wt:ii~e addressing the board. Items
to be checked into.
Upon motion-made by Sydney_ Nels~n,. seconded by Andy Lindquist and
unani.rrously carried, the following resolution wa~ adopted:
RESOLVED by :the Board of.-County 'Cormri.ssioners of otter Tail County
Minnesota, that
WHEREAS, in accordance with a procedural agreement between the
Minnesota Departrrent of Natural Resourcep and the u. s. Fish and Wildlife Service,
dated May 23, 1962, certification by the County Board of Commissioners for aa:i:ui-
sition of lands by the u. s. Fish and Wildlife Service is requested, and
WHEREAS, representatives of the U.S. Fish and Wildlife Service
rret with the County Board on Februa:ry 19th, 1985 and inf9rrred said Board that
a waterfowl easerrent had been secured fran Mr. and Mrs. Orland W. Ohe on the SE¼
NE¼, N½NE¼SE¼, and the east 2 rods of the S½NE¼SE¼ of Section 13-135-:-44,
NOW, THEREFORE BE IT RESOLVED, the County Boa.rd does hereby
approve said ao:i:uisition by the U.S. Fish & Wildlife Service.

Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani-
mously carried, ·to approve the application of Doriald G. Blank for pennit to sell
non-into~cating malt liquor at Hidden Acres Resort in Candor Township, subject to
approval by the County Sheriff.
Motion was made by Sydney Nelson, seconded by Andy Lindquist and unani-
rnously carried, to deny the request of Ed Bilden Livestock for exemption fran the
weight restrictions on roads.
· A letter addressed to the County Board from the United States Depart-
ment of the Interior relative to ditch assessments -was, upon notion made by Sydney
Nelson, seconded by Andy Lindquist and unanimously carried, referred to the Joint
otter Tail-Wiilikin County Ditch #2 Committee.
Motion.was made by Sydney Nelson, seconded by Mel O. Olson and unani-
mously carried, to appoint Andy Lindquist as otter Tail Cotmty's .representative on
the otter Tail-Wilkin County Ditch #2 Committee.
Elrrer Spranger of Fergus Falls TONil~hip.appearedbefore the Board re-
garding the annexed I)Ortion of the City of Fergus Falls which is to be reverted back
to Fergus Falls Township, questioning the validity of the taxes inposed during the
tirre of the order of annexation. No action taken.
Larry Krohn · info:med the Board How~d Koeppen, -head custodian, is
hospitalized and the tenn of hospitalization and recuperation could be for a period
of up to six months. . _ Motion was made by Sydney Nelson, seconded by Andy Lindquist
and unaninously carried, to hire a temporary full time individual to fill the posi-
tion temporarily vacated by Koeppen.
Motion was made by Mel Olson, seconded by Andy Lindquist and unani-
mously carried, to deny a request from First Bank System Mortgage for forgiveness of
penalty on the payment of delinquent tax on the Gary Boettger property in Ward.t,
City of Fergus Falls.
Will Stephan of the Wetlands Division of the U.S. Depart:rrent of the
Interior appeared before the Board and presented a check in the amount of $54,229
.representing payrrent in lieu of taxes on wetland acres in otter Tail County.
County Board February 19, 1985
Representatives of the City of Perham, Otter Tail Power Company
and the Solid Waste ~agerrent Corrmittee appeared before the ~rd for t:he putpose
of discussion on the agreement between the subsidiary company of Otter--Tail Power
Company ·and Otter Tail County for the construction and maintenance of a refuse
burner to be constructed in the ~ity of Perham. After listening to the various
interested parties' the follavving resolution was intreduced by Syfuey Ne-lson -who
rroved for its adoption. The notion was seconded by Andy Lindquist and carried
with Andy Lindquist, Mel O. Olson,~land Sydney Nelson voting "yes'', no "no" votes,
A. Hubert Nordgren and Berton Hovland being absent.

RESOLUTION
Upon motion made by Sydney Nelson, seconded by Andy Lindquist, and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County,
Minnesota, that
WHEREAS, a subsidiary corporation of Otter Tail Power Company will own
and operate a solid waste incinerator within the Industrial Park in the City
of Perham, Minnesota (hereinafter the "Facility"); and
WHEREAS, the State Legislature of the State _of Minnesota has authorized
and mandated counties to provide for the necessary services of collection and
disposal of solid waste generated by the inhabitants of the County, but that
the various landfill sites located in the County are becoming filled and
consequently the County is in need of an alternative method of disposing of a
portion of its solid waste; and
WHEREAS, it is in the best interest of the County and the Otter Tail
Power subsidiary to cooperate with each other in the construction of a
new facility to incinerate County's solid waste and to"produce heat in the
form of steam for the use and benefit of at least two commercial enterprises
within the City of Perham; and
WHEREAS, the County has determined that use of the Facility will reduce
the volume of solid waste produced in the County and surrounding counties that
is presently disposed of in landfills and will result in the recovery of energy
that otherwise is wasted; and
WHEREAS, pursuant to Minnesota Statutes 400.04, Subd. 3, the County finds
that the Facility will be adequate, available for use and competitive with other
means of providing solid waste services; and
WHEREAS, it is in the best interests of the County and the Otter Tail Power
subsidiary to assure a continuous solid waste stream if the Facility is to operate
effectively; and
WHEREAS, the County will undertake to execute agreements with other
counties to obtain such additional solid waste as may be necessary to meet
the needs of the Facility,
NOW, THEREFORE, BE IT RESOLVED that the County enter into a contract
for solid waste incineration at Perham, Minnesota with a subsidiary of
Otter Tail Power Company.following its proper incorporation and capitalization;
and the Vice Chairman is hereby authorized to execute said contract upon approval
by the Otter Tail County Attorney of the incorporation and capitalization of
this subsidiary.
