HomeMy WebLinkAboutBoard of Commissioners - Minutes - 01/03/1984MINUTES OF THE REGULAR MEETING OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS January 3, 1984 Pursuant to Statute, the Otter Tail County Board of Commissioners met Tuesday, January 3, 1984, with Andy Leitch, Sydney Nelson, Hub Nordgren, Bert Hovland and Van Ellig present. County Auditor Sylvia Bergerud opened the meeting at 9:45 and declared the first order of business to be the election of Chairman and Vice Chairman for the year 1984. Upon motion made by Hub Nordgren, seconded by Andy Leitch and carried, Sydney Nelson was selected Chairman. Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, Van Ellig was selected Vice-Chairman. Auditor Bergerud was instructed to correct the minutes of the December 8, 1983 meeting as it pertained to the resolution regarding the County Commissioners' compensation for 1984, to read" ... shall be set at the same as last year, $11,806.92'; ... Statues 282.05 for the apportionment of the proceeds from the sale of tax-forfeited lands; WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing districts pursuant to Minn. Stat. 282.08, and WHEREAS, Minn. Stat. 282.08(4)(b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the prciperty have been paid, for ac- quisition and maintenance of county parks and recreational areas, and WHEREAS, Otter Tail County has parks and recreati6na1·1areas which would benefit by such an apportionment, NOW, THEREFORE, BE IT RESOLVED, that' the County Auditor retain 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds available after making the neces- sary statutory disbursements, said proceeds to be disbursed according to law. ATTEST: Clerk Upon motion made by Bert Hovland , seconded by -------------- ___ H_u_b_N_o_r_·d~g_r_e_n ________ and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The sum of thirty cents (30¢) be paid out of the Revenue Fund of the County for every pocket gopher killed in said county during the year 1984 in cases where the townships in which pocket gophers were so killed shall provide for the payment of an additional bounty of thirty cents (30¢) each pocket gopher so killed. for RESOLVED further that said payment of such bounty shall be.,made by the County Auditor upon certificates executed by the Chairman of the Towri Boafd of said townships setting ~orth that the pocket gophers were duly presented to the Chairman of such Board and that the townships had issued and delivered to each claimant a town order for sixty cents (60¢) gopher so killed. for each pocket Adopted at Fergus Falls, MN this 3rd day of January, 1984. ATTEST: 4.,.vf;kr ~ Clerk Upon motton made by Van Ellig, seconded by Hub Notdgren and carried, the followtng resolution was adopted: RESOLUTION RESOLUTION IN OPPOSITION TO THE RE.LOCATION OF DISTRICT 4 MN/DOT OFFICE IN DETRO•IT LAKES AND REDUCTION OF STATE AID DISTRICTS WHEREAS, consideration is being given to the reduction in the number of -·.· ,,, Minnesota Department of Transportation districts, and WHEREAS, District 4 is one of the districts which appears to be actively affected by the reduction, and WHEREAS, because of the reduction, consideration is being given to the elimination of the District 4 office (headquarters) located in Detroit Lakes, Minnesota, and WHEREAS, the restructuring of the Mn/DOT district boundaries would affect the rural county representation on the Screening Committee and in other areas regarding the County State Aid Rules and Regulations, NOW THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners are opposed to any major reduction or relocation of staff of the District 4 Mn/DOT office. BE IT FURTHER RESOLVED, that Detroit Lakes, Minnesota be the office (headquarters) site of any adjusted district boundaries. BE IT FURTHER RESOLVED, that because of any restructuring in Mn/DOT that the representation of the rural counties on:the _Screening Committee not be reduced or within the County State Aid Rules and Regulations. NOW, THEREFORE, BE IT RESOLVE}), that no person shall operate any vehicle or combination of ve_hicles upon any restri_cted county roa_d or highway in the County Qf Otte.r Tail and State of Minnesota, generally described as follows; Otter Tail County State Aid Highways and Ott:er Tail County Roads, where the gross weight on any single axle, as defined in Minne$ota Statutes 1945, Sec, 169.87, $ub-diyision 1, ex~e~ds five tons (lOJOOO pounds) and the County Highway Engineer of said County is hereby · directed and authorized to determined the need and to erect and main- tain appropriate signs plainly indicating the prohibitions and re.., stric:t:i;ons at each end of that portion_ Q~ any highway affected thereby, aqd these rest~ictions shall be effective an~ this prohibition effective upon the erection and maintenance, o~ th.e appropriate signs. ATTEST: • Upon motion made by Bert Hovland, seconded by Van Ellig and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota,that WHEREAS, it is the opinion of this Board that costs for the Otter Tail County Court Public Defender could greatly be reduced by '.offering the position through the bidding process, NOW', THEREFORE, BE IT RESOLVED, the Court Judges be urged to consider the possibility of bidding out the position of Coonty Court Public Defender to qualified licensed attorneys. Applications were presented to the County Board by representatives of the U. S. Fish and Wildlife Service for acquisition of waterfowl easements on the following properties: Mr. & Mrs. Louis B. Berndt, S½ of Lot 2, Section 7-136-43 Mr. & Mrs. Richard J. Berndt, et al, on SE¼SW¼ Section 7, and Lots l & 2, E½NW¼ of Section 18, all in 136-43 Mr. and Mrs. John H. Boen, SE¼NE¼, N½NE¼SE¼ of Section 28-136-44 Motion was made by Bert Hovland to approve said easements. The motion was seconded by Andy Leitch but failed with Van Ellig, Hub Nordgren and Sydney Nelson voting "no". Motion was made by Bert Hovland, seconded by Andy Leitch and carried, to approve corrections to the plat of Ridgewood Estates, 32-133-42, as certified by Kermit Bjorgum, Registered Land Surveyor. Judge Gray, Judge Nelson and Clerk of Court Ken Rudd appeared before the Board and discussed the unification of the courts and its effett on Otter Tail County court operations, and also the County Court Public Defender. With no further business, at 2:30 p.m., the Chairman of the Board adjourned the meeting until 9:30 a.m., Hednesday, January 4, 1984. -WEDNESDAY'S SESSION - Pursuant to adjoutnment, the Board of County Commissioners of Otter Tail County Mfnnesota met Wednesday, January 4, 1984, with all members present. Chairman Nelson opened the meetfng at 9:47 a.m .. Glen Melby, County Sheriff, appeared before the Board and requested · additional compensation for the Bailiffs. Motion was made by Van Ellig, seconded by Bert Hovland and carried, to increase the Bailiff fee to $25.00 per diem. Sheriff Melby requested permission to carry over the unused balance or $23,618.02 from 1983 capital outlay budget and increase the 1984 budget by· same, unused balance due to two cars not having been purchased as budgeted for tn 1983. Motion was made by Andy Leitch to allow the transfer from 1983 to 1984. The motion was seconded by Sydney Nelson but failed wtth Hub Nordgren, Van Ellig and Bert Hov- land voting "no". Motion was made by Bert Hovland to pay for the new car recently pur- chased for the sheriff's department out of the 1983 budget allowance. The motion was seconded by Sydney Nelson and carried with Hub Nordgren voting "no". The County Board interviewed three candidates presented to the Board by the District Dtrector of the Department of Agriculture for the position of West Otter Tai'l County Agricultural Inspector, Clayton Bowman, Rothsay, MN, Gene Wells, Fergus Falls, MN, and Mark Bowers, Ashby, MN. After individual interviews with the candidates and upon a ballot vote, Mark Bowers, Ashby, MN was selected as the West Otter Tail County Agricultural Inspector. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to grant aid in the amount of $500.00 to the Township of Paddock for assistance in road construction in Sections 27, 28,30 and 31. Motion was made by Van Ellig to rescind the denial of the water- fowl easements considered January 3rd on property in Norwegian Grove and Pelican Townships. The motion was seconded by Bert Hovland and carried with Sydney Nelson voting "no". Upon motion made by Van Ellig, seconded by Bert Hovland and carrted I wi_th Hub Nordgren and Sydney Nelson votfng "no", the following resolution was adopted: RESOLVED by the Board of County Commissi-0ners of Otter Tatl County Mi.nnesota, that WHEREAS, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U.S. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acqui,.. sion of lands by the U.S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U.S. Fish and Wildlife Service met with the County Board on January 3, 1984 and informed said Board that waterfowl easements had been secured 6nJth~ following properties: Mr. and Mrs. Louis B. Treasurer Andrews reported an error in the collection of tax in the T6wnship of Lida resulttng from a split in property and the wrong tax collected. After discussion. motion was made by Van Ellig. seconded by Bert Hovland and carried. authorizing a warrant in the amount of $134.12 to be paid out of the County Revenue Fund to credit the proper·account, #37-000-29-0107-013. MN. for the second publication of the County's Financial Statement, at legal rates. and Patt~ Printers, New York Mills, MN. for the publtcation of the Delinquent Tax List for the Year 1983; at legal rates. and appoint the HENNING ADVOCATE to publish the first publication of the County's Financial Statement. Motion was made by Van Ellig. seconded by Andy Leitch and carried. to acknowledge receipt of a letter from the Office of the State Auditor regarding the audit for the year 1983. and the Chairman of the Board was authorized to sign said letter on behalf of the County Board. Motion was made by Andy Leitch. seconded by Bert Hovland and carried 1983 base with Van Ell ig voting "no". to increase the/salary of the County Recorder to the base salary of the County Treasurer at $25,577.00. Motion was made by Van Ellig to move the salary of the Land & Resource Manager up to 88% of the average salary of the top 11 counties tabulated. The mo- tion died for lack of a second. County Board January 4, 1984 M~tion was made by Bert Hovland to bring County Coordinator Larry Krohn's salary up to a 1983 base of $25,828, with additional adjustments to be made in the next couple years. The motion was seconded by Van Ellig and carried with Andy Leitch and Sydney Nelson voting "no". Motion was made by Van Ellig to increase the County Assessor Gene Daven- port's base 1983 salary to 90% of the average salary of the top· eleven counties, and increase Zoning Administrator Malcolm Lee's salary to 86% of the average salary of the top eleven counties polled. The motion was seconded by Bert Hovland and carried with Andy Leitch and Hub Nordgren voting "no", because in previous discussion the zoning administrator's salary had been considered and no change made. Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried with Van Ellig and Andy Leitch voting "no", objections to the County Court Public Defender budget and the Data Processing Department budget, respectively; the following budgets were approved for the various departments: Assessor Attorney Auditor Board of Adjustment Boat & Water Safety Civil Defense Clerk of District Court Coroner County Board County Coordinator County Court County Court Public Defender County Health Officer Courthouse Data Processing Dist.
