HomeMy WebLinkAboutBoard of Commissioners - Minutes - 03/22/1983I MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met Tuesday, March 22, 1983 with Van Ellig absent. Chairman Hovland called the meeting to order at 12:45.p.m .. Motion was made by Hub Nordgren to authorize payments in the amount of 5½% of gross salary to a qualified deferred compensation plan for the benefit of elected officials who are not included in the Public Employees Retirement Asso- ciation. The motion failed for lack of a second. Easement acquisitions by the U. S. Fish and Wildlife Service scheduled to be considered were re-scheduled until April 6th. A request from the Town Board of Elmo Township was presented to the Board, calling for the county take-over of a township road that joins county road #134 with county road #40 and #136. Motion was made by Hub Nordgren to accept said petition and the County Auditor was instructed to file safue. The motion was seconded By Sydney Nelson and carried. Motion was made by Andy Leitch to purchase the property in the City of Dalton that the County has been using for stock-piling, etc., at a purchase price of $14,500.00. The motion failed for lack,of a second. Motion was then .. made by Hub Nordgren, seconded by Sydney Nelson and carried with Andy Leitch voting "no", to o;fifer· $Vi'~'000 as ·the purchase price for sa~d property. Motion was made by Sydney Nelson, seconded by Hub Nordgren and car- ried, to approve payment to the Rufer, Hefte, Pemberton, Schulze, Sorlie, Sefkow & Kershner Law Firm, Fergus Falls, in·the amoun! of $1,707 for legal fees and con- sultations relative to the Westrtdge Mall vs Otter Tail County tax dispute. In response to a request from the City of Pelican Rapids for assis- tanc~ by the County Attorney's Office for prosecution of criminal complaints ori- ginati'ng i'n the City of Pelican Rapids, motion was made by Hub Nordgren, seconded by Sydney Nelson and carried, to table action until legislation is enacted to clarify. Richardson for permit for on sale wine license at the Red Hut Restaurant in Sverdrup Township was approved. Meyer, Meyer Garbage Service, P_erham, Minnesota, for solid waste collection and transportation license. Jack Barner and Bill Sitve~berg appeared before the Board and presented petitions from various property owners on Oakwood Beach and Eldorado Beach requesting to be excluded from the Otter Tail Lake Area Sewer District. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to accept said peti- tions and the County Auditor was instructed to file same. Motion was made by Andy Leitch, seconded by Hub Nordgren and carrieq, to deny the request for exclusion from the district because the petitioners are fully protected as,lspelled out in a paragraph of a letter received from the U.S. Environmental Protection Agency, Dated February 4, 1983, under sig~ature of Gene Wojcik, Chief, Unit I, EI Section: "Homeowners who do not wish to accept Federal Funds would not be required to parti- cipate in the maintenance district. They would then assume complete responsibility for assuring that their on-site system meets the requirements of the Sanitation Code of Otter Tail County. The Department of Land and Resources Management through the authority granted in the Otter Tail County Shoreland Management Ordinance and Min- nesota Senat~vBill 771 would continue to permit and ~nspect these systems to guar- antee compliance. Any costs incurred to comply with the ordinance or correct a facility failure would be strictly borne by the homeowner only." I County Board March 22, 1983 Rollie Mann, Executive Secretary of the Otter Tail Lake Area Sewer District, appeared before the Board requesting the appointment of viewers for said District, and re-appointment of Ed Shimeta to the Board of Commissioners of said District. After discussion, motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to appoint Duane Ellis, Richville, MN, Clifford Ukkelberg, Battle Lake, MN and George Walter, Perham, MN, as viewers of the Otier TailLake Area Sewer District. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to table action on appointment of members of the sewer district board of commissioners until a firm word has been received on proposed legislation calling for election of said commissioners. Upon motion made by Andy Leitch, seconded by Hub Nordgren and carried, the following applications f~r reduction of assessed valuation were approved: James E. The motion was seconded by Sydney Nelson and carried with Bert Hovland voting "no". Motion was made by Andy Leitch, seconded by Hub Nordgren and· carried, to authorize payment upon delivery to the satisfa~tion of the county sheriff. I Upon motion made by Sydney Nelson, seconded by Hub Nordgren and carried with Andy Leitch voting 11 no 11 , ·the·:following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, Otter Tail County in conjunction with the City of Fergus Falls and t~e City of Breckenridge; MN~ contracted with the firm of Rieke Carroll Muller Associations, Inc., Hopkins, Minnesota, to do a solid waste s.tudy of Otter Tail County·, and the Ci'ty of Breckenridge, and WHEREAS, Reike Carroll Muller Associates, Inc., has now completed said solid waste management study, NOW, THEREFORE, BE IT RESOLVED, said study is hereby accepted and approved on behalf of Otter Tail County. Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, with Andy Leitch voting "no", to advertise for bids to be received until 2:30 p.m., Tuesday, April 19, 1983, for the purchase of a three cubic yard front end loader for use by the highway department.
