HomeMy WebLinkAboutBoard of Commissioners - Minutes - 10/19/1982MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL ·couNtY MINNESOTA Pursuant to adjournment, the Board of County Commissioners met at l2~BO.p.m.,· Tue~day, Octoberl 19,'1982, all members present. Howard Koeppen, Custodian, appeared before the Board relative to insulating the heating pipes on second floor and installing non-corrosive underground gas lines into the courthouse. M~~ Koeppen was instructed to obtain three quotations for the .. rnetessary insulation, and to proceed with the non-corrosive underground lines. Motion was made by Van Ellig, seconded by Sydney Nelson and carried, to approve payment in~the amount of $3,722.35 to K-V Associates, Inc., Falmouth, Massachusetts for the Peeper Beeper for use by Land & Resource Management. Motion was made by Bert Hovland, seconded by Hub Nordgren and carried, to approve the application of Esther Lee for license to sell non-intoxicating malt \ liquor at Wee Town, Friberg Township. Motion was made by Hub Nordgren, seconded by Sydney Nelson and_carried, to approve the application of Donald Hill, for on-sale liquor license at Oakwood Supper Club, Henning Township, subject to submitting the necessary bond. Structure Pl P-A Culverts on CSAH #75 tn the amount of $268,630.00, and WHEREAS satd contract has now been completed to the sattsfaction of the County Board at a total cost of $275,017.20, an increase of $6,387.20 due to overruns on Common Borrow, Hand.,.Placed Riprap, Seed Misture and Sodding, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the ~mount of $24,682.20 payable to Dieseth Specialty Company, Fergus Falls, MN in final payment thereof. ATTEST: Clerk,, Upon motion made by Sydney Nelson, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on March 10, ·, Q_8?, the Coun_ty Board accepted the bid of Kenneth Anderson, Henning, MN in the amount of $4,809.54 for mowing Area B, and WHEREAS, the above contr~ct ha~ now.beeh completed to the satis- faction of the County Board at a total cos:t of.$4,792.49, a decrease of $17.05 due to unsatisfactory work on CSAH #62, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $463.90 payable to Kenneth Anderson, Henriihg, MN as fi na 1 payment thereof. ATTEST: Clerk Upon motion made by Bert Hovland, seconded by Van Ellig and carried with Sydney Nelson and Hub Nordgren voting "no", the following resolution was adopted: RESOLVED by theBoard of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agreement between the ~inne- sota Department of Natural Resources and the U.S. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands rby the U.S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U.S. Fish and Wildlife Service met with the County Board on October 19, 1982 and informed said Board that a waterfowl easement had been secured from Mr. and Mrs. Ferdinand K. Bakken on the North 2 rods of SW¼NW¼, N½SE¼NW¼, SW¼NW¼SW¼, of Section 4, and Lot 2, except the south 20 acres, SW¼NE¼, N¼SE¼NE¼, SE¼NE¼SE¼ of Section 5, all in 136-43, NOW, THEREFORE, BE IT RESOLVED, the County Board has considered the above request and grants approval ~herepf. . . Chairl.14 w ATTEST_: ~l:kr[) Clerk • • Upon motion made by Bert Hovland, seconded by Sydney Nelson and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, there are 155 Deputy Registrars in the State of Minnesota, many of whom face a continuous and expanding problem of receiving bad/dishonored checkes; and WHEREAS, there is no provision in the law which assists Deputy Registrars to collect on these bad/dishonored checks; and WHEREAS, the person who issues the bad/dishonored check receives no reprimand and in fact often ts able to continue to drive their vehicle on Minne- sota Highways, even though they are not legally registered, NOW, lHEREFORE, BE IT RESOLVED, the County Board of Otter Tail urges passage of proposed legislation under M.S. 168.041, Subd. 3, to state substantially as follows:. Subd. 3(a) When any person is issued registration plates, tabs and/or Title Certificates for. am-tor ~e~icle 1where payment is made by a check or draft which is subsequently dishonored o~ returned for a~y reason, any registra~, deputy registrar or other authorfzea agent for the issua~ce of registration plates and certificates, may make application to the Court for its Order re- quirfng the registration plates and registration certificate of said motor vehicle to be surrendered to the Court. Upon surrender thereof, the Court shall issue a receipt thereof. The Deputy Registrar may apply for a refund of the dishonored or returned check or draft, after the Court has received the registration plates and/or registration certificate. The Commissioner of Public Safety shall pay for the requested refund to the Deputy Regfstrar and the person who issued said dishonored or returned check or draft shall pay an additional $10.00 feet to be split 30% to the County Court Fund and 70% to the County Sheriff Fund. Clerk The following resolution was introduced by Commissioner Ellig who moved for its adoption: RESOLVED by the Board of County Commis~idners of Otter Tail County Minnesota, that WHEREAS the business of tourism created over $32 million dollars of income in Otter Tail County in 1980, and WHEREAS, a substantial portion of this amount and real estate taxes are paid for by the residents of the State of North Dakota, and WHEREAS, the Otter Tail County Board recogniies the importance of the tourist industry in Otter Tail County and wishes to encourage its valued contribution to our local economy and those persons who are responsible for it; NOW, THEREFORE, BE IT RESOLVED, that the ~a~ority of the Otter Tail County Board by this Resolution wishes to recognize and clearly demonstrate their appreciation to those persons vacationing in and using Otter Tail County for their recreation needs, including those from North Dakota. Cl erk County Board October 19, 1982 Laura Youngsma, Data Processing Manager, appeared before the Board relative to the proposed one day seminar for users. After considerable discuss~on, motion was made by Bert Hovland to accept the'proposal of Scoggins and Associates, Athens GA, for a one day seminar, at a cost of $800.00, plus $450.00 travel expenses. The motion was seconded by Van Ell ig and was defeated with Hub Nordgren, Andy Leitch and Sydney Nelson voting "no". After additional discussion, motion was made by Van Ellig to 'hire the firm of ~cGladrey Hendrickson & Co., Fargo, ND to conduct a one day user seminar. The motion was seconded by Sydney Nelson and carried with Hub Nordgren voting "no". Representatives of the East .and West Otter Ta11 Soil & Water Con- servation Districts appeared before the Board"and presented the one year renewal contract for the proposed soil survey for Otter Tail County. Motion was made by Van Ellig, seconded by Bert Hovland and carried with Hub Nordgren and Andy Leitch voting "no", to extend the option for one year, at no cost to Otter Tail County for the extension. Representatives of the Alano Corporation appeared before the Board requesting tax exempt status on property located in the City of Fergus Falls. After discussion, motion was made by Van Ellig, seconded by Bert Hovland and car- ried, to approve a tax exempt status for said property for the 1982 assessment, payable l 983 .
