BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA

Pursuant to adjournment, the Board of County Commissioners of Otter
Tail County Minnesota met at 9:30 a.m., Tuesday, September 7, 1982, all members
present.
Representatives of the Otter Tail County Historical Society appeared
before the Board with a request for funds for the year 1983. After discussion,
motion was made by Van Ellig, seconded by Bert Hovland and carried, to appropriate
the sum of $28,060.00 for the Otter Tail County Historical Society.
Motion was made by Bert Hovland, seconqed by Van Ellig and carried,

indicating no objection to the burial of a sewage system by Margaret Johnson on
her property on Crystal Lida, Lida Township.
A hearing was h~ld·-~s per published notice on the proposed use of
Federal Revenue Sharing Funds under Entitlement Period #14. After discussion,
motion was made by Hub Nordgren, seconded by Bert Hovland and carried, to designate
$600,000 for use by the County Road & Bridge Fund, with the balance of $186,565
to County Revenue for Capital Expenditures.
The County Board, having previously advertised for bids for micro-
film equipment and processing of backlog records, proceeded to open bids which
were found to be as follows:

After consideration, motion was made by Van Ellig, seconded by Bert
Hovland and carried, to accept the bids received from 3M, Minneapolis, MN in the
amount of $12,545.24 and Alternative Micrographics, Spicer, MN, in the amount of
$61,650.63, upon the recommendation of the County Recorder, Helen Skramsted.
The Directors of the West Otter Tail Soil Conservation District
appeared before the Board presenting their budget requests for the fiscal year
commencing July l ,1982. After consideration, motion was made by Bert Hovland, se-
conded by Van Ellig and carried, to appropriate the sum of $25,000 for each of the
Soil Conservation Districts in Otter Tail County.
Upon motion made by Bert Hovland, seconded by Van Ellig and carried,
the following resolution was adopted, with Sydney Nelsonand Hub Nordgren voting "no":

WHEREAS, in accordance with a Procedura 1 Agreement· between the

Minnesota Department of Natural Resources and the U.S. Fish and Wildlife Service,
dated May 23, 1962, certification by the County Board of Commissioners for acqui-
sition of lands by the U.S. Fish and Wildlife.Service is requested~ and
WHEREAS, representatives of the U. S. Fish and Wildlife Service met
with t~e County Boatd on September 7th and informed said Commissioners that water-
fowl easements had been secured from the fol lowing:

Upon motion made by Andy Leitch, seconded by Bert Hovland and carried
with Sydney Nelson and Hub Nordgren voting "no", the following resolution was adopted:
RESOLVED by the Boa.rd of County Commissioners of Otter Tail County

WHEREAS, in accordance with a Protedural Agreement between the
Mi_nnesota Department of Natural Resources and the U.S .. Fi.sh and Wi.ldli_-fe Servi_ce,
dated May 23, 1962, certification by the County Board of Commissionersfor acqui-
sition of lands by the U. S. Fish and Wildtfe Service is requested, and
WHEREAS, representaibes of the U. S. Fish and Wi:ldl'i'fe Service met
with th.e County Board on September 7th and informed said Board that a waterfowl
easement had been seucred from Mr. and Mrs. Robert'·J. Rogness on the West 100 acres

County Board September 7, 1982
Jeff Morton, Phelps Mill Caretaker, appeared before the Board relative
to problems encountered at Phelps Mill.
Koward Koeppen, Custodian, appeared before the Board and presented
proposals for changes in the washrooms serving the jury and consultation rooms for
District Court. After consideration, motion was made by Bert Hovland, seconded by
Sydney Nelson and carried, to accept the proposal of Jerry's Construction, Elizabeth,
MN in the amount of $659.00 for remodelling. Motion was made by Sydney Nelson, seconded
by Hub Nordgren and carried, to accept the bid of Kordel Furniture, Fergus Falls, MN
fbr carpeting in the amount of $642.00.
Terry Lejcher of the Department of Natural Resources appeared before
the Board relative to serious leakage and deterioration problems encountered at the
dam at Phelps Mill, recommending the county hire a dam consultant for the necessary
repairs.
The plat of Whispering Springs, located in Government Lot 5, Section
12-134-43 was presented to the Board and approved upon motion made by Bert Hovland,
seconded by Van Ellig and carried.
Upon motion made by Sydney Nelson, seconded by Hub Nordgrenand carried,
the plat of Oak Shores, 2nd Add~n, located in Government Lot 3, Section 36-135-39, was
approved.
Motion was made by Andy Leitch, seconded by Van Ellig and carried, to
approve the plat of Wenstrom Beach, located iri Government Lot 2, Section 32-131-42.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve the following applications for special use permit, subject to conditional

County Board September 7, 1982
Motion was made by Andy Leitch, seconded by Hub Nordgren and carried,
to approve an application of Milt Paulson for special use permit to fill remainder
of Lot 8, Eastwood Shores, Clitherall Township, subject to conditional requirements.
Motion was made by Sydney Nelson, seconded by Hu5 Nordgren and carried,
to concur wfth the Otter Tail County Planning Advisory Commission and deny approval
of the application of R. S. Potter for s·pecial use permit to cut ,frost ridge and fill
low area on Oak Shores, 2nd Add 1n, Rush Lake Township.
Motion was made by Van El)ig, seconded by Bert Hovland and carried,
to table action on an application of Kenneth Rostad for special use permit, until
September 21st, at which time it is requested Jourdan Sullivan, Mr. Rostad, if he
wishes to do so, and any other representative of'the Otter Tail County Planning
Advisory Commission, together with Bi 11 Ka 1 a r of the Land & Resource Management
office, Be in attendance.
A preliminary plat of Boes Beach, to be located in Sectfon 31-137-42
was presented to the Board and upon motion made by Bert Hovland, seconded by Hub
Nordgren and carried, approved.
A preliminary plat of Albright Add 1 n~ to be located in Se.ction 33-
136-42, was approved upon motion made by Bert Hovland, seconded by Sydney Nelson
and carried.
The following applfcations for sewage dfsposal installers license

County Board September 7, 1982
Upon motion made by Bert Hovland, seconded by Sydney Nelson and car-
rfed, the Chairman of th~ Board was authorized to sign an agreement on behalf of
Otter Tafl County with ~he State of Mfnnesota Department of Natural Resources for
for a joint venture for updating shoreland development data base, with the instal-
lation of a teleray computer terminal and a digital decwriter IV.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to ~pprove an application of Richard and Vernon Guyer for reduction of assessed valua-
tion on property in Section 9 of Star Lake Township.
With no further business, the Chairm~n adj6~rned'the meeting until
9:30 a.m., Wednesday, September 8i 1982.
-WEDNESDAY'S SESSION -
Pursuant to adjournment, the Board of County Commis~ioners of Otter
Tail County met at 9:30 a.m.,-Wednesday, September 8, 11982, all members present.
George Nelson, County Treasurer, appeared before the Board relative
to investments.
The subject of the neceisity of a seller of property to the U. S.
Fish and Wildlife Service contacting the Commissioner of the District in which the
property is located was brought up for discussion. Motion was made by Sydney Nelson,
seconded by Van Ellig and carried with Andy Leitch and Hub Nordgren voting "no",
the elimi'nate the necessity of the seller's contacting the Commissioner.
Applications by Michael Sundblad for b.eer, dance and set-up licenses
were presented to the board for reconsideration, having been denied at the August
24th meettng. After discussio~, motion was made by Bert Hovland, seconded by Sydney
Nelson and carried, to approve said a~plications.
The application of Dennis Fuhrman for special use permit, tabled from
Tuesday, September 7th, was brought before the Board for final action. After dis-
cussion~ motion was made by Bert Hovland, seconded by Hub Nordgren and carried, to
allow sodding and filling in of black dirt, but no further excavation.
Jim Nitchals, Administrator, City of Fergus Falls, together with
representatives of the Fergus Falls City Council, appeared before the Board relative
to the solid waste problems and the proposed burning facility. After considerable
discussion, motion was made by Bert Hovland, seconded by Sydney. Nelson and carried,
to establish a committee consisting of two members from each commissioner dtstrict
to .study viable alternatives for solid waste, meetings to commence by the end of
September or first part of October.
Leon Johnson and Paul Schwartz, of Indeco, together with ·Terry Lejcher,
DNR and Dennis Berend, County Engineer, Lyle Anderson of Anderson Bros. Const., Fergus
Falls, appeared before the Board relative to serious deterioration and leakage at
the dam at Phelps Mill. After consider.able discussion, motion was made by Van Ellig,
seconded by Bert Hovland and carried, to authorize the County Engineer, the County
Attorney and the Department of Natur~l Resources to check into methods to determine
extent of deterioration, and possible funding through state and federal grants be~
cause of the fact the dam and mill are on the register of historic places, report to
be made to the Board on September 21st.

Upon motion made by Sydney Nelson, seconded by Bert Hovland and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County·
Minnesota, that
WHEREAS Leona C. Zimmerman, successor in interest, has made applica-
tion to repurchase the following described property, having forfeited to the State
of Minnesota on the 14th day of October, 1980 for non-payment of tax:
Government Lot~ l, 2, 3 & 4, lying East of Town~hip road in
Section 31-134-41,
Said applicant having paid the total of $1,121.94 being the aggregate
of all delinquent taxes and assessments, with penalties, costs and interest,
NOW, THEREFORE, BE IT RESOLVED, the County Board does here by approve
s.a id repurchase, permission to do so to be in the best public interest and relieve
undue hardship.

carried, the following resolution was adopted:
RESOLVED by theBoard of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, Raw Arsenic was distributed and mixed with other material
and eventually dumped and buried under direct supervision of State Agencies during
the years of 1930 to 1940 in the City of Perham, Minnesota, and
WHEREAS, Core hole testing to locate arsenic deposits were per-
formed by the State Pollution Control and the State Board of Health, and
WHEREAS, Core holes wereleft open and surface water is filtering
through arsenic deposits and further contaminating_ground water,
NOW~ THEREFORE, BE IT HEREBY RESOLVED, the Otter Tail County Board
does hereby petition the State of Mi. nnesota· a:nd its l egis l ati ve body to take , I ~ •
immediate action to remove and clean up lethal and spreading contamination of
arsenic in the ground water of the City of Perham, Minnesota and surrounding
areas in Otter Tail County where other problems may exist.

The Board, having previously advertised for bids to be received for
grading and aggregate surfacing under C.P. 82:126, proceeded to open bids which were
found to be as follows:

After consideration, motion was made by Andy Leitch, seconded by
Bert Hovland and carried, to accept the bid of Stromseth Construction, Watertown,
SD, in the amount of $226,574.76~ being the 1owe~t bid. ·
Darrell Woessner, Fergus Falls, MN, appeared before the Board,
stating he and several other individuals are-contemplating purchase of the establish-
ment now known as the Bronco Club, requesting approval of a liquor license should the
purchase be made and business set up. Motion wasmade by Hub Nordgren, seconded by
Van Ellig and carried, to approve a liquor license, subject to approval by the
County Sheriff and state requirements. ·
At the invitation of the County Board, candidates for the various
l egtsl a ti ve districts representing Otter Tail County appeared before the Board,
for the purpose of answering questions of board members, department heads, etc ..
The various department heads addressed concerns affecting their respective depart-
ments, requesting consideration by the legislature in the upcoming session.
With no further business, at 3:15 .p~m., the Chairman adjourned the
meeting until the afternoon of September 21st.
