OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of Otter
Ta i1 County Minnesota met at 12: 50 p .m. , Tuesday, June 22, l 982., a 11 members present.
. ..
David Lista spoke before the Board on behalf of petitioners who h~ve
requested exclusion from the Otter Tail Cake Area Sewer bistrict. Mr. Lista and
others in attendance were advised by the County Attorney authority for the district
rests in the Sewer District Commission and all petitions, requests, etc., should be
addressed to the commission.
Representative from the U.S. Fish and Wildlife Service met with the
Board concerning waterfowl easement acqu is it i ans. Motion was made by Andy Leitch,
seconded by Sydney Nelson and carried, to table action on an application in Dane
Prairie Township until the applicant contacts the County Commission~r involved in
that township.
Motion was made by Bert Hovland, seconded by Sydney Nelson and carried,
to, commencing in 1983, publish all bills with the commissioners proceedings and only
those in excess of $5,000 in the financial statement.
Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried,
to approve the application of LeRoy Feldt, Feldt Plumbing & Heating, Frazee, MN, for
sewage disposal d1hstallers license ..
Motion was made by Bert Hovland, seconded'by Van Ellig and carried, to
approve the application of Glenn A. Erickson~ Erickson's Septic Pumping Service,
Fergus Falls, MN for sewage disposal system cleaners license, subject to posting of
bond.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
with Andy Leitch voting "no", to accept and approve the Otter Tail County Crisis
Relocation Plan as submitted by Malcolm Lee, Civil Defense Director, and the Chairman
of the Board was authorized to sign same on behalf of the County Board.
Motion was made by Hub Nordgren, seconded by Sydney Nelson and carried,
to eliminate the plan review of resort and business sewer systems within the shore-
land ordinance, and place authority under the Land & Resource Management office.

the followtng resolutton was adopted:
RESOLVE.D by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, in accordance with a Procedural Agreement between the
Minnesota Department of Natural Resources and the U. S. Fi~h and Wtldlffe Service,
dated May 23, 1962, certification by the: County Board of Commissioners for acqui-
sition of lands by the U. S. Fish and Wildlife Service is requested, and
WHEREAS, r~presentittves of the U. S. Ftsh and Wildlife Service met '-,· . .
with the County Board on June 22, 1982 and informed safd Board that a wat~rfowl
easement had 6een ·secured from the following:

RESOLUTION
Upon .motion made by Sydney Nelson , seconded by Hub -------
__ N_o_r_d~g_r_e_n ___ and carried, the following Resolution was adopted:
RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS of Otter Tail County,
. Minnesota, that
WHEREAS, because of the present completed construction of County Highway
No. 130 in the Southeast Quarter of the Southwest Quarter, the West Half
of the Southwest Quarter and in Government Lot 9 of Section 26, Township 137
North, Range 41 West and in the North Half of the Northwest Quarter and
· Government Lot 3 of Section 35, Township 137 North, Range 41 West, in
Otter Tail County, portions of the pre-existing right-of-way are no longer used
or necessary; and
WHEREAS, the County Highway Engineer, Dennis D. Berend, recommends
that said old portions of the right-of-way no longer used or necessary be
vacated,
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota Statutes 163,
Otter Tail County vacate those portions of the pre-existing County Highway
No. 130 road right-of-way located in the Southeast Quarter of the Southwest
Quarter, the West Half of the Southwest Quarter and Government Lot 9,
Section 26, Township 137 North, Range 41 West and in the North Half of the
Northwest Quarter and Government Lot 3 of Section 35, Township 137 North, Range
41 West, except the following strip of land being in part located on the above
described tracts which lies within 50 feet on either side of the following
described center line:
Commencing at the South Quarter corner of Section 27, Township
137 North, Range 41 West, thence North 89°44' East for a distance of
2638.3 feet to point of beginning, thence continue North 89°44'
East for a distance of 2116.3 feet, thence deflect to the right on a
7°00 1 curve (Delta Angle 45°11.4') for a distance of 645.6 feet,
thence South 45°04.6' East for a distance of 277.3 feet and there
terminating.

carried, the foil owing resolution was ad.opted:

RESOLVED by theBoard of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS, a'pplicatiori has been made by Gerald Schultz, Dalton,
MN in accordance with Minnesota Pollution Control Agency's Sol{d Waste Disposal
Regulations ,to operate a demolition debris disposal site for the disposal of
wood, waste, brtck, etc., from house and cabins from the 10 Mile Lake Resort in
Section 21 of Tumuli Township,
NOW, THEREFORE, BE IT HEREBY RESOLVED, the Qtter Tail County
Board would not object to burial of ih~ debris from the disposal site for the
10 Mile Lake Resort, owned by Gerald Schultz, subject to appro~al of the site
by the Minnesota Pollution Control Agen~y, subject to the burial 6f the debris
being completed according to Minnesota Pollution-Contr:o 1 Agency specifications
and subject to the completed budal project bei'ng approved by the Minnesota
Pollution Control Agency.

Upon motion made by Bert Hovland, seconded by Sydney Nelson and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, on Maich 10, 1982, the County Board accepted the bid of
M-R Sign Company, Fergus Falls, MN fn the a~6u~t of $28.148.60 for road signs
and posts, and
WHEREAS, said road signs and posts have now been delivered to the
satisfaction of the County Board at a total cost of $28,148.60,
NOW, THEREFORE, BE IT RESOLVED, the Co~nty Auditor i~ hereby
authorized and directed to issue a warrant in the amo.unt of $28,148.60 payable
to M-R Sign Company, Fergus Falls, Mfnnesotci fn full payment thereof.

Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried,
to vacate certain portions of highway right~of~way obtained for Highway #130 in the
SE¼SW¼, W½SW¼ and G.L. 9 of Section 26-137-41 and the N½NW¼ and G.L. 3, of Section 35-
137-41, and the Chairman of the Board and County Auditor were authorized to execute
documents on behalf of Otter Tail County.
The matter of division of the County ·for the purpose of agricultural
inspection was discussed. After consideration, motion was made by Bert Hovland,
seconded by Andy Leitch and carried, to continue the areas as originally established.
After futther di.scussion, motion was made by.Hub Nordgren, seconded by Sydney Nelson
and carried, to establish new lines of division, commencing January l, 1983, to coin-
cide with the East and West County Extension Service areas, Bert Hovland and Andy
Leitch voting ".no".
Motion was made by Sydney Nelson,· seconded by Hub Nordgren and carried,
to approve the proposal of depository of public funds and assignment of securities
from the Vergas State Bank, Verga~. Minnesota.
The Board, having previ'ously advertised for bids· to be recetved for
the sale of the house and outbuildfngs, excluding ihe ~arage and cabfn, on the
property across the river from Phelps Mill, known as the Neison pr6perty~ proceeded
to open bfds which were· found to be as follows;

Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve forgiveness of penalty for Louis Stoll, on a late payment of tax fn Star
Lake Township, due to a return by the U.S. Postal Service, Andy Lei"tch voting "no".
Motion was made by Bert Hovland, seconded by Van Ellig and carried,
to change the date for receivfng of bids for micro-film s~rvice and equipment for
the County Recorder I s office from July 20th to l O: 30 a .m., Tuesday, September 7, 1982.
Motion was made by Andy Leitch, seconded by Bert Hovland and carried,
to approve payment in the amount of $1,190.00 to Reynolds Const., Underwood, MN,
for restriping and seal coat of the parking lots, upon completion of filling of holes
in the west parking lot.

Upon motion made by Bert Hovland, seconded by Van Ellig and carried,
the following resolution was adopted:
RESOLVED by the Board of Couryty Commissioners of Otter Tail County
Minnesota, that
WHEREAS on April 8, 1982, the Co~nty Board accepted the bid of
Quality Builders, Fergus Falls, MN, fn the amount of·$l1:2so.oo for the construction
of a 40 1 x 66 1 x 12 1 pole building for th~ use of the Sheriff's Department, and
WHEREAS, said building has be~n ~o~pleted to the satisfaction of
the County Board at a total cost of $11,250.00,

NOW, THEREFORE, BE IT RESOLVED, _the County Auditor is hereby
authorized and directed to issue a warr~nt in the amount of $11,250.00 to
Quality Builders, Fergus Falls, MN, in full payment thereof.

Glen Melby, County Sheriff, appeared before the Board and presented
proposals received for the purchase of a new automobile for use by the Sheriff 1 s
Department. After consideration, motion was made by Bert Hovland, seconded by Van
Ellig and carried, to accept -the low, quotation from Minnesota Motor Company, Fergus
Falls, MN in the amount 6f $8,853.00 for a 1982 Chevrolet Impala, payment upon
delivery.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to approve the plat of 2nd Add 1 n to River & Woods Estates, located .in Section 9-133-43.
Motion was made by Bert Hovland, seconded by Hub Nordgren and carried,
to designate the Otter Tail Cotinty Department of H~man Services as the authority for
the purposes -of the new commitment law, effective August l ~ 1982 .

Upon motion made by Bert Hovland, seconded by Van Ellig and carried,

Beach Resort, Dunn Township, was approved.
Mofion was made by.Andy Leitch, seconded by Hub Nordgren and carried
with Van Ell ig voting 11 no 11 , to .provide a culver.t for County Ditch #11 in Tordenskjold.
Township, not to exceed the cost of $129.00, whith is the balance in the Ditch #11
fund.
Motion was made by Andy Leitch, seconde·d by Hub Nordgren and carried,
to proceed with whatever action is necessary t~ request the State establish a speed
zone on CSAH No. 82 between Sections 5 & 6 in Everts T6w~ship, in response to a
petition received.
