Allen Gundberg, Treasurer of the Pebble Lake Golf Club, appeared before the Board requesting a gambling permit for the club in Buse Township. ~ . ·I Motion was made by Van Ellig, ~econded by Bert Hovl~nd and carried, to approve a gambling permit for the Pebble Lake Golf Club, in Buse Township, fee of $10.00. Motion was made by Andy Leitch·, seconded by Sydney Nelson and carried, to approve special aid to Nidarqs Township in the amount of $500.00 to rip-rap a road next to Stuart Lake. Proposals were presented to the Board for purchase of a new lawri- mower and chain saw for use at Phel~s Mill. Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried, the caretaker was authorized to accept low bids, for lawn mower from Fergus Falls True Value Hardware in the amount of $234.99 wit~ trade, and chain saw with OK Hardware, Fergus Falls in the amount of $135.00 with trade. The County Board, having previously advertised for bids to be re- ceived for C.S. Structure Pl. Representatives of the City of Fergus Falls appeared before the Board relative to overlayment of County #1, lying within the city limits of the City of Fergus Falls. AFter considerable discussion, motion was made by Van Ellig, seconded by Bert Hovland and carried with Hub Nordgren and Andy Leitch voting "no", to overlay at county's expense, that portion of Alcott Avenue from the city limit into town, of 9 ton capacity, if possible, if not, whatever can be done. An official notification was ·recei;e9 by the County-Boa.rd from the Waste Management Board of the inventory of preferred areas for processing facilities for hazardous waste, to include an area in, the Ci"ty of _Fergus Falls, north of State Highway #210 on the east edge of the City of Fergus Falls. No action taken. Motion was made by Sydney Nelson,_ seconded by Van Ellig and carried, to approve payment of 50% of the cost of additional culverts in Paddock Township, due to washouts. MoUon was made by Bert Hovland, seconded by Hub Nordgren and carried, to approve purchase of twelve 12 1' tile for use on County Ditch #56, Trondhjem Town- ship. Howard Koeppen, Head Custodian, appeared before the Board and presented proposals for sand-sealing the county parking lots. After consideration, motion was made by Bert Hovland, seconded by Van Ellig and carried~ to accept the Reynolds pro- posal for sealing, repairing and striping of the east and west parking lots and the employees I parking lot, at a cost of $1,180.00. Stat. 256.01 and 256.975; and WHEREAS, Minn. Stats. 375A.13 by order of Judge Elliott 0. Boe following a resolution by this board requesting such action; and,· WHEREAS, the Otter Tail County Study Commission has filed a Partial Report recommending that the optional form of. government providing for the consolidation of the offices of County Auditor and Treasurer be implemented, and that the referendum of the voters of the county on this option be held at a special election on June 1, 1982 with the following ballot presented to the voters: ( __ ) FOR the proposal to consolidate the offices of CountY Auditor and Treasurer ( __ ) AGAINST the proposal to consolidate the offices of County Auditor and Treasurer. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners accepts the recommendation of the Study Commission as found in its Partial Report dated May 4, 1982 and directs the County Auditor to conduct the special election on the option of consolidating the offices of County Auditor and Treasurer on June 1, 1982 according to the law for such an election. Bergeru~Cle Upon motion made by Bert Hovland, seconded by Van Ellig and carried, with Sydney Nelson and Hub Nordgren voting "no", the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a procedural agreement between the Minnesota Department of Natural Resources and the U.S. Ffsh and Wildlife Ser~ice, dated May 23, 1962, certification by the County Board of Commissioners for acquisi- tion of lands by the U. S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U. S. Fish and Wildlife Service met with the Board of Commissioners on May 5, 1982 and informed said Board that a water- fowl easement had been secured from Mr. Andy P. Formo on the SW¼NE¼ and Lot 2, of Section 8-132-42; Mr. and Mrs. Thomas K. Carpenter on the NW¼SW¼ of Section 25- 131-41; and Mr. and Mrs. James C. Olson on the NE¼SE¼ of Section 36-131-41; and Mr. and Mrs. Arthur Eckhardt on the NE¼SW¼, S½SW¼, SE¼ except the north 12.5 rods of the east 16 rods, of Section 5-133-42, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve the aforementioned waterfow] · easements for acquisition by the U. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to approve an application of Bert Skogmo to split a delinquent 1979 tax, property of which was split in 1979 with the current tax owing, allowing Mr. Skogmo's portion of the tax to be paid, thus release it from judgment, property located in Fergus Falls Township. Motion was made by Sydney Nelson, seconded by Van Ellig and carried, to approve an abatement of taxes on property owned by John T. Bucholz in the City of Perham, condemned property overvalued. Motion was made by Van Ellig, seconded by Hub Nordgren and carried, to approve payment of $31,101.37 td Barker-Williams Insurance Agency for premium .on the county's liability policy.~ Motion was made_by Bert Hovland, seconded by Hub Nordgren and carried, to deny forgiveness of penalty on a late 'payment of tax of Dave Bode, on Lot 2, Block 2, Jacobson's Pelican View Subdivision, Dunn Township. Gene Davenport, County ~~ses~or, and Larry Krohn, Executive Secretary, reported on a field trip taken to Scott tounty to view the data processing system in Scott County. No action ta ken. Mike Kirk, County Attorney, reported on the outcome of the Frey vs Otter Tail County case recently heard in District Court. Motion.was made by Bert Hovland, seconded by Sydney Nelson and carried, authorizing the County Attorney to draft letters of appreciation to the Western Insurance Company and to Richard Hefte, attorney, for their success in said case. At 3:08 p.m., the Chairman adjourned the meeting until 9:30 a.m., Thursday, May 6, 1982. -THURSDAY'$ SESSION~ Pursuant to adjournment, the Board of County Commi.ss i.oners met at 9:37 a.m., Tliursday, May 6, 1982, all members present. 9 Larry Schauf, representative of Johnson Controls, appeared before the board with a proposal on an energy saving cut-.back switch. After dis.cussi'on, motion was· made by Van Ellig to authorize the installation of said switch, pursuant to the proposal in order to save money, at a cost of $4,376 for an automat;:c setback control and $953.00 flr three pneumatic thermostats and three pneumatic temperature control valves, one set for each entry. The motidn was seconded by Bert Hovland and carried. Motion was made by Hub Nordgren, seconded by Sydney Nelson and carried, authorizing the County Audito~ -to.advertise for bfds to.be received until 10:00 a.m., Tuesday, June 8, 1982, for the lease of a 200 1 x 600' parcel located in the NW¼ of Section 21, Orwell Township, said lease to be subject to use by law enforcement officers of Otter Tail County as a firiQg range. Louis Sieling appeared before the Board relative to problems encountered in the removal of timber from the gravel pit located in Section 10 of Dead Lake Town- ship. After discussion, motion was made by Sydney Nelson, seconded by Van Ellig and carried, to readvertise for bids to be received until 10:15 a.m., Tuesday, June 8, 1982. The matter of bids for the bridge replacement over the Wing River, under S.A.P. 56-599-17 was brought up for final action.· Motion was made by Hub Nordgren, seconded by Sydney Nelson and carried, to accept the bid of Midwest Con- tracting, Inc., Marshall, MM in the amount of $54,120.00, being the lowest bid. Motion was made by Bert Hovland, seconded by Van Ellig and carried, to authorize obtaining three quotations for a ventilating system for the drafting room of the highway department building. Di ck Kimba 11, representing the Department of Natural Resources, ap- peared before the board introducing new maps recently printed by the DNR on state controlled public accesses, said maps being available throu9h fish and game agents, Chamber of Commerce Associations, County Auditors' offices, etc .. Upon motion made_, by Bert Hovland, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS Chapter 454 of the Laws of Minnesota 1982 amended Minnesota Statutes Sections 386.42 and 386.43, and WHEREAS Chapter 454 states that the County Board shall, upon recom- mendation of the County Recorder, adopt a resolution setting a fee schedule for the services provided therein, and WHEREAS, Ch~pter 811 of the Minnesota Laws of 1965 created in Minnesota the Uniform Commercial Code, which Code provides that the office of the County Re- corder-is the place to file public notice(s) of encumbrance(s) on personal property, and the same Chapter 811 repealed most of the then effective statutes providing for the filing of Chattel Mortgages and Conditional Sales Contracts, and WHEREAS Chapter 356, Sections 347 to 351, of the Laws of Minnesota 1981 set the current fee schedule for filing Uniform Commercial Code documents, and WHEREAS it is intended that the fees for Minnesota Statutes 386.42 and 386.43, be as close as practical to the current Minnesota Uniform Commercial Code fees (MS 336.9-407), NOW, THEREFORE, the fees for service provided pursuant to Chapter 454 of the Laws of Minnesota 1982 shall be as follows: For the initial report each year, the fee shall be $5.00 for each debtor -(name of the person against whom the lien is claimed) listed. The $5.00 fee per debtor listed shall include the listing of Up to and including five filings or five photocopies of listed documents or any combination of up to and including five listed filings and/or photo- copies for each individual debtor. There shall be an additional charge of 50 cents perdocument listed and/or photo~opy made in excess of the first five listings and/or photocopies per debtor. · · For each supplemental weekly report, the fee shall be $5.00 for each addi- tional/new debtor included iri the sup~lemental report, and $5.00 for each debtor listed in the initial report or any previous supplemental report for which any changes are listed in the supplemental ·report . - The $5.00 fee per debtor shall inclu_de· th-e Hs_ting of up to and focluding five listed filings and/or photocopies for each indi~idual debtor. There shall be an additional charge of 50 cents per document listed or photocopy made in excess of the first five listings and/or photocopies per debtor. Representatives of the U. S. Fish and Wildlife Service appeared be- fore the Board relative.to an easement secured from Julia:: Jacobson ~st·~'.-preperty-~in Section 7 of Tordenskjold Township. After discussion, motion was made by Andy Leitch, seconded by Van Ellig and carried, to table acti'on on said lease pending information from the Town Boa rd. and the Jacobson family. In response to a letter from the State Auditor's Office relative to county audits, motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, authorizing the County Auditor to draft a letter to the State Auditor requesting the ptissibility of having a private firm audit the affairs of the county, on an annual basis. Hopkins Michael Gunderson Grandview Heights Ballroom Perry's Pine Lake Township Dora Township RESOLUTION Upon motion made by __ A_n_d_y_L_e_,_·t_c_h _____ , seconded by _H_u_b_N_o_r_d~g~r_e_n ___ and carried, the following Resolution was adopted: RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS of Otter Tail County, Minnesota that WHEREAS, the West Central Regional Development Commission was previously established pursuant to the Regional Development Act of 1969, Minn. Stats. 462.381 through 462.396; and WHEREAS, the existence of the West Central Regional Development Commission is no longer in the public welfare and interest and is not needed to accomplish the purposes of the Regional Development Act of 1969. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners petitions the Commissioner of the Minnesota Department of Energy Planning and Development by this formal resolution requesting that the West Central Regional Development Commission be terminated pursuant to Minn. Stats. 462.398 because the existence of the Commission is no longer in the public welfare and interest and is not needed to accomplish the purposes of the Regional Development Act of 1969.
