Hubert Nordgren and Van R. Ellig present. J The County Auditor called the meeting to order and stated the first I I ' order of business was the election of Chairman and Vice Chairman for the year 1982. Upon motion made by Hub Nordgren, seconded by Sydney Nelson and carried, Andy Leitch was selected as Chairman; and upon motion made by Andy Leitch, seconded by Hub Nordgren and carried, Bert Hovland was selected as Vice Chairman. RESOLVED further that said payment of such bounty shall be made by the County Auditor upon certificates executed by the Chairman of the Town Board of said townships setting forth that the pocket gophers or wood chucks were duly presented to the Chairman of such Board and that the townships had issued and delivered to each claimant a town order for forty cents (40¢) for each pocket gopher or wood chuck so killed. Clerk Upon motion made by Bert Hovland seconded by and carried, the following.resolution was adopted: --------------Van Ellig RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The Chairman of the Board•be and is hereby authorized to select two members of the Board, together with himself, as members· of various boards: .. ~ ' County Board of Health for the year 1982; to have charge of the CourtHouse, Court House Annex, Jail and grounds for the year 1982; purchase all furniture and supplies, except books blanks and stationery needed for the Court House and Jail during the year 1982, and.provide for such repairs as may become an immediate necessity. Statute 282.05 for the apportion- ment of the proceeds from the sal_e of_ t,ax-forfeited, ~ands·; WHEREAS, the County Auditor shall apportion the. tax sale proceeds to the taxing districts pursuant to Minn. Stat, 282. 08, and· WHEREAS, Minn. Stat. 282.08(4)(b) provides that the County Board may set aside· 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues·levied on the property have been paid, for acquisition and maintenance, of county parks and recreational areas, and WHEREAS, Otter Tail County has parks and recreational areas which would benefit by such an apportionment. NOW, THEREFORE, BE IT RESOLVED, t.hat the County Auditor retain 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds available after. making the necessary statutory disbursements, said proceeds to be disbursed according to law. After reviewing proposals received by the County Auditor from various insurance firms for bonds for various county employees and officials, motion was made by Sydney Nelson, seconded by Van Ellig and carried, to accept the quotation of Enstad-Mann-Baatz, Fergus Falls, Minnesota for a $10,000 blanket bond, plus a $50,000 bond for the County Treasurer, at a total annual premium of $479.73. The Board, having previously advertised for bids to be received for the county's printing and publishing costs for the year 1982, proceeded to open bids which were found to be as follows: Delinquent tax list for 1981 Board minutes and legal notices County Financial Statement, 1st publication County Financial Statement, 2nd Publication PARKERS PRAIRIE INDEPENDENT Legal Rates THE DAILY JOURNAL, Fergus Falls Legal Rates NEW YORK MILLS HERALD Legal Rates PELICAN RAPIDS PRESS Legal Rates After considerable discussion, motion was made by Sydney Nelson, seconded by Van Ellig and carried with Andy Leitch voting "no", to accept printing and publishing bids as received, Motion was made by Andy Leitch, seconded by Van Ellig and carried, to.re-appoint Irene Lundby, Underwood, MN, as a member of the Otter Tail County Extension Committee. Motion was made by Bert Hovland, seconded by Sydney Nelson and carried, to re-appoint John Sethre, Carlisle, as a member of the Otter Tail County Extension Committee. Motion was made by Bert Hovland, seconded by Van Ellig and carried, to grant an increase of $25.oo· per.. month to the Otter Taii County Agricultural Inspectors for the year 1982. Motion was made by Bert Hovland, seconded by Sydney Nelson and car- ried, to approve a land surveyors certificate of correction to plat on Birchwood River Estates, in G.L. 2, Section 32-133-42. Payroll schedules for the various offices in the county indicating , the $100.00 per month increase in wages were presented to the board for approval. Upon motion made by Bert Hovland, sec.onded by Van Ellig and carried, the Chairman of the Board was authorized to sign the si:J.lary,'.authorizations on behalf of the County Board. . , Motion was made by Bert Hovland, seconded by Sydney Nelson and car- ried, to approve payment in the amount of $6,853.16 to Nidland ·co-operative, Inc., Fergus Falls, Minnesota, for a ,supply of chemicals for use in weed eradication. Motion was made by Sydney Nelson, seconded by Van Ellig and carried, authorizing Malcolm Lee to obtain quotations for the purchase of a new typewriter for the office of Land & Resource Management. Motion was made by Van Ellig, seconded by Hub Nordgren and carried, to increase the rent of office space for Field Abstract, Inc., to $400.00 per month commencing January 1, 1982. Andy Le,i t,ch, second~d. by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of Cou~·ty Commissioners of Otter Tail County 'Minnesota, that WEREAS, on July 21, 1981, the County Board accepted the bid of Evavold-Vikesland Const,, Fergus Falls, ·MN in the amount of $253,952.45 for grading and aggregatesurfacing on CSAH-#81, under S.A.P. 56-681-;:03, and WHEREAS, the above contract has now been completed to the satis- faction of the County Board at a total cost of $264,113.50, an increase of $10,161.05 due to overruns on excava~on, aggregate surfacing, seeding and sod- ding, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the. amount of $28,972,93 payable to Evavold-Vikesland Const., Fergus Falls·, MN as final payment for this work. Clerk ' Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, changing road conditions created by temperature changes, rain, snow, traffic, etc.,· can result in the deterioration and serious damage .to roads and highways in Otter .Tail County unless weight restrictions are imposed upon the vehicles permitted to operate thereon. NOW, THEREFORE, BE IT RESOLVED, that no person shall operate any vehicle or combination of vehicles upon any restricted county road or highway in the County of Otter Tail and State of Minnesota, generally described as follows:· Otter Tail County State Aid Highways and Otter Tail County Roads, where the gross weight on any single.axle, as defined .in· Minnesota Statutes 1945, Sec. 169.87, Sub-division 1, exceeds five tons (10,000 pounds) and the County Highway Engineer of said County is hereby directed and authorized to determine the need and to erect and maintain ,appropriate signs plainly indicating the pro- hibitions and restrictions at each. end of that portion of any highway affected thereby, and these restrictions shall be effective and this prohibition effective upon the erection of the appropriate signs. Chai~ ATTEST: / c1 · o Clerk Upon motion made by Hub Nordgren, seconded by Van Ellig and car- ried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that Pursuant to Section 161.39, Subdivision l through 6, 'Minnesota Statutes, 1978, the County Engineer, for and on behalf of the County of Otter Tail, is hereby authorized to request and obtain from the MinnesotaDepartment of Transportation, needed engineering and technical services for which payment will be made by the County upon receipt of verified claims from the Commiss1oner of Transportation. This authority is to remain eff-ctive until rescinded by either party. Adopted at Fergus Falls, Minnesota this 5th day of January, 1982. III BE IT RESOLVED, That pursuant to Section 161.36 Subdivision 1 through 6, Minnesota Statutes, 1978, the Commissioner of Transportation be appointed as agent of the County of Otter Tail to let its agent, contract' for the construction of portions of County Highways-and the chairman and the auditor are hereby authorized and directed for an on behalf of the County to execute and enter into a contract with the Commissioner of Transportation prescribing the terms and conditions· of such contracts in the form as set forth and contained in "Minnesota D~par~ment of Transportation Agency Agree- ment Form No. 30773", a copy of which said"form was before the Board, assuming on behalf of the County all o;f the obligatdions-:therein _contained. ATTEST: Clerk .1 -WEDNESDAY'S SESSION - Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 a·.m.; :Wednesday, January 7, 1982, all members present. Richard Grewe, City of Fergus Falls' Building and Zoning Adminis- trator, met with the County Board relative'·to nandicap requirements. No action taken. James Myhra of the West Central Regional Development Commission appeared before the board requesting a commitment on the part of the County Board for funds for operation of the Regional Development Commission: After considerable discussion, motion was made by Hub Nordgren, seconded by Bert Hovland and carried, to table action until February 16th. The County Sheriff appeared before the Board and presented proposals from various automobile firms for the purchase of a 1981 model automobile for use by the sheriff's department. After consideration, motion was ma~e by Van Ellig, seconded by Hub Nordgren and carried, to approve purchase and payment of a 1981 .Chevrolet Malibu~ 2 dr., from Minnesota Motor, Fergus Falls, MN in the amount of $7,574.10. Sheriff Glen Melby and Nursing Service Director Diane Thoreson appeared before the Board relative to salary increase~ for the year 1982. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to approve applications for a wine license and license to sell non- intoxicating malt liquor for Ben & Carol Zacher at The Wharf in the Township of Everts. Upon motion made by Bert Hovland, seconded by Sydney NelS:on and carried, the following resolution was adopted: RESOLUTION WHEREAS the 1981 Minnesota Legislature passed into law Chapter 363, Section 49, amending 299D.03, Subdivision 5, paragraph (b), and WHEREAS this law provides that all fines and forfeited bail monies from violations of statutes governing the maximum weight of motor vehicles collected from persons apprehended or arrested by employees of the State of Minnesota and all such receipts shall be transmitted to the State Treasurer, and WHEREAS the counties of Minnesota provide the court facilities, and WHEREAS the counties of Minnesota pay the salaries of the County Attorney, Clerk of Courts and their staffs who prosecute and process such claims into the Courts, and WHEREAS the counties of Minnesota receive nothing in compensation for processing the above violations. NOW THEREFORE, BE IT RESOLVED that the County Commissioners of Otter Tail County solicit the support of the Minnesota Legislature and the Association of Minnesota Counties to rectify the above statute by introducing and passing legislation, entitling the counties to retain their three-eighths (3/8ths) of such receipts as previously permitted, or to strike all the language contained in paragraph (b) of amended 299D.03, Subdivision 5 of Chapter 363, Laws of Minnesota.
