HomeMy WebLinkAboutBoard of Commissioners - Minutes - 11/12/1981MINUTES OF THE ADJOURNED MEETING ·OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA 'Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 a.m,, Thursday, November 12, 1981, all members present. Alva Krekula, East Otter Tail Co_unty Agricultural Inspector appeared before the Board and presented a new progrci,m of fertilizer inspection under the direction of the MinnesotaDepartment of Agriculture. Bob Torkelson,of Century: 21, Fergus Falls, appeared before the Board relative to the possibility of obtaining various licenses, liquor, set-up and beer, for the Hi-Way Host Restaurant in Buse Township. Chester Possehl, District Co~rdinator of the 'Minnesota Department-of Agriculture, appeared before the Board relative to screening of applicants for East Otter Tail County Agricultural Inspector. Mr. Possehl was authorized by the Board to give written tests to all applicants, narrowing the field to three to five for interview by the County Board. Diane Thorsen, Director of the County Nursing Service, appeared be- for the Board relative to the Otter Tail County Medical Consultant. After discussion, motion was made by Andy Leitch, seconded by Van Ellig and Carried, to retain Larry Mathison as Otter Tail County Medical Consultant, at a fe~ of $500.00 per month, commencing January 1, 1982, with a transfer of $6,000 from County Revenue to the Human Services Fund to cover said cost. The matter of self-insurance through the Association of Minnesota Counties and the Minnesota County Attorneys Association for liability insurance was brought before the Board by the County Attorney, Mike Kirk. The County Attorney was instructed to check into the feasibility of entering the A.M:c. and M.C.A.A. pool for self-insurance. \ Motion was made by And_y Leitch, sec,onded by Bert Hovland, to approve a waterfowl easement on the Richard A. Fihn property and the Alvin B. Miller, et al, property in Dane Prai.rie and i::umuli Townships. The motion did not carry with Sydney Nelson and Hub No;·dgr~n voting "no", Van Ellig absent. Upon motion made by 'Bert Hovland, seconded by Andy Leitch and car- ried, with Sydney Nelson and Hub Nordgren voting "no", the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Service, dated May 23, 1962, certification by the _County Board of Commissioners for acqui- sition of lands by the U.S. Fish and Wildlife Service is requested, and WHEREAS, r~presentatives of the U. S. Fish and Wildlife Service met withthe County Board on November 12th and informed said Board that waterfowl easements had been secured from the following: Ms. Florence A. Putnam, the N 20 acres of Lot 4, also known as the frac. NW¾NW¾ of Section 2-136-43 Ella E. Anderson, SE\NE¾, Section 36-136-43 Mr. & Mrs. Ordean J. Westby, E½SW\SE\, SE\SE\, Section 7-135-42 Mr. & Mrs. Leslie Zuehlsdorff, et al, Lots 4 and 5 arid the West 385.06' of the south 905.00 1 of Lot 2, Section 9-133-42 NOW, THEREFORE, BE IT RESOLVED, the County Board approves acquisition of the aforementioned waterfowl easements by the U. S. Fish and Wildlife Service. Dated at Fergus Falls, Minnesota this 12th day of November, 1981. ATTEST: Clerk Upon motion made by Andy Leitch, seconded by Van Ellig and carried with Sydney Nelson and Hub Nordgren voting "no", the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Service, dated May 23, 1962, certification by the County Board of Commissioners for acqui- sition of lands by the U.S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U. ATTEST: Clerk Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on October 27, 1981~ t~e Courity Board accepted the bid of Fergus Dodge, Inc., Fergus Falls., 'Minnesota. for one 1981 Plymouth Stationwagon, at a cost of $8,894.00, and WHEREAS, the above vehicle has now-been delivered to the satisfaction of the Board, and the Veterans Service Office, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is authorized and directed to issue a warrant in the amount of $8,894.00 payable to Fergus Dodge, Inc. , Fergus-Falls, Minnesota in full payment thereof. Dated at Fergus Falls, Minnesota this 12th day of November, 1981. ATTEST: Clerk Proposals for new chairs and a conference desk for the County Board Room were presented to the Board. After inspection and discussion, motion was made by Sydney Nelson, seconded by Bert Hovland and Carried, to authorize the purchase of a conference table from Orlyn Pederson at a cost of $1,600 and chairs from the Cooper's Office Supp~y, eight chairs at $240.00 per chair and 6 chairs at $193.00 per chair. After receiving orders from the City of Pelican Rapids for the demolition of hazardous buildings on tax forfeited property in the City of Pelicari Rapids, motion was made by Bert Hovland, seconded by Sydney Nelson and carried, to authorize'the City of Pelican Rapids Fire Department to dispose of said buildings located on S.L. A, Section 27-136-43, by burning. Motion was made by Andy Leitch, seconded by Sydney Nelson and. carried, to approve the agreement with Great Plains Natural Gas Company for interruption of service, and the Chairman of the Board was authorized to sign the acknowledgement on behalf of Otter Tail County. Motion was made by Van. Ellig, seconded by Andy Leitch and carried, to increase the broad money and securities burglary robbery insurance coverage to $100,000 at a premium of $419.00. Motion was made by Sydney Nelson, seconded by Bert Hovland and carried, to accept the contract of Lagerquist Elevators, Inc., for performing a full load safety test on the courthouse elevators, at a cost ,of $285. 00: Motion was made by Andy Leitch, seconded by Sydney Nelson and carried, to approve·the application of the Underwood Co-op Creamery, for.a special use permit to erect a 30,000 gallon anhydrous ammonium storage tank in Section 12-133-41. Upon motion made by Bert Hovland, seconded by Andy Leitch and carried, the following applications for special use permit were approved: Robert Sjulstad Ken C;onnor Carl Hammer Dunn Township Dunn Township Dora Township Operate a floor covering business from home Fill low area Landscape lot, using retairiing walls, etc. Motion was made by Andy Leitch, seconded by Van Ellig and carried, to approve a preliminary plat of Wenstrom Beach, to be located in Section 32-131-42. Motion was made by Bert Hovland, seconded by Van Ellig and carried, to approve a preliminary plat of Tri-Lake Estates, 1st Add'n, to be located in Sections 9 & l_O -136-42. With no further business, the Chairman adjourned the meeting until 9:30 a.m., Friday, November 13, 1981. -FRIDAY'S SESSION - Rursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at.9:30 a.m., Friday, November 13th, 1981, all members present. Motion was made by ~ert Hovl1md, seconded :by Andy Leitch and carried, to offer for sale at cl6sed auction, used highway equipment, to local Otter Tail County governmental subdivisions.,: at 10: 00 a. m. , Tuesday, December .8, 1981. Motion was made by Bert Hovland, seconded by Andy Leitch and car- ried, to assist in the cost of construction of a right turn lane off County #115 in Buse and Fergus Falls Townships with the townships each contributing $650.00. Motion was made by Van Ellig, seconded by Be.rt Hovland and carried with Andy Leitch and Hub Nordgren voting "no", to set up a purchase order system and a central supply, as a duty of the executive secretary. Upon motion made by Sydney Nelson, seconded by Andy Leitch. and carried, the follow:ing resolution was adopted: RESOLVED by the Board of County Commissioners: of Otter Tail County Minnesota, that WHEREAS, on April 7, 1981, the County Board accepted the bid of Dennis Drewes·, Inc., Frazee, MN in the amount of. $69,218.80 for grading and aggregate surfacing on County Road #130, and WHEREAS, this c.ontract has now been completed to the satis.,- faction of the County Board at a total cos·t of $72,301.66, an increase of $3,082.86 due to overruns on excavation, seeding and sodding, NOW·, THEREFORE, BE IT RESOLVED, the· County Auditor is· hereby· authorized and directed to issue a warrant .in the amount of $13,298.74 payable to Dennis Drewes, Inc. , as final payment for this· work. ATTEST: Clerk Upon motion made by Andy Leitch, seconded by Van Ellig and carried, the followirig resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The County Board Chairman is hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into a contract with the Commissioner of Transportation for the removal df snow from particular portions of all of the roads, highways or run~ays under the jurisdiction of the County of Otter Tail, all on the terms anq conditions contained and set forth in the "State of Minnesota, Department' of Transportation, Division of Field Operations, Snow Removal Agreement, a copy of which said form was before the Board, assuming on behalf of the County. of Otter Tail all of the contractual obligations therein contained. BE IT FURTHER RESOLVED, that Dennis D. Berend, the County Engineer of said Otter Tail County be and is hereby authorized to request and order from time to time men and equipment for the removal of snow in accordance with and under the terms of said contract. ATTEST: Clerk Upon motion made by Andy Leitch, seconded by Bert Hovland and carried with Hub Nordgren voting "no", the following resolution was adopted: RESOLUTION WHEREAS, Minnesota Laws 1980, Chapter 607, Article 19 authorizes a County to impose a gravel production tax, with provisions for reporting and payment of such tax by an operator engaged in the removal of gravel, to the County Auditor; and also establishes penalties to be imposed if the required reports are not submitted or the due tax paid, and WHEREAS, said Minnesota Laws 1980, Chapter 607, Article 19 provides for a distribution of funds collected by the imposition of the gravel tax as follows: 60% to the County Road and Bridge Fund; 30% to a County Town Road and Bridge Fund for the maintenance and repair of roads traveled by vehicles hauling gravel, in a manner to be determined by the County Board; and 10% to a County Land Restoration Fund for expenditures required for site work on County property. NOW, THEREFORE, BE IT RESOLVED, that as of January 1, 1982,a gravel production tax will be imposed in Otter Tail County under Minnesota Laws 1980, Chapter 607, Article 19 at the rate of 10¢ per cubic yard of material. BE IT ALSO RESOLVED, tha.t a County "Town Road and Bridge Fund" and a County "Land Restoration Fund" are hereby established. BE IT FURTHER RESOLVED, that for the purposes of this Resolution, all granular material is considered to be gravel when it is removed from any de- posit in Otter Tail County for any purpose whatsoever. BE IT FURTHER RESOLVED, tha.t thi!3 Resoluti,on shall supersede the gravel production tax Resolution dated November 25, 1980 whi,ch is hereby rescinded on January 1, 1982.
