MINUTES OF THE ADJOURNED MEETING
OF THE
BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners of
Otter Tail County Minnesota met at 12:50 p.m., September 22, 1981, all members
present.
The Otter Tail County Soil & Water Conservation Districts appeared
before the Board and presented a proposal for a soil survey for Otter Tail County
at a total cost of $1,553,978, with Otter Tail County's contribution to be
$517,992.60 paid over an eight year period at $64,749 per year, commencing in
September of 1984. After listening to various interested parties, motion was made
by Bert Hovland to sign the agreement and participate in the soil survey. The
motion was seconded by Van Ellig but failed with Andy Leitch, Sydney Nelson and
Hub Nordgren voting "no". After further discussion, motion was made by Hub Nordgren
to table action until after the township officers have had their fall meetings, for
input from the townships. The motion was seconded by Andy Leitch and carried with
Bert Hovland and Van Ellig voting:-"no".
The final plat of Ratliff Estates, located in Section 12-131-40, was
presented to the Board and upon motion made by Andy Leitch, seconded by Bert Hovland
and carried, approved.
Motion was made by Andy Leitch, seconded by Bert Hovland and carried,
to appoint Cliff Ukkelberg to the appraisal board of county ditches.
Glen Melby, County Sheriff, appeared before the Board relative to
the need for a new firing range. After discussion, motion was made by Andy Leitch,
seconded by Bert Hovland and carried, to purchase approximately two or two and one-half
acres at $800.00 per acre adjacent to the county garage in Aurdal Township, for a
firing range.
Pursuarit,to pub"lished notice~:a hearing .was-iheld·cohcerning the
proposed annual budget for fiscal year 1982 and the use of revenue sharing funds
as contained in the proposed budget. After considerable discussion, the budgets
as presented by each department were requested to be returned to each department
official and cut to no more than 9% over the budget as set for 1981a to be finalized
in October.
RESOLUTION
Upon motion made by __ A_n_d_y_L_e_i_t_c_h _______ , seconded by
____ B_e_r_t_H_o_v_l_a_n_d ____ and carried, the following Resolution was adopted:
RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS of Otter Tail County,
Minnesota that
WHEREAS, Otter Tail County Road #5 was relocated and opened for
travel several years ago; and
WHEREAS, most of the old right-of-way of County Road #5 was vacated
at that time; and
WHEREAS, a portion of old right-of-way in Section 4 of Girard Township
was not vacated at the time t~at County Road #5 was relocated, and said
old.right-of-way is not needed any longer for county highway purposes; and
WHEREAS, the old right-of-way no longer needed for county purposes is
legally 'described as follows:
All that portion of Highway Right of Way in Government Lots
Three and Five (3 & 5) and Southwest Quarter of the Southwest
Quarter (SW¼ of SW\) of Section 4, Township 133 North, Range
39 West lying between Lake Ethel and a Fifty (50) foot strip
of land lying Westerly of and adjacent to the following described
centerline:
Commencing at the Northwest corner of Section 4, Township 133
North, Range 39 West, thence South 01°12 1 West for a distance
of 1,701.9 feet, thence South 67°38' East for a distance of
558.7 feet, thence deflect to the right on a 7°00' Curve
(Delta Angle 38°53') for a distance of 91.7 feet to point of
beginning, thence continue on said 7°00 1 Curve for a distance
of 463.8 feet, thence South 28°45' East for a distance of
452.0 feet, thence deflect to the right on a 4°00 1 Curve
(Delta Angle 28°16') for a distance of 706.7 feet, thence
South 00°29• East for a distance of 94.11 feet, thence deflect
to the right on a 1°00 1 Curve (Delta Angle 04°11') for a
distance of 418.3 feet, thence South 03°42' West for a distance
of 190.0 feet and there terminating.
NOW, THEREFORE, BE IT RESOLVED:
1. That the following described coun½y highway be and the same
hereby is vacated pursuant to Minnesota Statutes 163.11, Subd. 4:
All that portion of Highway Right of Way in Government Lots
Three and Five (3 & 5) and Southwest Quarter of the Southwest
Quarter (SW¼ of SW¼) of Section 4, Township 133 North, Range
39 West lying between Lake Ethel and a Fifty (50) foot strip
qf land lying Westerly of and adjacent to the following described
centerline:
Commencing at the Northwest corner of Section 4, Township 133
North, Range 39 West, thence South 01°12 1 West for a distance
of 1,701.9 feet, thence South 67°38' East for a distance of
558.7 feet, thence deflect to the right on a 1°00 1 Curve

South 00°29• East for a distance of 94.11 feet, thence deflect
to the right on a 1°00 1 Curve (Delta Angle 04°11') for a
distance of 418.3 feet, thence South 03°42' West for a distance
of 190.0 feet and there terminating.
2. That a copy of this resolution be served upon each occupant of
lands through which the vacated portion of old County Road #5 passed, and
that the County Auditor post notice of this resolution for at least 10 days.
3. That a copy of the resolution together with proof of service and
affidavit of posting be filed in the County Auditor's office.

Bursuant to Minn. Stat. 375.025 and notice :thereof, a hearing was
conducted for the purpose of redistricting Commissioner Districts #3 and #5, to
conform with newly redistricted ward lines in the City of Fergus Falls. After
discussion, motion was made by Hub Nordgren, seconded by Bert Hovland and carried,
to adopt the following resolution:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS, the City of Fergus Falls has changedthe precinct lines
and ward lines for election purposes in the City of Fergus Falls, and
WHEREAS, the Third Commissioner District and the Fifth Commissioner
District are involved in the City of Fergus Falls,
NOW, THEREFORE, the County Board does hereby determine the
Third Commissioner District and the Fifth Commissioner District lines be changed
to conform to the existing ward lines within the City of Fergus Falls, with the
Third Commissioner District encompassing Ward I and the Fifth.Commissioner Dis-
trict comprising Wards II, III and IV.

Motion was made by Sydney Nelson, seconded by Bert Hovland and
carried, to approve the application of Robert & Glendia Pouliot for license to
sell beer at their general store in Corliss Township.
Roger Bengtson, Veterans Ser.vice Officer, appeared before·· the
Board with a request for a new automobile for use of the Veterans Service Office.
After discussion, motion was made by Andy Leitch, seconded by Sydney Nelson and
carried, authorizing advertising for bids to be received until 2:00 p.m., October
27, 1981.
Motion was made by Sydney Nelson, seconded by Van Ellig and carried,
to approve payment in the amount of $91,500 to the Association of Minnesota Counties
for payment of premium on the Worker's Compensation Plan.
A petition calling for speed restrictions at the intersection of
County Roads #4 and #31 at the outlet of Lake Lida was presented to the Board for
consideration. After discussion, motion was made by Bert Hovland, seconded by
Andy Leitch and carried, to accept said petition and request a study be made of
the area for restricted speed.
Motion was made by Sydney Nelson, seconded by Van Ellig and carried,
to grant special aid to the Township of Perham for construction on the Grand View
Heights Road, in the amount of $500.00.
Motion was made by Bert Hovland, seconded by Van Ellig and carried,
to approve payment in the amount of $6,897.00 to Association of Minnesota Counties
representing dues payable for 1982.
Motion was made by Bert Hovland, seconded by Sydney Nelson and
carried with Andy Leitch and Van Ellig voting "no", to approve payment in the
amount of $578.00 to National Association of Counties, 1982 membership fee.
Sandy DiBrito, Perham City Administrator, along with representatives
of Midland Feeds and Tuffy's of Perham, appeared before the Board and presented
a petition requesting certain highways in the City of Perham be raised to 10 ton
per axle weight maximum to conform with the U.S. 10 highway weight limitation.
After considerable discussion, the following resolution was adopted, upon motion
made by Sydney Nelson, seconded by Van Ellig and carried unanimously:
RESOLUTION
WHEREAS, the local businesses have requested the designation
of several 10 ton routes to utilize Trunk Highway No. 10 in and adjacent
to the City of Perham, and
WHEREAS, Road Rater test data has indicated sufficient load
carrying capacity on several County State Aid Highways in the area to
accomodate 10 tons.
NOW, THEREFORE, BE IT RESOLVED, that County State Aid Highway
No. 8 be designated a 10 ton route; beginning at the intersection with
Trunk Highway 10 and terminating at the north city limits of Perham,
and also that County State Aid Highway No. 80 be designated a 10 tqn
route beginning at the southeast junction with Trunk Highway 10 and
terminating at the northwest junction with Trunk Highway 10,

Upon motion made by Andy Leitch, seconded by Bert Hovland and
carried, the following resolution was a~ted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnema, that
WHEREAS, on May 6, 1980, the County Board accepted the bid of
Ackling Construction Company, Perham, MN in the amount of $117 ,396 .. 20 for
grading and aggregate surfiacing, on CSAH #7, under S .. A.P. 56-607-02, and
WHEREAS, the above contract has now been completed to the satis-
faction of the county board at a total cost of $132,647 .. 35, an increase of
$15,251.15 due to overruns on excavation, aggregate surfacing, pipe culverts and
sodding,
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby
authorized and directed to issue a warrant in the amount of $13,264.74 payable
to United States Fidelity and Guaranty Company and Ackling Construction Company
as final payment for this work.

Upon motion made by Sydney Nelson, seconded by Hub Nordgren and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners.of Otter Tail
County Minnesota, that
WHEREAS, on December 9, 1980, the County Board accepted the bid
of Mac Queen Eq'uipment, Inc., Saint Paul, .MN for one self-propelled highway
line striper in the amount of $39.404.00, and
WHEREAS, the above striper has now been delivered to the satis-
faction of the County Board at a cost of $39.404.00,
NOW, THEREFORE, BE IT RESOLVED, the County Auditor is authorized
and directed to issue a warrant in the amount of $319,404.00 payable to MacQueen
Equipment, Inc. , 595 Aldine St. , ·saint Paul, MN in full payment thereof.
