HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/25/1981MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 1:00 p.m., Tuesday, August 25, 1981, with, all members present. Gene Davenport, County Assessor, appeared before the Board relative to a recent tax court decision and the impact it might have on Otter Tail County properties. After discussion, motion was made by Van Ellig, seconded by Andy Leitch and carried, instructing the County Attorney's office to review such decisions and proceed with appropriate action. Motion was made by Van Ellig, seconded by Sydney Nelson and car- ried, to have the county's solid waste officer set up a meeting for the latter part of September or early October for the purpose of discussing solid waste needs, notices to be mailed to all landfill boards, city officials, if not reppe- sented on a landfill board, and the township association chairmen. Upon request of the City of Dent, motion was made by Sydney Nelson, seconded by Bert Hovland and carried, to advertise for bids to be received for the demolition of the structure and filling of the basement on Lot 9, Block 1, City of Dent. An application for a conditional use permit to operate a wholesale nursery located in the SW\SW¾ of Section 1-133-40 for Tom Sullivan was brought be- fore the Board. Mr. Sullivan represented himself and Mr. Thomas Donoho, attorney, represented various concerned property owners. After considerable discussion'.re- garding access to the proposed site, motion was made by Andy Leith and seconded by Hub Nordgren, to approve provided access to the site be from Trunk Highway #78. The motion failed. : / Motion was then made by Van Ellig to accept the recommendation of the Planning Advisory Commission, with conditions. The motion was seconded by Bert Hovland and carried with Andy Leitch and Hub Nordgren voting "no". Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to approve a special use permit, with conditional requirements, for Doug Ortlciff, Lot 12, Block l, Maple Acres, Girard Township, for permission to level knoll, ·placing dirt in low area. Upon motion by Bert Hovland, seconded by Sydney Nelson and ca~ried, a special use permit, with conditional requirements, was approved for Crystal Hills Association, Inc., James R. Hetland, President, on Lots 53, 54 and pt 55, Block 3, Crystall Hills, Lida Township, to fill low area. Upon motion made by Sydney Nelson, seconded by Bert Hovland and car- ried, the following sewage disposal installers licenses were approved: Robert J. Esser Ronald Neuschwander Esser Plbg. & Htg. Neuschwander Excavating Perham, Minnesota West Fargo, North Dakota Motion wasmade by Hub Nordgren, seconded by Andy Leitch and carried, to approve the application of Valentine Karasch, Henning, MN, for sewage disposal system cleaners license. Arnie Hemquist of the Otter Tail Lake Property Owners Association and two representatives from the Department of Agriculture appeared before the Board and discussed the Dutch Elm disease situation in the rural areas of the county. It was decided to bring the matter to the attention of the township officers' association and municipalities and work through the County Extension Service. Gloria Jonas, representing Otter Tail Country and Vikingland-USA, discussed last year's efforts and plans for 1982. Motion was made by Sydney Nelson, seconded by Van Ellig, to approve the application of the FRanciscan Sisters of Little Falls, for tax exempt status and cancellation of the 1981 tax on property in Amor Township. The motion failed. A question of liability coverage for the Soil & Water Conservation District was discussed and referred to the County Attorney's office. Motion was made by Andy Leitch, seconded by Van Ellig and carried, to approve payment in the amount of $1,200 to Cooper's Office Supply for the pur- chase of a used Minolta copy machine, to include a six month warranty on parts and labor, for use by the County Auditor's office. .. Upon motion made by Andy Leitch, seconded by Van Ellig and car- ried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, proceedings have been initiated pursuant to Minn. Stat. 116.02, Subd. 3 and Subd. 4 for the establishment of the Otter Tail Lake Area Sewer District and system, and WHEREAS, Ulteig Engineering, Inc., has been appointed and has qualified as the engineer for said district and system; and WHEREAS, all parties wish to clarify and agree to the payment of all costs and expenses that may be incurred by the County of Otter Tail, Otter Tail Lake Area Sewer District and the Otter Tail Lake Property Owners Association in case the proceedings initited pursuant to Minnesota Statutes 116.02, Subd. 3 and Subd. 4 are dismissed or for any reason no contract is entered for the construction of the sewer system, and WHEREAS, Ulteig Engineering, Inc., has agreed to the provisions described herein, NOW, THEREFORE, BE IT RESOLVED, the contract absolving Otter Tail County of any fees or costs incurred between Ulteig Engineering and Otter Tail County be and is hereby approved and the County Board Chairman and County Auditor are authorized to execute said agreement on behalf of Otter Tail County. Adopted at Fergus Falls, Minnesota this 25th day of August, 1981. ATTEST: Clerk Upon motion made by Bert Hovland, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by theBoard of County Commissioners of Otfer Tail County Minnesota, that WHEREAS, Harriet E. Sisson, owner of record, has made application to repurchase the West 66' of G.L. 8, lying south of line drawn west from the northern most corner of Lot 9, Block 3, Pelican Beath, ex. tracts, ·in Section 2-137-43, said property having forfeited tothe State of Minnesota on the 13th day of October, 1980, for non-payment of the 1976 tax and subsequent years, and WHEREAS, the aggregate of all delinquent taxes and assessments, with penalties, costs and interest in the amount of $288.24 has been paid, NOW, THEREFORE, BE IT RESOLVED, the County Board does here by approve the above application and grants repurchase, to be in the best public interest and relieve undue hardship.
