Motion was made by Van Ellig, seconded by Bert Hovland and carried, to reaffirm denials of the Otter Tail Colinty Planning Advisory Commission on the following applications: William Shockey Guy Worden & James P. Change platted lake lot to controlled access to lake Plat four back lots with no road Motion was made by Andy Leitch, seconded by Van Ellig and carried, to approve a preliminary plat of White Sands Estates, to be located in Section 5 of Everts Township, and a special use permit to construct approximately 1700 feet of roadway to serve proposed plat. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, to approve the plat of Froslee Shores, to be located in Sections 2-132-39 and 35- 133 -39. Motion was made by Bert Hovland, seconded by Van Ellig and carried, to approve a plat of Kids Corner, located in Section 6 -133 -41, Andy Leitch abstaining. Upon motion made by Van Ellig, seconded by Andy Leitch and car- ried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, Otter Tail County's ordinance:;relating to subdivision controls, shoreland management, setbacks and minimum lot sizes have not been amended since 1978; and ·' WHEREAS, the said ordinances do not in all respects comply with present state law and county practices; and WHEREAS, it may be necessary to amend the shoreland ordinances for the purpose of the federally funded Otter Tail Lake sewage project; and WHEREAS, the Board would benefit from a review of said ordinances, NOW, THEREFORE, BE IT RESOLVED, that the offices of the County Attorney and Shoreland Management of Otter Tail County, Minnesota, are directed to review the above-named ordinances foru~he purpose of making recommendations to the Otter Tail County Board regarding the need and desirability of amending said ordinances. ATTEST: ~;;) l3.£A-~J Clerk Motion was made by Van Ellig, seconded by Andy Leitch and carried, authorizing two employees of the Land and Resource Management .office to attend a workshop to be held in Detroit Lakes. Motion was made by Bert Hovland, seconded by Andy Leitch and carried, to offer for sale at public auction a parcel of land in Llda Township, and the County Auditor was authorized to have an abstract prepared on said property assure ownership prior to advertising. Motion was made by Bert Hovland, seconded by Andy Leitch and car- ried, to call a special meeting for 9:30 a.m., Tuesday, March 3, 1981 for the purpose of considering bids for S.P. 56-601-011, and for any other business that may come before the Board, Sydney Nelson voting "no". Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to conduct a hearing on the proposed use of Entitlement Period #12, Federal Revenue Sharing funds, at 9:30 a.m., Tuesday, March 3, 1981, and a budget hearing on the Revenue Sharing Funds at_9:30 a.m., Tuesday, March 10, 1981. Upon motion made by Van Ellig, seconded by Andy Leitch and carried, reconstruction of Summit Avenue from Cascade Street to Friberg Avenue and recon- struction of Cascade Street from Washington Avenue to Vernon Avenue, in the City of Fergus Falls, be added to the long range construction plan and considered at the hearing to be conducted on February 4th, as requested by the City of Fergus Falls. Upon motion made by Bert Hovland, seconded by Van Ellig and carried, Hub Nordgren was appointed to the A.M.C. District IV Study Board. Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, with Bert Hovland and Van Ellig voting "no", to appoint John Snowberg as caretaker of county parks at $100.00 per month plus hospitalization insurance benefits. '('Q_SCinded ~-3 -kl Upon motion made by Bert Hovland, seconded by Sydney Nelson and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on May 6, 1980, theCounty Board accepted the bid of Ackling Construction in the amount of $22,424.55 for grading and aggregate surfacing on a Dunn Township road in Sections 22 and 27 near Franklin Lake, and WHEREAS, the above contract has now been completrd to the satis- faction of the County Board at a total cost of $21,962.75, a decrease of $461.80· due to an underrun on sodding, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized to issue a warrant in the amount of $2,223.28 payable to Ack~ing Construction Company, Perham, MN as final payment for this work. Adopted at Fergus Falls, Minnesota this 20th day of January, 1981. ATTEST: ~-ds)~ Clerk Upon motion made by Van Ellig, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on June 5, 1979 the County Board accepted the bid of Starry Construction, Long Prairie, MN in the amount of $212,811.40 for C.P. 79: ss·, and WHEREAS, the above contract has now been completed to the satis- faction of the County Board at a total cost of $255,318.20, an increase of $42,506;80 due to additional work and liquidated damages in the amount of $6,800.00, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $18,778.48 payable to Starry Construction Co., Long Prairie, MN as final payment for this work. Dated at Fergus Falls, Minnesota this 20th day of January, 1981. ATTEST: Clerk Harold Schmidt, representative of the AFSCME 65, and representatives of the county highway maintenance union appeared before the Board relative to requested salary increases for 1981. After considerable discussion, motion was made by Sydney Nelson to grant highway department union members a 62¢ per hour pay increase. The motion died for lack of a second. Motion was made by Van Ellig, seconded by Sydney Nelson, to grant a 10% pay increase for 1981 and 1982 based on a two year contract. The motion failed with Andy Leitch, Bert Hovland and Hub Nordgren voting "no". Motion was made by Bert Hovland, seconded by Andy Leitch and carried, to approve payment in the amount of $290.00 to Glenn Cording & Associates, representing one-third of the total cost of $870.00 field observations in connection with a review of wall distress in the law enforcement center. Motion was made by Andy Leitch, seconded by Sydney Nelson and car- ried, to approve an agreement between Minnesota Counties Research Foundation to provide professonal consulting services to assist in developing a cost allocation plan for services performed in 1979 at a cost not to exceed $4,800 and the Chairman of the Board was authorized to execute said agreement on behalf of Otter Tail County. Motion was made by Hub Nordgren, seconded by Sydney Nelson and car- ried, to approve an agreement between Otter Tail County and the Burlington Nor- thern, Inc., for the widening and improvement of County Highway No. 143 in Section 30 -135 -36, near Bluffton, Minnesota, and the Board Chairman and County Auditor are hereby authorized to execute said agreement on behalf of Otter Tail County. Motion was made by Van Ellig, seconded by Andy Leitch and carried, to approve an agreement between the City of Fergus Falls, Minnesota and Otter Tail County for the reconstruction and resurfacing of Fir Avenue in the City of Fergus Falls, with the County's obligation being the costs of grading, base and bituminous work, for the full width of the street, exclusive of curb and gutter, and the Chairman of the Board and the County Auditor were authorized to execute said agreement on behalf of Otter Tail County. Upon motion made by Sydney Nelson, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS on the 22nd of December, 1980, the county board accepted proposals from Minnesota Motor Company, Fergus Falls, MN in the amount of $6,767.00 for a 1980 Chevrolet Malibu Classic, and Fergus Dodge, Inc., Fergus Falls, MN in the -amount of $5,803.21 for a 1980 Dodge Aspen 2-dr., for use by the Sheriff's ·Department, and WHEREAS the above automobiles have now been delivered to the satisfaction of the County Board, NOW, THEREFORE, BE IT HEREBY RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $6,767.00 to Minnesota Motor Company, Fergus Falls, MN and Fergus Dodge, Inc., in the amount of $5,803.21, in full payment thereof. Stat. 37§.51 and notice thereof, a hearing was conducted for the purpose of considering the Otter Tail County Board of Adjustment proposed ordinance. After listening to the various interested parties, Bert Hovland introduced the following ordinance and moved for its adoption: ORDINANCE The County Board of Otter Tail County ordains: I. General Provisions A. Title: This Orqinance from the date of its passage shall be entitled: B. c. THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT ORDINANCE Purpose: The purpose of this Ordinance shall be to implement offic±al controls established by Otter Tail County, Minnesota, under Chapter 394 of Minnesota Statutes. Legal Au6hority: This Ordinance is enacted pursuant to Minnesota Statues~ 394.27 to maintain and confirm the Board of Adjustment previously created without an Ordinance. II. Establishment of Board of Adjustment and Its Powers and Duties A. The Board of Adjustment previously established by the Otter Tail County Board of Commissioners by resolution is hereby confirmed and maintained as the Board of Adjustment defined in Minnesota Statutes~ 394.27. B. The Otter Tail County Board of Adjustment shall consist of five members: four of these members shall be appointed at large by the Otter Tail County Board of Commissioners, at least one of these four individuals shall be a resident of an unincorporated area of the county; and the fifth member shall be the Chairman of the Otter Tail County Planning Commission. C. The term of office of members of the Board of Adjustment shall be for a period of at least one year. Any member may be reappointed for successive one-year terms by the Otter Tail County Board of Commissioners. This provision shall not apply to the Chairman of the Planning Commission, who shall serve on the Board of Adjustment during the time period that he or she is Chairman of the Planning Commission. D. Any member of the Board of Adjustment may be removed by the Otter Tail County Board of Commissioners for malfeasance or nonfeasance in the performanceof his or her official duties. E. No elected officer of Otter Tail County, nor any employee of the Otter Tail County Board of Commissioners shall serve as a member of the Otter Tail County Board of Adjustment. F. The powers and duties of the Otter Tail County Board of Adjustment shall be as set forth in Minnesota Statutes§ 394.27. III. Effective Date This Ordinance shall become effective upon its passage and publication. The motion was seconded by Van Ellig and by unanimous vote· was declared adopted, this 20th ~ay of January, 1981. ATTEST: Clerk RESOLUTION Upon motion made by Bert Hovland, seconded by Van Ellig and carried, the following resolution was adopted: I RESOLVED, by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, Otter Tail County, like most other units of government, is experiencing funding sh_ortages ~nd wi_ll very · li]5.el:,f e?4>erience more and greater funding shortages in the future, and WHEREAS, new employees should be hired and employees who leave employment with the County should be replaq~d only when absolµtely necessary, and WHEREAS, it is appropriate for the Otter Ta.1.l. County Board of Commissioners to make the determination of whether the filling of a position is necessary in the best interests of the County, NOW, THEREFORE, BE IT RESOLVED, that subject to the laws of the State of Minnesota and existing collective bargaining agreements, a hiring freeze is hereby imposed upon Otter Tail County, Minnesota, except where hiring is absolutely essential, and BE IT FURTHER RESOLVED, that all department heads present any hiring request to the Otter Tail County Board of Commissioners prior to filling any position, whether newly established or arising from the leaving of employment of· an existing employee. Adopted at Fergus Falls, Minnesota, this 20th day of January, 1981. ATTEST: I RESOLUTION Upon motion made by Van Ellig, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that WHEREAS, the Auditors of the State of Minnesota have indicated that counties not on the accrual basis of accounting will receive adverse opinions when audited; and WHEREAS, Otter Tail County realizes that there are certain benefits and advantages to an accrual form of accounting, and WHEREAS, no other county in Minnesota is presently on the accrual system, nor is the State of Minnesota or Federal Government, and WHEREAS, a change from the cash basis of accounting to an accrual basis in Otter Tail County would involve extensive costs for which the State has not provided funding assistance, and WHEREAS, it does not appear that Otter Tail County would enjoy sufficient benefits from a transfer to the accrual basis of accounting at this time to justify the expenditure by the County of its own funds for such a system, NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County, Minnesota, remain on a cash basis accounting system, and BE IT FURTHER RESOLVED, that Otter Tail County accept an adverse opinion from the Auditors of the State of Minnesota in this regard.
