Nelson, Berton Hovland, Andy Leitch, A. Hubert Nordgren and Van R. Ellig present. After the swearing in of the newly elected commissioners by Judge Harlan L. Nelson, the clerk stated the first order of business was the election of the Chai-rman and Vice Chairman for the year 1981. Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, A. Hubert Nordgren was elected Chairman. Upon motion made by Hub Nordgren, seconded by Sydney Nelson and carried, Andy Leitch was elected Vice Chairman. Roger Oldenkamp, attorney, appeared before the Board as counsel for Malcolm Lee, recently terminated manager of the Land & Resource office, re- questing reinstatement of Mr. Lee. After considerable discussion, motion was made by Bert Hovland, seconded by Sydney Nelson and carried, with Andy Leitch and Hub Nordgren voting "no", to rescind the motion of December 22nd calling for Mr. Lee's dismissal and reinstate Mr. Lee as Manager of the Land & Resources, effective as of the 22nd of December, 1980. Motion was made by Bert Hovland, seconded by Sydney Nelson and carried with Andy Leith and Hub Nordgren voting "no", to rescind the motion of December 22nd authorizing advertising for a new manager of the Land & Resources office and withdraw all advertising. Motion was made by Van Ellig, seconded by Andy Leitch and carried, to appoint Dorothy Ness, Fergus Falls to the Fergus Falls-Otter Tail County Airport Zoning Board for a three year term, as recommended by the zoning board. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to appropriate $2,300 out of the County Revenue Fund for Otter Tail Country·: Tourism Ass'n, with the stipulaton no less than $300.00 be transferred by them to Viking Land-USA. Upon motion made by Bert Hovland · , seconded ----------------- by Andy Leitch and carried, the following resolution was ----"------------- adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The following dates be designated as the dates on which the County Board shall meet during the year 1981: February 3rd and 4-th March 10th and 11th April 7th and 8th May 12th and 13th June 9th and 10th July 13th and 14-th August 11th and 12th September 8th and 9th October 13th and 14-th November 9th and 10th December 8th and 9th Adopted at Fergus Falls, Minnesota this 6th day of January, 1981. Statute 282.05 for the apportion- I ment of the proceeds from the sale of tax-forfeited lands: I WHEREAS, the County Auditor shall apportion the tax sale proceeds to the ,taxing districts pursuant to Minn. ~tat. 282.0E, and· WHEREAS, Minn. Stat. 282. 08( 4 ){b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county partks and recreational areas, and WHEREAS, Otter Tail County has parks and recreational areas which would benefit by such an apportionment, NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retain 20% of the proceeds from the rale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds available after making the necessary statutory disbursements, said proceeds to be disbursed according to law. ATTEST: Clerk The Chairman made the following appointees: Committee in charge of Court House, Court House Annex, Government Services Building, Jail and Grounds: Andy·Leitch and Sydney Nelson Committee in charge of furnishings, supplies, etc.: Bert Hovland and Van Ellig -------------------------------- Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of-Otter Tail County Minnesota, that WHEREAS, funding has been approved for Otter Tail County under Grant Number 43190405280, Crime Control Planning Board for the purpose of con- ducting a project entitled Otter Tail County Jail Treatment Coordinator, for a period ending April 1, 1981, and WHEREAS, the Otter Tail County Board desires to continue the services of the Otter Tail County Jail Treatment Coordinator after the grant funds have been exhausted, NOW, THEREFORE, BE IT RESOLVED, the Otter Tail County Board does hereby assume fiscal responsibility of the Otter Tail County Jail Treat- ment Coordinator after the grant funds expire on April 1, 1981. ATTEST: Clerk Upon motion made by Bert Hovland, seconded by Van Ellig and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Ser- vice, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the U. S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U. S. Fish and Wildlife Service met with the County Board on January 6, 1981 and informed said Board that a waterfowl easement had been secured from Mr. and Mrs. Frederick Fosse, on the SE¼ of Section 10 -134 -44, NOW, THEREFORE, BE IT RESOLVED acquisition of the aforementioned waterfowl easement by the U. Metion was made by Andy Leitch, seconded by Hub Nordgren and carried, requesting Otter Tail Country Tourism select an individual as Otter Tail County's representative to Viking Land-USA. Motion was made by Bert Hovland, seconded by Sydney Nelson and carried, to correct the minutes of the December 22nd meeting to read "to grant an increase of 9% for each department's non-union personal services budget, to be distributed at each department head's discretion, with the 9% to include . . ,, merit increases for the year 1981, plus whatever longevity applies. Motion was made by Sydney Nelson, seconded by Bert Hovland and carried, authorizing the county engineer to advertise for bids to be received until 10:00 a.m., Tuesday, February 3, 1981, for road signs and posts. Chaii-man• ATTEST: Clerk 0 With no further business, the Chairman declared the meeting adjourned until 9:30 a.m., Wednesday, January 7th, 19·91. -WEDNESDAY'S SESSION - Pursuant to adjournment,,the Board of County Commissioners of Otter Tail County met at 9:30 a.m., Wednesday, January 7, 1981, all members present. Motion was made by Andy Leitch, seconded by Van Ellig and carried, to correct the minutes of the December 10th meeting to eliminate the reference in the Resolution pertaining to the County Board 1981 salaries .for per diem allowance for service on the.Human Services Board as this was addressed at the December meeting of the Human Services Board. Motion was made by Bert Hovland, seconded by Van Ellig and carried, to approve an application of Walter & Phyllis Lewis for homestead classification in Maine Township. Rick Norgren appeared before the Board requesting repair and clean- out of County Ditch #11 in Tordenskjold Township. Considerable discussion followed, no action taken. Motion was made by Sydney Nelson, seconded by Van Ellig and carried, authorizing the County Assessor to increase assessment fees for assessing done by the county assessor's office for various townships and cities from $3.00 to $3.25 per parcel. Motion was made by Andy Leitch, requesting Malcolm Lee provide his own transportation from his home to the courthouse. The motion was seconded by Hub Nordgren but died in a tie with Van Ellig and Sydney Nelson voting "no". Motion was made by Sydney Nelson, seconded by Andy Leitch and carried, authorizing the County Treasurer, George Nelson, to liquidate various certificates of deposit under the former nursing home account, using his discretion in depositing into savings accounts to accumulate for transfer to money market cer- tificates. Glen M~lby and Roger Bengtson, members of the county's personnel committee, appeared before the board relative to the county's car policy. No action taken. 0 Upon motion made by Andy Leitch, seconded by Van Ellig and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, the County has considered the establishment of a Deferred Compensation Plan to be made available to all eligible County employees, elected officials and independent contractors pursuant to Section 457 of the Internal Revenue Code permitting such Plans; and WHEREAS, certain tax benefits could accrue to employees, elected officials, and independent contractors participating in said Deferred Compensation plans; and WHEREAS, such benefits will act as incentives to County employees to voluntarily set aside and invest portions of their current income to meet their future financial requirements and supplement their PERA and/or Social Security; and WHEREAS, the National Association of Counties has established a Master Deferred Compensation Program for its member Counties, permitting its member Counties and their employees to enjoy the advantages of this Program; and WHEREAS, by adoption of the NACo Program, all regulatory, opera- tional, administrative and fiduciary responsibilities are hereby assumed by NACo in behalf of County; and WHEREAS, NACo, as Plan Administrator, agrees to hold harmless and indemnify the County, its appointed and elected officers and participating employees from any loss resulting from NACo or its Agent's failure to perform its services pursuant to the NACo Program; NOW, THEREFORE THE COUNTY GOVERNING BODY DOES HEREBY RESOLVE~, AS FOLLOWS: The Governing body, meeting in regular scheduled session this 7th day of January, 1981, hereby adopts the National Association of Counties Deferred Compensation Program and hereby establishes the County of Otter Tail, Minnesota Deferred Compensation Plan for the voluntary participation of all eligible County employees, elected officials and independent contractors. The County Auditor is hereby authorized to execute for the County, individual participation agreements with each said employee requesting same, and to act as the "Administrator" of the Plan representing the County and to execute such agreements and contracts as are necessary to implement the program. It is implicitly understood that, other than the incidental expenses of collecting and disbursing of the employee's deferrals and other minor administrative matters, there isto be no cost or contribution by the County to the program. Stat. all taxi?g qistricts are required to submit levies for the following taxing year prior to October 10th, and WHEREAS; the County Board is bound by these statutes to have the levy set and budget established by October 10th, NOW, THEREFORE, BE IT RESOLVED, all depa~tments of the county, including unions, personnel committees, department heads, etc., be and are therefore required to submit all budget, salary, etc., requests to the County Board prior to August 15th. Robert Wendel, representative of National Association of County Officials, appeared before the Board relative to a deferred compensation plan proposed by the NACo. Motion was made by Andy Leitch, seconded by Van Ell_ig and carried, to accept the plan as offered by NACo and allow a representative to meet with the various depa.:r:-tment heads and employees. Norman· Fjestad .. appeared before the Board rel~tive to the WesMin _,. Resource Conservation and Development Committee member-appointments. Motion was made by·Bert Hoviarid, seconded by Van Ellig and carried, to re'.'."appoint Norman Fjestad to th_e WesMin RC & D Committee for the year 1981. Motion was made by Sydney Nelson, seconded by Andy Leitch and carried, to appoint Bert Hovland as Otter Tail County's representative on the WesMin RC & D Committee, for the year 1981.
