HomeMy WebLinkAboutBoard of Commissioners - Minutes - 12/09/1980i MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 a.m., Tuesday, December 9, 1980, with all members present. The Board, having previously advertised for bids to be received for a highway line striper to be used by the highway department, proceeded to open bids which were found to be as follows: MacQueen Equipment, Inc., Saint Paul, MN Bryan Equipment, Inc., Brainerd, MN Swanston Equipment Co., Fargo, ND Meeting Specifications $39,404.00 44,600.00 47,295.00 Below Specifications $21,713.00 22,530.00 After considerable discussion, motion was made by Sydney Nelson, seconded by John Snowberg and carried with Bert Hovland voting "no", to accept the bid of MacQueen Equipment, Inc., Saint Paul, MN in the amount of $39,404.00, the lowest bid meeting specifications. The Board, having previously advertised for bids to be received for the seasonal supply of calcium chloride, proceeded to open bids which were found to be as follows: Anderson Chemical Company, Litchfield, MN Van Waters & Rogers, Saint Paul, MN Flake $193.68 196. 72 Pellet $250.00 252.65 After consideration, motion was made by Bert Hovland, seconded by Andy Leitch and carried, to accept the recommendations of the County Engineer and award the contract to Anderson Chemical Company, Litchfield, MN for $193.68 per ton carload lots of flake calcium chloride and $250.00 per ton, carload lots for pellet calcium chloride, being the lowest bid. / / \ I I Upon motion made by Andy Leitch, seconded by Sydney Nelson and carried, the following resolution was adopted: RESOLVED by theBoard of County Commissioners of Otter Tail County Minnesota, that WHEREAS the County Board on the 5th of June, 1979', awarded the bid for highway striping to Traffic,1'kiking Service, Buffalo, MN in the amount of $33,592.50, and WHEREAS the above contract has now been completed to the satis- faction of the County Board at.a total cost of $42,422.20, an increase of $8,829.50 due to additional work, NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the amount of $4,242.22 payable to Traffic Marking Service, Buffalo, MN as final payment for this work. Dated at Fergus Falls, Minnesota this 9th day of December, 1980. ATTEST: Motion was made by Andy Leitch, seconded by Sydney Nelson and carried, to conduct a hearing at 2:00 p.m., Tuesday, January 20, 1981, for the purpose of establishing an ordinance to implement official controls for the Otter Tail County Board of Adjustment and the County Auditor was authorized to publish the necessary notices. Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, an agreement between the City of Fergus Falls and the County of Otter Tail for pro- secution of misdemeanors and petty misdemeanor violations occurring within the cor- porate limits of the City of Fergus Falls was approved, and the Chairman of the Board and the County Audi tor were authorized to execute said agre_ement on behalf of the County. Upon motion made by Hub Nordg~en, seconded by Bert Hovland and car- ried, Wilfred Estes, Battle Lake, MN was re-appointed to the Otter Tail County Plan- ning Advisory Commission for a period of three years, commencing January 1, 1981. Upon motion made by Bert Hovland, seconded by Sydney Nelson and car- ried, Richard Fortmann, Fergus Falls, MN was re-appointed to the Otter Tail County Planning Advisory Commission for a period of three years, commencing January 1, 1981. Upon motion made by Andy Leitch, seconded by Sydney Nelson and car- ried, the County Auditor was authorized to advertise for printing and publishing for the year 1981, bids to be received January 6, 1981 at 2:00 p.m. Motion was made by Sydney Nelson, seconded by Bert Hovland and car- ried, to approve the application of Jerry Wolf for on sale liquor license, Sunday liquor license and wine license for use at the Ravens Inn, Perham Township. Motion wasmade by Hub Nordgren, seconded by Bert Hovland and carried, to grant a paid holiday to all county employees, a choice of either December 26th or January 2:.sd, to be determined by each department, with the court house to remain open for public business. Motion was made by Sydney Nelson, seconded by Andy Leitch and carried, to appoint Melvin Paavola as a member of the Otter Tail County Housing and Redevelop- ment Authority, to complete the unexpired term of Jared Smal]ey who has resigned. After examining proposals for conducting a mini-and a maxi audit of the courthouse as requested by the Minnesota Energy Agency, motion was made by Bert Hovland, seconded by John Snowberg and carried, to hire the firm of Vigesaa Engineers, Moorhead, Minnesota, to conduct the necessary audits. Motion was made by Hub Nordgren, seconded.by Sydney Nelson and car- ried, to approve the °following applications for special use permits, subject to conditional requirements: Carl C. Amor Township Dora Township Fill low area Fill low area Fill low area Cut and fill Motion was made by Bert Hovland, seconded by Sydney Nelson and carried, to enter into a purchase agreement with 3M for the 3M Secretary 2, copy machine, presently being used by the Land & Resource Management office, pay-off to be within a three year period. Motion was made by Bert Hovland, seconded by Hub Nordgren and car- ried, to approve payment of $3,223.76 to the West Central Regional Development Commission for Otter Tail County's portion of the Otter Tail County Land Use study. Motion was made by John Snowberg, seconded by Bert Hovland and car- ried, to reinstate Otter Tail County's membership 'in the National Association of Counties and pay the annual dues of $578.00, Andy Leitch voting "no". Motion was made by Hub Nordgren, seconded by Andy Leitch and carried, authorizing the County Auditor to write to the Crime Control Planning Board and ad- vise them Otter Tail County will assume the fiscal responsibility of the Otter Tail County Jail Treatment Coordinator after the grant funds expire April 1, 1981. The Chairman adjourned the meeting until 9:30 a.m., Wednesday, December 10, 1980. Upon motion made by Sydney Nelson, seconded by Andy Leitch and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that The annual salary of the County Attorney shall be fixed at 85% of the judge's salary, with a graduated increase of 5% for each two year term of performance, up to 100% of the judges' salary, and The assistants' salaries to be 60% and 70% of the county attorney's salary, for the year 1981. ATTEST: c;;;hL ; .. ~ 1:3..v,ff' ,u , J Clerk Upon motion made by Hub Nordgren, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on-the 19th day.of September, 1974, Rollie Thiel en- tered into contract with the State of Minnesota, through Otter Tail County as agent, for the purchase of tax-forfeited property, being, Except the SWly 16', all of Lot 4, Block 4, and Except the SEly 20' of the NEly SO' and except the SWly 161 , all of Lot 5, Block 4, Original Plat of the City of Henning, total price being $4,000.00, plus land assurance fee of $120.00, and WHEREAS a down payment of $1,120.00 was paid at time of pur- chase with the balance of $3,000 to be paid in ten annual equal installments plus interest of 4% on the unpaid balance, and WHEREAS said contract calls for payment of all taxes and special assessments as they come due, and WHEREAS, no payments have been remitted since the initial down payment and delinquent taxes have accrued on said property, NOW, THEREFORE, BE IT RESOLVED, the contract be and is hereby cancelled, and BE IT FURTHER RESOLVED, said parcel shall be included in the next sale of tax-forfeited lands so sold in Otter Tail County. ATTEST: Clerk Upon motion made by Hub Nordgren, seconded by Sydney Nelson and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, it has been proposed that the Seventh Judicial District be redistricted to remove certain counties from the Seventh District in order to create a new Eleventh Judicial District, and WHEREAS, reducing the present size of the Seventh District will result in the costs of administering the Seventh District being borne by fewer counties, thus increasing the expenses of Otter Tail County and the remaining counties in the Seventh District, and WHEREAS, the Seventh Judicial District in its present form provides an effective and efficient legal system and by reducing the number of district judges from four to two, it will seriously erode the existing legal system, and WHEREAS, on May 10, 1980, the Seventh District Bar Association, at its annual meeting passed a resolution opposing any change in the Seventh Judicial District, NOW, THEREFORE, BE IT RESOLVED, the Board of Commissioners of Otter Tail County Minnesota opposes the redistricting of the Seventh Judicial District to create a new Eleventh Judicial District, and BE IT FURTHER RESOLVED, copies of this resolution be forwarded to each Otter Tail County representative in the State Legislature.
