OF THE
BOARD OF COUNTY COMMISSIONERS
OTTER TAIL COUNTY MINNESOTA
Pursuant to adjournment, the Board of County Commissioners met
at 1:00 p.m., Tuesday, November 25, 1980, all members present.
Motion was made by S¥dney Nelson, seconded by Bert Hovland and
carried, to approve an application of Norman I. Meyer & Garold R. Bergum on
property in Dead Lake Township where wooded land was assessed as tillable,
for reduction in assessed valuation.
Motion was made by John Snowberg, seconded by Andy Leitch and
carried, to approve payment in the amount of $2,201.80 to Sauby Insulation,
Fergus Falls, MN for insulation at the house at Phelps Mill.
Motion was made by Sydney Nelson, seconded by John Snowberg and
carried, to appropriate out of the County Revenue Fund the sum of $500.00 for
the 1981 budget for the Minnesota Red River Valley Development Ass'n.
The Board, having previously advertised for bids to be received
for a dynamic deflection test system to be purchased jointly with other counties,
proceeded to open bids which were found to be as follows:
Foundation Mechanics, Inc., El Segundo, CA $46,965.00
After consideration, motion was made by Sydney Nelson, seconded
by Hub Nordgren and carried, to accept the bid of Foundation Mechanics, Inc.,
El Segundo, CA in the amount of $46,965.00, being the only bid.
The Board, having previously advertised for bids to be received
for a walk-in van for use by the highway department with the above mentioned
road-rater, proceeded to open bids which were found to be as follows:

After consideration, motion was made by John Snowberg, seconded
by Andy Leitch and carried, to accept the bid of Fergus Dodge, Inc., Fergus
Falls, Minnesota in the amount of $10,252.69, being the lowest bid.
Upon motion made by Andy Leitch, seconded by John Snowberg and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS on November 24th, Robert Dieseth made application to
repurchase the N 40 1 of W 55' of Res. Block 67, Amended Plat, City of Fergus
Falls, said property having forfeited to the State of Minnesota on the 13th
day of October, 1980, and
WHEREAS the above applicant has paid the aggregate of all
delinquent taxes and assessments, with penalties, costs and interest in the
sum of $559.66,
NOW THEREFORE, BE IT RESOLVED, the County Board does hereby
approve said application and does hereby grant the repurchase to relieve
undue hardship and be in the best public, interest.

RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS, on the 24thday of November, 1980, Robert Dieseth,
successor in interest of the W 55' of Lot 18 and of Lot 19, Block 20, Original
Plat, City of Fergus Falls, has made application to repurchase said property
having forfeited to the State of Minnesota on the 13th day of October, 1980, and
WHEREAS the above applicant has paid the aggregate of all delin-
quent taxes and assessments, with penalties, costs and interest in the sum of
$4,395.85,
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby
approve said application and does hereby grant the repurchase, permission to
do so to be in the best public interest and relieve undue hardship.

carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS on the 24th of November, 1980, Robert Dieseth, successor
in interest of Lots 6 & 7, Block 20, Original Plat of the City of Fergus Falls,
has made application to repurchase said property having forfeited to the State
of Minnesota on the 13th day of October, 1980, and
WHEREAS the above applicant has paid the aggregate of all delin-
quent taxes and assessments, with penalties, costs and interest in the sum of
$12,125.21,
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby
approve said application and does hereby grant the repurchase, permission to
do so to be in the best public interest and relieve undue hardship.

Upon motion made by Andy Leitch, seconded by John Snowberg and
carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS the City of Fergus Falls, by its Mayor and City Admini-
strator, has made application for the conveyance of the North 150' of Lots 11
and 12, Block 3, Newcomb's Addition to the City of Fergus Falls, said property
having forfeited to the State of Minnesota on the 13th day of October, 1980,
said property to be used for roadway purposes,
NOW, THEREFORE, BE IT RESOLVED the County Board does hereby
approve said application and recommends the same be granted.

Motion was made by Andy Leitch, seconded by Bert Hovland and
carried, to place all delinquent 1980 personal property and mobile home taxes
into judgment, and the following report of the County Board of the County of
Otter Tail, State of Minnesota, of uncollected personal property taxes for the
year 1980 is presented:
Fergus Falls, Minnesota, November 25, 1980
BE IT KNOWN, That the County Board of Otter Tail County, Minnesota, did
meet in session on the 25th day of November, 1980, that at said session the County Treasurer
of said County delivered to said Board the list of uncollected personal property taxes for
the year 1980, together ~ith his certificate thereon as required by law; and that at said
session the said Board did duly consider said list of uncollected taxes, and did cancel
such taxes as they are satisfied cannot be collected. That the following is a correct list
of said uncollected personal property taxes in said County for said year of 1980, as so re-
vised by said Board, and that the Clerk of District Court is ordered to issue citations
thereon, to-wit:

and carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS a promotional sign placed ~y the City of Perham at
the junction of CSAH #BO and TH #10, near the City of Perham has been removed
by the State of MinnesotaDepartment of Transportation, and
WHEREAS it is the consensus of the Otter Tail County Board
of Commissioners that said sign provides an enhancement to the general area
and is non-obstructive,
NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby
request said sign be permitted to remain at the intersection of CSAH #BO
and TH #10,
BE IT FURTHER RESOLVED, copies of this resolution be mailed
to The Minnesota Commissioner of Transportation, The State and Federal
Representatives and the Region IV Department of Transportation office.

Upon motion made by Andy Leitch, seconded by Sydney Nelson and
carried, the following resolution was adopted:
RESOLUTION
WHEREAS, Minnesota Laws 1980, Chapter 607, Article 19 authorizes
a County to impose a gravel production tax, with provisions for reporting
and payment of such tax by an operator eng~ged in the removal of. gravel,
to the County Auditor; and also establishes penalties to be imposed if the
required reports are not submitted or the due tax paid, and
WHEREAS, said Minnesota Laws 1980, Chapter 607,.Article 19 provides
for a distribution of funds collected by the imposition of the gravel tax
as follows: 60% to the County Road and Bridge Fund; 30% to a County Town
Road and Bridge Fund for the maintenance and repair .of roads traveled by
vehicles hauling gravel, in a manner to b~ determined by the County Board;
and 10% to a County Land Restoration Fund for expenditures required for
site work on County property.
NOW, THEREFORE, BE IT RESOLVED, that as of January 1, 1981 a gravel
production tax will be imposed in Otter Tail County under Minnesota Laws 1980,
Chapter 607, Article 19 at the rate of 10¢ per cubic yard of material.
BE .IT ALSO RESOLVED, that. a County ''.Town Roa,d and Bridge Fund" and
a County "Land Restoration Fund" are: h~re~y: esta~lished.
BE I.T FURTHER RESOLVED, that for the purposes of this Resolution,
sand is considered to .be gravei except ·when •it is us.ed strictly as fill
IDaaterial with no other structural benefits being derived from the material.

Upon motion made by Sydney Nelson, seconded by Andy Leitch and
carried, the following resolution was adopted:
RESOLUTION
WHEREAS, Otter Tail County has imposed a gravel production tax
as authorized under Minnesot~ Laws 1980, Chapter 607, Article 19, and
WHEREAS, the various. Townships of Otter Tail County are required
to report (Form· 1) and pay-the ta.x on· gravel produced from their sources,
and
WHEREAS, the various Tcrwnships of Otter Tail County are eligible
to share in a portion of the tax collected from all County gravel.sources.
NOW, THER.EFORE, BE IT RESOLVED, that all Townships desiring to
receive an allqtlllent from the· County ''·Town Road and Bridge Fund" shall
file an annual 1;epo1;t (Form 21 disclosing the location -and the amount of
gravel material used for the Jllaintenance of their respective road systems.
BE IT ALSO RESOLVED, that the Otter Tail County Board of Corrnnissioners
shall annually devise a_ fot;111ula. fqr th.e distribution· of payments from the
County '1To~ Road and Bridge Fund" based on the gravel useage and replacement
or repair of major drainage structures of each participating township and
the monies available.
BE IT FURTHER RESOLVED, that the.first payments to the participating
townships shall be made on or be.fore July 1, 19.82 for the gravel taxes
collected in 1981 and subsequeµt piyments shall_ be,made on or before July 1st·
of each year thereafter.

carried, the following resolution was adopted:
RESOLVED by the Board of County Commissioners of Otter Tail
County Minnesota, that
WHEREAS, the Otter Tail County Board of Commissioners desires
to fill a vacancy in the Crystal Lida Sewer Commission created by the resignation
of Mr. Kenneth McNabb, and
WHEREAS, the Otter Tail County Board of Commissioners desires to
re-appoint L. Bud Hanson andClarence Peterson to the commission, their terms
having expired on August 31, 1980,
NOW, THEm;FORE, BE IT RESOLVED, that Wesley Schierman is hereby
appointed to fill the unexpimi term of Mr. Kenneth McNabb, and L. Bud Hanson and
Clarence Peterson are hereby re-appointed to the Sewer Commission for an addi-
tional term of four years. Said appointment and re-appointments shall take
effect immediately, and the name, commencement date and termination date of
the term of each current member of the Board is hereby designated as follows:
