HomeMy WebLinkAboutBoard of Commissioners - Minutes - 09/09/1980MINUTES OF THE ADJOURNED MEETING OF THE BOARD OF COUNTY COMMISSIONERS OTTER TAIL COUNTY MINNESOTA Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 9:30 a.m., Tuesday, September 9, 1980, with Bert Hovland absent. Stu Fox, N.C.R. representative, appeared before the Board with a demonstration on N.C.R. validating terminals proposed for the County Treasurer's office. No action taken. Upon motion made by Sydney Nelson, seconded by Hub Nordgren and carried, the Chairman of the Board and the County Auditor were authorized to execute a quit claim deed to Rudolph U. and Martha Maijala, as joint tenants, conveying easement on the underlying property located in the SW¼SE¼ of Section 35 -137 -37, 0 being an easement for highway purposes in which the County no longer has an interest. Because of negotiations between Otter Tail County and Osher Company at the time of the sale of the county nursing home, motion was made by Andy Leitch, seconded by Hub Nordgren and.carried, to pay the sum of $4,597.66, being 7/12 of the 1981 tax, based on the 1980.assessment at which time the property was in the name of Otter Tail County. Upon motion made by Andy Leitch, seconded by Hub Nordgren and car- ried, the following applications were approved for reduction of assessed valuation: I. C. & Mary Dahl Jim Schmidt Dunn Township Assessed at higher percentage of completion than actual Fergus Falls City Mobile home overvalued for actual use (subject to approval by City of Fergus Falls) Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to not grant forgiveness on a portion of interest on a delinquent tax on property in Carlisle Township owned by the U. S. Fish and Wildlife Service. Motion was made by Sydney Nelson, seconded by Andy Leitch and car- ried, approving payment to Corporate Risk Managers, Inc., Eden Prairie, Minnesota in the amount of $78,000 to cover annual cost of Worker's Compensation Plan, under a joint powers agreement through the Association of Minnesota Counties. ---~ I cca i , I Upon motion made by Andy Leitch, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota,· that WHEREAS, the City of Vining has made application for the con- struction of a fire hall in said City, and WHEREAS before approval is granted, clearance must be made by the County of Otter Tail as to conflicts with the county plans or regulations, NOW, THEREFORE, BE IT RESOLVED, the construction of a fire hall by the City of Vining, in the City of Vining, does not conflict with any county plans or regulations. C ATTEST: Clerk I Upon motion made by Hub Nordgren, seconded by Sydney Nelson and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, increasing heavy traffic together with rapidly deteriorating highway surfaces result in a need for counties to be able to determine the existing structural strength of roadbeds for designing cost-effective resurfacing thicknesses and seasonal weight restrictions, and WHEREAS, the counties of Mn DOT District Four have expressed an in- terest in the joint-purchase of testing equipment which will provide a non destruc- tive testing procedure for determining the existing roadbed structural strength, and WHEREAS, joint county ownership will provide the following advantages: 1. Rapid testing proceduresas developed with the proposed equipment will provide time for equipment sharing between the several counties. 2. Shared ownership costs will make total costs economically feasable for each of the counties. 3. Duplication of technician employment and training will be eliminated. 4. Test result data will be available .to the counties in a timely manner. WHEREAS, Minnesota Statute 471.59 (1978) authorized counties to jointly purchase and operate equipment under.the Joint Exercise of Powers. NOW, THEREFORE, BE IT RESOLVED: 1. Otter Tail County hereby authorizes participation with other counties of MnDOT District Four in an agreement for the joint purchase, ownership and operation of the testing equipment requiredfor determining the existing roadbed structural strength. 2. Otter Tail County is hereby authorized to act on behalf of the several counties to purchase the desired testing· equipment and to administer the operatbn and maintenance of this equipment 3. Each county's share of the purchase price shall be determined as follows: 50% of the purchase cost shall be divided equally between the participating counties. The remaining 50% shall be divided among the participating counties in the same ratio as the individual county's approved county state aid highway m:iJeage bears to the total approved mileage of the participating counties. 4. Each participating county shall pay a per test user fee for tests per- formed in that county based on periodically adjusted actual operating costs for all tests performed by the equipment. 5. The County Board Chairperson and the County Auditor are hereby authorized to sign the Joint Powers Agreement, copy of which is filed in the Auditor's office, which outlines the purchase and administration of the necessary testing equipment. Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, to approve a preliminary plat of Hillview Estates, to be located in Sections 3 and 7, Edna Township. Motion was made by Hub Nordgren, seconded by Sydney Nelson and carried, to table action on a preliminary plat of Heikes Heights, to be located in Section 14 - 134 -43, for one month to consult with the participants. Motion wasmade by Hub Nordgren, seconded by Andy Leitch and carried, to approve the.preliminary plat of Sandy Point Beach, to be located in Section 17 - 134 -38, subject to conditions as recommended by the Otter Tail County Planning Advisory Commission. Motion was made by Andy Leitch, seconded by Sydney Nelson and carried, to grant special aid to Nidaros Township.in the amount of $500.00, to lower a large culvert between Sections 10 and 15, Nidaros, according to D.N.R. specifications. With no further business, the Chairman adjourned the meeting until 9:30 a.m., Wednesday, September 10, 1980 . • -WEDNESDAY'S SESSION - Pursuant to adjournment, the Board of County Commissioners of Otter Tail County met at 9:30 a.m., Wednesday, September 10th, 1980, with Bert Hovland being absent. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to approve transfer of metes and bounds description parcels from Whitman to Kenneth Rustad in Section 5 -133 -41. The Board, having previously advertised the sale of a gravel pit location in Section 24 -133 -38, proceeded to open bids which were found to be as follows: Carl Deckert, Henning, Minnesota $350.00 Upon motion made by Hub Nordgren, seconded by Andy Leitch and carried, the bid of Carl Deckert, Henning, Minnesota in the amount of $350.00 was accepted, it being the only bid. Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, to approve an application of Ronald Bina for license to sell wine at the Galaxy Resort in Star Lake Township. Motion was made by Andy Leitch, seconded by John Snowberg and carried, to furnish a piece of culvert to the City of Dalton for a drainage structure. Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, to approve an application of Ronald Bina for license to sellmn-intoxicating malt liquor at the Galaxy Lounge in Star Lake Township. With no further business, upon motion made by Andy Leitch, seconded by Sydney Nelson and carried, the meeting was adjourned until 1:00 p.m., Tuesday, September 23, 1980. C ATTEST: Clerk
