COUNTY COMM,ISS:i:ONERS OTTER TAIL COUNTY MINNESOTA I Pursuant to adjournment, the Board of County Commissioners of Otter Tail County Minnesota met at 1:00 p.m.,_Tuesday, February 19, 1980, all members present .. Upon motion made by Sydney Nelson,. seconded by Andy Leitch and carried, the Chairman of the Board and the County Auditor were authorized to, execute an assignment of funds for the Northeast Otter Tail County Sanitary Landfill District to the Farmers & Merchants State Bank of New York Mills, MN, with Hub Nordgren votin·g "no". Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to approve the plat of Dayton Hollow Subdivision, to be located in Sections· 8 & 18 -132 -43. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to approve a preliminary plat of the Peninsula's to be located in Sections 4 & 9 of Dora Township, subject to change in lot size as noted on preliminary plat. Motion was made by Sydney Nelson, seconded by Hub Nordgren and carried, to approve an application of Melvin McGowan, agent for M_artin Schrepfer, for special use permit to construct road to county specifrications to serve a proposed subdivision in Section 10 -135 -39, subject to approval of the Rush Lake Town Board. Motion was made by Sydney Nelson, seconded by John Snowberg, .to approve_a preliminary.plat of Solar Shores, to be located in Section 10 -135 -39, with maximum of six .lots. The motion failed with Aridy Leitch, Bert Hovland and Hub Nordgren voting "no". Motion was made pY Andy Leitch, seconded by Hub Nordgren and carried, with-John Snowberg and ·sydney Nelson voting "no", to approve the preliminary plat of Solar Shores, to be located in Section 10 ~,135 -39~ as ·presented. Upon motion made by Sydney Nelson, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and ·the U. S. Fish and Wildlife Ser- vice, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by t.hei U. S. ·.Fish an:4 Wildl"ife Service is requested, ]I' ',. and WHEREAS, -r~pre-~e~tativesfof_,_the u.· $;• Fisha,nd Wildlife.Service met with the Board of Commissioners on February 19th and informed said Board that a waterfowl easement had been secured from Mr. and Mrs. Dean C. Huwe on the SW1~, ex. tr., in Section 24 ~ 137 37, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve the aforementioned waterfowl easement acquisition by the U. S. Upon motion made by Sydney Nelson, seconded by Hub Nordgren and carried, the following resolution was adopted: RESOLVED by theBoard of County Commissioners of Otter Tail County Minnesota, that WHEREAS·, in accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U. S. Fish and Wildlife Ser- vice, dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands bythe U. S. Fish and Wildlife Service is requested, and WHEREAS, representatives of the U. S. Fish and Wildlife Service met with the County Board on February 19, 1980 and informed said Board that a waterfowl easement had been secured from Mr. and Mrs. LeRoy W. Harnan, et al, on the E½SE¾, E½W¾SE¾, subject to an easement for ingress and egress over the southerly 20 feet ofthe E½SE¾ and the E½W'1~SE¾ of Section 23 -137 -37, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve the aforementioned waterfowl.easement for acquisition by the U. S. Fish and Wildlife Service. Dated·at Fergus Falls, Minnesota this 19th day of February, 1980. Fish and Wildlife Service met with the Board of Commissioners of Otter Tail County on February 19, 1980, and informed said Board that.a waterfowl easement had been secured from Allan Jacobson, et al, on the N½SW¼ of Section.21 -131 -39, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve the aforementioned waterfowl easement for acquisition by the U. " ) . to the unwary purchaser of property and· to the county government offices ·in the transfer of property containing taxes .that are due and owing, , _. l' '· ,- ' NOW, THEREFORE, BE IT RESOLVED, the ·Board of County Commissioners of Otter Tail County does hereby support'.said H.F. 1741 calling for the payment of all taxes,_ current and delinquent, prior to the.recording of a deed, BE IT FURTHER RESOLVED a copy of this resolution is to be mailed to the Association of Minnesota Counties, the Minnesota Association of County Officials and Otter Tail County legislators. E tr. on .NE·; Original plat of the City of Henning, has made ·application for' repurchas~_ of said property having forfeited to the State of Minnesota on the 23rd day of January, 1980, and WHEREAS said applicant has paid the aggregate of all delin- quent taxes and assessments, with penalties, costs and interest in the amount of $720.50, NOW, THEREFORE, BE IT RESOLVED, the County Board does hereby approve said application for repurchase; to be in the best public: interest and relieve hardship. Ch ATTEST: Clerk ·upon motion made by Hub Nordgren, seconded by Bert Hovland and carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County Minnesota, that WHEREAS, on April 10, 1979 the County Board accepted. the bid . of Helle International, Fergus Falls, Minnesota, in the amount of $60,076.08 for two dump trucks, and· WHEREAS, the above trucks have now been delivered tothe satis- faction of the county board at a total cost of $60,076.08;· NOW, THEREFORE, BE IT RESOLVED, the County Auditor is hereby authorized and directed to issue a warrant in the ainount of. $60_, 076. 08 payable to Helle International, Inc., Fergus Falls, Minnesota as final payment. Clerk Motion was made by Sydney Nelson, seconded by Andy Leitch and carried, to modify.the long range bridge and highway construction plan for Gorman bridge construction in 1980, thereupon the following resolution was introduced by Bert Hovland, who moved for its adoption. The motion was seconded by Andy Leitch, carried unanimously and was adopted: RESOLUTION WHEREAS, Otter Tail County, to comply with the State of Minnesota Action Plan, did hold a public meeting on February 5, 1980, to consider a long range br-idge and highway construction plan, and WHEREAS, the adoption o:I; a future bridge and highway construction plan in a_ccordance with the Minnesota Ac ti.on Plan is required, NOW, THEREFORE, IT I:S RESOLVED, that the "Otter Tail County, 1980 Annually Revised Bridge and Highway Constructi_on Plan, dated February 5, 1980", as prepared by the County Highway Engineer, with the modifications as noted at this meeting is the 1980 long range Bridge and Highway Con-<. - struction Plan for Otter-Tail County, BE IT FURTHER RESOLVED, that the proposed construction date on any project can be changed to accommodate the available funding and construction requirements. Motion.was made by Sydney Nelson, seconded by Andy Leitch and carried, with Hub Nordgren voting "no", to enter into a lease agreement with Doug Ackling for the East Otter Tail County Extension Service in the City of Perham, commencing on completion of remodeling. Lease to run for one year. Glen Haugrud, representing the West Otter Tail Soil & Water Conservation District, appeared •before the Board requesting additional funds to complete the fiscal year. Motion was made by Andy Leitch, seconded by Bert Hov- land and carried, to grant an additional $3,000 to the West Otter Tail Soil & Water Conservation District. Quotations were received by County Court for the installation of bookcases in the conference room. Upon motion made by Andy Leitch, seconded by Bert Hovland and carried, approval was given to the bid 9f Orlyn Pederson Co., in the amount of $1,550. Upon motion made by Bert Hovland, seconded by Andy Leitch and carried, Robert Fritz, Fergus Falls,. was reappointed to the Airport Zoning Board for a three year term. Motion was made by Bert Hovland, seconded by Hub Nordgren and carried, to approve the application of Robert C. Garberg for license to sell non-intoxicating malt liquor at Bob's 'Bait, Friberg Township. Motion was made by Bert Hovland, seconded by Hub Nordgren and carried, authorizing the Chairman of the Board and the County Auditor to execute the AFL-CIO, Local 1830, union agreement on behalf of Otter Tail County. Motion was made by Sydney Nelson, seconded by Bert Hovland and carried, to approve payment, in the amount of $4,285.25 to the County Road & Bridge Fund, for expenses incurred on County Gar~~e #10 -Perham, chargeable to the County Building Fund. Upon motion ma~e by Sy,dney ,Nelson, se!=!onded py Andy Leitch and ,. carried, payment was approve in the amount of $876.11 out of County Ditch #41 for 1979 costs incurred by the Road & Bridge Fund, $729.09 for engineering wages paid and $147.02 for equipment rental. Motion was made by Hub NoPdgren, seconded by Sydney Nelson and carried, with Andy Leitch voting "no", authorizing the County Engineer to adver- tise for bids to be received until 10:30 a.m., Tuesday, April 8, 1980, for road- side mowing, county-wide. Commissioner ·Leitch's negative vote was because.the specifications call for a 13foot swath, and Commissioner Leitch feels the whole ditch right-of-way should be mowed. Motion was made by Hub Nordgren, seconded by Bert Hovland and carried, to advJrtise for bids to be received until 10:00 a.m., Tuesday, April 8, 1980 for road signs and posts. Motion was made by Bert Hovland, seconded by Hub Nordgren and carried, to advertise for bids to be received until 10:00 a.m., Tuesday,_April 8, 1980, for culvert supplies. Motion was made by Andy Leitch, seconded by .Sydney Nelson.and carried, to advertise for bids to be received until 10:00 a.m., Tuesday, April 8, 1980 for bituminous materials. Motion was made by Andy Leitch, seconded by Hub Nordgren and carried, to advertise for bids to be received until 10:00 a.m., Wednesday, April 9, 1980, for the sale of a portion of _the county right-of-way at the junction of County Road #82 and the State Trunk Highway #59 in Section 31 of Dane Prairie Township. Motion was made by Andy Leitch, seconded by Bert Hovland and carried, to forward the study on "911", Emergency Number Plan for Otter Tail County, to the Public Service Commission an·d to. the, 911 Project Director.
